This article argues in favor of holding leaders responsible for international crimes but also worries quite a bit about what would be a fair standard of mens rea for these leaders. Section 1 sets out the key facts of the case and the basis of the International Criminal Tribunal for Yugoslavia Trial Chamber's conviction of General Tihomir Blaskic. Section 2 presents the basis of the ICTY Appeals Court's overruling of the Trial Chamber's decision. Section 3 focuses on the issue of (...) mens rea concerning those who command others to commit such crimes as the taking of hostages and the use of human shields. Section 4 sets out a limited argument in favor of negligence as a type of mens rea in international criminal law. Finally, section 5 discusses the relevance of the idea of the theory of joint criminal liability in such cases. (shrink)

ABSTRACTSkepticism about citizen competence is a core component of Christopher H. Achen and Larry M. Bartels’s call, in Democracy for Realists, for rethinking our model of democracy. In this paper I suggest that the evidence for citizen incompetence is not as clear as we might think; important research shows that we are good group problem solvers even if we are poor solitary truth seekers. I argue that deliberative democracy theory has a better handle on this fundamental fact of human (...) cognition and therefore has a more realistic view of the conditions that might improve citizen competence. Charles Mills adhered to the highest standards of philosophical scholarship, while seeing his work firmly as a contribution to the cause of social justice. He had a deep appreciation for historical context and a history of ideas approach to racial/philosophical questions. He was one of the foremost Rawls interpreters or our time, though only a few years before his passing was he so recognized. He channeled his analytic training in his habit of demonstrating how a view is strengthened when an (...) author shows how objections can be systematically replied to. I wish he had tried to integrate class and race into a larger theoretical system, of both an explanatory and normative character. In this book Larry Temkin examines the concepts of equality and inequality, and addresses one particular question in depth: how can we judge between different sorts of inequality? When is one inequality worse than another?
