ABSTRACT Pharmacogenetics is a rapidly expanding area of research exploring the relationship between inter‐individual genetic variation and drug response, with the goal of developing genetically optimised therapies. Slippery slope arguments claim that a particular action should be rejected (or supported) because it might be the first step onto a slippery slope leading to undesirable (or desirable) consequences. In this article, several slippery slope arguments relevant to the context of pharmacogenetics are evaluated under consideration of underlying reasons for their popularity. The (...) author concludes that although the examined arguments are unconvincing as slippery slope arguments, they do matter in this context. While positive slippery slope arguments serve as a driving force to fuel the development of pharmacogenetics, their negative counterparts play an important role to sensitise policy makers and the public to potential problems. Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

A measure of coherence is said to be reliability conducive if and only if a higher degree of coherence (asmeasured) of a set of testimonies implies a higher probability that the witnesses are reliable. Recently, it has been proved that the Shogenji measure of coherence is reliability conducive in restricted scenarios (e.g., Olsson and Schubert, Synthese, 157:297–308, 2007). In this article, I investigate whether the Shogenji measure, or any other coherence measure, is reliability conducive in general. Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Er zeigt auf dieser Grundlage, dass drei verschiedene Arten der Diversifizierung der Wissenschaft – intern, extern-institutionell und extern-aktivistisch –, die vom vor dem Hintergrund des negativen Begriffs als Einschränkung der Wissenschaftsfreiheit verstanden werden, tatsächlich zu ihrer Verbesserung beitragen. The article re-examines the relationship between the works of Alfred Schütz and Harold Garfinkel, focusing on their respective approaches to temporality in interaction. Although there are good reasons to emphasize the differences between Schütz’s notion of individual projects of action and Garfinkel’s interest in communicative sequencing, there is also an interesting historical connection. In order to elucidate this connection, the article provides a close reading of the steps that lead Schütz from his premise of ‘egological’ time consciousness to his understanding (...) of the reflexive and interactive process of meaning establishment and interpretation developed in his first book, _The Phenomenology of the Social World_ (1967 [1932]). The article reflects further upon which aspects of Schütz’s considerations resonated with Garfinkel in his formative years and how Garfinkel related to them variously in his later development of ethnomethodology. Hence, it appears that Garfinkel’s ethnomethodology successively departs from many of Schütz’s premises while simultaneously incorporating and further developing some of his notions on the sequential organization and temporal flux of interactive processes. In general, there are two main approaches to settling the alleged conflict between religion and science. On the first approach, one argues that there is not even the possibility of such a conflict, since the uses of religious utterances are sufficiently different from those of scientific ones to constitute them a distinct logical type. Thus, if religion appears to conflict with science, either this is merely an appearance, or else one of them, at least, is also performing the function of (...) the other, in which case their conflict is really either a scientific conflict or a religious conflict. In no case, however, can the truth of a scientific utterance be any reason for inferring the falsity of a religious one, and much less can it be any reason for entertaining doubts about the religious utterance's logical propriety. UEFA’s Financial Fair Play regulations represent the most restrictive regulatory intervention European club football has ever seen. Put simply, it demands from clubs to operate on the basis of their own football-related incomes. While the policy has attracted considerable attention from the economic and social sciences, very few contributions systematically investigate it from a philosophical-ethical perspective. The present paper fills this research gap by posing questions on FFP in relation to fair play as a normative concept. We draw on sport (...) economic assessments concerning potential outcomes of FFP and argue that the policy should go beyond the mere pragmatic goal of promoting financial sustainability and truly aim for creating a level playing field, otherwise it should not be labeled ‘fair play’. My aim is to investigate which coherence measures turn out to be reliability conducive in the more general scenario (...) where the testimonies do not have to be equivalent. It is shown that four measures are reliability conducive in the present scenario, all of which are ordinally equivalent to the Shogenji measure. Corporate social responsibility (CSR) has become a much-discussed subject in the business world. The Internet has become one of the main tools for CSR information disclosure, allowing companies to publicise more information less expensively and faster than ever before. As a result, corporations are increasingly concerned with communicating ethically and responsibly to the diversity of stakeholders through the web. This paper addresses the main question as whether CSR information disclosure on corporate websites is influenced by country of origin and/or industry (...) sector. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). It is routinely observed in NLP that sentences seem to “evoke” situations (where I use this term comprehensively to cover events, episodes, eventualities, processes, etc.). Much like discourse entities evoked by explicit noun phrases, these evoked situations can be referred to anaphorically, as for instance in (1) and (3) below, and can be modified in various ways, for instance by supplying their duration and location, as in (2) and (4).

Foucault’s theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of ‘freedom as critique’: Freedom can be defined as the capability to critically reflect upon one’s own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault’s thinking obscures freedom. The standard response (...) interprets Foucault’s later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault’s work. By differentiating these concepts, this article proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for ‘modal robustness’ and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault’s thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion about freedom. (shrink)

This paper is concerned with Michel Serres’s critique of property. Through the concept of ‘le propre,’ which in French can mean both ‘clean’ and ‘one’s own,’ and a naturalist reading of Rousseau, he proposes a ‘stercorian’ eco-criticism of property. Focusing on concepts of limits provides a fruitful angle from which to illuminate Serres’s critique of law and property. The first section will introduce Serres as a thinker of limits, borders, and boundaries. In the second and third parts, attention will be (...) drawn to his eco-criticism of law and property from a feminist and philosophy of science perspective, concluding with a fourth part, in which Serres’s approach will be contextualized in relation to other naturalisms. His work has far-reaching consequences for discourses of human agency in the context of the Anthropocene and makes a crucial contribution to how a new naturalist criticism of property might be conceived. The ability to sequence individual genomes is leading to the identification of an increasing number of genetic risk factors for serious diseases. Knowledge of these risk factors can often provide significant medical and psychological benefit, but also raises complex ethical and social issues. This paper focuses on one area of rapid progress: the identification of mutations causing long QT syndrome and other cardiac channel disorders, which can explain some previously unexplained deaths in infants (SIDS) and children and adults (SUDS) and (...) prevent others from occurring. This genetic knowledge, discovered posthumously in many cases, has implications for clinical care for surviving family members who might carry the same mutations. The information obtained from genetic testing, in the context of personal and family history, can guide individually tailored interventions that reduce risk and save lives. At the same time, obtaining and disclosing genetic information raises difficult issues about confidentiality and decision making within families. We draw on the experience of the Montefiore-Einstein Center for Cardiogenetics, which has played a leading role in the genetic diagnosis and clinical management of cardiac channel diseases, to explore some of the challenging ethical questions arising in affected families with adolescent children. We focus on the related issues of (1) family confidentiality, privacy and disclosure and (2) adolescent decision making about genetic risk, and argue for the value of interdisciplinary dialogue with affected families in resolving these issues. Feeling moved or touched can be accompanied by tears, goosebumps, and sensations of warmth in the centre of the chest. The experience has been described frequently, but psychological science knows little about it. We propose that labelling one’s feeling as being moved or touched is a component of a social-relational emotion that we term kama muta. We hypothesise that it is caused by appraising an intensification of communal sharing relations. Here, we test this by investigating people’s moment-to-moment reports of feeling (...) moved and touched while watching six short videos. We compare these to six other sets of participants’ moment-to-moment responses watching the same videos: respectively, judgements of closeness, reports of weeping, goosebumps, warmth in the centre of the chest, happiness, and sadness. Our eighth time series is expert ratings of communal sharing. Time series analyses show strong and consistent cross-correlations of feeling moved and touched and closeness with each other and with each of the three physiological variables and expert-rated communal sharing – but distinctiveness from happiness and sadness. The paper considers the importance of culture for achieving universal dialogue. It clarifies the meanings of the terms “culture” and “art”, focusing on their historical transformations, and on the historical development of the history of art and archaeology, two academic disciplines which investigate art and culture. The recognition of the meanings is treated here as a basic initiating and necessary step in investigating intercultural dialogue.

El uso de analogías en bioética es muy frecuente. Dado que son instrumentos especialmente eficaces desde un punto de vista retórico, resulta fundamental determinar bajo qué condiciones la formulación de analogías constituye un recurso discursivo legítimo. En este artículo, distinguimos entre usos no-discursivos y usos discursivos de las analogías, y dentro de estos últimos, entre usos explicativos y usos argumentativos. En base a esta clasificación, proponemos distintos conjuntos de criterios para determinar si una analogía particular constituye un recurso discursivo legítimo (...) o no. This paper discusses corporate entanglement, impactfulness and responsibility in the Anthropocene, amidst events and conditions that ‘uncontain’ time. It takes its direction of travel from artist Brian Jungen’s ‘Cetology’ (2002), a whalebone sculpture made out of cut-up plastic garden chairs, which conjoins the times of earth and world history, as it hangs in the air of the art gallery, ‘as if’ exhibited in the natural history museum. The paper relates ‘Cetology’s’ engagement with natural history, time, and commodification to matters of (...) corporate entanglement and responsibility within company law and governance. Problems with understanding the comparable imprint of large and multinational companies on matters, places, and communities are identified, after the domination of corporate legal frameworks over nature and the stability and perfection of economic incentives at law. The reading of this (critical-legal) situation is developed through theory and engagement with materialist and critical thinkers, who unite in their concern with distributed human–nature relations and the ‘concreteness’ that attends collisions in time, ruin and affect. Walter Benjamin and Theodor Adorno’s writings are central to this analysis, and strengthen the commentary on ‘natural history’ themes curated by Jungen. The paper contemplates how times’ uncontainment might invoke a change in expectation and method for the company law field, assigning contingency to the corporation and provoking a new mode of reflection about corporate entanglement and responsibility at law. Cowan assumes a unitary capacity-limited attentional focus. We argue that two main problems need to be solved before this assumption can complement theoretical knowledge about human cognition. First, it needs to be clarified what exactly the nature of the elements (chunks) within the attentional focus is. Second, an elaborated process model needs to be developed and testable assumptions about the proposed capacity limitation need to be formulated.

In recent years there has been a renewal of interest in Meinong's work; but since the bulk of it is still encased in his quite forbidding German, most students are limited to the few available translations and to secondary sources. Unfortunately Meinong has been much maligned - only in a few instances with good reason - and has consequently been dealt with lightly. Meinong stood at a very important junction of European philosophical and scien tific thought. In all fields - (...) physics, chemistry, mathematics, psychology, philolo- revolutionary strides were being made. Philosophy, on the other hand, had run its post-Kantian course. New philosophical thinkers came from different disciplines. For example, Frege and later Russell were mathematicians, Boltzmann and Mach were physicists. Earlier Bolzano and then Brentano were originally theologians, and Meinong was a historian. 1 The sciences with their new insights and theories offered an enormous wealth of information which needed to be absorbed philosophically; but traditional philosophy could not deal with it. Physics presented a picture of reality which did not fit into the traditional schemes of empiricism or idealism. Ontological and epistemological questions became once again wide open issues. This paper attempts to investigate various facets of the multi-layered dynamics of open-book exams, from student perceptions, preferences, academic performance and satisfaction, to the highly relevant issue of academic integrity. Unfortunately, despite some controversies regarding academic integrity and the repercussions of open-book exams, very few studies have directly investigated the relationship between satisfaction and perceived academic performance and preference in open-book exams. A survey of 250 students from both science and non-science disciplines randomly selected from one public university was conducted (...) in Malaysia. An online survey was utilized to gather the data. Partial Least Squares-Structural Equation Modelling technique, a second-generation multivariate statistical model, was utilized to analyze the data that. This approach employs both PLS-SEM’s outer model and inner model. The findings indicate that open-book exams that do not undermine the overall academic standards are more likely to lead to students’ satisfaction. The high engagement levels might mediate this relationship by contributing to the perceptions of satisfaction. Additionally, the level of academic integrity was found to affect student satisfaction with the practice by moderating the relationship in the opposite direction. This study provides robust theoretical and practical implications on several interactions between the dependent variable of academic integrity, the mediating variable of student reaction, and the independent variable of student satisfaction and performance with open-book exams. This understanding is crucial for stakeholders as higher education’s organizational expectations continue to evolve and revolve around these variables to create a conducive learning paradigm. Schubert squarely addresses the question of whether there is a single standard of certainty that can be applied to such disparate areas as logic, mathematics, politics, religion, familial/tribal commitments, and science. The result is a new “philosophy in a grand manner” and a powerful ethical proposal for our time.

Employees perception of the existence of a covenantal relationship between themselves and their employer indicates that they believe there is a mutual commitment to shared values and the welfare of the other party in the relationship. Research suggests that these types of employment relationships have positive benefits for both employees and employers. There has been little research, however, on the factors that determine whether such relationships will develop and thrive.In this paper, we suggest that the organizations ethical work climate may (...) be an important factor affecting employees perceptions about the nature of the relational contract between themselves and their employer. Specifically, we argue that work climates emphasizing benevolence and principle will be associated with covenantal relationships. Conversely, we believe that work climates emphasizing egoism will make it less likely that covenantal relationships will develop between an employer and employee. (shrink)

Phenomenology questions the centrality that Kant attributes to the “I think.” It claims that on the pre-reflective level experience is selfless as unity is given. I call this the “unity argument.” The paper explores the significance of this claim by focusing on the work of Edmund Husserl. What interests me is that although the unity argument claims that we can account for the unity of experience without appealing to the an “I think,” Husserl agrees with Kant that experience must be (...) owned. Moreover, he endorses Kant's dictum that ‘the “I think” must be capable of accompanying all my presentations’. The aim of the paper is to explore how Husserl can consistently appeal to Kant's account of the “I think” and at the same time contend that on the pre-reflective level experience is selfless. The thesis I wish to advance is that although the unity argument acknowledges that experience is necessarily mine, it reveals that it is a necessary feature of self-reference that I have never taken absolute ownership over my experience. This may explain why our sense of self can often be out of tune with the way we live our lives. (shrink)

This paper takes Zahavi’s view to task that every conscious experience involves a “minimal sense of self.” Zahavi bases his claim on the observation that experience, even on the pre-reflective level, is not only about the object, but also has a distinctive qualitative aspect which is indicative of the fact that it is for me. It has the quality of what he calls “for-meness” or “mineness.” Against this I argue that there are not two phenomena but only one. On the (...) pre-reflective level, experience is transparent. Conscious experience may well be reflexive but this does not imply that I additionally have a sense of what it is like for me to have that experience. I do not just happen to disagree with Zahavi’s account of pre-reflective experience but, more importantly, I am concerned that he imposes it onto his interpretation of Edmund Husserl. Zahavi claims that when Husserl argues that consciousness is necessarily a form of self-consciousness, he must be committed to the view that we necessarily have a sense of ownership. However, Husserl only claims that I am self-conscious but not that I am a self that owns its consciousness. Zahavi thus misses the novelty of Husserl’s position, namely that I do not need to have a sense of abiding ownership, to have experience. (shrink)
