There is a need to explore educational strategies that translate ethics knowledge into ethical behavior. Commonly used pedagogical approaches steeped in traditional normative ethical theory are less powerful than sensemaking in preparing clinicians to respond to ethical problems in practice. This integrative review of 15 articles explores the use of sensemaking as an instructional method for clinical ethics. Whittemore and Knafl’s :546–553, 2005) integrative review method guided a systematic appraisal of data from both qualitative and quantitative research traditions, synthesizing disparate (...) studies in analyzing literature about the use of sensemaking as a pedagogical approach in teaching ethics. Findings supported the use of Weick’s sensemaking theory to develop instructional methods that encourage ethical decision making in students as well as promote ethical response by health care providers. The review reveals important theoretical and training implications for introducing sensemaking as a means to promote ethical action in clinical practice. (shrink)

In clinical practice, evidence suggests that teaching ethics using normative ethical theory has little influence on the ethical actions of providers in practice. Thus, new training methods are needed that improve clinician response to ethical problems. A sensemaking approach to ethics training has demonstrated promise as an evidence-based pedagogical method to improve ethical reasoning and response. Project ECHO is theoretically linked to improved sensemaking. This study examines the effectiveness of ECHO and training in use of sensemaking approaches to ethical response (...) by clinicians. A quasi-experimental design study using univariate linear regression was used to examine the effect of the three types of ethics training on ethical response self-efficacy scores, while controlling for participant characteristics of years in practice, discipline and sex. We found evidence that training in sensemaking through participation in ECHO promotes improved ethical response self-efficacy of clinicians. However, results also suggest that a traditional ECHO format that does not explicitly introduce sensemaking strategies into the training does not result in the same learning outcomes as measured through an ethical response self-efficacy survey. Two recent cases raise the question: Should the body be considered a form of property? Patients generally do not share in the profits derived from the applications of research on their body parts and products. Nor is their consent for research required so long as the body part is unidentified and is removed in the course of treatment. A market in body parts and products would require consent to all categories of research and ensure that patients are protected from coercion (...) and given the chance to be paid fairly for their contributions. Such a market might force us to rethink our policies prohibiting organ sales. Donors, recipients, and society will benefit from a market in body parts so long as owners—and no one else—retain control over their bodies. (shrink)

According to the main theories of the knowledge-based economy (KBE), the recent transformations of capitalism are the origins of a general societal change. Managerial theories consider KBE to be a series of win-win mechanisms that simultaneously favour firms, workers and consumers. The cognitive capitalism theory perceives in the development of cognitive capitalism signs of the formation of a post-capitalist economy. This article discusses the main features of these two theoretical orientations and identifies some core ambivalences in KBE. The relationship between (...) the market and society in KBE is marked by a dialectical process. The former incorporates mechanisms of potential economic valorization generated by informal social relationships. To this end, it must internalize actors, practices and cultures that are partially in conflict with it, given that it must make ever greater attempts to bring the overall process back within the ownership regime. One thus witnesses a reduction of the barriers between firms and society, that can simultaneously engender a more subtle dominance of the former over the latter, or the growth of autonomy, self-organization and peer cooperation among social actors. This second possibility relies entirely upon politics and collective action. (shrink)

Joan Didion uses Biblical analogues in her novel Play It As It Lays (1970) to recount the American western myth she learned in her youth, “the story that the wilderness was and is redemptive” (“Thinking about Western Thinking” 14). Her use of scriptural analogues helps us to understand the moral themes in this novel. Situating her novel in America’s most disappointing frontier —Hollywood, Didion uses the Biblical metaphor of the desert to relate a tale of moral chaos illustrated by failed (...) marriages, sexual adultery, forsaken children, and suicide. In Didion’s scriptural analogues, we see, in this Hollywood story, a contemporary wilderness riven by spiritual despair and moral devastation, but a wilderness that can lead to deliverance. (shrink)

I argue that a distinction made in recent literature in the philosophy of mind between self-organizing and self-governing systems can serve as the basis of a principled distinction between ‘good’ and ‘bad’ determination on the part of the compatibilist with respect to freedom or control. I first consider two arguments for the claim that causal determinism undermines control: the Consequence Argument as presented by Peter van Inwagen, and the Four Case Argument of Derk Pereboom. I then elucidate the difference between (...) a self-organizing and self-governing system, and argue that the capacity for self-representation that is constitutive of the latter allows for agential control. This difference, I argue, can provide the basis of a principled distinction between good and bad determination. I subsequently show how the framework presented undermines the Consequence and Four Case Arguments in their attempt to establish the claim that causal determinism undermines control, and I discuss the application of this framework to manipulation arguments in general. Finally, I consider and respond to Galen Strawson’s Basic Argument and the general rejoinder to my account that one is not responsible for the particular way in which one exercises one’s capacity for self-representation, and that this undermines any claim to agential control and responsibility. Some bioethicists argue that conscientious objectors in health care should have to justify themselves, just as objectors in the military do. They should have to provide reasons that explain why they should be exempt from offering the services that they find offensive. There are two versions of this view in the literature, each giving different standards of justification. We show these views are each either too permissive (i.e. would result in problematic exemptions based on conscience) or too restrictive (i.e. would (...) produce problematic denials of exemption). We then develop a middle ground position that we believe better combines respect for the conscience of healthcare professionals with concern for the duties that they owe to patients. Our claim, in short, is that insofar as objectors should have to justify themselves, they should have to do it according to the standard that we defend rather than according to the standards that others have developed. Legislative strategies for reducing infant abandonment and neonaticide developed in response to a series of sensational cases that occurred in Texas in 1999. The media coverage of these cases implied that the incidence of the crime was increasing, and Texas legislators responded with a law permitting parents to anonymously surrender their newborn at designated locations such as hospitals. This was the first “safe haven” law. Interest peaked nationwide, and by 2008 all states had a similar version of the law. These (...) laws can trigger rapid cessation of parental rights and a fast-tracked adoption to a preapproved family, reflecting the legislators’ assumption that it is better to permit struggling mothers to leave their children with well-intentioned strangers than to abandon the children or end their lives. The paper argues against using the language of "marriage" in public policy. Not simply because our current marriage laws result in confusing, unequal and unjust treatment of citizens, but because "marriage" is an unavoidably value-laden concept such that any marriage law will privilege some reasonable values over others. We should instead favor public policies that are more neutral, such as policies regarding civil unions.

Beauvoir's writings index the politics of ontological, structural, instrumental, and affective instances of violence. In all cases, she sees violence as a result of political practices. Rather than simply deploring or condemning violence, however, Beauvoir demonstrates that we have to understand that it delineates and is manifest in all our relationships and representations. Nevertheless, we need not accept violence, and indeed, we must struggle against it. Oppressive human relationships situate us as systematically and unequally exposed to violent injury and premature (...) death, and as unequally able to nourish a creative and flourishing life. These conditions are never justified. Beauvoir insists that we must affirm ambiguity and freedom against structural conditions of oppression, and act politically to minimize violence and its tragic effects. (shrink)

Is there something distinctive about humanity that justifies the idea that humans have moral status while non-humans do not? Providing an answer to this question has become increasingly important among philosophers as well as those outside of philosophy who are interested in our treatment of non-human animals. For some, answering this question will enable us to better understand the nature of human beings and the proper scope of our moral obligations. Some argue that there is an answer that can distinguish (...) humans from the rest of the natural world. Many of those who accept this answer are interested in justifying certain human practices towards non-humans—practices that cause pain, discomfort, suffering, and death. This latter group expects that in answering the question in a particular way, humans will be justified in granting moral consideration to other humans that is neither required nor justified when considering non-human animals. In contrast to this view, an increasing number of philosophers have argued that while humans are different in a variety of ways from each other and other animals, these differences do not provide a philosophical defense for denying non-human animals moral consideration. Industry groups engage in venue shifting when they seek to overturn or alter restrictive regulations imposed by one political venue through another. A critical step in this process is resolving uncertainties surrounding the preference of the targeted venue and the nature of the relevant policy proposal. While existing studies emphasize a long-term trial-and-error process of policy learning, we focus on nascent industries and argue that ventures seek other information sources to resolve these uncertainties quickly. In particular, nascent industry groups are (...) likely to perceive that the targeted venue will support their policy proposal if the targeted venue is ideologically distant from the venue that has enacted the restrictive regulations, if the targeted venue has recently supported other nascent industry groups’ similar policy proposals, or if the industry groups themselves are more exposed to industry peers’ success in promoting the same policy proposal in other jurisdictions. Under these conditions, the industry groups invest more to influence the targeted venue in response to restrictive regulations enacted by other venues. We find support for our theory by examining how from 2013 to 2019 the small unmanned aircraft systems industry trade associations in the United States lobbied state governments to nullify local regulations. The purpose of this paper is to give an overview of studies that sought to answer a number of questions about critical thinking First, studies are reviewed that looked at the correlation of scores on two major instruments, the Watson-Glaser Critical Thinking Appraisal (WGCTA) and the California Critical Thinking Skills Test (CCTST). Then, results are reported that provide information about the relation between critical thinking and academic skills, and the independence of the construct of critical thinking. Finally, findings are reported (...) on the relation between critical thinking and critical thinking dispositions, job related skills, years of education, fields of study, classroom interactions, learning styles, and cultural factors. Telling stories after a loved one’s death helps surviving family members to find meaning in the experience and share perceptions about whether the death was consistent with the deceased person’s values and preferences. Opportunities for physicians to evaluate the experience of a patient’s death and to expose the ethical concerns that care for the dying often raises are rare. Narrative medicine is a theoretical perspective that provides tools to extend the benefits of storytelling and narrative sense–making to physicians. This case (...) study describes narrative writing workshops attended by physicians who care for dying patients. The narratives created revealed the physicians’ concerns about ethics and their emotional connection with patients. This case study demonstrates that even one–time reflective writing workshops might create important opportunities for physicians to evaluate their experiences with dying patients and families.
