Speech Act Theory has proved useful for classifying utterances, because of its seemingly universal application; on the other hand, legal theorists are interested in speech acts for several reasons, the most important being the fact that the theory helps to explain how the law uses language. In legal language there is a large number of speech acts, and most of them fall under the category of performatives: these do not report about doing something, their utterance actually constitutes performing an action. (...) Because performatives are actions, they cannot be considered to be either true or false but only “felicitous” or “infelicitous". Laws could be considered as types of speech acts, as well as contracts and wills. We can say that in, a very general way, speech act theory is helpful because it permits us to understand legal events from a new perspective: in this paper my attempt is to show that a difference exists between "doing something with words" and "doing something legal with words", and that doing something in speaking in the common language is different from doing it in speaking the legal discourse, since in the legal domain we do not speak to do speech acts, but to carry out legal acts. The purpose of this paper is to explicit the possible extension of Speech Act theory to the analysis of sublanguages or Languages for Special Purposes , and to show in particular its relevance to the subset known as English for Special Purposes . I explore some of the ways that assumptions about the nature of substance shape metaphysical debates about the structure of Reality. Assumptions about the priority of substance play a role in an argument for monism, are embedded in certain pluralist metaphysical treatments of laws of nature, and are central to discussions of substantivalism and relationalism. I will then argue that we should reject such assumptions and collapse the categorical distinction between substance and property.

Thought, according to Hegel, is not only the product of a faculty of a subject, or a means by which a thinking subject tries to grasp a world that is alien to him. It is also the very structure of the world, that is disclosed to a subject through the thinking activity of a subject. The fundamental question that crosses the whole post-Kantian philosophy is that of the relation between thought and reality, i.e. the question of whether reality depends on (...) the categorial requirements imposed by the thinking subject, or whether reality maintains some form of independence from the thinking subject. Seen from this standpoint, Hegel can be read both as an author who radicalizes Kant’s transcendental perspective, and also as a critic of that perspective. In other words, he can be seen as an idealist: according to Hegel, any philosophy is idealist if it claims that something finite, qua finite, is essentially connected with something other. He can also be seen as an anti-idealist: insofar as his philosophy aims to overcome a hyper-transcendentalist perspective, i.e. it is so since it rejects idealism as subjective idealism. Moreover, Hegel’s anti-idealism can be characterized as realism. This is because, if we admit that overcoming transcendentalism without falling back again on a pre-critical conception of thought and of reality involves an idea of thought which is not reducible to a "mentalistic" conception of it, we need to conceive of thought as something that is not alien to reality. Hegel conceives of thought as intimately connected with the world, as its own rational structure. This “realism” of thought is what makes Hegelian idealism, so to speak, anti-idealistic. Through this "realism" of thought Hegel pursues two goals. On the one hand, Hegel attempts to overcome a subjectivistic and instrumentalistic conception of thought, according to which a subject talks and relates to a reality that is always only a construction of him, and so it is necessarily the simulacrum of something that remains inaccessible in its truth. On the other hand, Hegel attempts to overcome a conception of reality characterized merely as alien and opposite to thought itself, and which is the counterpart of the subjectivistic and instrumentalistic conception of thought. By pursuing these two goals it should be gained a conception of reality which could warrant some form of objectivity, but which cannot be equated with the substantialistic conception of the pre-Kantian metaphysics. S'il est un point que les réflexions contemporaines sur le temps ont mis en relief et inscrit profondément dans notre conscience, c'est que l'avenir qu'on espère dépend directement du présent qu'on réalise. Telle est notre attitude en face du présent, telle elle sera inéluctablement en face de l'avenir; et donc l'avenir lui-même, puisque ce dernier n'est rien sinon un présent caché encore, au cœur d'un présent déjà actuel, et explicite. Il est en effet de l'essence même de notre condition humaine (...) d'avoir un présent structuré et comme stratifié. Certes on peut imaginer le présent comme un point sans épaisseur, comme la limite évanescente entre un segment de ligne qui marque le passé à jamais révolu, et l'avenir qui se meut vers nous pour basculer inexorablement vers le non-être en franchissant ce présent. Mais cette image, utile pour bien des tâches, ne correspond d'aucune manière à la réalité vivante de la conscience humaine et des activités qui lui sont propres. Nous sommes dans le présent ce que nous sommes et ce que, en un sens, nous croyons pouvoir dire que nous avons été. Une grande partie de ce que nous appelons le passé, notre passé personnel et sans doute notre passé spécifique, est présent, non seulement à titre de souvenir, pouvant être, ou non, évoqué, mais à titre de schéma dynamique modifiant notre être-au-monde, notre présente réaction au réel le plus réel, à la situation où nous avons à déployer notre activité. This article examines three early writings of Hans L. Martensen, Søren Kierkegaard’s teacher and the target of his criticisms. The writings focus respectively on self-consciousness, mysticism, and freedom. They each make important claims about religion, and together they disclose the young Martensen’s systematic understanding of the epistemological, mystical, and moral-ethical dimensions of human experience as shaped by the representations of Christian faith and life. The analysis reveals an agile thinker, whose creative philosophical and theological ideas are the product of imaginative (...) speculation growing out of passionate religiosity. Some connections will be drawn from these essays to the writings of Søren Kierkegaard. (shrink)
