Action-based legal theory is a discrete branch of praxeology and the basis of an emerging school of jurisprudence related to, but distinct from, natural law. Legal theory and economic theory share content that is part of praxeology itself: the action axiom, the a priori of argumentation, universalizable property theory, and counterfactual-deductive methodology. Praxeological property-norm justification is separate from the strictly ethical “ought” question of selecting ends in an action context. Examples of action-based jurisprudence are found in existing “Austro-libertarian” literature. Legal (...) theory and legal practice must remain distinct and work closely together if justice is to be found in real cases. Legal theorizing was shaped in religious ethical contexts, which contributed to confused field boundaries between law and ethics. The carrot and stick influence of rulers on theorists has distorted conventional economics and jurisprudence in particular directions over the course of centuries. An action-based approach is relatively immune to such sources of distortion in its methods and conclusions, but has tended historically to be marginalized from conventional institutions for this same reason. While crises are omnipresent in history and historiography, the meaning of the concept of ‘crisis’ is becoming more elusive than ever. The authors scrutinise how historians use this concept with respect to contemporary history, the twentieth century and modernity in general. After briefly sketching the conceptual history of ‘crisis,’ the article addresses the questions of how the concept structures historiographical narratives, what types of crises historians distinguish, and whether we should retain the concept or refrain from using it, considering its (...) vagueness, suggestive power and political instrumentalisation. Darüber hinaus imaginieren sie sich selbst als Tiere. Schließlich bündeln beide Romane diese Konstellation in Schlüsselszenen, die auf dieselbe (...) Here I present the first version of the transcription of the Commentarius in Metaphysicam by Konrad Graf from Cod. Pp 183 4°, Teil 2, Zentral- und Hochschulbibliothek Luzern [ZHB], Sondersammlung (ff. 1r-56v), which collects Graf's lectures in metaphysics, held at the Lucerne Gymnasium in 1635-36. The transcription of the text was carried out at the Lucerne Faculty of Theology within the SNSF project "Zwischen monastischer und reformierter Metaphysik. Die schweizerische 'Wiege' der Ontologie im Zeitalter der Reformation" (SNSF (...) project 100012_192559 - applicant: Prof. Dr. Giovanni Ventimiglia (TF- University of Lucerne), Employees: Marco Lamanna, Chiara Paladini. The project aimed to redefine the "cartography" of the Reformation in Switzerland on the traces of metaphysics teaching (Reportationes) in Swiss educational institutions and monastic poles, and thereby to gain a precise place for Swiss studies in the panorama of research on metaphysics and ontology in the early modern period. The project was based on a preliminary investigation that made it possible to recover new texts transmitting lessons on metaphysics held in Lucerne and Engelberg. The method was 1. to produce a systematic and comprehensive documentation based on an index of manuscripts and printed texts, most of them already identified, which testify to the existence of a cultural flourishing in Switzerland that has so far remained unexplored. 2. this documentation should be placed on a solid textual basis by transcribing and eventually critically editing those texts judged to be of interest in terms of their content and influence, in order to make them accessible to the scholarly community and to readers. 3. finally, we will examine the specific aspects of the teachings transmitted in these manuscripts. Friedrich Wilhelm Graf skizziert die Biographie des in den 1950er und 1960er Jahren uberaus einflussreichen Hamburger Systematischen Theologen Helmut Thielicke, um dann dessen Aktivitaten zur Grundung einer Zeitschrift fur Theologische Ethik zu rekonstruieren. Dabei untersucht er auch Thielickes Kontakte zu dem amerikanischen Theologen Reinhold Niebuhr und zu Paul Tillich. Vorgestellt werden die von Thielicke zunachst in den Blick genommenen Herausgeber, seine Programmentwurfe zu Aufgabe und Profil der seit Januar 1957 erscheinenden Zeitschrift fur Evangelische Ethik und das tatsachliche Herausgebergremium, dem (...) neben Thielicke protestantische Universitatstheologen wie Heinz-Dietrich Wendland, Hendrik van Oyen, Wolfgang Schweitzer sowie der kirchlich vielfaltig engagierte rheinische Unternehmer Friedrich Karrenberg und der spatere WDR-Intendant Klaus von Bismarck angehorten. Durch die dichte Analyse der in den ersten Jahrgangen der Zeitschrift fur Evangelische Ethik gefuhrten Kontroversen uber die atomare Bewaffnung sowie den Institutionenbegriff zeigt Friedrich Wilhelm Graf, dass die ZEE primar ein Organ innerprotestantischer Verstandigung sein und zugleich die politisch-soziale Gestaltungskraft des bundesdeutschen Protestantismus starken sollte. Trotz ihres dezidiert internationalen Anspruchs wurde die Zeitschrift schon bald zu einem Organ, in dem hauptsachlich nur noch deutschsprachige protestantische Theologen publizierten. (shrink)

Within collective epistemology, there is a class of theories that understand the epistemic status of collective attitude ascriptions, such as ‘the college union knows that the industrial action is going to plan’, or ‘the jury justifiedly believes that the suspect is guilty’, as saying that a sufficient subset of group member attitudes have the relevant epistemic status. In this paper, I will demonstrate that these summativist approaches to collective epistemology are incompatible with epistemic permissivism, the doctrine that a single body (...) of evidence may rationalize multiple doxastic attitudes. In particular, I will make use of epistemic permissivism to provide a general recipe for generating so-called divergence cases, which demonstrate situations in which rationality requires group-level and member-level attitudes to diverge. I will call this class of cases permissive divergence cases. While other divergence cases have been discussed in the literature, permissive divergence cases prove themselves to be less susceptible to many of the worries raised against their competitors, while being directly built on an often-defended epistemological thesis. Was haben Gerechtigkeit, Frieden, Glück und Wertebildung miteinander zu tun? Der Band beantwortet diese Frage interdisziplinär. Die BeiträgerInnen untersuchen Lernprozesse hinter gerechtem Urteilen, setzen sich mit Projekten zur Friedensstiftung durch Konfliktberatung auseinander und analysieren schulische Programme zur Förderung von Zufriedenheit und Glück. Sie erläutern darüber hinaus die Relevanz von Wertebildung in einem fachspezifischen Curriculum und denken Gerechtigkeits-, Friedens- und Glücks-bildung historisch und systematisch weiter. This paper is an attempt to think through paranoia’s epistemic and affective features, which pervade both the worldview presented in Senecan tragedy and the inner life of many of its protagonists. Drawing upon recent literary-critical work, I argue that paranoia is temporally and epistemically ambivalent: subjects simultaneously attempt to “get ahead” of a looming cataclysm—looking to the future in an attempt to avert disaster—while inevitably “falling behind,” failing to predict or preempt the future in time to protect themselves. Much of (...) Senecan tragedy plays out paranoia’s future-oriented vigilance on the formal level. Foreshadowing, allusions, and meta-literary flourishes serve to render both readers and characters hyperaware of the earth-shattering horrors to come; however, in doing so, they also reveal that this forward-oriented bracing only serves to dredge up negative affect in advance. By contrast, I argue that Seneca’s Phoenissae thematizes in the character of Oedipus not only paranoia’s future-looking vigilance but also its inherent lagging, the failure to know and act in advance. These elements of slowness, stuckness, and delay open a space for stillness, relief, and intimacy, even within a narrative which hurtles toward cataclysm. (shrink)

Dieses letzte große Buch Troeltschs entstand in einem komplizierten Arbeitsprozess zwischen 1915 und 1922 und gilt als der zentrale Text im geschichtsphilosophischen Diskurs der 20er Jahre. Der gefeierte Berliner Kulturphilosoph verarbeitete hier die traumatischen Erfahrungen des Ersten Weltkriegs und suchte durch sein Konzept der „europäischen Kultursynthese“ ethische Potentiale europäischer Integration und die Aussöhnung der Deutschen mit der westlichen Demokratie zu fundieren. Dazu verarbeitete er weit über 1000 Titel aus dem zeitgenössischen geschichtsphilosophischen Diskurs. One of the important determinants of development during the transition to adulthood is the undertaking of social roles characteristic of adults, also in the area of finishing formal education, which usually coincides with beginning fulltime employment. In the study discussed in this paper, it has been hypothesized that continuing full-time education above the age of 26, a phenomenon rarely observed in Poland, can be considered as an unpunctual event that may be connected with difficulties in the process of identity formation. (...) Relationships between identity dimensions and identity statuses, and age and educational context were analyzed. 693 individuals aged 19-35 took part in the study. The participants attended three types of educational institutions: full-time university studies, part-time university studies, and full-time post-secondary school. Among the students of full-time university studies predictable dependencies, also in respect of highlevels of indicators of identity crisis and a high frequency of diffused identity occurrence, were observed. Such dependencies were not found in the group of full-time post-secondary school students. (shrink)

Der Christliche Philosoph verfügte über die Gabe, selbst im kämpferischen Atheisten den suchenden Anderen, Nachbarn und Dialogpartner zu erkennen - dabei entwickelte er im Weltanschauungsstaat DDR herausragende hermeneutische Fähigkeiten. Die Herausgeber möchten an diesen bedeutenden katholischen Intellektuellen erinnern und laden dazu ein, Feiereis in seinen Texten zu begegnen.

Die Evolutionstheorie hat sich in den letzten 150 Jahren von einer speziellen naturwissenschaftlichen zur universellen wissenschaftlichen Theorie entwickelt.

The paper explores the relationships and interconnections in the philosophical and sociopolitical concepts of Günther Anders and Hannah Arendt. Both philosophers, who were married to each other for a short time, not only shared a similar fate in that they both had to flee from National Socialism, but both dealt with similar questions, albeit in different manners: with Auschwitz and the Holocaust, with the problem of totalitarianism, with the development of the Modern, which is defined by technology and industrial labour. (...) A comparison shows that many themes in the thinking of these philosophers are near to each other, but the methods and foci are other. At the foreground of Anders’ thinking is the question of the destructive influence of modern technology and weapons of mass destruction. However, Arendt concentrates on totalitarian political structures and the possibility of people to take action. Nevertheless, they both are concerned that people’s humanity is at risk under the political and technological conditions of the Modern. (shrink)

There is no longer any doubt that the coming decades will bring serious threats to humanity from anthropogenic climate change. As we have suggested elsewhere, horrible scenarios are far more realistic than non-horrible ones, and science and technology are incapable, especially in our non-ideal world, of equitably distributing wealth, access to resources and adaptations to climate change. In this article, we offer an alternative to these inevitable horrible scenarios. The alternative is to implement either an anti-natalist policy, or procreative beneficence (...) and reproductive rights policies aimed at radically reducing the birth rate. These alternatives, however, are potentially unfair and quite possibly unthinkable to most of humanity. (shrink)
