Restraint as an intervention in the management of acute mental distress has a long history that predates the existence of psychiatry. However, it remains a source of controversy with an ongoing debate as to its role. This article critically explores what to date has seemingly been only implicit in the debate surrounding the role of restraint: how should the concept of validity be interpreted when applied to restraint as an intervention? The practice of restraint in mental health is critically examined (...) using two post-positivist constructions of validity, the pragmatic and the psychopolitical, by means of a critical examination of the literature. The current literature provides only weak support for the pragmatic validity of restraint as an intervention and no support to date for its psychopolitical validity. Judgements regarding the validity of any intervention that is coercive must include reference to the psychopolitical dimensions of both practice and policy. (shrink)

Madness and Modernism provides a phenomenological study of schizophrenic disorders, criticizing some standard conceptions of these disorders. Sass argues that many aspects of this group of disorders can actually involve more sophisticated (albeit dysfunctional) forms of mind and experience.

The focus of this paper is the syntax of inverse scope in Hungarian, a language that largely disambiguates quantifier scope at spell-out. Inverse scope is attributed to alternate orderings of potentially large chunks of structure, but with appeal to base-generation, as opposed to nonfeature-driven movement as in Kayne 1998. The proposal is developed within mirror theory and conforms to the assumption that structures are antisymmetrical. The paper also develops a matching notion of scope in terms of featural domination, as opposed (...) to c-command, and applies it to otherwise problematic cases of pied piping. The distinguished philosopher Louis Loeb examines the epistemological framework of Scottish philosopher David Hume, as employed in his celebrated work A Treatise of Human Nature. Loeb's project is to advance an integrated interpretation of Hume's accounts of belief and justification. His thesis is that Hume, in his Treatise, has a "stability-based" theory of justification which posits that his belief is justified if it is the result of a belief producing mechanism that engenders stable beliefs. But Loeb argues that the (...) striking corollary to this theory is that no belief generating mechanism is fully stable - or fully justified - for a fully reflective person. This carefully argued and original interpretation of Hume makes sense of seemingly contradictory ideas and will provoke serious discussion among Hume scholars. (shrink)

Among those who criticize the concept of a common refrain is that we really have no idea what futility means. For example, physicians seem to disagree on whether a treatment being futile means that it has a less than 5% chance of working or a 20% chance of working. If the concept is so unclear, then it seems a thin reed upon which to base a momentous ethical decision—namely, that the physician's judgment should be allowed to override the wishes of (...) the competent patient or the patient's duly appointed surrogate. The human labor and animal inputs required to manufacture meat products are kept physically and symbolically distanced from the consumer. Recently however, meatpacking plants received significant news media attention when they emerged as hotpots for COVID-19 — threatening workers’ health, requiring plants to slow production, and forcing farmers to euthanize livestock. In light of these disruptions, this research asks: how did news media frame the impact of COVID-19 on the meat industry, and to what extent is a process of _defetishization_ (...) observed? Examining a sample of 230 news articles from coverage of US meatpacking plants and COVID-19 in 2020, I find that news media largely attributes the cause for the spread of COVID-19 in meatpacking plants to the history of exploitative working conditions and business practices of the meat industry. By contrast, the solutions offered to address these problems aim at alleviating the immediate obstacles posed by the pandemic and returning to, rather than challenging, the status quo. These short-run solutions for complex issues demonstrate the constraints in imagining alternatives to a problem rooted in capitalism. Furthermore, my analysis shows that animals are only made visible in the production process when their bodies become a waste product. (shrink)

Research on ethical issues within food systems is often human-centric. As a consequence, animal-centric policy debates where regulatory decisions about food are being made tend to be overlooked by food scholars and activists. This absence was notable in the recent debates around Australia’s animal live export industry. Using Foucault’s tools, we explore how ‘food security’ is conceptualised and governed within animal cruelty policy debates about the live export trade. The problem of food security produced in these debates shaped Indonesians as (...) ‘victims’ of food insecurity due to the nation’s inability to produce sufficient quantities of protein. This understanding of the problem reproduced the dominant framing of food security as a problem for developing countries addressed by increasing global food production. The underlying premise uncritically accepted in Australia’s debates on live export trade was that intensive animal agriculture, and Australia’s live export trade specifically, were essential to alleviating global food insecurity. Drawing on our findings, we show how dominant representations of ‘food security’, and related regulatory and technological trajectories, flourish where alliances between animal and food activists, scholarship, and movements are weak. Accordingly, we argue for agri-food scholars to take up opportunities to contribute to the policy discussions about the treatment of animals to effectively expand the kinds of problems, solutions, and strategies of resistance produced in the discourses surrounding food system issues. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Since the mid-1970s, scholars have recognized that the skeptical interpretation of Hume's central argument about induction is problematic. The science of human nature presupposes that inductive inference is justified and there are endorsements of induction throughout "Treatise" Book I. The recent suggestion that I.iii.6 is confined to the psychology of inductive inference cannot account for the epistemic flavor of its claims that neither a genuine demonstration nor a non-question-begging inductive argument can establish the uniformity principle. For Hume, that inductive inference (...) is justified is part of the data to be explained. Bad argument is therefore excluded as the cause of inductive inference; and there is no good argument to cause it. Does this reinstate the problem of induction, undermining Hume's own assumption that induction is justified? It does so only if justification must derive from "reason", from the availability of a cogent argument. Hume rejects this internalist thesis; induction's favorable epistemic status derives from features of custom, the mechanism that generates inductive beliefs. Hume is attracted to this externalist posture because it provides a direct explanation of the epistemic achievements of children and non-human animals — creatures that must rely on custom unsupplemented by argument. In recent years, bioethics has increasingly become an international area of inquiry with major contributions being made not only in North America but also in Europe and in the Pacific Rim countries. This general observation is particularly true for research ethics. Little attention has been paid, however, to this internationalization of bioethics in general and research ethics in particular, and there are few studies comparing what has emerged in the different countries.

/Analyticity theorists/, as I will call them, endorse the /doctrine of analyticity in ontology/: if some truth P analytically entails the existence of certain things, then a theory that contains P but does not claim that those things exist is no more ontologically parsimonious than a theory that also claims that they exist. Suppose, for instance, that the existence of a table in a certain location is analytically entailed by the existence and features of certain particles in that location. The (...) doctrine implies that the table's existence requires nothing more of the world than that those particles exist and bear the features in question. Analyticity theorists have alleged that this idea may be used to defend controversial existence claims against a battery of objections. I argue that this style of defense fails, because the doctrine faces counter-examples. An existence claim may be analytically entailed by some truth and still report a substantial further fact. Smith, Glass, and Miller have reported a meta-analysis of over 500 studies comparing some form of psychological therapy with a control condition. They report that when averaged over all dependent measures of outcome, psychological therapy is. 85 standard deviations better than the control treatment. We examined the subset of studies included in the Smith et al. metaanalysis that contained a psychotherapy and a placebo treatment. The median of the mean effect sizes for these 32 studies was. 15. There was a (...) nonsignificant inverse relationship between mean outcome and the following: sample size, duration of therapy, use of measures of outcome other than undisguised self-report, measurement of outcome at follow-up, and use of real patients rather than subjects solicited for the purposes of participation in a research study. A qualitative analysis of the studies in terms of the type of patient involved indicates that those using psychiatric outpatients had essentially zero effect sizes and that none using psychiatric inpaticnts provide convincing evidence for psychotherapeutic effectiveness. The onty studies clearly demonstrating significant effects of psychotherapy were the ones that did not use real patients. For the most part, these studies involved small samples of subjects and brief treatments, occasionally described in quasibeliavioristic language. It was concluded that for real patients there is no evidence that the benefits of psychotherapy are greater than those of placebo treatment. (shrink)

Cosmetic surgery is a fast-growing medical practice. In 1997 surgeons in the United States performed the four most common cosmetic procedures443,728 times, an increase of 150% over the comparable total for 1992. Estimated total expenditures for cosmetic surgery range from $1 to $2 billion. As managed care cuts into physicians' income and autonomy, cosmetic surgery, which is not covered by health insurance, offers a financially attractive medical specialty.

Hume's claim that a state is a belief is often intertwined—though without his remarking on this fact—with epistemic approval of the state. This requires explanation. Beliefs, in Hume's view, are steady dispositions (not lively ideas), nature's provision for a steady influence on the will and action. Hume's epistemic distinctions call attention to circumstances in which the presence of conflicting beliefs undermine a belief's influence and thereby its natural function. On one version of this interpretation, to say that a belief is (...) justified, ceteris paribus, is to say that for all that has been shown the belief would be steady in its influence under suitable reflection. On a second version, it is to say that prima facie justification is an intrinsic property of the state, in virtue of its steadiness. There is a curious bifurcation in the literature on ground and its logic. On the one hand, there has been a great deal of work that presumes that logical complexity invariably yields grounding. So, for instance, it is widely presumed that any fact stated by a true conjunction is grounded in those stated by its conjuncts, that any fact stated by a true disjunction is grounded in that stated by any of its true disjuncts, and that any fact stated by (...) a true double negation is grounded in that stated by the doubly-negated formula. This commitment is encapsulated in the system GG axiomatized and semantically characterized by [deRosset and Fine, 2023] (following [Fine, 2012]). On the other hand, there has been a great deal of important formal work on “flatter” theories of ground, yielding logics very different from GG [Correia, 2010] [Fine, 2016, 2017b]. For instance, these theories identify the fact stated by a self-conjunction $$(\phi \wedge \phi )$$ with that stated by its conjunct $$\phi $$. Since, in these systems, no fact grounds itself, the “flatter” theories are inconsistent with the principles of GG. This bifurcation raises the question of whether there is a single notion of ground suited to fulfill the philosophical ambitions of grounding enthusiasts. There is, at present, no unified semantic framework employing a single conception of ground for simultaneously characterizing both GG and the “flatter” approaches. This paper fills this gap by specifying such a framework and demonstrating its adequacy. (shrink)

Responsible conduct of research courses are widely taught, but little is known about the purposes or effectiveness of such courses. As one way to assess the purposes of these courses, students were surveyed about their perspectives after recent completion of one of eleven different research ethics courses at ten different institutions. Participants enrolled in RCR courses in spring and fall of 2003 received a voluntary, anonymous survey from their instructors at the completion of the course. Responses were received from 268 (...) participants. Seventy-seven percent of open-ended responses listed specific kinds of information learned; only a few respondents talked about changes in skills or attitudes. The perception that courses did more to provide information than to foster skills or attitudes was verified in quantitative responses. Over 75% of the respondents specifically noted that courses were useful in preparing them to recognize, avoid, and respond to research misconduct. The two principal findings of this multi-institutional study are that respondents reported: a wide variety of positive outcomes for research ethics courses, but that the impact on knowledge was greater than that for changes in skills or attitudes. In a 2018 referendum, the Irish electorate voted in favour of repealing Ireland's quasi-total legal ban on abortion. The referendum campaign saw important public discussions regarding gender roles in twenty-first century Ireland. While the constitutional ban on abortion was condemned by abortion rights advocates for marginalising women's agency, the legislation which replaced it has not escaped criticism either. Therefore, questions surrounding the conceptualisation of women's agency in the 2018 referendum are still relevant today. Adopting a multimodal critical discourse analysis approach, (...) this paper analyses signage from the weeks before the vote to examine the discursive construction of women's agency in the linguistic landscape of the referendum campaign. I argue that many mainstream campaign organisations – including those arguing for liberalisation of abortion laws – were complicit in the discursive diminishment of women's agency, suggesting that the campaign did not necessarily challenge prevailing ideologies of gender and agency. The history and philosophy of affective terms and concepts contains important challenges for contemporary scientific accounts of emotion regulation. First, there is the problem of moral undertow. This arises because stipulating the ends of emotion regulation requires normative assumptions that ultimately derive from values and morals. Some historical precedents are considered to help explain and address this problem. Second, there is the problem of organization. This arises because multiple emotions are often organized and oriented in very particular ways over the (...) life of the individual in a manner that cannot be adequately explained using the concept of “emotion.” A modern variant of the traditional concept of passion is invoked to help address this problem. This article aims to shed light on both the foundations and the consistency of the position regarding akrasia Xenophon attributes to Socrates in the Memorabilia. As does Plato's Socrates, Xenophon's Socrates maintains that akrasia is impossible in the presence of knowledge. On the other hand, he differs from the platonic Socrates by granting to enkrateia, instead of knowledge, the role of foundation for virtue. If enkrateia is the very condition for acquiring knowledge and virtue, consequently the responsibility for countering akrasia (...) falls to enkrateia. (shrink)

A predominant ethical view holds that physician‐investigators should conduct their research with therapeutic intent. And since a physician offering a therapy wouldn't prescribe second‐rate treatments, the experimental intervention and the best proven therapy should appear equally effective. "Clinical equipoise" is necessary. But this perspective is flawed. The ethics of research and of therapy are fundamentally different, and clinical equipoise should be abandoned.

Many philosophers adopt methods that emulate those of the natural sciences. For them, this position, which they call naturalism, defines the indispensable set of starting points for fruitful debate in various areas. In spite of this consensus, however, little is ever said about the way naturalism depends on the primary idea of nature. If we understand this dependency of naturalism on underlying accounts of nature, we would be in a better position to recognize and evaluate different kinds of naturalism. In (...) this research monograph, I undertake a sustained study of the concept of nature to answer this need. I examine in detail how conceptual, historical, and scientific constraints affect, and are in turn affected by, the concept of nature in various domains of philosophy, and I relate the conceptual framework of scientific inquiry back to the lived experience that is proper to everyday self-understanding. The method I use is conceptual analysis. I begin with an evaluation and justification of this method, and then present the fundamental idea that forms the backbone of the entire book, namely the idea of complexification of concepts in the course of history. I present the four main views on nature that have dominated Western thought: the dynamic view, related primarily to Aristotle’s approach, the mechanistic view, the Romantic view, and the evolutionary view. From here, I engage in a detailed inquiry into the fundamental ideas of explanation and causation, defending a pluralist account for both. I then examine carefully the intricate relation between things and the meaning of the words we use to describe them. I show how we can acknowledge the emergence of complex properties from simpler ones within an overall evolutionary view of nature. I also explore how concepts concerning the nature of things are related to values. The final chapter deals with an objection that arises from those who claim that the empirical method is the only one available for our knowledge of nature. I show that the value of conceptual analysis, as used in this book, remains unharmed by this objection. We need to accept that, in the course of history, the concept of nature has become complexified, multilayered, and increasingly loaded with internal tension because of its many relations to different areas of our conceptual scheme.
