Sexual assault is a common experience for women and a significant topic for feminist scholarship. However, discussions of forensic evidence collection have been largely neglected. This paper considers the ethics of forensic evidence collection by situating the conversation in the context of the experience of sexual assault. The power of patriarchal norms and rape myths, the impact of trauma, and the systemic sexism in the medical and legal systems are also discussed. In this paper I take up the task, begun by Lewis and Lewis in their seminal paper on the topic, of offering a theory of holes according to which a hole is simply its hole-lining. I begin by motivating the theory, arguing that it holds interest even absent its original animating concerns of nominalism and materialism, and present desiderata any such theory must satisfy. With this in place, I offer a definition both of a lining and of hole sameness, arguing (...) that these can overcome the most prominent standing objections to identifying holes with linings. Finally, I present a more powerful counterargument in the spirit of Casati and Varzi, and conclude with an emended version of the theory meeting all our earlier desiderata. I conclude by dispelling some possible worries about the nominalist and materialist credentials of my theory. (shrink)

In this paper I propose and motivate a logic of the interdefined concepts of making true and control, understood as intensional propositional operators to be indexed to an agent. While bearing a resemblance to earlier logics in the tradition, the motivations, semantics, and object language theory differ on crucial points. Applying this logic to widespread formal theories of agency, I use it as a framework to argue against the ubiquitous assumption that the strongest actions or options available to a given (...) agent must always be pairwise incompatible. The conclusion is that this assumption conflicts with failures of higher order control of agents over their degree or precision of control, failures exhibited by such imperfect agents as ourselves. I discuss models in this setting for understanding such imperfectly self-controlling agents. In an appendix, I prove several relevant results about the logic described, including soundness and completeness both for it and for certain natural extensions. (shrink)

Advancements in biological ageing research have shown that age-related diseases may be fought more effectively in the future by directly intervening into the ageing process. This prospect is associated with hopes for solving problems of demographic change. It also addresses raising awareness for complex ethical, legal and social issues that have hardly been a topic of discussion to date. Therefore, as the objective of our project, an interdisciplinary discourse module entitled “Ethics of Biogerontology” was developed to initiate a social debate (...) on the ethical, legal, and societal implications of biogerontology. The discourse module focuses on competences and argumentation skills and was developed with experts from relevant disciplines, e.g. biogerontology, social gerontology, philosophy, geriatrics, and medical ethics. Concepts of age and ageing are tightly interlinked with biogerontology and are as such relevant as teaching contents of the discourse module. The course module was tested in eight discourse teaching projects in research, medicine, and education in various partner institutions and evaluated based on an ethical competence model. This article describes the conception, including the learning objectives, of such a teaching course and the associated teaching contents. It also gives a justification for their selection. Finally, we summarize the results of the evaluation. (shrink)

In Western countries a considerable number of older people move to a residential home when their health declines. Institutionalization often results in increased dependence, inactivity and loss of identity or self-worth (dignity). This raises the moral question as to how older, institutionalized people can remain autonomous as far as continuing to live in line with their own values is concerned. Following Walker's meta-ethical framework on the assignment of responsibilities, we suggest that instead of directing all older people towards more autonomy (...) in terms of independence, professional caregivers should listen to the life narrative of older people and attempt to find out how their personal identity, relations and values in life can be continued in the new setting. If mutual normative expectations between caregivers and older people are not carefully negotiated, it creates tension. This tension is illustrated by the narrative of Mr Powell, a retired successful public servant now living in a residential home. The narrative describes his current life, his need for help, his independent frame of mind, and his encounters with institutional and professional policies. Mr Powell sees himself as a man who has always cared for himself and others, and who still feels that he has to fulfil certain duties in life. Mr Powell's story shows that he is not always understood well by caregivers who respond from a one-sided view of autonomy as independence. This leads to misunderstanding and an underestimation of his need to be noticed and involved in the residential community. (shrink)

This essay provides an analysis of the theme of power in the text of the mystic Mechtild of Magdeburg, The Flowing Light of the Godhead. The author examines how this mediaeval woman learned to be an adroit shaper of power in her own life; how she understood the effects of corrupt clergy who persecuted her; how she directly faced corrupt power figures; how she used the rhetoric of femininity to subvert the more obvious power structures; how she gathered male friends (...) and clerics around her to legitimate her work; and how she skilfully negotiated the complex religious labyrinth of orthodoxy in her day. This essay provides an analysis of her engagement and entanglement of power relations, whether through her actions, her mystical work, or her direct discourse on the topic in Book VI of her text. This article presents two cases of women doing development work for civil society organizations in the Global South. The author uses the cases to explicate the relationship of global civil society, development work, feminism, and Christianity. The case studies were collected through life history interviews with the participants. The cases, interpreted in light of the ‘third space’ cultural theory of Homi Bhabha, destabilize the fixed identity of these women as ‘development workers’, ‘feminists’, ‘Western’, and ‘Christian’.

This work acknowledges that spirituality is an integral part of adult learning and development. Building on the history of adult education and training, the authors suggest that the profession needs to recover some of its early concerns for holistic and spirituality informed practice.

This article explores how cross-sector partnerships (CSPs) operating in a development context built resilience during the outbreak of the COVID-19 pandemic. Based on a qualitative analysis of eight partnerships operating in East-Africa, Central America, and Indonesia, I show how CSPs engaged in three practices of resilience building (i.e., forming unconventional alliances, mobilizing digital technologies, and building subnetworks), which allowed them to remain functional despite facing adversity. In addition to fostering their resilience, my findings show how engaging in these practices enabled (...) the CSPs to develop new capabilities (i.e., improved abilities to engage with beneficiaries) that benefit them in the long run. Based on these insights, I advance our understanding of resilience building by unpacking this concept on a CSP level. Furthermore, by unfolding the relevance of incidental learning in a cross-sectoral setting, I widen our knowledge of learning processes in CSPs. (shrink)

Epistemological disjunctivists make two strong claims about perceptual experience's epistemic value: experience guarantees the knowledgeable character of perceptual beliefs; experience's epistemic value is “reflectively accessible”. In this paper I develop a form of disjunctivism grounded in a presentational view of experience, on which the epistemic benefits of experience consist in the way perception presents the subject with aspects of her environment. I show that presentational disjunctivism has both dialectical and philosophically fundamental advantages over more traditional expositions. Dialectically, presentational disjunctivism resolves (...) a puzzle disjunctivists face in their posture vis-à-vis skeptical scenarios. More systematically, presentational disjunctivism provides an especially compelling view of disjunctivism as an internalist view of perceptual consciousness by explaining the way perceptual presence manifests the subject's rationality in a distinct way. Humans are experts in cooperating with each other when trying to accomplish tasks they cannot achieve alone. Recent studies of joint action have shown that when performing tasks together people strongly rely on the neurocognitive mechanisms that they also use when performing actions individually, that is, they predict the consequences of their co‐actor’s behavior through internal action simulation. Context‐sensitive action monitoring and action selection processes, however, are relatively underrated but crucial ingredients of joint action. In the present paper, we try (...) to correct the somewhat simplified view on joint action by reviewing recent studies of joint action simulation, monitoring, and selection while emphasizing the intricate interrelationships between these processes. Negative disjunctivists like Mike Martin and Bill Fish understand hallucinations in purely epistemic terms, and do not attribute phenomenal character to these visual misfires. However, the approaches by Martin and Fish are importantly different, and there has been little systematic work on how negative disjunctivism is motivated. In this paper, I argue for a version of negative disjunctivism that centers on the idea that perception involves the exercise of a fallible self-conscious capacity. I claim that this at once explains hallucinations (...) in purely negative terms that are close to Martin’s approach, while at the same time providing negative disjunctivism with an explanatory basis that Fish attempts to provide and Martin’s view lacks. According to epistemological disjunctivism (ED), ordinary perceptual experience ensures an opportunity for perceptual knowledge. In recent years, two distinct models of this idea have been developed. For Duncan Pritchard (Epistemological disjunctivism, 2012, Oxford University Press; Epistemic angst: Radical skepticism and the groundlessness of our believing, 2012, Princeton University Press), perception provides distinctly powerful reasons for belief. By contrast, Clayton Littlejohn (Journal of Philosophical Research, 41, 201; Knowledge first, 2017, Oxford University Press; Normativity: Epistemic and practical, 2018, Oxford University Press) and (...) Alan Millar (The nature and value of knowledge: Three investigations, 2010, Oxford University Press; Philosophical Issues, 21, 332) argue for a version of ED in terms of a “knowledge first” program, on which perception directly provides knowledge, without relying on antecedent reasons or justification. Specifically, both Littlejohn and Millar argue that “reasons first” ED faces a problematic regress. In this article, I defend “reasons first” ED by arguing that experience provides a type of reason that escapes the regress. I also argue that reasons are a fundamental aspect of ED, especially in its anti-skeptical stance. (shrink)

This article describes a case study on the Machiguenga, a remote Indigenous tribe affected by the Camisea Gas Project in the Peru. We introduce the anthropological concept of ‘glocalization’ and integrate this with organizational knowledge of ‘identity work’. Our findings demonstrate that identity work is a multi-faceted and boundary spanning process that significantly affects stakeholder relations and contributes to conflict between local communities and oil and gas companies. Indigenous identity can be both threatened and strengthened in response to natural gas (...) development and is related to how individuals, communities and the Machiguenga engage in identity work. We also discuss broader implications for management ethics, including a discussion of how Indigenous self-identify processes create a challenge for stakeholder theory. (shrink)

The sociobiological fashion has for a long time discouraged the development of theories of the immediate causation of behaviour. It is only recently that new approaches are being developed to improve on the classical ethological theory originated by Lorenz and Tinbergen. One new departure is behavioural field theory (BFT) which brings back the concept of energy in behaviour, without being susceptible to the drawbacks of the energy or fuel concept of classical theory. Job evaluation systems are becoming increasingly important in Europe to counter sex‐discrimination, but evaluation criteria can themselves be discriminatory. Dr Jeanne de Bruijn is Professor in Women and Policy at the Free University of Amsterdam.

With the ever-growing accessibility of case law online, it has become challenging to manually identify case law relevant to one’s legal issue. In the Netherlands, the planned increase in the online publication of case law is expected to exacerbate this challenge. In this paper, we tried to predict whether court decisions are cited by other courts or not after being published, thus in a way distinguishing between more and less authoritative cases. This type of system may be used to process (...) the large amounts of available data by filtering out large quantities of non-authoritative decisions, thus helping legal practitioners and scholars to find relevant decisions more easily, and drastically reducing the time spent on preparation and analysis. For the Dutch Supreme Court, the match between our prediction and the actual data was relatively strong (with a Matthews Correlation Coefficient of 0.60). Our results were less successful for the Council of State and the district courts (MCC scores of 0.26 and 0.17, relatively). We also attempted to identify the most informative characteristics of a decision. We found that a completely explainable model, consisting only of handcrafted metadata features, performs almost as well as a less well-explainable system based on all text of the decision. (shrink)

This study examines how the match between personal and firm-level values regarding environmental responsibility affects employee job satisfaction and creativity and contributes to three literature streams [i.e., social corporate responsibility, creativity, and person–environment fit]. Building on the P–E fit literature, we propose and test environmental orientation fit versus nonfit effects on creativity, identifying job satisfaction as a mediating mechanism and regulatory pressure as a moderator. An empirical investigation indicates that the various environmental orientation fit conditions affect job satisfaction and creativity (...) differently. More specifically, environmental orientation fit produces greater job satisfaction and creativity when the employee and organization both demonstrate high concern for the environment than when both display congruent low concern for the environmental. Furthermore, for employees working in organizations that fit their personal environmental orientation, strong regulatory pressure to comply with environmental standards diminishes the positive fit effect on job satisfaction and creativity, while regulatory pressure does not affect the job satisfaction and creativity of employees whose personal environmental orientation is incongruent with that of the organization. Epistemological disjunctivists hold that perceiving subjects have “reflective access” to factive perceptual support for belief. However, little has been done to elaborate the intended notion of reflection, or introspective awareness more generally. Moreover, critics have pointed out that the disjunctivist conception of “reflective access” can seem vulnerable to varieties of Williamson’s anti-luminosity argument. In this paper I defend disjunctivism from this charge, arguing that it holds the resources for a potent defense of the claim that knowledge of perceptual states is (...) luminous. Indeed, I argue that appreciating the relation between disjunctivism and luminosity sheds critical light on how the disjunctivist conceives of perceptual support for belief. (shrink)

In recent work, Scott Soames (2010, 2013, 2015, 2019) and Peter Hanks (2011, 2013, 2015) have developed a theory of propositions on which these are constituted by complexes of intellectual acts. In this article, I adapt this type of theory to provide an account of perceptual content. After introducing terminology in section 1, I detail the approach proffered by Soames and Hanks in section 2, focusing on Hanks’s version. In section 3, I introduce a problem that these theories face, namely, (...) how to account for the unity among the relevant intellectual acts. Section 4 provides an answer to this problem of unity, while section 5 explicates the relation to Soames and Hanks. In section 6, I extend the model to a theory of the unity of experiential consciousness. Finally, in section 7, I apply the preceding considerations to debates about the nature of perceptual representation. The upshot will be that experiential unity is not simply a phenomenal feature of consciousness, but central to an account of the role perceptual representation plays in perceptual cognition. What is the role of conscious experience in the epistemology of perceptual knowledge: how should we characterise what is going on in seeing that o is F in order to illuminate the contribution of seeing o to their status as cases of knowing that o is F? My proposal is that seeing o involves conscious acquaintance with o itself, the concrete worldly source of the truth that o is F, in a way that may make it evident to the subject (...) that o is an instance of ‘x is F’ as she understands this, and hence evident that o is F. Seeing that o is F is thus a way of its being evident that o is F and is therefore a way of knowing that o is F. (shrink)

The paper presents a speculative model for associative memory. It has two layers: the lower layer describes memory of a single cell, the upper layer describes how the work is distributed address-free over a large set of cells. Thinking, consciousness and various features of memory are interpreted in terms of the memory model.
