The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty measurement; (...) and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. The chapter concludes with some implications of our research for a theory of need-based justice. (shrink)

In this paper, Leonard Waks investigates connections between listening and expertise or mastery, contrasting approaches from Eastern and Western philosophy. The first section accounts for listening in the Daoist classic Zhuangzi, a work addressing themes in Chinese philosophy through metaphor and story narratives. In one story a character named “Confucius” advises a student to fast the mind and listen recklessly. The affinity between reckless and what has been called “apophatic” listening is demonstrated by the shared feature of mental emptiness (...) — listening without the imposition of conceptual categories. The second section demonstrates close affinities between the account of listening and expertise or mastery in the Zhuangzi and in the account of expert perception in contemporary Western philosophy and psychology, as exemplified by phenomenologist Hubert Dreyfus. We present a vignette study conducted with a quota sample of the German population (n = 400). Subjects had to redistribute a good between two hypothetical persons who contributed equally to the available amount but differed in quantity needed and the reason for their neediness. On a within-subjects level, we tested for the effects of need, accountability, and resource availability on their third-party distribution decisions. Between subjects, we further varied the kinds of needs: The persons either needed the good as (...) a means to survive, to live a decent life, to participate in society, or to be autonomous. Despite equal productivity, the mean share allocated to the needier person was significantly higher than an equal share. However, this share turned out significantly smaller when the needier person was accountable for needing more than the other. Nonetheless, even if accountable, the needier person still got a share larger than their contribution would suggest. When there was a surplus of resources, the needier person got an even higher share than when resources were scarce. (shrink)

"Atom," "byte" and "gene" are metonymies for techno-scientific developments of the 20th century: nuclear power, computing and genetic engineering. Resistance continues to challenge these developments in public opinion. This book traces historical debates over atoms, bytes and genes which raised controversy with consequences, and argues that public opinion is a factor of the development of modern techno-science. The level and scope of public controversy is an index of resistance, examined here with a "pain analogy" which shows that just as pain (...) impacts movement, resistance impacts techno-scientific mobilization: it signals that something is wrong, and this requires attention, elaboration and a response to the challenge. This analysis shows how different fields of enquiry deal with the resistance of social-psychological mentalities in the face of industrial, scientific and political activities inspired by projected futures. This paper argues that certain expressions of practical necessity – like ‘I have to do this, I do not have a choice’ or ‘Here I stand, I can do no other’ – allow an insight into deep structures of personality and self-understanding. They point at a limit where someone would have to ‘become another person’ (in his own view), if he was forced to an alternative decision, because of neglecting ground-projects and convictions, which are essential for his self-conception. This limit (...) is marked by a loss of autonomy and authenticity. The paper discusses why and in how far expressions of personal necessities seem to have a special value and authority as they call forth the respect of the other towards an individual personality, even though this does not exclude that there may also be a necessity of self-reform. Bedürfnisse sind etwas, das uns als Menschen grundlegend bestimmt. Der vorliegende Band fasst eine Reihe von Vignettenstudien zusammen, in denen untersucht wird, welche Rolle Bedürfnisse im Umgang mit Problemen der Verteilungsgerechtigkeit spielen. Während sie in Diskussionen zur Verteilungsgerechtigkeit häufig eher unterrepräsentiert sind, wird hier gezeigt, dass sie eine fundamentale Bedeutung im Denken der Menschen haben. Es wird unter anderem deutlich, dass unparteiischen Beobachter*innen graduelle Gerechtigkeitseinschätzungen von Verteilungssituationen vornehmen, die davon abhängig sind, wie umfangreich die beobachteten Parteien mit einem Gut ausgestattet (...) sind. Wenn außerdem bekannt ist, wie hoch deren Bedarf an jenem Gut ist, finden die Einschätzungen relativ zu diesem Referenzpunkt statt. Außerdem werden in der Rolle von unparteiischen Entscheider*innen hypothetische Verteilungsentscheidungen getroffen, die den Bedarf, die Leistung sowie die Verantwortung der betroffenen Parteien berücksichtigen. Hierbei wird der Bedarf einer Partei auch dann zumindest teilweise kompensiert, wenn diese weniger zu der zur Verfügung stehenden Gütermenge beigetragen hat, als sie selbst benötigt. Die Bereitschaft, den Bedarf einer Partei teilweise zu kompensieren, sinkt jedoch, wenn sie dafür verantwortlich ist, mehr als andere zu benötigen oder weniger als andere beigetragen zu haben. Und sowohl in der Rolle von unparteiischen Beobachter*innen als auch in der Rolle von unparteiischen Entscheider*innen wird zwischen unterschiedlichen Bedarfsarten unterschieden, deren Erfüllung verschiedene Wichtigkeit beigemessen wird. Sie haben sich bis in die Gegenwart hinein stetig weiterentwickelt, so dass sein Werk insgesamt bedeutende Potentiale hinsichtlich der gesellschaftlichen Rolle von Religion birgt - und daruber hinaus auch hinsichtlich derjenigen von Bildung. Daniel Tobias Bauer rekonstruiert beide Entwicklungslinien bis in die Gegenwart hinein und uberfuhrt sie in den praktisch-theologischen Diskurs. Dies geschieht methodisch anhand Habermas' These, dass bedeutende geistesgeschichtliche (...) Begriffe ursprunglich in der Religion verankert waren und nur aus dieser Verwurzelung heraus gegenwartig angemessen zu verstehen sind. It was written in 1921 in opposition to the relativistic, subjectivistic and nihilistic tendencies of Nelson's time. The book contains an exposition of a method that is a further development of Kant's transcendental dialectics, followed by an application to the critical analysis of arguments by many famous thinkers, including Bentham, Mill, (...) Poincaré, Leibniz, Hegel, Einstein, Bergson, Rickert, Simmel, Brentano, Stammler, Jellinek, Dingler, and Meinong. The book presents a general theory of philosophical argumentation as seen from the viewpoint of the typical fallacies committed by anybody arguing philosophically, whether professional philosophers or philosophical laypeople. Although the nature of philosophy and philosophical argumentation is one of the most recurrent objects of reflection for philosophers, this book represents the first attempt at a general theory of philosophical fallacy. According to Nelson, it is in the shape of false dilemmas that errors in reasoning always emerge, and false dilemmas are always the result of the same mechanism--the unwitting replacement of one concept for another. Unter dem Dach der Philosophie gingen empirische Forschung und normative Theorie lange Zeit Hand in Hand, bis sie spätestens um die Zeit der Emanzipation der Einzelwissenschaften in eine schwierige, nicht immer eindeutig bestimmbare Beziehung zueinander traten; dieses unterbestimmte Verhältnis tritt uns vor dem Hintergrund aktueller Debatten wieder entgegen. Das zeigt sich zum Beispiel auch bei Fragen der Ethik: In den letzten Jahrzehnten zeigten verschiedene wissenschaftliche Disziplinen verstärktes Interesse an empirischen Bemühungen um ein deskriptives Verständnis von Moral. Hier gibt es nach (...) wie vor eine starke Trennung zwischen den Bereichen der normativen Theorie einerseits und der empirischen Forschung andererseits, wobei in beiden Bereichen dazu tendiert wird, die jeweils anderen Diskurse zu vernachlässigen, wobei Unklarheit über die Möglichkeiten und Grenzen einer fruchtbaren Integration herrscht. In this chapter, I take up the question of whether one of the central principles of jus ad bellum – just cause – is relevant in a world in which cyberattacks occur. I argue that this principle is just as relevant as ever, though it needs modification in light of recent developments. In particular, I argue, contrary to many traditional just war theorists, that just cause should not be limited to physical attacks. In the process, I offer an improved definition (...) of cyberattack and show how some other principles of jus ad bellum constrain this widened notion of just cause. (shrink)
