Seeing that socio-legal theory has produced a number of compelling grand theories about law’s development as a body of knowledge, this contribution analyzes legal evolution on the micro-level of decision-making in concrete cases. To that end, law finding is reconstructed as a three stage process of reason-based rule-construction. Legal evolution is argued to stem from the argumentative jumps that are made in this process in order to use what is initially drawn from the body of legal knowledge (...) in new cases. These jumps are justified by additional reasoning that plays a crucial role in that it brings new information to the law finding process. It is explained how this new information gets incorporated in the body of knowledge as a result of discursive maneuvers of legal practitioners. (shrink)

Certain critical accounts of conventional research practices in business and the social sciences are explored in this essay. These accounts derive from alternative social paradigms and their underlying assumptions about appropriate social inquiry and knowledge construction. Among these alternative social paradigms, metatheories, mindscapes, or worldviews are social constructionist, critical, feminist, and postmodern or poststructural thinking. Individuals with these assumptions and values for knowledge construction are increasingly challenging conventional scholarship in what has been referred to as paradigm (...) debates or wars. Issues of incommensurability or cross-paradigmatic communication potentials, as well as reflexivity, are raised in terms of moral education and development potentials for applied social science fields. Barriers and suggestions for increased moral development in academic and professional communities are discussed. In particular, moral forums in which participants have enhanced intrapersonal and interpersonal communication skills appear to be needed to surface and share often taken-for-granted assumptions concerning moral knowledge construction. Computer-based design environments for skilled domain workers have recently graduated from research prototypes to commercial products, supporting the learning of individual designers. Such systems do not, however, adequately support the collaborative nature of work or the evolution of knowledge within communities of practice. If innovation is to be supported within collaborative efforts, thesedomain-oriented design environments (DODEs) must be extended to becomecollaborative information environments (CIEs), capable of providing effective community memories for managing information and learning within constantly evolving collaborative contexts. Recent developments in the philosophy of science and the historical study of scientific accomplishments have deprived these presuppositions of their former plausibility. Sooner or later, this must have an effect on the teaching of science. In this paper I am presenting a brief outline of an alternative theory of knowing that takes into account the thinking organism's (...) cognitive isolation from 'reality'. This orientation was proposed by Vico at the beginning of the 18th century, disregarded for two hundred years, and then propounded independently by Piaget as a developmentally grounded constructivist epistemology. The paper focuses specifically on the adaptive function of cognition, Piaget's scheme theory, the process of communication, and the subjective perspective on social interaction. In the concluding section it then suggests some of the consequences the shift of epistemological presuppositions might have for the practice of teaching. (shrink)

We propose a non-standard interpretation of Alternating-time Temporal Logic with imperfect information, for which no commonly accepted semantics has been proposed yet. Rather than changing the semantic structures, we generalize the usual interpretation of formulae in single states to sets of states. We also propose a new epistemic operator for ?practical? or ?constructive? knowledge, and we show that the new logic (which we call Constructive Strategic Logic) is strictly more expressive than most existing solutions, while it retains the same (...) model checking complexity. This original article outlines a theoretical path and posterior critical analysis regarding two relevant matters in modern nursing: patterns of knowing in nursing and commodification contexts in contemporary health systems. The aim of our manuscript is to examine the development of basic and contextual nursing knowledge in commodified contexts. For this purpose, we outline a discussion and reflexive dialogue based on a literature search and our clinical experience. To lay the foundation for an informed discussion, we conducted a literature (...) search and selected relevant articles in English, Spanish, and Portuguese that included contents on patterns of knowing, commodification, and nursing published from 1978 to 2017. Globalization, commodification, and austerity measures seem to have negative effects on nursing. Work conditions are worsening, deteriorating nurse–patient relationships, and limiting reflection on practice. Nurses must develop knowledge to challenge and participate in institutional organization and public health policies. Development of nursing knowledge may be difficult to achieve in commodified environments. Consequently, therapeutic care relationships, healthcare services, and nurses' own health are compromised. However, by obtaining organizational, sociopolitical, and emancipatory knowledge, nurses can use strategies to adapt to or resist commodified contexts while constructing basic knowledge. (shrink)

Undertaking engagement in public health research is ethically essential. There is a growing emphasis on practicing engagement as the co‐construction of knowledge, which goes beyond other common forms of engagement in health research practice: consulting and informing. Taking such an approach means researchers jointly construct knowledge with research users and beneficiaries; all parties design and conduct research together and share decision‐making power. This article makes the normative argument that such engagement is necessary to achieve the foundational moral (...) aims of public health research—building relations of equality and addressing the health needs of those considered disadvantaged—which reflect the field's underlying commitment to social justice. It next identifies and discusses three ways in which co‐constructing knowledge advances those moral aims: by facilitating self‐determination, supporting individuals’ right to research, and maximizing social knowledge to address cognitive and epistemic injustice. This work uses microgenetic study of classroom learning to illuminate (1) the role of pre-instructional student knowledge in the construction of normative scientific knowledge, and (2) the learning mechanisms that drive change. Three enactments of an instructional sequence designed to lead to a scientific understanding of thermal equilibration are used as data sources. Only data from a scaffolded student inquiry preceding introduction of a normative model were used. Hence, the study involves nearly autonomous student learning. In two (...) classes, students developed stable and socially shared explanations (“causal schemes”) for understanding thermal equilibration. One case resulted in a near-normative understanding, while the other resulted in a non-normative “alternative conception.” The near-normative case seems to be a particularly clear example wherein the constructed causal scheme is a composition of previously documented naïve conceptions. Detailed prior description of these naive elements allows a much better than usual view of the corresponding details of change during construction of the new scheme. A list of candidate mechanisms that can account for observed change is presented. The non-normative construction seems also to be a composition, albeit of a different structural form, using a different (although similar) set of naïve elements. This article provides one of very few high-resolution process analyses showing the productive use of naïve knowledge in learning. (shrink)

Knowledge management is important in the construction industry, but there is a dramatic gap between rhetoric and reality, highlighting mistaken expectations of technology. We report on a case study of a major construction company. The UK construction industry, with scarce academic qualifications, and limited use of IT, depends on knowledge sharing, and, crucially, on tacit knowledge. Economic crisis presents particular problems, and recent trends in work organization have far-reaching implications. The industry depends on human (...) knowledge, with limited systems support. 1. Much of modern and contemporary philosophy of mind in the ‘analytic’ tradition has presupposed, since Descartes, what might be called a realist view about the mind and the mental. According to this view there are independently existing, determinate items (states, events, dispositions or relations) that are the truth-conferrers of our ascriptions of mental predicates.[1] The view is also a cognitivist one insofar as it holds that when we correctly ascribe such a predicate to an individual the correctness consists in (...) the discovery of a determinate fact of the matter about the state the individual is in ( a state which is somehow cognized by the ascriber. Disputes have arisen about the nature of the truth-conferrers (e.g., whether they are physical or not) and about the status and the nature of the individual’s own authority about the state he is in. A dissenting position in philosophy of mind would have to be handled carefully. It would, most importantly, need to allow for the objectivity of ascriptions of mental predicates at least insofar as it made sense to reject some and accept others on appropriate grounds. Perhaps such a position in the philosophy of mind can be likened in at least one way to what David Wiggins has characterised as a doctrine of ‘cognitive underdetermination’ about moral or practical judgments.[2] In comparing his position of cognitive underdetermination about moral or practical judgments to some things Wittgenstein has said about the philosophy of mathematics, Wiggins suggests that, ‘In the assertibility (or truth) of mathematical statements we see what perhaps we can never see in the assertibility of empirical (such as geographical or historical) statements: the compossibility of objectivity, discovery, and invention.’[3]. The commodification of health care, particularly primary care, presents challenges to care and knowledge development. The purpose of this study is to examine how nurses perceive and develop their knowledge in a commodified context. A mixed‐methods study was conducted that included a closed‐question survey and in‐depth interviews with nurses in public primary care in Catalonia. There were 104 valid responses to the questionnaire and 10 in‐depth interviews. The main findings of the survey were related to workload and limited (...) time for nursing care. Six themes emerged from the in‐depth interviews: (1) limited time for nursing, (2) feelings of burnout, (3) awareness of patient and family satisfaction, (4) organizational factors that favor nurses' needs, (5) organizational factors that hinder nurses' needs, and finally (6) public administration requirements. Participants perceive excessive workload and time constraints and feel that this affects their nursing care and their physical and mental health. However, nurses purposefully use knowledge patterns to cope with the problems associated with commodification. Nurses have multidimensional, contextualized, and integrated knowledge that allows them to optimize their care based on the needs of their patients. This research examines many challenges related to nursing practice and the nursing discipline and opens the door for further research that encompasses all areas of nursing. (shrink)

The result of the author's extensive practical experience: a decade in computer process control using large scale systems, another decade in machine pattern-recognition for vision systems, and nearly a decade dealing with artificial intelligence and expert systems. However, it is with Francis Bacon that its function and scope are first recognized – as a preliminary stage in the attainment of knowledge, and as an epistemological tool (a rule) for achieving true knowledge. In this paper, I follow the various steps of construction and use of Baconian doubt as it appears in the first book of the New Organon. I will argue that Bacon - in distancing himself from (...) traditional scepticism – will come to conceive methodical doubt not only as a procedure for renovating knowledge, but more specifically as a prescriptive condition for identifying what 'mind' is required to pursue the aim of renovating knowledge. Summary Covert encoding is one of the strategies available to languages for the encoding of motion, in which, in accordance with the laws of Gestalt, the meaning of an expression encoding motion is not coincident with the mere sum of the meanings of each of its constitutive units, relying on the mediation of grammatical and co(n)text­established knowledge for its interpretability. Moving on from a data set gathered for a previous study and adopting a holistic, constructional approach, several strategies were (...) found in a diachronic corpus of Italian, French and Spanish for the covert encoding of motion in such languages, based on whether the motion­interpretation attributed to the covert construction is mediated by either linguistic or extralinguistic knowledge. The diachronic investigation also showed that the use of such patterns is diachronically consistent in frequency, thus proving that such patterns of interaction between language and cognition may be regarded as functional for speakers of all languages and time stages, also confirming that a holistic, constructional approach to language study can help shed light on linguistic–cognitive phenomena on the basis of language variation and change. The article proposes that the objects of study in the social sciences are built into routines of interactions that we named interpretative communities. These adopt different qualities from those of an interview, because they are beyond the negotiations and agreements established by individuals to point out their positions in the development of knowledge. Moreover, from the perspective of interpretive communities, it becomes possible to identify biases that occur in the absence of epistemological vigilance in the task of specifying the (...) theoretical objects to achieve interpretive models, and promotes the use of reflexivity in community processes that report ontological security and reintegrate daily life. To develop these arguments a narrative axis is presented of the social scientist movements from a methodical solipsism towards a collective construction of knowledge. On this trajectory, life story helps to broaden the interview, also the dialogue facilitates the recognition of operational consensus that secures a sense of belonging and opens up the possibility to review the community appropriation by two perspectives, one of the subject co-producer of knowledge and one of the operating groups. El artículo propone que los objetos de estudio en las ciencias sociales se construyen dentro de rutinas de interacciones denominadas comunidades interpretativas, las cuales adoptan calidades distintas a las de una entrevista porque están más allá de las negociaciones y acuerdos que establecen los individuos para precisar sus posiciones en la elaboración de conocimientos. Además, desde la perspectiva de las comunidades interpretativas se hace posible identificar los sesgos que se producen por la ausencia de la vigilancia epistemológica en la tarea por especificar los objetos teóricos para lograr modelos interpretativos, y se promueve el uso de la reflexividad en los procesos comunitarios que reportan seguridad ontológica y reintegran el mundo de la vida. Para desarrollar estos argumentos se fija un eje narrativo en los desplazamientos del científico social desde un solipsismo metódico hacia la construcción colectiva de conocimiento. En su trayecto la historia de vida ayuda a ampliar la concepción de la entrevista y el tratamiento del diálogo facilita el reconocimiento de los consensos operativos que fijan un sentido de pertenencia y abren la posibilidad para revisar su apropiación comunitaria mediante dos perspectivas, la de los sujetos coproductores de conocimiento y la del grupo operativo. Constructing energy scenarios is traditionally an endeavour driven by experts. I suggest that an outcome of relying solely on expertise is incompleteness. Moreover, expertise, while being a necessary condition, is not a sufficient condition for epistemic quality and normative legitimacy of energy scenarios given the scope of transitions that energy scenarios entail, which includes substantial societal repercussions. Four reasons will be provided for wide participation when constructing energy scenarios. First, there are several forecasting shortcomings of top-down approaches. Second, to rely (...) solely on expertise provides incomplete conceptualizations of energy and central concepts such as ‘smartness’, in addition to neglecting normative views. Third, increased epistemic quality is an outcome of wide participation. A fourth reason is derived from the argument of inductive risks, stating that thresholds of evidence should reflect the potential outcomes if erroneously corroborating or rejecting a hypothesis.
