Grasping an Ought. Adolf Reinach’s Ontology and Epistemology of Legal and Moral Oughts.Lorenzo Passerini Glazel - 2020 - Acta Universitatis Lodziensis. Folia Iuridica 90:29-39.
We almost every day direct our actions with reference to social, moral or legal norms and oughts. However, oughts and norms cannot be perceived through the senses: how can we “grasp” them, then? Adolf Reinach distinguishes enacted norms and oughts created through a social act of enactment, from moral norms and oughts existing in themselves independently of any act, knowledge or experience. I argue that this distinction is not a distinction between two species of oughts within a common genus: it (...)

On the Mode of Existence of Mute Law and the Inference of Cryptotypes.Lorenzo Passerini Glazel - forthcoming - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique:1-16.
A widespread thesis in the analytical theory of law is that norms exist as linguistic entities. Rodolfo Sacco is one of the authors who have most fruitfully insisted, on the contrary, that there is no necessary correlation between norms and language, not even in the specific context of law. He thus extended the conceptualisation of legal normativity well beyond the boundaries of language through the notions of cryptotype and mute law. This paper takes into account two alternative hypotheses to the (...)

Forme della volontà e impronte di norme nella formazione della norma consuetudinaria.Lorenzo Passerini Glazel - 2020 - Noesis 34:71-88.
Custom is a complex phenomenon, and one that is hardly given a satisfying account, especially if it is assumed, as many legal positivists do, that law is only produced through acts of will. After examining five main reasons for the complexity of custom, I will consider Uberto Scarpelli’s thesis that customary law can be given an account within legal positivism through a reinterpretation of norm-generating facts as the manifestations of a will. But what kind of will is implied here, and (...)

  7. The Systematic Unity of Reason and Empirical Truth in Kant's Critique of Pure Reason.Lorenzo Spagnesi - 2023 - Kant Studien 114 (3):435-462.
This paper attempts a reconstruction of reason’s contribution to empirical truth in connection with Kant’s definition of truth as the agreement of cognition with its object. I argue that Kant’s treatment of truth in the Transcendental Analytic gets completed in the Appendix to the Transcendental Dialectic with an often neglected but compelling argument (what I shall call the Variety Argument). This argument postulates such a variety in the appearances as to undermine any attempt at formulating empirical truths. Crucially, I argue (...)

  8. Vices, Virtues, and Dispositions.Lorenzo Azzano & Andrea Raimondi - 2023 - TheoLogica: An International Journal for Philosophy of Religion and Philosophical Theology 7 (2).
In this paper, we embark on the complicated discussion about the nature of vice in Virtue Ethics through a twofold approach: first, by taking seriously the claim that virtues (and certain flavours of vices) are genuinely dispositional features possessed by agents, and secondly, by employing a pluralistic attitude borrowed from Battaly’s pluralism (2008). Through these lenses, we identify three varieties of viciousness: incontinence, indifference, and malevolence. The upshot is that the notion of vice is not as categorically homogeneous as that (...)

There are various forms of teleological thinking central to debates in the early modern and modern periods, debates in which David Hume (1711–1776) is a key figure. In the first section, we shall introduce three levels at which teleological considerations have been incorporated into philosophical accounts of man and nature, and sketch Hume’s criticisms of these approaches. In the second section, we turn to Hume’s non-teleological ‘science of man’. In the third section, we show how Hume has an account of (...)

  12. Regulative Idealization: A Kantian Approach to Idealized Models.Lorenzo Spagnesi - 2023 - Studies in History and Philosophy of Science 99 (C):1-9.
Scientific models typically contain idealizations, or assumptions that are known not to be true. Philosophers have long questioned the nature of idealizations: Are they heuristic tools that will be abandoned? Or rather fictional representations of reality? And how can we reconcile them with realism about knowledge of nature? Immanuel Kant developed an account of scientific investigation that can inspire a new approach to the contemporary debate. Kant argued that scientific investigation is possible only if guided by ideal assumptions—what he calls (...)

  13. Phenomenological Metaphysics as a Speculative Realism.Lorenzo Girardi - 2017 - Journal of the British Society for Phenomenology 48 (4):336-349.
The debate between speculative realism and phenomenology has become quite heated over the past years. The matter of contention is the possibility of a metaphysics that can provide knowledge of reality as it is in itself. The speculative realists accuse phenomenology of denying this possibility, confining knowledge to the sphere of subjectivity. What has been overlooked in this debate is the similarity between the speculative project of Quentin Meillassoux and a Husserlian metaphysics. This article looks at these positions from a (...)

  20. Of Bastard Man and Evil Woman, or, the Horror of Sex.Lorenzo Chiesa - 2012 - Film-Philosophy 16 (1):199-212.
Lars von Trier’s Antichrist (2009) has often been described as a ‘gothic’, if not straightforwardly ‘horror’ movie. While this claim could easily be challenged with regard to strict genre definitions, it is doubtless the case that the film deals very explicitly with fear, first and foremost the female protagonist’s fear of herself, which is placed at the top of the so-called ‘pyramid of fear’ drawn by her therapist/wanna-be-Saviour partner. My opinion is that Antichrist perfectly displays the horrific effects of the (...)

Critical Notice of Subject, Thought and Context.Lorenzo Peña & Manuel Liz - unknown
The main starting point of many of the contributions collected into the book is the kind of Twin Earth considerations, along with meaning individualism. Is Putnam's claim about water in this world and a stuff in an alternative world being different materials?. Is meaning in the head? One seems allowed to be skeptical about the starting point of the debate between such as emphasize broad content and those who think that the basic semantic entities are narrow contents, which would fail (...)

In this essay, I offer a vindication of pride. I start by presenting the Christian condemnation of pride as the cardinal sin. I subsequently examine Mandeville’s line of argument whereby pride is beneficial to society, although remaining a vice for the individual. Finally, I focus on, and endorse, the analysis of pride formulated by Hume, for whom pride qualifies instead as a virtue. This is because pride not only contributes to making society flourish but also stabilizes the virtuous agent by (...)

In this paper, I examine Eugenio Lecaldano’s way of tackling the issue of the meaning of life. I highlight the dependence of his individualistic approach on the specific character of the person who inquires into the meaning of life. I also sketch a weaker way of understanding the meaning of life as an attempt to provide reasons which are valid from the standpoint of the present, and which will make us continue living.

Hume on Shame.Lorenzo Greco - 2023 - In Raffaele Rodogno & Alessandra Fussi (eds.), The Moral Psychology of Shame. Moral Psychology of the Emotions. pp. 79-101.
David Hume is famous for developing a ‘science of man’ based on a thorough investigation of passions and sentiments. What is most surprising is that, in his sentimental geography, shame appears to play a rather marginal role. In this essay, I shall maintain that it is nonetheless possible to find room for shame in Hume, and that the most promising way to do so is to consider it in the light of a different passion on which Hume dwells at length, (...)

Against Neo-Aristotelian Virtue Ethics: The Humean Challenge.Lorenzo Greco - 2018 - Teoria: Rivista di Filosofia Fondata da Vittorio Sainati 38 (2):123-33.
In this essay, I discuss some elements of Hume’s virtue ethics that distinguish it from the neo-Aristotelian approach. I stress some of its characteristics – its emphasis on character traits rather than on actions, the role it reserves for moral education, its being sentimentalist – and highlight its points of strength with respect to the neo-Aristotelian version. I do that by defending an interpretation of Hume’s virtue ethics in terms of a form of subjectivism hinging on individuals possessing virtuous or (...)

In this essay, I offer a survey of Julia Annas’ perspective on virtue ethics. I focus on her most recent work and highlight the role reflection plays in shaping her conception of the virtuous agent. I compare her approach with that of rival moral conceptions, both within and outside virtue ethics, and conclude with a doubt raised from a Humean point of view.

The argument put forward by this article is not that democratization does not benefit from the activity of a vibrant civil society, but rather that academic research should address this relationship in a critical way. This article maintains that one should take care to distinguish between 'civil society' as an ideal-type concept that embodies the qualities of separation, autonomy and civil association in its pure form, and the factual world of 'civil societies' composed of associations that embody these principles to (...)

The complete characterisation of order types of non-standard models of Peano arithmetic and its extensions is a famous open problem. In this paper, we consider subtheories of Peano arithmetic (both with and without induction), in particular, theories formulated in proper fragments of the full language of arithmetic. We study the order types of their non-standard models and separate all considered theories via their possible order types. We compare the theories with and without induction and observe that the theories without induction (...)
