These essays engage Jin Y. Park’s recent translation of the work of Kim Iryŏp, a Buddhist nun and public intellectual in early twentieth-century Korea. Park’s translation of Iryŏp’s Reflections of a Zen Buddhist Nun was the subject of two book panels at recent conferences: the first a plenary session at the annual meeting of the Society for Asian and Comparative Philosophy and the second at the Eastern Division of the American Philosophical Association on a group program session sponsored by the (...) This is both a work-immanent analysis of Lun dao , and an introduction to Jin’s thought. It begins with the problem of induction, which is the study’s central theme, and proceeds to outline Jin’s ontological response. In addition, it also considers his epistemological response to the problem.
The article analyzes one of the fundamental rights – the right to maintenance, which proper implementation ensures normal development of the child. This right matches with the duty of parents to maintain their minor children. Paragraph 6 of Article 38 of the Constitution of the Republic of Lithuania states that parents have a duty to educate their children to be honest people and loyal citizens, supporting them until adulthood. The obligation to maintain children is established in the first 3.192 Article (...) paragraph of the Civil Code of the Republic of Lithuania, and the responsibility for avoiding to maintain a child is provided in Article 164 of the Criminal Code. The article discusses the fact that the analysis of criminal law rate is not precise enough. Article 164 of the Criminal Code does not match with the child maintenance methods specified in the CC Article 3.196 paragraph 1. Since criminal liability is only for judgment in default in civil cases, a person shall only be liable for breaking the right to maintain a child, provided in the CC 3.196 paragraph 1. This article deeply analyzes the problematic qualification aspects of the avoidance to maintain a child. Some alternative ways of child maintenance are mentioned, as can be chosen from other law instruments (bailiffs, Guarantee child support fund) and it leads to the ultima ratio principle. On the other hand, it is not required to seek alternative remedies for affected interests, and it is possible to initiate a pre-trial investigation. Therefore, this article seeks to identify specific civil and criminal law rules delimitation. Avoidance of child maintenance is an ongoing crime. The main problem in legal practice is to determine an end of this ongoing criminal conduct. The practice of the Supreme Court of Lithuania is not unanimous. In some cases, the end of this ongoing conduct is considered to be a moment when the past judgment has entered into force, in other cases – the moment of indictment. These positions are criticized by many authors and it is suggested to follow the Supreme Court’s practice, according to which the moment when a judgment of conviction for the criminal act is passed should be considered as an end of an ongoing criminal conduct. This article proposes that thinking of scientific instruments as playthings or philosophical toys offers a method for looking at the ways in which we learn from made things and from the act of making in investigating the world. Rather than approaching artefacts as stable ob- jects, definable and categorisable in terms of their function, this method puts forward the instability and mobility of artefacts on several levels: in terms of their movements between hands, social contexts and systems of knowledge, in (...) terms of their physical articulations and of their changing functions, and in terms of the flows and processes of materials at work within and through them. The history of the church, inter-confessional relations and religious policies of the state is one of the developing areas of today's historical studies. An increasing number of special historical researches, papers, articles devoted to these issues, covering different periods in the history of our country, were a proof to that. Such interest is well justified as Ukraine is a country with complex ethnical and confessional set-up. This calls for deep insight into the history of relations between different confessions in the (...) past. The article analyses specific features of the church policies of the Polish-Lithuanian Commonwealth during the four year parliament (Sejm) of 1788-1791, acts of law adopted in that period that set legal grounds for the status of the Orthodox Church in the state, and studies the interpretation of those events and documents by church historian V. Bednov. Special attention was paid to the analysis of the actions of the Polish authorities to be avoided in today's church policies or, alternatively, to be encouraged today to maintain public peace and inter-confessional dialogue in the country. In his work, V. Bednov described in details all clauses of the Resolution of the General Congregation held in Pinsk, which were later legitimised by the Polish parliament (1791) and confirmed in the special Sejm constitution. This document was intended to dramatically change the status of the Orthodox Church in the Polish-Lithuanian Commonwealth. Yet, time was lost, and prejudices that prevented the document from being adopted without limitations became one of the factors further resulting in the disappearance of the Polish-Lithuanian Commonwealth as an independent state after the second (1793) and third (1795) partitions. These prejudices did not help to resolve controversies between Catholic, Uniate and Orthodox Christians either. The work of V. Bednov analysing the above issues was highly praised by his contemporaries. Yet, the scholar never returned to this topic in his studies, which makes this area very promising for modern researchers. Podría pensarse que el discurso epistemológico no puede abordar la experiencia mística, sin embargo desde el siglo XX diversos autores se han dado a la tarea de formular modelos epistemológicos que permitan comprender el estatus epistemológico de dicha experiencia. A partir del auge de perspectivas lingüísticas y sociológicas que se apoyaron en la filosofía de Wittgenstein y en la importancia que éste dio al lenguaje, a la experiencia que en él se expresa y a la comunidad que se entiende con (...) este lenguaje, el modelo constructivista dominó las discusiones epistemológicas sobre la experiencia mística. Sin embargo, este modelo también fue criticado desde varias perspectivas que consideraban que el constructivismo terminaba por reducir la experiencia a la doctrina. A partir de un análisis de este debate, el presente artículo argumenta a favor de un modelo naturalizado y propone algunos criterios para su constitución; muestra, también, la pertinencia de este modelo para una concepción epistemológica de la experiencia mística. The article deals with the application rationae personae of the right to selfdetermination. Relying on the existing international legal framework, decisions of the judicial bodies and doctrine, the author analyses conceivable beneficiaries of the above-mentioned right: the inhabitants of Trust and Non-Self-Governing territories, peoples under foreign occupation, the entire population of a state and subgroups within a state.
Since 2004, Nanyan Cao and some other scholars have implicitly or explicitly claimed that engineering ethics in China is importantly different from engineering ethics in the United States. The evidence for that claim relies on examination of official documents or certain large features of Chinese society. Though neither is an uncommon approach to studying engineering ethics in China, neither actually studies engineering practice in China. This article does—or at least gets much closer. The authors have asked almost two hundred Chinese (...) engineers about what they do and why they do it. The responses suggest that Chinese engineers, or at least those surveyed, think about engineering ethics much as American engineers do. The responses also suggest that much more empirical work needs to be done before we can claim to understand either the similarities or differences between engineering ethics in China and engineering ethics in “the West.”. Biometric identity systems are now a prominent feature of contemporary law enforcement, including in Europe. Often advanced on the premise of efficiency and accuracy, they have also been the subject of significant controversy. Much attention has focussed on longer-standing biometric data collection, such as finger-printing and facial recognition, foregrounding concerns with the impact such technologies can have on the nature of policing and fundamental human rights. Less researched is the growing use of voice recognition in law enforcement. This paper examines (...) the case of the recent Speaker Identification Integrated Project, a European wide initiative to create the first international and interoperable database of voice biometrics, now the third largest biometric database at Interpol. Drawing on Freedom of Information requests, interviews and public documentation, we outline the emergence and features of SiiP and explore how voice is recognised and attributed meaning. We understand Speaker Identification Integrated Project as constituting a particular ‘regime of recognition’ premised on the use of soft biometrics to disembed voice in order to optimise for difference. This, in turn, has implications for the nature and scope of law enforcement, people's position in society, and justice concerns more broadly. (shrink)
In recent years, philosophical ideas developed during the Wei-Jin period, broadly referred to as xuanxue in Chinese and ‘Neo-Daoism’ or ‘Dark Learning’ in English, have been accorded increasing attention in academia. This article provides an introduction to some major thinkers of the Wei-Jin period, addressing both their original writings and recent scholarly interpretations. The article aims to demonstrate that many Wei-Jin period intellectuals formed their theories through reinterpreting the relationship between texts associated with Daoism and Confucianism. Thinkers of this period (...) often attempted to show how these defining ‘schools’ of pre-Qin Chinese thought did not propose theories that were fundamentally inconsistent, and that their ideas could be woven together as elements of a coherent view. This intellectual movement can thus be, and often has been, viewed as an attempt to integrate Daoism and Confucianism. However, a more nuanced reading demonstrates that these thinkers were reworking the relationship between what were seen as predominately Daoist or Confucian themes from their very foundation. Accordingly, the common description of Wei-Jin thinkers as ‘Daoist’ is decidedly incongruous. (shrink)

This study investigates the mechanism of how sensory experiences influence visitors’ digital engagement with a destination through establishing a strong bond and identification between a destination and tourist utilizing a two-step process. First, visitors’ sensory experiences in a destination are identified through a content analysis of online review comments posted by visitors. Afterward, the effects of those sensory experiences on visitors’ digital engagement through destination dependence and identification with that destination are examined. Findings suggest that sensory experiences are critical antecedents (...) of visitors’ bond and identification with a destination. Visitors’ positive destination-related sensory experiences increase their dependence on and identification with the destination, and this dependence and identification positively influence their digital engagement behavior on social media. : In his philosophy of nothingness, Kitar Nishida illuminates the matrix of transformation of the world ‘‘from the Created to the Creating’’ (tsukuru mono kara tsukurareta mono e) through shintai, or the body. In this matrix, shintai enters into the stage of an action-sensation continuum and emerges as the immaculate iconic tool of nothingness to create new figures as extended self. This idea of shintai has resonance with the development of postwar art in Japan. The ‘‘Space of Transparency’’ put forth (...) by Ufan Lee, the leader of Monoha, is the principal example. This dissertation contextualizes the emergence of the Church of Light by Tadao Ando within the Japanese religio-philosophical tradition of nothingness. The idea of nothingness was revived during the first half of the twentieth-century by Kitaro Nishida with two cultural ramifications in the post-war period: a series of dialogues on the points of convergence and divergence between nothingness and the God of Christianity, and an architectural art movement called Monoha, or l'Ecole de Choses. Under the concept of "structuring emptiness," Monoha attempted (...) to restore perceptual depth where dichotomous semiotic representation is overcome through shintaisei, the co-originating corporeal fabric between the subject and object. This two-fold mapping, theological and architectural, not only illuminates the post-war cultural milieu from which Ando's church of spatial emptiness emerged, but also locates the church within the legacy of Nishida's nothingness. ;Nishida's philosophy of nothingness offers a perceptual theory of the "dialectic of self-negation" enacted by shintai, "the actively knowing body." Shintai is the agent of emptying selfhood by functioning as 'the sensational capacity to be filled by' the world. Shintai concretizes the perceptual matrix of co-emergence between the interiority of selfhood and the outside world. When its sensational capacity overflows, shintai enters into the realm of creative action to accommodate the surplus. The figure thus created is not a sign embodying subjective intentions, but constitutes the corporelly-inscribed, pre-reflective experiential datum of the world. Nishida called such a figure "the pure body of the artist," implying its apprehension not as the other in unknowable confrontation, but as the extended self. ;The dissertation examines how this notion of self-renunciatory perception through shintai opens a new hermeneutic horizon for the Church of Light. The church presents an unprecedented conjunction between emptiness, based on the reductive removal of signs, and the cross of light. This seemingly contradictory integration confronts the modern degradation of the cross into an atrophied sign of Christianity and seeks to retrieve its fully efficacious symbolic power. The emptiness contributes to the revival of a deeper communicative mode as shintai by negating the habituated perception pivoted upon the dichotomy between the deciphering subject and the semiotic elements. The perception of light, a natural thing rather than a sign, which infiltrates the cross, is a preliminary ritual to save the perception from the paradigm of the semiotic representation. Shintai, the self-emptying corporeality, resonates with and becomes penetrated by, rather than subjectivizes, the light. On this restored perceptual depth, the cross is perceived not as a sign, but as a part of the pre-reflective, ontological datum constructed and apprehended by shintai. This perceptual experience endorses the associational similarity between the pre-Christian datum predicated upon shintai as the agent of the self-renunciatory subjectivity and Christianity with its theology of the self-transcending love of kenosis. Vann McGee has presented a putative counterexample to modus ponens. I show that (a slightly modified version of) McGee’s election scenario has the same structure as a famous lottery scenario by Kyburg. More specifically, McGee’s election story can be taken to show that, if the Lockean Thesis holds, rational belief is not closed under classical logic, including classical-logic modus ponens. This conclusion defies the existing accounts of McGee’s puzzle.
