On one hand, Chinese consumers are well known for conspicuous consumption and the adoption of luxury products and named brands. On the other hand, they also have a bad reputation for buying counterfeit products. Their simultaneous preferences for two contrasting types of product present a paradox that has not been addressed in the literature. This study attempts to present an explanation of this paradox by examining the effects of traditional Chinese cultural values and consumer values on consumers’ deontological judgment of (...) pirated CDs and the amount of social benefits they perceive they gain from them. We interviewed 300 Hong Kong Chinese consumers, and found that face consciousness increased materialism and risk aversion, thereby producing a favorable deontological judgment of pirated CDs. Face consciousness also has a direct effect on the amount of social benefits perceived in pirated CDs. Both favorable deontological judgment and perceived social benefits contributed to a strong intention to buy pirated CDs. The results are discussed in a cultural perspective. (shrink)

This study examines the impact of attitude toward piracy on intention to buy pirated CDs using Chinese samples. Attitude toward piracy is measured by a multi-item scale that has been shown to have a consistent factor structure with four distinct components, namely, social cost of piracy, anti-big business attitude, social benefit of dissemination, and ethical belief. Our findings reveal that social benefit of dissemination and anti-big business attitude have a positive relationship with intention to buy pirated CDs while social cost (...) of piracy and ethical belief have a negative relationship. Among these components, ethical belief tends to most strongly predict intention to buy pirated CDs. Demographic variables such as gender and age also help explain the respondents' intention to buy pirated CDs. In addition, those respondents with experience of buying pirated CDs would tend to be more likely to buy pirated CDs than those without such experience. The results are discussed with a view to helping copyright businesses to effectively suppress piracy, and directions for future research are suggested. (shrink)

In this article, I embark on an analysis of Søren Kierkegaard's view of human otherness in strict correlation to his Christian philosophy. More specifically, my aim is to show that Kierkegaard's thought is essentially informed by a decisive appropriation of the soteriological category of sin which has momentous implications for Kierkegaard's views of selfhood and intersubjectivity. The main argument is that both Kierkegaard's negative evaluation of human otherness and his acerbic indictments of any collectivist interference in salvific matters cohere with (...) his appropriation of the doctrine of the Fall. At the same time, I show in what sense Kierkegaard deems human alterity to be indispensable to one's spiritual self-becoming expressed through the Christian imperative of loving the other as neighbor. Seen thus, agape, while supplementing Kierkegaard's creationistic psychology, actually becomes the necessary restorative opposite of sinfulness in the self's encounters with the distinct uniqueness of the human other. Why do many societies moralize apparently harmless pleasures, such as lust, gluttony, alcohol, drugs, and even music and dance? Why do they erect temperance, asceticism, sobriety, modesty, and piety as cardinal moral virtues? According to existing theories, this puritanical morality cannot be reduced to concerns for harm and fairness: It must emerge from cognitive systems that did not evolve for cooperation (e.g., disgust-based “purity” concerns). Here, we argue that, despite appearances, puritanical morality is no exception to the cooperative function of (...) moral cognition. It emerges in response to a key feature of cooperation, namely that cooperation is (ultimately) a long-term strategy, requiring (proximately) the self-control of appetites for immediate gratification. Puritanical moralizations condemn behaviors which, although inherently harmless, are perceived as indirectly facilitating uncooperative behaviors, by impairing the self-control required to refrain from cheating. Drinking, drugs, immodest clothing, and unruly music and dance are condemned as stimulating short-term impulses, thus facilitating uncooperative behaviors (e.g., violence, adultery, free-riding). Overindulgence in harmless bodily pleasures (e.g., masturbation, gluttony) is perceived as making people slave to their urges, thus altering abilities to resist future antisocial temptations. Daily self-discipline, ascetic temperance, and pious ritual observance are perceived as cultivating the self-control required to honor prosocial obligations. We review psychological, historical, and ethnographic evidence supporting this account. We use this theory to explain the fall of puritanism in western, educated, industrialized, rich, and democratic (WEIRD) societies, and discuss the cultural evolution of puritanical norms. Explaining puritanical norms does not require adding mechanisms unrelated to cooperation in our models of the moral mind. (shrink)

This article draws together two works created in late fifteenth-century Mantua. Although radically different in kind, they were borne from the same acts of violence: Andrea Mantegna’s Madonna of Victory and a responsum about Jewish religious law by Rabbi Joseph Colon. Mantegna’s altarpiece, painted to commemorate the bloody battle of Fornova as a Gonzaga victory, was paid for by Daniele Norsa; Norsa, a Jewish banker, was accused of destroying a prior Christian icon and ordered to finance the new altarpiece as (...) reparations for this crime, under threat of death. Colon’s responsum addressed the permissibility of creating a Christian image under duress—idolatry being one of the sins for which a Jew must sacrifice their life rather than transgressing. We explore the remarkable artistry and distinct craft practiced by the painter and the rabbi—image making in the one case, legal reasoning in the other—as modes of describing, interpreting, and creating reality. Both works address problems of religion and idolatry, faith and coercion, victory and violence, and triumph and lament. Together they reveal the dynamics of a fascinating iconoclash, a conflict of culture waged over the struggle between making and breaking images. (shrink)

The influential political philosopher Leo Strauss has been credited by conservatives with the recovery of the great tradition of political philosophy stretching back to Plato. Among Strauss's most enduring legacies is a strongly negative assessment of Nietzsche as the modern philosopher most at odds with that tradition and most responsible for the sins of twentieth-century culture--relativism, godlessness, nihilism, and the breakdown of family values. In fact, this apparent denunciation has become so closely associated with Strauss that it is often seen (...) as the very core of his thought. In Leo Strauss and Nietzsche, the eminent Nietzsche scholar Laurence Lampert offers a controversial new assessment of the Strauss-Nietzsche connection. Lampert undertakes a searching examination of the key Straussian essay, "Note on the Plan of Nietzsche's Beyond Good and Evil." He shows that this essay, written toward the end of Strauss's life and placed at the center of his final work, reveals an affinity for and debt to Nietzsche greater than Strauss's followers allow. This is a study of the encounter with the problem of heresy in Europe between the World Wars, in Germany and among Jews above all. It is first and foremost an intellectual history, though not exclusively so, and has four related aims. It argues, first, that the advent of a heretical ideal among Jews in the interwar period marked the definitive end of a chapter in German-Jewish history that began with Moses Mendelssohn. Mendelssohn's gambit and the liberal Judaism that arose (...) in its wake proved unworkable by this time, and the arrival of avowedly heretical forms of Jewish return signaled the end of his epoch. But we also find in this period the beginnings of a search for post-liberal modes of Jewish identity in which its predecessor endured in interesting and unexpected ways. Second, the dissertation reconstructs and analyzes the two leading languages of heresy in the interwar period, the gnostic and the pantheist. The first pined for salvation from a sinful world by the grace of a wholly transcendent, extramundane and therefore absent God, or a deus absconditus , and was associated in the interwar period with the Protestant representatives of dialectical theology. The pantheist language of heresy, by contrast, contested the gnostic spirit by divinizing the world, and was associated with the interconfessional revival of Spinoza. On the strength of this contextual reconstruction, the study aims, third, to reinterpret the philosophical careers of three important twentieth-century thinkers, all of them German-Jewish emigres: Hans Jonas, whose philosophical biology made him an unproclaimed "guru" to the German Green movment; Leo Strauss, the philosopher and unwitting father of a neo-conservative revolt in American politics; and Gershom Scholem, the eminent scholar of religion and Jewish culture. The study shows how their diverse projects all had origins in their encounter with the problem of heresy in interwar Europe. Their projects had also a common end: all resurrected the ancient Greek distinction between physis and nomos , and all contested normative Judaism by coming down squarely on the side of the former as the ground for Jewish identity in particular and human being more generally. Fourth and last, the dissertation makes an argument for the abiding salience of a theological dimension to European intellectual life between the wars and beyond. If nothing else, the stories presented here should alert us to the ways in which talk about God could be adapted for talk about nature, or politics, or art, to the ways in which discourses of the divine not only endure in this worldly world of ours, but flourish. Recent feminist philosophy of language has highlighted the ways that the speech of women can be unjustly impeded, because of the way their gender affects the uptake their speech receives. In this chapter, I explore how similar processes can undermine the speech of a different sort of speaker: Indigenous communities. This involves focusing on Indigeneity rather than gender as the salient social identity, and looking at the ways that group speech, rather than only individual speech, can be unjustly impeded. To (...) do this, I make use of the notion of ‘discursive injustice’ that has been developed by Quill Kukla, and, with reference to three case studies, show how discursive injustice can effectively derail the speech of Indigenous communities. Michael Gilbert’s multi-modal theory of argument challenges earlier accounts of arguing assumed in formal and informal logic. His account of emotional, visceral, and kisceral modes of arguing rejects the assumption that all arguments must be treated as instances of one “logical mode.” This paper compares his alternative modes to other modes proposed by those who have argued for visual, auditory, and other “multimodal” modes of arguing. I conclude that multi-modal and multimodal (without the hyphen) modes are complementary. In the summer of 1886, shortly before his fifty-eighth birthday, Leo Tolstoy was seriously injured while working in the fields of his estate. Bedridden for over two months, Tolstoy began writing a meditation on death and dying that soon developed into a philosophical treatise on life, death, love, and the overcoming of pessimism. Although begun as an account of how one man encounters and laments his death and makes this death his own, the final work, On Life, describes the optimal (...) life in which we can all be happy despite our mortality. After its completion, On Life was suppressed by the tsars, attacked by the hierarchs of the Russian Orthodox Church, and then censored by the Stalinist regime. This critical edition is the first accurate translation of this unsung classic of Russian thought into English, based on a study of manuscript pages of Tolstoy's drafts, and the first scholarly edition of this work in any language. It includes a detailed introduction and annotations, as well as historical material, such as early drafts, documents related to the presentation of an early version at the Moscow Psychological Society, and responses to the work by philosophers, religious leaders, journalists, and ordinary readers of Tolstoy's day. Leo Strauss is known primarily for reviving classical political philosophy through careful analyses of works by ancient thinkers. As with his published writings, Strauss’s seminars devoted to specific philosophers were notoriously dense, accessible only to graduate students and scholars with a good command of the subject. In 1965, however, Strauss offered an introductory course on political philosophy at the University of Chicago. Using a conversational style, he sought to make political philosophy, as well as his own ideas and methods, understandable (...) to those with little background on the subject. Leo Strauss on Political Philosophy brings together the lectures that comprise Strauss’s “Introduction to Political Philosophy.” Strauss begins by emphasizing the importance of political philosophy in determining the common good of society and critically examining the two most powerful contemporary challenges to the possibility of using political theory to learn about and develop the best political order: positivism and historicism. In seeking the common good, classical political philosophers like Plato and Aristotle did not distinguish between political philosophy and political science. Today, however, political philosophy must contend with the contemporary belief that it is impossible to know what the good society really is. Strauss emphasizes the need to study the history of political philosophy to see whether the changes in the understanding of nature and conceptions of justice that gradually led people to believe that it is not possible to determine what the best political society is are either necessary or valid. In doing so, he ranges across the entire history of political philosophy, providing a valuable, thematically coherent foundation, including explications of many canonical thinkers, such as Auguste Comte and Immanuel Kant, about whom Strauss did not write extensively in his published writings.
