Brain-computer interfaces allow agents to control computers without moving their bodies. The agents imagine certain things and the brain-computer interfaces read the concomitant neural activity and operate the computer accordingly. But the use of brain-computer interfaces is problematic for criminal law, which requires that someone can only be found criminally responsible if they have satisfied the actus reus requirement: that the agent has performed some (suitably specified) conduct. Agents who affect the world using brain-computer interfaces do not obviously perform any (...) conduct, so when they commit crimes using brain-computer interfaces it is unclear how they have satisfied actus reus. Drawing on a forthcoming paper by Allan McCay, I suggest three potential accounts of the conduct that satisfies actus reus: the agent’s neural firings, his mental states, and the electronic activity in his brain-computer interface. I then present two accounts which determine how actus reus may be satisfied – one a counterfactual and the other a minimal sufficiency account. These accounts are lent plausibility because they are analogous to the but-for and NESS (Necessary Element in a Sufficient Set) tests for causation which are generally accepted tests for causation in legal theory. I argue that due to the determinations of these accounts and considerations regarding the relationship between the mind and brain, actus reus is satisfied by either the agent’s neural activity or brain-computer interface electrical activity. Which of these satisfies actus reus is determined by how well the brain-computer interface is functionally integrated with the agent. (shrink)

In this new work, political theorist Michael J. Thompson argues that modern societies are witnessing a decline in one of the core building blocks of modernity: the autonomous self. Far from being an illusion of the Enlightenment, Thompson contends that the individual is a defining feature of the project to build a modern democratic culture and polity. One of the central reasons for its demise in recent decades has been the emergence of what he calls the cybernetic society, (...) a cohesive totalization of the social logics of the institutional spheres of economy, culture and polity. These logics have been progressively defined by the imperatives of economic growth and technical-administrative management of labor and consumption, routinizing patterns of life, practices, and consciousness throughout the culture. Evolving out of the neoliberal transformation of economy and society since the 1980s, the cybernetic society has transformed how that the individual is articulated in contemporary society. Thompson examines the various pathologies of the self and consciousness that result from this form of socialization--such as hyper-reification, alienated moral cognition, false consciousness, and the withered ego--in new ways to demonstrate the extent of deformation of modern selfhood. Only with a more robust, more socially embedded concept of autonomy as critical agency can we begin to reconstruct the principles of democratic individuality and community. (shrink)

This article discusses the significance of international borders in Europe and Northeast Asia during the Cold War (1945–1989) and after. Using the concept of ‘moral hazard’, the article examines what happens when great powers frequently violate the borders of neighboring countries without suffering adverse repercussions. Norms of sovereignty and territorial integrity are viable only if large countries are willing to uphold them most of the time. The Soviet Union used or threatened to use military force against East European countries on (...) numerous occasions (1953, 1956, 1968, and 1980–1981) with impunity. The Russian Federation adopted a broadly similar policy toward neighboring countries that had been republics of the Soviet Union until 1991. Russian forces in Georgia, Moldova, Tajikistan, Belarus, and Ukraine served as instruments of Russian hegemony in those countries. Until 2014, Western governments made little or no effort to deter or counter Russian military encroachments in neighboring republics. By the principle of moral hazard, leaders in the Kremlin came to believe that they could act with a free hand in the former USSR. (shrink)

The article presents critical examination of theories about collective responsibility attempting to cover responsibility for historic injustices. The author will also try to establish the possibility of collective responsibility for the present members of the group to make recompense for the injustices committed by their ancestors depending on two factors expounded in the article.

Many theorists have defended the claim that collective entities can attain genuine agential status. If collectives can be agents, this opens up a further question: can they be conscious? That is, is there something that it is like to be them? Eric Schwitzgebel argues that yes, collective entities, may well be significantly conscious. Others, including Kammerer, Tononi and Koch, and List reject the claim. List does so on the basis of Tononi’s Integrated Information Theory of consciousness. I argue here that (...) List’s rejection is too quick, and that groups can, at least in principle, display the kind of informational integration we might think is necessary for consciousness. However, group consciousness will likely differ substantially from the individual experiences that give rise to it. This requires the defender of group consciousness to face up to a similar combination problem as the panpsychist. (shrink)

Diese Publikation handelt von der Beziehung zwischen dem Staat und dem Islam im allgemein-politischen und im schulischen Kontext, wobei der Islam neben anderen islamischen Institutionen in erster Linie von der Islamischen Glaubensgemeinschaft in Österreich (IGGÖ) vertreten wird. Der IGGÖ - ebenso wie anderen Kirchen und Religionsgesellschaften (KuR) - werden im österreichischen Religionsrechtssystem weitreichende Autonomierechte eingeräumt, vor allem in der Schule in Form eines konfessionellen Religionsunterrichts (RU). Zur Erforschung dieser Beziehung in der Schule wird ein rechts- und politikwissenschaftlicher Blick auf die (...) rechtlichen Rahmenbedingungen und die soziale Wirklichkeit des Islams und des RU der IGGÖ (IRU) in Wiener Mittelschulen geworfen. Konsequenterweise wird auch auf die verschiedenen involvierten Akteur*innen geblickt, insb. auf muslimische Schüler*innen und Eltern, Religionslehrer*innen, Fachinspektor*innen und sonstige Autoritäten der IGGÖ sowie Schuldirektor*innen, Bildungsdirektionen und das Bildungsministerium. Dafür wurden im Rahmen einer qualitativen Sozialforschung sieben (Schul-)Autoritäten der IGGÖ (IGGÖ-SA) als 'Vertreter*innen des Islams' und sechs Wiener Mittelschuldirektor*innen (MSD) als 'staatliche Vertreter*innen' interviewt. Die Interviews verfolgten drei Zwecke: 1) die Ergründung negativer rechtlicher, politischer, gesellschaftlicher und religionsgesellschaftlicher Einflussfaktoren auf die allgemeine Beziehung zwischen dem Staat und dem Islam bzw. der IGGÖ (und den Muslim*innen); 2) die Erhebung von Herausforderungen, Spannungen und Konflikten sowie Idealvorstellungen in der schulpolitischen, -bürokratischen, -organisatorischen, individuellen und korporativen Beziehungsdimension, sowie 3) die Erforschung von persönlichen Einstellungen und Haltungen von IGGÖ-SA und MSD zum Islam und dem IRU in der Schule sowie - vonseiten der IGGÖ-SA - zum Staat und der Gesellschaft. Während der dritte Zweck in dieser Publikation nur eine untergeordnete Rolle einnimmt, liegt das Hauptaugenmerk auf den abstrahierten Spannungsfeldern des 'gelebten Rechts' im Sinne der sozialen Wirklichkeit in den entsprechenden Beziehungsdimensionen, die in einer rechtssoziologischen Analyse dem normativem Recht gegenübergestellt und entlang idealtypischer Einstellungen und Haltungen auf Ursachen, Wirkungen und Lösungen untersucht werden. Die Analysethemen umfassen mitunter die Einbeziehung von Fachinspektor*innen für Religion in die Bildungsdirektionen, den Streit über die Abkürzung der IGGÖ für die Eintragung in Zeugnisse, die Schwierigkeiten in der Organisation mit dem RU, das (religiöse) Verhalten muslimischer Schüler*innen und Eltern in der Schule sowie die Grenzen der Lehre im IRU im Rahmen der staatsbürgerlichen Erziehung. Diesbezügliche Idealvorstellungen zu den Herausforderungen ermöglichen abschließend aus einer sozialintegrativen und pluralistischer Perspektive der IGGÖ-SA die Konturierung eines Österreichischen Islams bzw. eines idealtypischen IRU. The renaissance in Hegel scholarship over the past two decades has largely ignored or marginalized the metaphysical dimension of his thought, perhaps most vigorously when considering his social and political philosophy. Many scholars have consistently maintained that Hegel’s political philosophy must be reconstructed without the metaphysical structure that Hegel saw as his crowning philosophical achievement. This book brings together twelve original essays that explore the relation between Hegel’s metaphysics and his political, social, and practical philosophy. Adorno was deeply influenced by ideas about the rationalization of mass society and effects of commodification on consciousness. The work of Max Weber and Georg Lukács were dual influences that shaped much of Adorno's own work. He develops his critique of the “totally administered society” as a confluence of Weber's rationalization thesis as well as Lukács' theory of reification of consciousness due to the penetration of the commodity form into everyday life. But Adorno moves beyond these ideas by arguing that (...) the spread of exchange‐value and quantification, carried forth via the commodity form, collapses the modern individual and its consciousness into the prevailing forms of dominant rationality. I then show how his later projects of Negative Dialectics and Aesthetic Theory seek to protect the subject from these trends and then reflect on how Adorno's ideas can be brought together with Lukács' later ideas about social ontology in order to glimpse a broader concept of Critical Theory. Kramer was one of the most visionary musical thinkers of the second half of the 20th century. In his The Time of Music, he approached the idea of the many different ways that time itself is articulated musically. This book has become influential among composers, theorists, and aestheticians. Preview: Philosophy has notably struggled in the twentieth and twenty-first centuries to come to terms with how it participated in the erasure and invisibility of persons across the globe. Western philosophy over hundreds of years found itself immersed in the colonial project, in all its economic, social, political, legal, disciplinary, and aesthetic dimensions. Its logic of Western racial superiority, grounded in eugenics, social Darwinism, and deterministic accounts of racial realism, grew and deepened, especially in Europe and the Americas. No domain (...) was free, even Hugo Grotius’ grand work on international law and diplomacy, Mare Liberum (The Free Sea) was founded in justifying Dutch colonial seizures of ships and resources. The haunting of those shorn of their dignity besets us. We have forgotten, in a sense to go “backwards”; not just to “bracket” our stories of the world, but to see the persons we have continued to ignore through certain horizons of dominating meaning. It has been up to these people to find themselves even when under the erasure of the dominant mode of history, and in turn they have much to teach those of us willing to turn back to listen. The enduring popularity of Star Wars has much to do with its mythic dimensions. However, there are problems with Joseph Campbell's work on myth and George Lucas's use of Campbell's ideas in Star Wars. Both Campbell and Lucas promote a simplistic view that encourages fans to avoid some darker, more unsettling ideas in Star Wars, which may obscure myth's true power. Campbell remains one of the most famous mythologists, but he was by no means the first. Campbell's influence on Star (...) Wars seems obvious, but the details are difficult to determine, partly because Lucas himself gives different accounts of it. Campbell's monomyth leads us to see similarities between tales and, in so doing, overlooks many significant differences. Tensions between mythos and logos date back to ancient Greek philosophers, if not earlier. The mythic structure of Star Wars has immense hidden power, and this power has a dark side. (shrink)

For many years emotion theory has been characterized by a dichotomy between the head and the body. In the golden years of cognitivism, during the nineteen-sixties and seventies, emotion theory focused on the cognitive antecedents of emotion, the so-called “appraisal processes.” Bodily events were seen largely as byproducts of cognition, and as too unspecific to contribute to the variety of emotion experience. Cognition was conceptualized as an abstract, intellectual, “heady” process separate from bodily events. Although current emotion theory has moved (...) beyond this disembodied stance by conceiving of emotions as involving both cognitive processes (perception, attention, and evaluation) and bodily events (arousal, behavior, and facial expressions), the legacy of cognitivism persists in the tendency to treat cognitive and bodily events as separate constituents of emotion. Thus the cognitive aspects of emotion are supposedly distinct and separate from the bodily ones. This separation indicates that cognitivism’s disembodied conception of cognition continues to shape the way emotion theorists conceptualize emotion. (shrink)

The idea of an ideological war between science and religion, Thompson argues, is founded on a mistake. But this does not mean that there is nothing at stake. For behind the ill-conceived conflict lie complex issues about the nature of mind, consciousness, experience, subjectivity, quality, value, and the like, all of which need to be disentangled and assessed in their own right. Outgrowing Materialism leads the reader through a sequence of five “Worlds,” each of which offers a distinct way (...) of understanding (or failing to understand) these issues, and where God might belong (or not). Writing accessibly, but with a sharp eye for detail, Thompson sheds new light on the familiar territory of materialism, dualism, and structural realism, and evaluates the growing attraction of the multiverse. He argues that dualism mechanized the material world; then materialism exorcised the mental “ghost” from the machine; and finally, this machine is evaporating into pure mathematics. Outgrowing Materialism is half of Ten Ways to Weave the World: Matter, Mind, and God. The sequel, Embodying Mind, discusses five “Worlds” that precede and follow those discussed here. The idea that there are three types of argumentation, deduction, induction, and a third type variously called hypothesis, abduction, or retroduction, first appeared in an 1867 paper by Charles S. Peirce, “On the Natural Classification of Arguments”. According to Peirce’s tripartite division of argumentation, induction is not merely any form of argument that fails to be deductive, but argumentation that generalizes from a sample. In later writings Peirce broadened his notion to mean any testing of hypotheses through observation—as Peirce said, (...) “trying how things will act”. It is commonly assumed that grounding relations are asymmetric. Here I develop and argue for a theory of metaphysical structure that takes grounding to be nonsymmetric rather than asymmetric. Even without infinite descending chains of dependence, it might be that every entity is grounded in some other entity. Having first addressed an immediate objection to the position under discussion, I introduce two examples of symmetric grounding. I give three arguments for the view that grounding is nonsymmetric (I call this view (...) ‘metaphysical interdependence’). These arguments are: (i) that metaphysical interdependence is the only theory able to reconcile competing intuitions about grounding; (ii) that it is the only theory consistent with both ‘gunk’ and ‘junk’; and (iii) that offers a satisfactory solution to the problem concerning whether or not grounding is itself grounded. Georg Lukács was one of the most important intellectuals and philosophers of the 20th century. His last great work was an systematic social ontology that was an attempt to ground an ethical and critical form of Marxism. This work has only now begun to attract the interest of critical theorists and philosophers intent on reconstructing a critical theory of society as well as a more sophisticated framework for Marxian philosophy.
