The evidence linking tobacco product advertising to adolescent smoking initiation and resulting long-term addiction, premature death, and disability is well established. Each link in the causal chain has been substantiated: children and adolescents are especially vulnerable to advertising; point-of-sale advertising comprises 92.1% of cigarette advertising and marketing expenditures by manufacturers and 71.3% of smokeless tobacco advertising; tobacco companies have targeted youth through advertising; advertising exposure causes adolescents to start and to continue smoking; among adults who become daily smokers, nearly all (...) first use of cigarettes occurs by 18 years of age; adolescents who smoke are at high risk for long-term addiction because their brains are still developing; and long-term addiction results in the tremendous personal, social and financial costs of tobacco-related illnesses. Das Thema "menschliche Natur" hat eine lange Tradition in der Geschichte des philosophischen Denkens. Vor allem in Krisenzeiten und an Epochenschwellen stellte sich immer wieder Frage, was der Mensch "eigentlich" ist. Es sollte daher auch nicht überraschen, daß diese Frage auch in der Gegenwart wieder eine zunehmende Aufmerksamkeit findet. Nach langen Jahren eines nur zurückhaltenden Interesses findet die philosophische Anthropologie wieder stärkere Aufmerksamkeit. - Und doch handelt es dabei nicht nur um die Wiederaufnahme eines alten Themas. Die philosophische Beschäftigung (...) mit der menschlichen Natur hat im Zusammenhang mit den Fortschritten der modernen Bio- und Informationstechnologie eine unmittelbar praktische Relevanz bekommen, die sie in dieser Weise niemals zuvor hatte. Durch diese Fortschritte haben nämlich die Möglichkeiten technischer Eingriffe am Menschen eine Dimension erreicht, die nicht mehr nur einzelne seiner Merkmale manipulierbar macht, sondern seine "Natur" selbst. Dies gilt insbesondere im Hinblick auf die nicht mehr vollkommen utopische Idee eines genetischen Umbaus der gesamten Menschheit. Die Frage, die sich vor diesem Hintergrund stellt, ist die nach dem normativen Status der menschlichen Natur. Ist die psycho-physische Gestalt, in der wir den Menschen seit jeder kennen, ein Produkt zufälliger evolutionärer Prozesse und als solche moralisch neutral; oder ist sie intrinsisch wertvoll und daher schützenswert? Die in der Literatur geäußerten Meinungen zu dieser Frage gehen auseinander. Auf der einen Seite stehen diejenigen, die in der menschlichen Natur lediglich eine Tatsache sehen und keinen Grund erkennen können, weshalb diese Tatsache sakrosankt ein sollte. Unter bestimmten Voraussetzungen, so behaupten die Vertreter dieser Partei, kann es nicht nur legitim sein, die menschliche Natur zu verbessern, es kann sogar moralisch geboten sein. Auf der anderen Seite stößt genau diese Vorstellung einer technischen Rekonstruktion des Menschen auf Empörung und Abscheu. Abgesehen von allen Risiken, die mit einem solchen Herumbasteln verbunden sind, werde der Mensch auf diese Weise auf ein beliebiges "Stück Natur" reduziert; er werde zum totalen Objekt technischen Handelns und seiner Würde beraubt. Der menschlichen Natur müsse daher ein inhärenter Wert zugeschrieben werden, um den unverantwortlichen Plänen der Menschheitsverbesserer eine kategorische Grenze zu setzen. Doch was ist die "menschliche Natur"? Worin besteht sie und wie kann sie angesichts der unübersehbaren individuellen und kulturellen Vielfalt definiert werden? Dies ist die erste Frage, der die Beiträge des vorliegenden Bandes gewidmet sind. Und an sie schließt sich sogleich eine zweite an: Wenn es denn eine menschliche Natur gibt und wenn diese hinlänglich genau umrissen werden kann: Kann oder muß ihr dann ein moralischer Status zugeschrieben werden? Im Materialismusstreit der 1850er Jahre prallen die oft provokativ vorgetragenen Positionen des naturwissenschaftlich-weltanschaulichen Materialismus (vor allem Carl Vogts, Jacob Moleschotts und Ludwig Büchners) auf Positionen (insbesondere diejenige Rudolf Wagners), die die Naturwissenschaften mit den traditionellen religiösen Überzeugungen – etwa von der Unsterblichkeit der Seele, von der Gültigkeit der biblischen Weltchronologie oder von der Abstammung der Menschheit von einem einzigen Elternpaar – bruchlos verbinden zu können glauben. Mit den wissenschaftlichen Überzeugungen verbinden sich zudem politische Optionen. Jenseits aller lautstarken Polemik werden in (...) diesem Streit die Erklärungskompetenzen der Religion, der Philosophie und der Naturwissenschaften neu gegeneinander abgegrenzt – wobei der Philosophie (in ihren Vertretern I. Comme l’indiquent ici un grand nombre de ses collègues et de ses disciples, son œuvre très fournie part du constat que l’idéalisme transcendantal n’est pas vraiment parvenu à fonder la synthèse de la raison et de la réalité et à résorber le (...) divorce que le nominalisme a introduit entre le logos et le monde quand il a érigé le sujet en instance jugeante détachée de tout (p. 18, 574). Kant a fait le premier pas pour émanciper la logique du primat de la forme judicative (p. 67). Mais ni son contextualisme temporel, qui rapporte tout ce qui est su à la forme du temps (p. 345), ni les efforts de son continuateur Cohen pour fonder l’idéalisme critique sur un dépassement du psychologisme n’ont réussi à réconcilier la raison avec la réalité ou à rétablir son unité (p. 205). T. auch polemisch zu den ‚Modernen‘ und dem neo-nominalistischen Zeitgeist weithin. – Die Position Zeidlers dem allen gegenüber ist im Grunde sehr einfach zu kennzeichnen: Es ist ein Denken einer ihre eigene Geschichte in ihren ‚großen‘ Gestalten einbeziehenden Vernunft, die in ihrem Prinzipien-Selbst als theoretischer wie praktischer Erst- und Gesamtgrund menschliche Würde wie auch diesheitliche Ganzheit zu fundieren und zu garantieren vermag. – Zeidler darf in diesem Panorama mit Fug und Recht als eine Art Leuchtturm im rasch wechselnden Gewölk modernen und nachmodernen Gedankenlebens erscheinen. It has often been argued that Humean accounts of natural law cannot account for the role played by laws in scientific explanations. Loewer (Philosophical Studies 2012) has offered a new reply to this argument on behalf of Humean accounts—a reply that distinguishes between grounding (which Loewer portrays as underwriting a kind of metaphysical explanation) and scientific explanation. I will argue that Loewer’s reply fails because it cannot accommodate the relation between metaphysical and scientific explanation. This relation also resolves a puzzle (...) about scientific explanation that Hempel and Oppenheim (Philosophy of Science 15:135–75, 1948) encountered. (shrink)

Why do forces compose according to the parallelogram of forces? This question has been controversial; it is one episode in a longstanding, fundamental dispute regarding which facts are not to be explained dynamically. If the parallelogram law is explained statically, then the laws of statics are separate from and “transcend” the laws of dynamics. Alternatively, if the parallelogram law is explained dynamically, then statical laws become mere corollaries to the dynamical laws. I shall attempt to trace the history of this (...) controversy in order to identify what it would be for one or the other of these rival views to be correct. I shall argue that various familiar accounts of natural law not only make it difficult to see what the point of this dispute could have been, but also improperly foreclose some serious scientific options. I will sketch an alternative account of laws that helps us to understand what this dispute was all about. (shrink)

This paper considers the place of reasons in the metaphysics of epistemic normativity and defends a middle ground between two popular extremes in the literature. Against members of the ‘reasons first’ movement, we argue that reasons are not the sole fundamental constituents of epistemic normativity. We suggest instead that the virtue-theoretic property of competence is the key building block. To support this approach, we note that reasons must be possessed to play a role in the analysis of central epistemically normative (...) properties, and argue that the relation of possession must be analyzed in terms of competence. But while we diverge with reasons-firsters on this score, we also distance ourselves from those who deny reasons any important role in epistemology. For we maintain that possessed reasons do help to ground deontic facts in the epistemic domain (e.g., facts about what one epistemically ought to believe, may believe, or is justified in believing). Indeed, we present an argument that the possession of sufficient epistemic reasons is necessary and sufficient for propositional justification, and that proper basing on such reasons yields doxastic justification. But since possession and proper basing are themselves grounded in competence, reasons are not the end of the explanatory road: competence enables them to do their work, putting them—and us—in the middle. It is often claimed that humans are rational, linguistic, cultural, or moral creatures. What these characterizations may all have in common is the more fundamental claim that humans are normative animals, in the sense that they are creatures whose lives are structured at a fundamental level by their relationships to norms. The various capacities singled out by discussion of rational, linguistic, cultural, or moral animals might then all essentially involve an orientation to obligations, permissions and prohibitions. And, if this is (...) so, then perhaps it is a basic susceptibility, or proclivity to normative or deontic regulation of thought and behavior that enables humans to develop the various specific features of their life form. This volume of new essays investigates the claim that humans are essentially normative animals in this sense. The contributors do so by looking at the nature and relations of three types of norms, or putative norms-social, moral, and linguistic-and asking whether they might all be different expressions of one basic structure unique to humankind. These questions are posed by philosophers, primatologists, behavioral biologists, psychologists, linguists, and cultural anthropologists, who have collaborated on this topic for many years. The contributors are committed to the idea that understanding normativity is a two-way process, involving a close interaction between conceptual clarification and empirical research. (shrink)

An increasing number of regulations propose the notion of ‘AI audits’ as an enforcement mechanism for achieving transparency and accountability for artificial intelligence (AI) systems. Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...) that AI audits should similarly provide assurance to their stakeholders about AI organizations’ ability to govern their algorithms in ways that mitigate harms and uphold human values. We discuss the necessary conditions for the criterion audit, and provide a procedural blueprint for performing an audit engagement in practice. We illustrate how this framework can be adapted to current regulations by deriving the criteria on which ‘bias audits’ for hiring algorithms can be performed, as required by the recently effective New York City Local Law 144 of 2021. We conclude by offering critical discussion on the benefits, inherent limitations, and implementation challenges of applying practices of the more mature financial auditing industry to AI auditing where robust guardrails against quality assurance issues are only starting to emerge. Our discussion as informed by experiences in performing these audits in practice highlights the critical role that an audit ecosystem plays in ensuring the effectiveness of such methodology. Anger, disgust, elevation, sympathy, relief. If the subjective experience of each of these emotions is the same whether elicited by moral or nonmoral events, then what makes moral emotions unique? We suggest that the configuration of moral emotions is special—a configuration given by the underlying structure of morality. Research suggests that people divide the moral world along the two dimensions of valence (help/harm) and moral type (agent/patient). The intersection of these two dimensions gives four moral exemplars—heroes, villains, victims and beneficiaries—each (...) of which elicits unique emotions. For example, victims (harm/patient) elicit sympathy and sadness. Dividing moral emotions into these four quadrants provides predictions about which emotions reinforce, oppose and complement each other. (shrink)

Historically, the hypothesis driving emotion research has been that emotion’s data-base—in language, physiology, and behavior— is organized around specific mental states, as reflected in evaluative language. It is suggested that this approach has not greatly advanced a natural science of emotion and that the developing motivational model of emotion defines a better path: emotion is an evolved trait founded on motivational neural circuitry shared by mammalian species, primitively prompting heightened perceptual processing and reflex mobilization for action to appetitive or threatening (...) survival cues. As the field moves forward with increasingly sophisticated measurement technology and assessing more complex affective functioning, scientific understanding of human emotion will proceed best within the framework of this mammalian brain model. We argue that we can avoid epistemic dilemmas by properly understanding the nature and epistemology of the suspension of judgment, with a particular focus on conflicts between higher-order evidence and first-order evidence.

As sophisticated artificial intelligence software becomes more ubiquitously and more intimately integrated within domains of traditionally human endeavor, many are raising questions over how responsibility (be it moral, legal, or causal) can be understood for an AI’s actions or influence on an outcome. So called “responsibility gaps” occur whenever there exists an apparent chasm in the ordinary attribution of moral blame or responsibility when an AI automates physical or cognitive labor otherwise performed by human beings and commits an error. Healthcare (...) administration is an industry ripe for responsibility gaps produced by these kinds of AI. The moral stakes of healthcare are often life and death, and the demand for reducing clinical uncertainty while standardizing care incentivizes the development and integration of AI diagnosticians and prognosticators. In this paper, we argue that (1) responsibility gaps are generated by “black box” healthcare AI, (2) the presence of responsibility gaps (if unaddressed) creates serious moral problems, (3) a suitable solution is for relevant stakeholders to voluntarily responsibilize the gaps, taking on some moral responsibility for things they are not, strictly speaking, blameworthy for, and (4) should this solution be taken, black box healthcare AI will be permissible in the provision of healthcare. A German writer's aphoristic, poetic, and difficult reflections on Heidegger's Being and Time. There is a beyond of reason and unreason. It is the human psyche. —Positive Nihilism Like many German intellectuals, Hartmut Lange has long grappled with Heidegger. Positive Nihilism is the result of a lifetime of reading Being and Time and offers a series of reflections that are aphoristic, poetic, and (appropriately, considering his object of study) difficult. Lange begins with an abyss (“There is an abyss (...) of the finite. It is temporality”) and proceeds almost immediately to extremity: “The twentieth century was governed by psychopaths. They collapsed the boundaries of moral reason and refuted Kant's analysis of consciousness.” He reflects further: “But who shall punish whom? One man's virtue is another man's crime. Thus Hitler could feel unwaveringly, as he wiped out entire populations, the starry sky above him and the moral law within him, as stipulated by Kant.” He considers the concept of civilization (“misleading”; “how should one oppose the remedies of civilization to the egomania, the murderous appetites of such outright psychopaths as Stalin or Pol Pot?”), the act of thinking (a fata morgana), the psyche, and Heidegger's Dasein. Positive Nihilism can be considered a pocket companion to Being and Time. “Heidegger's understanding of Being is nihilistic,” Lange writes, and then explains his assertion. He draws on Kant, Nietzsche, Kierkegaard, and Shakespeare's Othello for supporting arguments and illustrations. “Everyone is possessed of the courage to have angst about death. The question is whether this courage necessarily secures those vital advantages Heidegger alleges”–that “self-understanding [is] the mental anticipation of death.” Lange wrestles with Heidegger's position, calling on Tolstoy, Georg Trakl, Herman Bang, and Heinrich von Kleist to argue against it. Some mathematical proofs explain why the theorems they prove hold. This paper identifies several challenges for any counterfactual account of explanation in mathematics (that is, any account according to which an explanatory proof reveals how the explanandum would have been different, had facts in the explanans been different). The paper presumes that countermathematicals can be nontrivial. It argues that nevertheless, a counterfactual account portrays explanatory power as too easy to achieve, does not capture explanatory asymmetry, and fails to specify why (...) certain proofs are explanatory and others are not. Greater informativeness about counterfactual dependence can even yield less explanatory power. (shrink)

Despite the recent backlash against epistemic consequentialism, an explicit systematic alternative has yet to emerge. This paper articulates and defends a novel alternative, Epistemic Kantianism, which rests on a requirement of respect for the truth. §1 tackles some preliminaries concerning the proper formulation of the epistemic consequentialism / non-consequentialism divide, explains where Epistemic Kantianism falls in the dialectical landscape, and shows how it can capture what seems attractive about epistemic consequentialism while yielding predictions that are harder for the latter to (...) secure in a principled way. §2 presents Epistemic Kantianism. §3 argues that it is uniquely poised to satisfy the desiderata set out in §1 on an ideal theory of epistemic justification. §4 gives three further arguments, suggesting that it (i) best explains the objective normative significance of the subject's perspective in epistemology, (ii) follows from the kind of axiology needed to solve the swamping problem together with modest assumptions about the relation between the evaluative and the deontic, and (iii) illuminates certain asymmetries in epistemic value and obligation. §5 takes stock and reassesses the score in the debate. Autism Spectrum Disorder (ASD) is a neurodevelopmental condition characterized by social/communicative difficulties and perseverative behaviours. While research on autism has flourished recently, few studies have been conducted on the disorder in non‐Western contexts. In low‐ and middle‐income countries (LMICs), biomedical research on autism is required to better understand the needs of the population and to develop contextually appropriate interventions. However, autistic individuals are a vulnerable study population and LMICs present with various considerations. While the presentation of autism is heterogeneous, stigma (...) is a common social consequence affecting research. Drawing specifically on the South African context, the ethical intersections of these issues are discussed, along with the limitations of the current informed consent process. Community engagement is recommended as an adjunct to informed consent to ensure that biomedical research is conducted in a more inclusive way. Practical pointers are provided for implementing systematic support for conducting community engagement alongside biomedical research. (shrink)

Many meta-ethicists have thought that rationality requires us to heed apparent normative reasons, not objective normative reasons. But what are apparent reasons? There are two kinds of standard answers. On de dicto views, R is an apparent reason for S to \ when it appears to S that R is an objective reason to \ . On de re views, R is an apparent reason for S to \ when R’s truth would constitute an objective reason for S to \ (...) , and it appears to S that R. De re views are currently more popular because they avoid overintellectualizing rationality. But they face problems owing to the way in which they do so. Some assume that we can escape these problems by requiring more information to be apparent or by appealing to defeat. But these strategies fail. So, I defend a new view: apparent reasons are apparent facts that agents are competently attracted to treat like objective reasons, where competence is indirectly defined in terms of objective reasons and a competence/performance distinction is honored. Since one can treat X like an F without having the concept of an F, the view does not overintellectualize rationality. But it is also strong enough to dodge the pitfalls of de re views. (shrink)

This volume discusses the origin and structure of the universe in mystical Islam (Sufism) and Islam's civilizational predecessors with special reference to parallel realms of existence and their interaction.
