Biobank-based research in Mexico is mostly governed by research and data protection laws. There is no direct mention of biobanks in either statutory or regulatory law besides a requirement that the Federal Ministry of Health and a Mexican institution devoted to scientific research approve the transfer of biological materials outside of Mexico for population genetics research purposes. Such requirements are the basis of Genomic Sovereignty in Mexico, but such requirements have not prevented international collaboration. In addition, Mexican law singles out (...) genetic research in informed consent provisions, but it does not specify whether all biobank-based research is genetic research. In order to facilitate international collaboration on biobank-based research, Mexico should directly address biobanking in its laws, building on the research framework and data protection framework already in place. What makes solitude a positive experience? What distinguishes experiences of solitude from experiences of loneliness? We review some of the literature on the benefits of solitude, focusing on freedom, creativity, and spirituality. Then, we argue that the relationship between agent and environment is an important factor in determining the quality of experiences of solitude. In particular, we find that solitude may support a person’s sense of agency, expanding the possibilities for action that a person has, and creating the conditions for (...) authenticity. We describe a phenomenology of solitude, based on a study that explores the nature of experiences of loneliness and solitude in a religious community. One finding is that solitude is characterised by presence, whereas loneliness is characterised by absence. Another finding is that solitude can contribute to a sense of empowerment that enables agents to pursue and achieve the goals they find valuable. (shrink)

Untersucht wird Kants gesamte Theorie der Modalbegriffe (Möglichkeit - Unmöglichkeit, Dasein - Nichtsein, Notwendigkeit - Zufälligkeit) seit Mitte der 1750er Jahre bis zur Kritik der reinen Vernunft. Die Postulate sind nach Kant nicht objektiv, sondern subjektiv-synthetisch: Der Gegenstand der Erfahrung, welcher zunächst anhand der objektiv-synthetischen Funktionen der Quantität, Qualität und Relation bestimmt wird, lässt sich nun (...) in seinem Verhältnis zum setzenden Subjekt betrachten. Die Postulate thematisieren jedoch nicht - hier liegt die konstitutive Charakteristik dieser synthetischen Urteile a priori - das Subjekt selbst, sondern das Objekt als solches und die Objektivität überhaupt. Wie diese Untersuchung zeigt, antwortet Kant erst hier - nicht in den viel diskutierten Deduktionskapiteln oder in den anderen Grundsatzkapiteln - auf die Frage "Was ist ein Objekt?" und bezieht zugleich Stellung gegenüber anderen philosophischen Theorien der Objektivität des 18. Sustainability reporting has become a well-entrenched practice in the mining sector. Failure to adequately live up to societal expectations is now considered a significant threat to the viability of the industry. There is general agreement that broad endorsement of standards for nonfinancial disclosure supports mining companies to improve their image, while conflicts persist. Because sustainability reports “speak” on behalf of sustainably operating organizations and may create socio-political effects, we explore the symbolic nature of SR. We conceive of SR as a (...) performative practice to research how it interferes with the world that it seeks to represent. Our case study research suggests that conformity with global templates is not an end in itself but might create below-compliance effects if a common interest in mining is developed in local arenas that avoids clarification of impacts and maintains ambiguity over responsibility. RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. Darwin diceva che le specie si trasformavano per poter sopravvivere: arriva un terremoto, un’inondazione e solo chi sa correre rapidamente o chi sa nuotare vive. Ok, ma cosa ci dice questa teoria sui cambiamenti che non portano a migliori possibilità di sopravvivere o di riprodursi? Ben poco. Perché nel corso dei secoli i denti molari dell’uomo si sono ridotti di dimensioni, così come le dita dei piedi? Certo non per sopravvivere e riprodursi meglio. Gli autori riportano nel corso di questa (...) rassegna vari esempi che la teoria di Darwin non riesce a spiegare e delle possibili spiegazioni alternative, asseverate da esperimenti scientifici validati e consacrati dalla comunità scientifica. Darwin aveva torto? Certamente no! Ma come tutte le opere della scienza richiede revisioni e miglioramenti. (shrink)

Uno de los documentos de la Antigüedad que más atención susci-ta en los años recientes es el llamado Vidas de los filósofos de Diógenes Laercio. Una nueva edición del texto griego salió a la luz en 1999 y otra más está en preparación. A pesar de que durante mucho tiempo se consideró este tratado solamente como un nutrido testimonio doxográfico, y a la persona misma de Diógenes como un transmisor poco fiable de noticias, para la historia de la filosofía es (...) parte de la tradición material que necesariamente ha resultado indis-pensable en la construcción de nuestra visión de la filosofía griega hoy en día. El libro completo reporta los testimonios de al menos ochenta y cinco personalidades que hicieron parte del panorama intelectual de la antigua Grecia. De cada una de esas personalidades se dan tanto noticias sobre su vida como resúmenes de su actividad filosófica y ci-tas presuntamente literales de sus obras. (shrink)

El presente trabajo investiga las tesis sobre el poder civil de Alonso de la Veracruz que buscan incorporar en la comunidad política española a los habitantes autóctonos del Nuevo Mundo, tesis que suelen relacionarse con F. de Vitoria y el tomismo español, y que últimamente son consideradas parte del republicanismo novohispano elaborado desde la periferia americana. Se busca demostrar que su propósito era aplicar una teoría de derechos naturales, sin que ello implique participación política de los indios americanos. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. In this study, we examine the philosophical bases of one of the leading clinical psychological methods of therapy for anxiety, anger, and depression, Cognitive Behavioral Therapy (CBT). We trace this method back to its philosophical roots in the Stoic, Buddhist, Taoist, and Existentialist philosophical traditions. We start by discussing the tenets of CBT, and then we expand on the philosophical traditions that ground this approach. Given that CBT has had a clinically measured positive effect on the psychological well-being of individuals, (...) it becomes important to study the philosophical foundations on which this therapy is based. This article examines the recent Council of Europe Convention on violence against women through the lens of postcolonial feminist critiques. The article argues that, while there is certainly cause for optimism, the Convention still falls into some of the traps identified by postcolonial feminists. The Convention largely circumvents the stigmatising risks that arise from framing certain VAW forms primarily as a problem of some ‘cultures’. Yet dangers linger in the Convention’s approach to ‘honour’ as an unacceptable justification for VAW. Inherent (...) risks also remain in the vulnerability frame through which the Convention views migrant, refugee, and asylum-seeker women. Applied uncritically, these approaches risk re-inscribing images of inherently powerless women victimised by their non-European ‘cultures,’ reminiscent of colonial times. (shrink)

Child-to-parent violence has dramatically risen in the last decade, becoming a concerning issue in many countries, so research on this issue has also increased. However, most of the studies on this topic have been conducted with samples of adolescents, and very few with samples of parents. In addition, the variety of assessment instruments does not reflect the elements of this type of violence. Thus, the current study was aimed to examine the factor structure, reliability, and validity of the Child-to-parent Violence (...) Questionnaire, parents’ version, in a sample of Spanish parents of adolescents. Moreover, the prevalence rates of the different types of violence and the reasons for violence were also examined. A total of 1,012 Spanish parents of adolescents aged between 12 and 17 years old were assessed using the CPV-Q-P. Data indicated a matrix of four factors with 14 items, assessing psychological violence, physical violence, financial violence, and control/domain over parents, and two factors with 8 items capturing the reasons for child-to-parent violence, with adequate psychometric properties. The more frequent type of violence was control and domain over parents, followed by psychological, financial, and physical violence, with no significant differences between mothers and fathers. Otherwise, instrumental reasons were more frequent than reactive types, with no differences between mothers and fathers. The CPV-Q-P is a useful instrument to assess child-to-parent violence from the parents’ perspective in both professional and research settings. (shrink)

Si durante siglos el Derecho Eclesiástico se identificó con el conjunto de normas emanadas de la Iglesia Católica, considerándose como sinónimo del Derecho Canónico, el proceso histórico de formación del mismo se iniciaría cuando el Estado se considera legitimado para legislar en materias eclesiásticas, defendiendo su propia soberanía frente al monopolio de la competencia del Derecho de la Iglesia, hasta entonces pacíficamente reconocido, fenómeno que se produjo de forma diversa en los países católicos que en aquellos en que triunfó la (...) reforma protestante. Trata-se de uma introdução interpretativa ao primeiro livro filosófico publicado por Simone de Beauvoir, Pirro e Cinéias (1944), que inaugura, segundo ela, após a eclosão da Segunda Guerra Mundial, o período moral de sua carreira literária e seu interesse particular em atribuir um conteúdo material à moral existencialista – junto de um livro publicado posteriormente, Por uma moral da ambiguidade (1947). Destaca-se, portanto, que Beauvoir é a autora que vai superar as oposições que separavam a natureza da cultura, o corpo (...) do espírito, a liberdade da facticidade, a subjetividade da objetividade, o individual do coletivo, o particular do universal, de tal forma que sua alternativa será, no ensaio aqui estudado, pensar como as liberdades separadas entre si se reconhecem mutuamente para que o movimento ontológico de uma em direção à outra possibilite uma investigação do vínculo fundamental e indissociável entre os extremos mencionados. Com efeito, nossa conclusão é que Pirro e Cinéias anuncia duas das ideias centrais que esclarecem o período moral da literatura beauvoiriana, que é a individualidade de cada situação vivida, tal como as situações de suas personagens literárias, e o movimento das liberdades situadas em sua própria dimensão: a dimensão humana. In dem Band entwickeln renommierte Autorinnen und Autoren in 22 Beiträgen Antworten auf eine Reihe von Fragen zu Immanuel Kant und der Rezeption seiner Philosophie in Österreich, die bis heute noch nicht ausreichend diskutiert wurden: Gab es überhaupt einen österreichischen Neukantianismus? Wie prägend ist die Philosophie von Kant für die Entwicklung der Philosophie in Österreich? Oder anders formuliert: Inwiefern haben österreichische Denkerinnen und Denker des 19. und 20. Jahrhunderts einen Beitrag zu einem spezifischen Verständnis der kantischen Philosophie geleistet? Dabei zeigt (...) sich, dass neben den zwei Hauptformen des Neukantianismus in der zweiten Hälfte des 19. Jahrhunderts – d.h. der Marburger und der Südwestdeutschen Schule – ein spezifisch österreichischer Zugang zu Kant historisch wie systematisch von besonderer Bedeutung ist und weitreichende Folgen hatte. Unter Absehung der üblichen geografischen Zuordnungen der verschiedenen Schulen lässt sich dieser als realistischer Kritizismus beschreiben und hat neben Richard Hönigswald und Robert Reininger seinen wichtigsten Vertreter in Alois Riehl. Jahrhunderts in bedeutenden Entwürfen und erbitterten Kontroversen europaweit diskutiert wurde. Zwischen produktivem und reproduktivem Status, d.h. zwischen Phantasie und Gedächtnis changierend wurde die Leistungsfähigkeit für Erkenntnis und Wissenschaft von den Gefahren der Täuschungen des Geistes durch die Einbildungskraft korreliert. Der Band leistet eine breit gefächerte Sichtung der unterschiedlichen Konzepte der Einbildungskraft und ein Tableau der Begründungsleistungen (...) erstellen, das historische und systematische Perspektiven produktiv vermittelt. Esta pesquisa teve como objetivo analisar o conhecimento teórico de conselhos tutelares sobre o Estatuto da Criança e do Adolescente e suas atuações a partir disso. Para isso, realizamos entrevistas com dois conselhos por meio de um questionário. As respostas foram dadas por escrito e, com elas, pudemos notar convergências e divergências entre esses conselhos. Com a análise, percebemos que cada conselho possui um olhar no seu trabalho, porém ambos possuem consciência de que seu dever é o de proteger e (...) garantir os direitos das crianças e dos adolescentes. Ambos os conselhos admitiram existir interação com a escola, porém, ela se restringe ao controle de frequência e da evasão escolar. Também, ambos remetem casos de violação de direitos à realidade social, afirmando que fatores econômicos não são determinantes nesses atos, porém, nos casos de famílias em situações econômicas desfavoráveis, o conselho tutelar é acionado. Por fim, enquanto um dos conselhos diz que aquele que viola algum direito da criança ou do adolescente deve ser responsabilizado, outro afirma que ele deve intervir com medidas educativas para resgatas a proteção do menor. Concluímos que os conselhos conhecem seus deveres, porém deixam a desejar no que tange à relação com as escolas. (shrink)

More organizations use AI in the hiring process than ever before, yet the perceived ethicality of such processes seems to be mixed. With such variation in our views of AI in hiring, we need to understand how these perceptions impact the organizations that use it. In two studies, we investigate how ethical perceptions of using AI in hiring are related to perceptions of organizational attractiveness and innovativeness. Our findings indicate that ethical perceptions of using AI in hiring are positively related (...) to perceptions of organizational attractiveness, both directly and indirectly via perceptions of organizational innovativeness, with variations depending on the type of hiring method used. For instance, we find that individuals who consider it ethical for organizations to use AI in ways often considered to be intrusive to privacy, such as analyzing social media content for traits and characteristics, view such organizations as both more innovative and attractive. Our findings trigger a timely discussion about the critical role of ethical perceptions of AI in hiring on organizational attractiveness and innovativeness. (shrink)

This article proposes to identify risk factors for moral distress from the literature, validate them through expert analysis and provide the basis for a new tool to assess the risk of moral distress among nurses. Moral distress is related to the psychological, emotional and physiological aspects of nursing. It arises from constraints caused by various circumstances and can lead to significant negative consequences. A scoping review and validation through expert analysis were used. The research question guiding this study was as (...) follows: What is known about risk factors for moral distress in nursing? The research was conducted using multiple sources including electronic databases and lists of references from relevant literature. The final sample consisted of 38 studies. A validation analysis was conducted by experts during December 2014 and June 2015. To exclude a risk factor item, at least 80% of the experts had to agree with the exclusion. In total, 53 risk factors for moral distress were identified, reviewed by the experts and grouped to form a new instrument that may help to identify risk for moral distress and to address its consequences.
