One of the major values of animal ethical theory can be found in the light it sheds on practical ethical problems involving animals. McCulloch and Reiss’ paper does precisely this regarding the culling of badgers in England to limit the spread of tuberculosis. Perspicaciously realizing that societal ethics represents a combination of utilitarian and rights-based theorizing, the authors apply both of these perspectives to the issue, noting that both theoretical approaches generate a rejection of culling in the presence of (...) other viable alternatives. In addition, the authors suggest and defend the use of an Animal Welfare Impact Assessment tool to assess the impact of various management approaches on the animals, and demonstrate its congruence with both the ethical theories considered, and with societal moral attitudes. In this way, they show that their conclusion is directly compatible with the societal ethic, in my view a major prerequisite for effecting social change. (shrink)

The aim of this paper is to introduce the instrumental variables technique to the discussion about causal inference in econometrics. I show that it may lead to causally incorrect conclusions unless some fairly strong causal background assumptions are made, assumptions which are usually left implicit by econometricians. These assumptions are very similar to, albeit not identical with, James Woodward's definition of an ‘intervention’. I discuss similarities and differences of the two points of view and argue that—understood as a practical method (...) of causal inference—the set presented here is superior. (shrink)

She recalled how they saw things as composed of opposites; not torn, but (...) completed and made whole by them.Theirs was not a Manichean brand of dualism that sees matter, flesh, the body, as inherently evil, because they constantly addressed each other as “soully-gal”—soul: spirit; gal: the body, flesh, the visible self. And it was clear from their tone that they gave one as much weight and importance as the other. They had never heard of the mind/body split. 1This closing claim is surely less than self-evident. Whether or not the companions had heard of the mind/body split depends on the meaning given to the verb “hear.” Certainly it was embedded in their language, however much the phrase “soully-gal” might recombine its parts.Did the split come from Descartes and early European debates, linguistically colonizing all those who came within its sphere—Africans, Barbadians, Brooklynites? It occurs in a writing by the Guyanese novelist Wilson Harris, his Palace of the Peacock. First in a tetralogy, this novel recounts something like a journey away from a life of colonial and postcolonial violence and oppression towards a hoped-for rebirth in “fulfilment and understanding.” 2 Early on, the harsh protagonist, Donne, mocks the narrator, his mysterious “double” and “brother,” Dreamer, who has remarked their distance from “the folk.” “Is it a mystery of language and address?” asks Donne. Slightly bewildered, Dreamer struggles to suggest that the obstacle is less of language than of a deeper disjunction:“it’s an inapprehension of substance,” I blurted out, “an actual fear of the substance of life, fear of the substance of the folk, a cannibal blind fear in oneself. Put it how you like,” I cried, “it’s a fear of acknowledging the true substance of life. In this introduction to the Topical Collection on Social and Cognitive Diversity in Science, we map the questions that have guided social epistemological approaches to diversity in science. Both social and cognitive diversity of different types is claimed to be epistemically beneficial. The challenge is to understand how an increase in a group’s diversity can bring about epistemic benefits and whether there are limits beyond which diversity can no longer improve a group’s epistemic performance. The contributions to the Topical Collection (...) discuss various proposals to maintain an appropriate amount of cognitive diversity in science, for instance, by recruiting and retaining practitioners from underrepresented social groups, providing incentives for explorative and risky research, encouraging interdisciplinary collaborations and stakeholder participation in research, requiring industry scientists to share their evidence, and developing strategies to encounter politically motivated attempts to manufacture doubt. To be successful, efforts to promote diversity in science should anticipate risks related to institutional interventions, navigate trade-offs between different types of epistemically good outcomes, and identify hidden costs that such policies may cause for various actors. Such efforts need to be assessed not only from an epistemic perspective but also from the point of view of fairness and the political legitimacy of scientific institutions. (shrink)

I-Language introduces the uninitiated to linguistics as cognitive science. In an engaging, down-to-earth style Daniela Isac and Charles Reiss give a crystal-clear demonstration of the application of the scientific method in linguistic theory. Their presentation of the research programme inspired and led by Noam Chomsky shows how the focus of theory and research in linguistics shifted from treating language as a disembodied, human-external entity to cognitive biolinguistics - the study of language as a human cognitive system embedded within the (...) mind/brain of each individual. The recurring theme of equivalence classes in linguistic computation ties together the presentation of material from phonology, morphology, syntax, and semantics. In todays’ super-diverse societies, communication and interaction in clinical encounters are increasingly shaped by linguistic, cultural, social and ethnic complexities. It is crucial to better understand the difficulties patients with migration background and healthcare professionals experience in their shared clinical encounters and to explore ethical aspects involved. We accompanied 32 migrant patients during their medical encounters at two outpatient clinics using an ethnographic approach. Overall, data of 34 interviews with patients and physicians on how they perceived their encounter and which (...) difficulties they experienced are presented. We contrasted the perspectives on the difficult aspects and explore ethical questions surrounding the involved issues. Patients and physicians describe similar problem areas, but they have diverging perspectives on them. Two main themes were identified by both patients and physicians: >patients’ behaviour in relation to doctors’ advice relationship issues<. A deeper understanding of the difficulties and challenges that can arise in cross-cultural settings could be provided by bringing together healthcare professionals’ and patients’ perspectives on how a cross- cultural clinical encounter is perceived. Ethical aspects surrounding some of the difficulties could be highlighted and should get more attention in clinical practice and research. (shrink)

This paper demonstrates how the UK’s Advertising Standards Authority governs advertising ethics with and on behalf of its members and stakeholders. Drawing on an archive of 310 non-commercial adjudication reports, we highlight the substantive norms and procedural mechanisms through which the ASA governs advertising complaints alleging offence and/or harm. Substantively, the ASA precludes potential normative transgressions by publishing, disseminating, consulting upon, and updating detailed codes of advertising conduct. Procedurally, the ASA adjudicates between allegations and justifications of offence and harm on (...) a received complaint-by-complaint basis, often upon consequentialist grounds. Such consequentialism, we claim, has the effect of normalizing power imbalances between the ASA’s members, on the one hand, and wider stakeholders, on the other hand. The paper argues that, in the context of UK advertising, what Michel Foucault called the right ‘to be or not to be governed like that’ is enjoyed by relatively few subjects. Having demonstrated how UK advertising practices are governed, the paper closes with suggestions as to how they might be governed otherwise. (shrink)

BackgroundAn injury followed by surgery poses many challenges to an athlete, one of which is rehabilitation, with the goal of returning to sport. While total restoration of physical abilities is a primary goal for most athletes, psychosocial factors also play an important role in the success of an athlete's return to sport. The purpose of this review was to examine the effectiveness of exercise and psychosocial interventions on RTS rates, which might be one of the most important outcomes for elite (...) athletes.MethodsTo carry out this review, PubMed, SAGE Journals, Web of Science, SPORTDiscus, ScienceDirect, and Google Scholar databases were searched from inception to July 2022. The inclusion criteria consisted exercise or psychosocial intervention for athletes after anterior cruciate ligament reconstruction, with reporting RTS rates as an outcome.ResultsFrom 1032 identified articles, four reports met inclusion criteria, all of which examined the recovery after ACLR. The mean MINORS score for the included studies was 16.3 ± 6.1, of which non-comparative studies scored 11.0 ± 1.4, while comparative studies scored 21.5 ± 0.7. There were consistent findings for benefits of exercise and psychosocial interventions on RTS rates. Return to preinjury rates in the reviewed studies vary between 63 and 95% with lower % observed in female athletes and with shorter follow-up. Interventional studies reporting RTS rates with a larger sample size and longer follow-up are needed.ConclusionPhysical and psychological function, as well as social support can be influenced by appropriate interventions, indicating future work on rehabilitation programs for return to preinjury might consider taking the holistic approach addressing those. In the following pages, we will attempt to show that, since its birth, the universe has been undergoing a process of self-organization. The appearance of life on Earth represents one of the stages in this process.

It is our pleasure to present the Proceedings of Sinn und Bedeutung 28– the first-ever SuB to be held by the growing group of semanticists at Ruhr University Bochum (RUB), Germany. SuB28 took place at RUB’s Convention Center from September 5-9, 2023. The conference was jointly organized by the RUB Institute for Linguistics, the Linguistic Data Science Lab, the Institute for German Language and Literature, and the Departments of Philosophy I and II. The conference featured a three-day main session (Sept. (...) 6-8) and a one-day special session on ‘The Semantics and Pragmatics of Co-Speech Communication’ (Sept. 5, organized by Tatjana Scheffler). The main session comprised 45 contributed talks and two poster sessions (plus lightning talks, with 14 posters each) as well as three invited talks (by Dorothy Ahn, Hazel Pearson, and Graham Priest). The special session hosted seven contributed talks plus one invited talk (by Cor-nelia Ebert). As is common for SuB, the Proceedings include contributions from the invited, contributed, and poster sessions alongside contributions to the workshop. (shrink)

This paper critically discusses role functionalism about color and suggests that it is not such a sui generis position as it is often considered to be. The discussionfocuses upon one, hopefully, central point. The main proponent of the idea of role functionalism is Jonathan Cohen who in his book The Red and the Real (2009)suggests a Refined Taxonomy of positions on color ontology. Namely, his proposal implies that color ontology should be divided into relationalist and non-relationalist accounts. Generally, he endorses (...) the relationalist theory of color which roughly claims that colors are constituted in terms of some relation between objects and subjects (inter alia). Specifically, Cohen defends Role Functionalism as the best version of relationalism according to which the relations that constitute colors are functional relations. Based on his role functionalist stance, he distances himself from dispositionalists. However, in this paper I show that he could be interpreted as one and therefore needs to reconsider his Refined Taxonomy of positions on color ontology. (shrink)

The autograph corpus of the Damascene scholar Ibn Ṭūlūn is dispersed throughout collections in North America, Europe, and West Asia. As an initial probe into these materials, I will describe, identify, and analyze two compendia in the Princeton University collection: Garrett MSS 196B and 1011H. They contain, among other things, a portion of al-Thaghr al-bassām, an autograph draft of his biographical dictionary of Damascene judges, which is later than the one edited and published in 1959, and a heretofore missing portion (...) of al-Qalāʿid al-jawhari- yya, his topography of al-Ṣāliḥiyya. I will also positively identify an anonymous, untitled manuscript in the Bodleian Library and show its relationship to the al-Thaghr al-bassām autograph. (shrink)

Širším tématem tohoto článku je otázka kulturní relativity v metodologii antropologie a sociálních věd. Cílem textu je popsat anti-anti-relativistický postoj antropologa Clifforda Geertze, v němž se odráží jeho interpretace pozdního díla L. Wittgensteina a jeho pojmu „životní forma“. Geertzův anti-anti-relativismus je výsledkem odmítnutí zaujmout pozici relativisty nebo etnocentristy, a to z několika důvodů. Hlavním problémem obou táborů je podle něj mylná představa kultury jako nedynamického a uzavřeného celku, která vyplývá z filozofické představy „ideálních“ pojmů. Taková představa je podle něj zvlášť (...) neudržitelná v dnešním globalizovaném propojeném světě. Geertz taktéž upozorňuje na dynamický způsob formování identity (subjektu nebo kultury) prostřednictvím setkání se s cizím. Životní forma je pro Geertze metodologický nástroj, který umožňuje vyhnout se rozhodování mezi relativismem nebo anti-relativismem a který naopak poskytuje dynamickou střední cestu, jejíž pomocí jde zkoumat vzájemné prolínání identit kultur a sociálních skupin. Obstetric ultrasound has become a significant tool in obstetric practice, however, it has been argued that its increasing use may have adverse implications for women’s reproductive freedom. This study aimed to explore Australian obstetricians’ experiences and views of the use of obstetric ultrasound both in relation to clinical management of complicated pregnancy, and in situations where maternal and fetal health interests conflict.

One can remember events and one can remember facts: to remember an event (e.g. the barista's pouring my coffee this morning), one needs to have personally witnessed this event. To remember a fact (e.g. that the barista was trained in Italy), it suffices to have learned this fact from some other source. The distinction between event-directed (i.e. experiential) and fact-directed (or propositional) attitudes is an established distinction in philosophy, psychology, and cognitive science that is also exemplified by other attitudes (incl. (...) seeing, imagining, and dreaming). Until recently, semantics and the philosophy of language have assumed that experiential attitudes can be more or less straightforwardly reduced to propositional attitudes. However, new work has identified some key properties of experiential attitudes that cast doubt on this reducibility. The present paper discusses the most notable of these properties, focusing on experiential attitude reports. It links these properties to recent developments in formal and philosophical semantics in an effort to foster the development of a rigorous, empirically adequate account of experiential attitudes. In practice, the role of lay members of research ethics committees (RECs) often involves checking the accessibility of written materials, checking that the practical needs of participants have been considered and ensuring that a lay summary of the research will be produced. In this brief report, I argue that all these tasks would be more effectively carried out through a process of patient involvement (PI) in research projects prior to ethical review. Involving patients with direct experience of the topic under (...) investigation brings added value beyond the contributions typically made by lay REC members, who are often not patients themselves. This is because PI tailors the design and conduct of research to the specific interests and concerns of the people who will actually take part in a project and make use of its findings. If a project has PI in its early stages, then a similar input from lay REC members could at best result in duplication of effort and at worst create the potential for conflict. The rationale for lay REC membership will therefore need to change from ‘contributing a patient perspective’ to ‘ensuring transparency and public accountability in REC decisions’. This has implications for addressing more strategic questions about lay REC membership, including who is best recruited to the role and how they should be expected to contribute in practice. There is widespread agreement among both supporters and opponents that affirmative action either must not violate any principle of equal opportunity or procedural justice, or if it does, it may do so only given current extenuating circumstances. Many believe that affirmative action is morally problematic, only justified to the extent that it brings us closer to the time when we will no longer need it. In other words, those that support affirmative action believe it is acceptable in nonideal theory, but (...) not ideal theory. This paper argues that affirmative action is entirely compatible with equal opportunity and procedural justice and would be even in an ideal world. I defend a new analysis of Rawlsian procedural justice according to which it is permissible to interfere in the outcomes of procedures, and thus I show that affirmative action is not morally problematic in the way that many have supposed. Vor allem die Frage nach der Möglichkeit der Quadratur des Kreises beschäftigte ihn. In seinen Lösungsansätzen spielt die Lehre vom Zusammenfall der Gegensätze eine entscheidende Rolle. In den vergangenen Jahren wurde Cusanus’ Technikverständnis an der Kueser Akademie für Europäische Geistesgeschichte intensiv erforscht. Im Ergebnis stellt Ingo Reiss in diesem Buch den cusanischen Zugang zu Mathematik und Technik und zu deren Wechselverhältnis vor.

The tension between economic policy and health policy is a longstanding dilemma, but one that was brought to the fore with the World Trade Organization’s Trade-Related Aspects of Intellectual Property Rights Agreement in 1994. The pharmaceutical industry has long argued that intellectual property protection is vital for innovation. At the same time, there are those who counter that strong IPP negatively impacts the affordability and availability of essential medicines in developing countries. However, actors on both sides of the debate were (...) in agreement that something needed to be done to address the HIV/AIDS crisis, especially in developing countries. In response to sustained and significant pressure from civil society groups, members of the World Trade Organization agreed to the Declaration on the TRIPS Agreement and Public Health in 2001.
