On one hand, Chinese consumers are well known for conspicuous consumption and the adoption of luxury products and named brands. On the other hand, they also have a bad reputation for buying counterfeit products. Their simultaneous preferences for two contrasting types of product present a paradox that has not been addressed in the literature. This study attempts to present an explanation of this paradox by examining the effects of traditional Chinese cultural values and consumer values on consumers’ deontological judgment of (...) pirated CDs and the amount of social benefits they perceive they gain from them. We interviewed 300 Hong Kong Chinese consumers, and found that face consciousness increased materialism and risk aversion, thereby producing a favorable deontological judgment of pirated CDs. Face consciousness also has a direct effect on the amount of social benefits perceived in pirated CDs. Both favorable deontological judgment and perceived social benefits contributed to a strong intention to buy pirated CDs. The results are discussed in a cultural perspective. (shrink)

This study examines the impact of attitude toward piracy on intention to buy pirated CDs using Chinese samples. Attitude toward piracy is measured by a multi-item scale that has been shown to have a consistent factor structure with four distinct components, namely, social cost of piracy, anti-big business attitude, social benefit of dissemination, and ethical belief. Our findings reveal that social benefit of dissemination and anti-big business attitude have a positive relationship with intention to buy pirated CDs while social cost (...) of piracy and ethical belief have a negative relationship. Among these components, ethical belief tends to most strongly predict intention to buy pirated CDs. Demographic variables such as gender and age also help explain the respondents' intention to buy pirated CDs. In addition, those respondents with experience of buying pirated CDs would tend to be more likely to buy pirated CDs than those without such experience. The results are discussed with a view to helping copyright businesses to effectively suppress piracy, and directions for future research are suggested. (shrink)

Why do many societies moralize apparently harmless pleasures, such as lust, gluttony, alcohol, drugs, and even music and dance? Why do they erect temperance, asceticism, sobriety, modesty, and piety as cardinal moral virtues? According to existing theories, this puritanical morality cannot be reduced to concerns for harm and fairness: It must emerge from cognitive systems that did not evolve for cooperation (e.g., disgust-based “purity” concerns). Here, we argue that, despite appearances, puritanical morality is no exception to the cooperative function of (...) moral cognition. It emerges in response to a key feature of cooperation, namely that cooperation is (ultimately) a long-term strategy, requiring (proximately) the self-control of appetites for immediate gratification. Puritanical moralizations condemn behaviors which, although inherently harmless, are perceived as indirectly facilitating uncooperative behaviors, by impairing the self-control required to refrain from cheating. Drinking, drugs, immodest clothing, and unruly music and dance are condemned as stimulating short-term impulses, thus facilitating uncooperative behaviors (e.g., violence, adultery, free-riding). Overindulgence in harmless bodily pleasures (e.g., masturbation, gluttony) is perceived as making people slave to their urges, thus altering abilities to resist future antisocial temptations. Daily self-discipline, ascetic temperance, and pious ritual observance are perceived as cultivating the self-control required to honor prosocial obligations. We review psychological, historical, and ethnographic evidence supporting this account. We use this theory to explain the fall of puritanism in western, educated, industrialized, rich, and democratic (WEIRD) societies, and discuss the cultural evolution of puritanical norms. Explaining puritanical norms does not require adding mechanisms unrelated to cooperation in our models of the moral mind. (shrink)

In this article, I embark on an analysis of Søren Kierkegaard's view of human otherness in strict correlation to his Christian philosophy. More specifically, my aim is to show that Kierkegaard's thought is essentially informed by a decisive appropriation of the soteriological category of sin which has momentous implications for Kierkegaard's views of selfhood and intersubjectivity. The main argument is that both Kierkegaard's negative evaluation of human otherness and his acerbic indictments of any collectivist interference in salvific matters cohere with (...) his appropriation of the doctrine of the Fall. At the same time, I show in what sense Kierkegaard deems human alterity to be indispensable to one's spiritual self-becoming expressed through the Christian imperative of loving the other as neighbor. Seen thus, agape, while supplementing Kierkegaard's creationistic psychology, actually becomes the necessary restorative opposite of sinfulness in the self's encounters with the distinct uniqueness of the human other. Two controversial cases in Confucian literature present the demands of filial piety as conflicting with those of impartial justice. Let us call them the Case of Concealment (Analects18.13) and the Case of Evasion (Mencius7A53). Adogmaticreading of the texts indicates that both Confucius and Mencius give more weight to filial piety than to justice. This essay, however, provides an alternative reading of the cases:the liberal reading. I argue that the Confucian teachers used the cases as moral dilemmas that force Confucian students (...) to learn how to use a cluster of Confucian virtues, including practical wisdom, discretion, and straight determination, under difficult circumstances. The liberal reading views these moral dilemmas as rhetorical tools; they guide Confucian students in meditative exercises and ultimately transform students’ mode of seeing and being. (shrink)

This article draws together two works created in late fifteenth-century Mantua. Although radically different in kind, they were borne from the same acts of violence: Andrea Mantegna’s Madonna of Victory and a responsum about Jewish religious law by Rabbi Joseph Colon. Mantegna’s altarpiece, painted to commemorate the bloody battle of Fornova as a Gonzaga victory, was paid for by Daniele Norsa; Norsa, a Jewish banker, was accused of destroying a prior Christian icon and ordered to finance the new altarpiece as (...) reparations for this crime, under threat of death. Colon’s responsum addressed the permissibility of creating a Christian image under duress—idolatry being one of the sins for which a Jew must sacrifice their life rather than transgressing. We explore the remarkable artistry and distinct craft practiced by the painter and the rabbi—image making in the one case, legal reasoning in the other—as modes of describing, interpreting, and creating reality. Both works address problems of religion and idolatry, faith and coercion, victory and violence, and triumph and lament. Together they reveal the dynamics of a fascinating iconoclash, a conflict of culture waged over the struggle between making and breaking images. (shrink)

The influential political philosopher Leo Strauss has been credited by conservatives with the recovery of the great tradition of political philosophy stretching back to Plato. Among Strauss's most enduring legacies is a strongly negative assessment of Nietzsche as the modern philosopher most at odds with that tradition and most responsible for the sins of twentieth-century culture--relativism, godlessness, nihilism, and the breakdown of family values. In fact, this apparent denunciation has become so closely associated with Strauss that it is often seen (...) as the very core of his thought. In Leo Strauss and Nietzsche, the eminent Nietzsche scholar Laurence Lampert offers a controversial new assessment of the Strauss-Nietzsche connection. Lampert undertakes a searching examination of the key Straussian essay, "Note on the Plan of Nietzsche's Beyond Good and Evil." He shows that this essay, written toward the end of Strauss's life and placed at the center of his final work, reveals an affinity for and debt to Nietzsche greater than Strauss's followers allow. Lampert argues that the essay comprises the most important interpretation of Nietzsche ever published, one that clarifies Nietzsche's conception of nature and of human spiritual history and demonstrates the logical relationship between the essential themes in Nietzsche's thought--the will to power and the eternal return. This is a study of the encounter with the problem of heresy in Europe between the World Wars, in Germany and among Jews above all. It is first and foremost an intellectual history, though not exclusively so, and has four related aims. It argues, first, that the advent of a heretical ideal among Jews in the interwar period marked the definitive end of a chapter in German-Jewish history that began with Moses Mendelssohn. Mendelssohn's gambit and the liberal Judaism that arose (...) in its wake proved unworkable by this time, and the arrival of avowedly heretical forms of Jewish return signaled the end of his epoch. But we also find in this period the beginnings of a search for post-liberal modes of Jewish identity in which its predecessor endured in interesting and unexpected ways. Second, the dissertation reconstructs and analyzes the two leading languages of heresy in the interwar period, the gnostic and the pantheist. The first pined for salvation from a sinful world by the grace of a wholly transcendent, extramundane and therefore absent God, or a deus absconditus , and was associated in the interwar period with the Protestant representatives of dialectical theology. The pantheist language of heresy, by contrast, contested the gnostic spirit by divinizing the world, and was associated with the interconfessional revival of Spinoza. On the strength of this contextual reconstruction, the study aims, third, to reinterpret the philosophical careers of three important twentieth-century thinkers, all of them German-Jewish emigres: Hans Jonas, whose philosophical biology made him an unproclaimed "guru" to the German Green movment; Leo Strauss, the philosopher and unwitting father of a neo-conservative revolt in American politics; and Gershom Scholem, the eminent scholar of religion and Jewish culture. The study shows how their diverse projects all had origins in their encounter with the problem of heresy in interwar Europe. Their projects had also a common end: all resurrected the ancient Greek distinction between physis and nomos , and all contested normative Judaism by coming down squarely on the side of the former as the ground for Jewish identity in particular and human being more generally. Fourth and last, the dissertation makes an argument for the abiding salience of a theological dimension to European intellectual life between the wars and beyond. If nothing else, the stories presented here should alert us to the ways in which talk about God could be adapted for talk about nature, or politics, or art, to the ways in which discourses of the divine not only endure in this worldly world of ours, but flourish. In this paper I critically discuss Miranda Fricker’s ‘trust-based’ view of collective testimony—that is, testimony that comes from a group speaker. At the heart of Fricker’s account is the idea that testimony involves an ‘interpersonal deal of trust’, to which the speaker contributes a commitment to ‘second-personal epistemic trustworthiness’. Appropriating Margaret Gilbert’s concept of joint commitment, Fricker suggests that groups too can make such commitments, and hence that they, like individuals, can ‘enter into the second-personal relations of trust that characterise (...) testimony’ (Fricker 2012: 272). I argue that this choice to appropriate Gilbert’s concept of joint commitment betrays a deep problem in Fricker’s account—a misconstrual of both the object and the subject(s) of the commitment a speaker makes in testifying. After developing this criticism, I outline an alternative way of construing the speaker’s commitment, which can be applied to both collective and individual testimony. (shrink)

Briefly stated my point is that the well-being of each person in a community conceived abstractly may be all too easily sacrificed for the sake of the abstraction. Physicians may offer critically ill patients places in programs of experimental treatment, but there is commonly a catch to the offer. To take part in a program of clinical experiment a patient must not only risk a possible failure of a fresh drug and the chance of destructive side effects from the drug, (...) but the patients must risk only getting the traditional treatment along with a placebo rather than the experimental drug. Placebo control, double blind critical protocols for testing effects of fresh drugs on critically ill patients are a commonplace. I question the scientific objectivity of the protocols and the underlying ethic, and suggest use of alternate protocols. Experimental tests in the treatment gram-negative bacteria blood infections, muscular dystrophy, and AIDS and AIDS-related diseases are examples. (shrink)
