BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Another Look at Flage's Hume Lesley Friedman In recent articles, Daniel Flage (1985a, 1985b) offers an interpretation of Humean memory-ideas as relative ideas: ideas of memory are analogous to definite descriptionsinsofar as they single outexactly one entity.1 Consequently, Flage argues that Hume has provided an adequate distinction between ideas generated by memory and ideas generated by imagination. It is my contention that Flage's reading is neither consonant with Hume's (...) remarks in the Treatise nor successful in reducing the number ofdifficulties with Hume's theory ofmemory. I shall argue that (1) it is not clear that all memory-ideas are complex (an assumption necessary for Flage's interpretation); (2) Flage construes all memory as episodic, but he overlooks semantic memory; and (3) there isa distinction between mis-remembering and imagining which Flage's account cannot accommodate. It is worth noting that Flage contends that he is giving an interpretation ofHume's account ofmemory; he is not simply attempting to find out the truth ofthe matter. That is, Flage's position is that there is good reason to think that Hume construed memory-ideas as relative ideas. Accordingly, Flage must provide evidence, preferably textual, for the claim that Hume held such a view. My position is thatit is unlikely that Hume held such a view, and even if he did, it is inadequate for grounding an external distinction between memory-ideas and imagination-ideas. In short, claiming that Hume was interested in a decisive distinction between ideas ofmemory and ideas ofimagination is to involve Hume in problems with which he was not concerned. Not only are Flage's remarks in conflict with Hume's, but ifwe readhim as Flage suggests, Hume's theory ofmemory becomes considerably more riddled with problems than it is if we do not so read him. Flage and Hume In section 1 of Treatise 1.1, Hume draws his celebrated distinction between ideas and impressions. In the second section he considers impressions in some detail and he does the same for ideas in section three. Following every impression, Hume claims, there is a corresponding idea, either produced by the faculty of memory or the faculty of imagination. He takes it as no less than obvious that memory-ideas are more "lively and strong" than imagination-ideas: Volume XDi Number 1 177 LESLEY FRIEDMAN Tis evident at first sight, that the ideas of the memory are much more lively and strong than those of the imagination, and that the former faculty paints its objects in more distinct colours, than any which are emplo/d by the latter.2 That memory-ideas are more lively than their counterparts in imagination Hume construes as asensible difference between the two. Accordingly, I shall refer to this difference as the internal difference. Thereis,however,another difference betweenthesekinds ofideas, namely, that memory-ideas preserve the order and form of their corresponding simple ideas, while imagination-ideas need not: Tis evident, that the memory preserves the original form, in which its objects were presented, and that where-ever we depart from it in recollecting any thing, it proceeds from some defect or imperfection in that faculty.... The same evidence follows us in our second principle, of the Uberty ofthe imagination to transpose andchange its ideas. My focus in this work is on giving an analysis of Peirce's post-1895 remarks about realism and the realism/nominalism debate. I argue that there is a consistent position to be found in these writings, yet in order to understand his position we must look not only at Peirce's remarks on realism, but also to the various themes connected with his realism, viz. to his discussion of the categories, pragmatism, and opposing views. ;From Peirce's direct remarks on realism we learn that (...) there are two kinds of universals, viz., laws and possibilities , both of which are independent of mind. Peirce's claim that Firsts are real as possibilities, and Thirds are real as that to which Seconds conform, constitutes his universal-realism . Thirds, however, are laws, that which science seeks to discover. The subjunctive conditionals which express scientific theories are either true or false, and the entities to which they refer are real or figments. In this consists Peirce's scientific realism, or "scholastic realism". ;From Peirce's discussions of the categories and of nominalism, we learn that there are two kinds of qualities: embodied and unembodied. The latter are uninstantiated universals, the former are dispositions. Peirce's doctrine of pragmaticism is an analysis of embodied qualities, i.e., what it means to say that "an object possesses a character." I suggest that Peirce insists that uninstantiables as necessary for realism about laws because they ground the counterfactuals which law-statements support. ;Because Peirce has both uninstantiated universals, and because he also believes that there is a sense in which universals really are "in" things as parts, he is neither Transcendental nor Immanent Realist exclusively. This article reviews recent cognitive and neurological approaches to the study of attention. It argues that such research is based on the notion that attention has a positive cognitive function selecting, like a sieve or a filter, elements from the background and foreground, to then be processed by the brain and made conscious when required. These approaches fail to explain cognitive overload and recent findings demonstrating that recognition and understanding—sensory, visual and semantic—also occur prior to attention. Merleau-Ponty and Freud offer (...) a different model: a negative distractive attention. Negative distractive attention serves as a threshold for stimuli excluded by neurological processes regulating overload and ensuring that consciousness can concentrate on the singularity of its objects. Such approach to attention explains how one can drive and talk. It is not a positive multi-tasking model but a negative distractive one. (shrink)

Although Mr. Schrader states that "it is beyond the scope of [his] paper to examine Kant's argument in the Analytic that our empirical knowledge rests upon a priori knowledge of space and time," he does offer a hint as to how he would go about this: "[Kant] seeks to show that the categories are necessary in order to cognize events in one space and one time, and that all empirical judgments rest upon the assumption that space and time are unitary." (...) This is undeniably the foundation of Kant's theory of time. It shows, however, a bias for the special manner of the objective deduction, where emphasis falls on the unity of consciousness as the basic premiss, instead of on the conditions of representations in general, which is how the basic premiss is stated in the subjective deduction in the first edition. The two are equivalent, as Kant insists, but the formulation in the subjective deduction wears a bolder, more radical countenance, since it stresses what is less explicit in the objective deduction, that all the Analytic is derived from nothing more than the nature of a representation. For most purposes the two transcendental deductions are interchangeable, but for the theory of time we turn most profitably to that deduction which dwells more meticulously on the earliest stages, and elaborates the most primitive steps of the deduction of the categories. The essay is an attempt to examine aspects of legal interpretation from an external, sociological point of view. “Interpretation”, in its normal juristic sense, is primarily a process in which decision‐makers with secondary legitimacy link their decisions to authority of primary legitimacy. The type of legitimacy which is dominant within the legal system greatly influences the style of interpretation ‐ in “closed” systems, where the stock of premises is fixed, “legalism” will abound. Legal interpretation is not concerned with what a (...) text really means, in any literal sense; and standards for judging legal interpretation are different from the standards of judging other forms of communication, for example, literature. Flage's account can accommodate onlymemories of complex ideas; he disallows the possibility of 'preserving* a simple idea in its simplicity. Yet there is an example of a purely (...) simple impression in the Treatise; and since for every impression there is in principle a corresponding idea which we can later recall, this example establishes the existence of a purely simple memory-idea. In what follows I will provide support for this claim, Flage's counterarguments (this volume) notwithstanding. Flage argues that given any perceived object, say a coloured dot, there is a visual field in which we perceive it. This field and the impression we receive from it, "must be a complex impression, that is, an impression that is composed of indefinitely many colour points. In this respect it is analogous to a pointillist painting or, to use a more contemporary example, a computer array composed of pixels" (1993, 190). Flage is probably right about this; from our point of view, it is implausible to suggest that there is any purely simple background, or worse, that there is no impression ofa background at all. Nonetheless, my concern is with what Hume thought and not with what is plausible orimplausible; and Hume does give an example ofa "background" that is notcomplex, namely, the scenarioinwhichwe perceive points oflight in darkness. We may observe, that when two bodies present themselves, where there wasformerly an entire darkness, the onlychange, that is discoverable, is in the appearance ofthese two objects, and that all the rest continues to be as before, a perfect negation oflight, and of every colour'd or visible object. This is not only true of what may be said to be remote from these bodies, but also of the very distance; which is interpos'd betwixt them; that being nothing but darkness, or the negation of light; without parts, without composition, invariable and indivisible. (T 57, bold italics added) I originally considered the ink spot experiment and theidea ofred in the dark as examples ofpurely simple impressions. Let me try this Volume XLX Number 1 199 LESLEYFRIEDMAN again, elaborating a bit more on the latter (what I take to be Hume's example of a version of the ink spot experiment). Early on in the Treatise Hume speaks of"that idea ofred which we form in the dark" (T 3). Let us then consider a red spot in complete darkness. Flage and I agree that this spot is qualitatively simple. Our disagreement is rooted in the nature ofthe "background," in this case the darkness. Flage claims that "the sighted-person sitting in the dark has an impression or impressions, namely, an impression of darkness" (1993, 190); and therefore the impression we have of the spot of red in darkness is not purely simple. In support of this claim he cites the followingevidence: Hume's remarks that (1) "the sighted-person sitting in the dark "receives no other perception... than what is common to him with one born blind' " (ibid., 189; T 55-56), and (2) "the idea of utter darkness can never be the same with that of vacuum" (T 56). Let me take each ofthese in turn. Presumably, the first quote is cited in order to estabUsh that the blind person does indeed have a perception (impression) of darkness. This cannot be right; ifsuch a person had an impression ofdarkness, he would also have an idea of darkness, and if we look to the part of the sentence which Flage leaves out of his quotation, we find the following: "and 'tis certain such-a-one [that is, a blind person] has no idea either of light or darkness" (T 56). Hume's point is simple: the reason that the blind person has no idea ofdarkness is because he has no impression of darkness; and we are in the same position as him when we are sitting in the dark. Ethical violations are becoming common in the business world. Teaching proper ethical behavior can begin in college. In this study, we surveyed 350 students to determine what affects students’ perceptions of the ethics of professors and to determine whether or not taking a course in ethics changes this perception. The most important factor in determining whether or not a professor is ethical is “fairness in grading.” Surprisingly, there was no statistically significant difference between students who took a course in ethics (...) and those who did not in their perception of what makes a professor ethical or unethical. There were some differences, however, between males and females in these perceptions. By learning ethical principle at the college-level, there may be an impact on ethical behavior when in the business world. (shrink)

The tobacco industry has used corporate social responsibility tactics to improve its corporate image with the public, press, and regulators who increasingly have grown to view it as a merchant of death. There is, however, an intractable problem that corporate social responsibility efforts can mask but not resolve: the tobacco industry's products are lethal when used as directed, and no amount of corporate social responsibility activity can reconcile that fundamental contradiction with ethical corporate citizenship. This study's focus is to better (...) understand the tobacco industry's corporate social responsibility efforts and to assess whether there has been any substantive change in the way it does business with regard to the issue of exposure to secondhand smoke. The results show that the industry has made no substantial changes and in fact has continued with business as usual. Although many of the tobacco companies' tactics traditionally had been defensive, they strove for a way to change to a more offensive strategy. Almost without exception, however, their desire to appear to be good corporate citizens clashed with their aversion to further regulation and jeopardizing their legal position, perhaps an irreconcilable conflict. Despite the switch to offense, in 2006 a federal judge found the companies guilty of racketeering. (shrink)

In this paper, we show that God is portrayed in the Hebrew Bible and in the Rabbinic literature—some of the very Hebrew texts that have influenced the three major world religions of Judaism, Christianity, and Islam—as One who can be argued with and even changes his mind. Contrary to fundamentalist positions, in the Hebrew Bible and other Jewish texts God is omniscient but enjoys good, playful argumentation, broadening the possibilities for reasoning and reasonability. Arguing with God has also had a (...) profound influence upon Jewish humor, demonstrating that humans can joke with God. More specifically, we find in Jewish literature that humor’s capacity to bisociate between different domains of human experience can share a symbiotic relationship with argumentation’s emphasis on producing multiple, contested perspectives. Overall, once mortals realize that figures such as God can accept many perspectives through humor, teasing, arguing, criticism, and in at least one case, even lawsuits, a critical point emerges: citizens should learn to live, laugh, and reason with others with whom they disagree. This essay argues that film deserves a place within the medical humanities curriculum and demonstrates effective strategies for employing it within medical ethics and humanities classrooms. Part One of the article emphasizes how and why medical ethics teachers can utilize documentary and fictional films, such as “Thomas Szasz and the Myth of Mental Illness,” “The Deadly Deception,”Whose Life Is It Anyway? and “Voices From the Front” in their courses. Such films encourage students to move beyond abstract debates and confront the (...) human pain inherent in all ethical dilemmas. Part Two focuses on documentary and fiction film in the medical humanities classroom. In this section, the author details how to incorporates films, such asThe Doctor, The Waterdance andHospital, into the humanities classroom, juxtaposing them with various literary works, such asOther Women's Children, Borrowed Time, andCeremony. Part Three of the essay presents a detailed discussion ofThe Elephant Man andFrankenstein, illustrating how visual and literary texts compliment each other within the humanities classroom. Overall, the author demonstrates how films function as engaging and complex visual texts providing unique insights in the particularities of American health care and, as such, can become valuable components within medical ethics and humanities classrooms.
