As functional magnetic resonance imaging becomes more precise and the data more extensive, neuroscientists like Kent Kiehl are raising the possibility that such research might someday, together with existing clinical assessment tools, increase our ability to predict the likelihood that a given convict will commit another crime after getting out of prison. Such an advance would provoke challenging questions about our notions of liberty and personal autonomy, with potentially chilling ramifications.

This investigation was designed to evaluate a new dream content measure, the Casto Spirituality Scoring System. Therefore, our research question was: "Can the spiritual content of dream reports be identified and measured?" We randomly selected 20 male and 20 female dream reports obtained in dream seminars in each of six countries. We added 20 dream reports from one U.S. female and one U.S. male undergoing "spiritual development" programs. Of the 280 dream reports in our collection, 59 contained spiritual content, according (...) to our definition of "spiritual" as one's focus on, and/or reverence, openness, and connectedness to something of significance believed to be beyond one's full understanding and/or individual existence. The research question was answered affirmatively in so far as the Casto Spirituality Scoring System yielded high reliability when the scores of two judges, working independently, were compared. The article proposes a framework for the analysis of identity as produced in linguistic interaction, based on the following principles: identity is the product rather than the source of linguistic and other semiotic practices and therefore is a social and cultural rather than primarily internal psychological phenomenon; identities encompass macro-level demographic categories, temporary and interactionally specific stances and participant roles, and local, ethnographically emergent cultural positions; identities may be linguistically indexed through labels, implicatures, stances, styles, or linguistic structures and systems; (...) identities are relationally constructed through several, often overlapping, aspects of the relationship between self and other, including similarity/difference, genuineness/artifice and authority/ delegitimacy; and identity may be in part intentional, in part habitual and less than fully conscious, in part an outcome of interactional negotiation, in part a construct of others’ perceptions and representations, and in part an outcome of larger ideological processes and structures. Drawing on sources such as home furnishing manuals, hygiene and household guidebooks, as well as literary texts, this article examines how the nineteenth-century domestic interior can be regarded as a functional environment regulated by textiles. In the debate about the correct usage of furnishing textiles in line with contemporary aesthetic and sanitary standards, women were held responsible for regulating these textile environments. While on the one hand this led to a supposedly natural and mechanical conflation of women and domestic space (...) which has often been interpreted as restrictive and encapsulating, my aim is to identify a specific feminine agency that has its origin in the home but is not limited to it. By tracing the negotiations of this gendered textile expertise in different fields of knowledge and forms of representation, this article reevaluates the relationship between textiles, domesticity and femininity in the nineteenth century. ZusammenfassungIn diesem Artikel wird untersucht, inwiefern Textilien in den einrichtungstheoretischen, medizinisch-hygienischen und literarischen Auseinandersetzungen mit dem Wohnen im 19. Jahrhundert als funktionale Umgebungen des Lebendigen entworfen werden. Damit sind zugleich geschlechtliche Zuschreibungen verbunden, die die Frau als Verantwortliche für die Regulierung dieser textilen Umgebungen ausmachen. Während es so einerseits zu einer naturalisierenden und mechanisierenden Überblendung von Frau und Wohnraum kommt, ist mit der Verwissenschaftlichung und Technisierung des Wohnens andererseits eine weiblich konnotierte Expertise verbunden, die nicht allein auf den Innenraum des (...) Hauses begrenzt ist. Der Artikel nimmt die Verhandlungen textiler Expertise und Gestaltungsmacht in unterschiedlichen Wissensbereichen und Darstellungsformen in den Blick, um das Verhältnis von Textilien, Wohnen und Weiblichkeit im 19. This Article discusses BLAs as tools of global labor migration governance, with a specific focus on gender. Drawing on our global database of 582 bilateral labor migration agreements, we investigate the extent to which these governing instruments connect and align with relevant international normative frameworks, in particular the extent to which they represent gains, gaps or gaffs in terms of gender equality and the human and labor rights protection of women migrants. In the context of the Global Compact for Safe, (...) Orderly and Regular Migration, which stresses a gender-responsive approach to migration governance as one of its guiding principles, we ask: Do the BLAs which are increasingly being used as instruments to govern labor migration contribute toward sustainable gender equality, decent work and reduced inequalities for women and gender-diverse migrants? Corporeality of human beings should be taken seriously and be included in their self-understanding as the ‘nature we are ourselves’. Such an ecophenomenological account has important normative implications. Firstly, I argue that the instrumental value of nature can be particularly well justified based on an ecophenomenological approach. Secondly, sentience is inseparable from corporeality. Therefore, insofar as it is a concern of the ecophenomenological approach to take corporeality and its implications seriously, sentient beings deserve direct moral consideration. Thirdly, it can strengthen (...) the so-far underestimated category of eudaimonic values of nature, which can be best developed through an ecophenomenological reconstruction. Taken together, ecophenomenology is vital for environmental ethics and helps us to leave behind its widespread ‘centrism’. In this article, we critically scrutinize the principle of proportionality when used in the context of security and government surveillance. We argue that McMahan’s distinction from just warfare between narrow proportionality and wide proportionality can generally apply to the context of surveillance. We argue that narrow proportionality applies more or less directly to cases in which the surveilled is liable and that the wide proportionality principle applies to cases characterized by ‘collateral intrusion’. We argue, however, that a more demanding criterion (...) than the lesser-evil justification that wide proportionality frequently entails is necessary in cases characterized by intentional intrusion upon non-liable individuals. The distinction between foreseeing and intending intrusion into the lives of individuals who are not liable has not previously been specifically addressed in discussions concerning surveillance ethics. This specification is thus increasingly important due to the general growing tendency for adherence to the precautionary principle and policies aimed at anticipating criminal acts before they are committed. Preventive surveillance of non-liable actors is considered an important instrument for obtaining this aim and thus calls for moral scrutiny in terms of permissibility and proportionality. We suggest the concept ‘wide proportionality +’ which applies to cases of intentional intrusion of non-liable individuals. (shrink)

Employment is critical for refugees’ positive integration into a receiving country. Enabling employment requires cross-sector collaborations, that is, employers collaborating with different stakeholders such as refugees, local employees, other employers, unofficial/official supporters, and authorities. A vital element of cross-sector collaborations is trust, yet the complexity of cross-sector collaborations may challenge the formation and maintenance of trust. Following a theory elaboration approach, this qualitative study with 37 employers and 27 support workers in Germany explores how employers’ experiences in cross-sector collaborations on (...) refugees’ labor market integration affect their trust in other stakeholders in this cross-sector space. Specifically, we explored employers’ perceptions of trust breaches, and how these perceptions affect their further engagement in cross-sector collaborations on refugee integration. Based on our findings, we propose a process model that describes how unmet collaboration expectations and negative assessments of collaborators’ attitudes and behaviors lead to perceived trust breaches which, in turn, lead to employers’ hesitancy to hire refugees and/or to engage in cross-sector collaborations. In doing so, we extend existing theory on trust within organizations to the cross-sector context of refugee integration, uncovering context-specific meanings to trustworthiness dimensions and illustrating how breaches of different trustworthiness dimensions can interact. Moreover, we show how social policies, resources, and trustors’ perceived vulnerability in collaborations shape their risk perceptions. This study highlights the central role of trust for refugee integration and illustrates how missing goals and process clarity endanger sustainable collaborations. (shrink)

Following Searle's procedure, I first address his argument that altruistic reasons for action inhere in the concept of rationality, and then examine his argument for his more general thesis. I conclude that a viable theory of rational action would be centered, not on (...) the concept of desire-independent reasons, but rather on the concept of rational desire. (shrink)

"Reductionism," in this context, is the view that the right to privacy necessarily depends on and derives from more fundamental rights, primarily liberty and property, and that this reduction has important normative implications for the law. Judges and scholars have articulated versions of reductionism for about a century, and yet, since the time of the seminal Pavesich opinion, none of these views has influenced the law. ;In this thesis, I offer a new version of reductionism. I start by examining the (...) original debate concerning the existence of a right to privacy, triggered by the seminal law review article by Warren and Brandeis. I argue that this debate was not resolved in favor of such a right until Justice Cobb, in Pavesich, offered a justification for it based on fundamental political principles. I next examine the debate between the contemporary reductionists Prosser, Thomson, and Posner, and their critics. I demonstrate that reductionists have not learned the lesson implicit in the original debate: if one hopes to gain influence in the area of privacy law, he must justify his theory on the basis of fundamental political principles. Finally, I offer a more coherent and defensible reductionist view, one based on Ayn Rand's theory of individual rights. I use my reductionist theory to explain why certain undesirable outcomes are inherent in privacy law as it currently exists, recommend a return to a jurisprudence of property and liberty, and indicate a method of implementing this recommendation. This article focuses on the early years of children from immigrant families in Germany. Research has documented disparities in young children’s development correlating with their family background, making clear the importance of early intervention. Institutional childcare—as an early intervention for children at risk—plays an important role in Germany, as 34.3% of children below the age of three and 93% of children above that age are in external childcare. This paper focuses on the extent to which children from families with a (...) background of migration differ in their social development when considering their age of entry into early external childcare. Data from the infant cohort study of the German National Educational Panel Study is used to analyze the impact of early institutional childcare before the age of 3 years on children’s social competence at the age of 5 years, controlling for gender, siblings, temperament, home learning activities, and socioeconomic status. Results show the effects of duration of early external childcare on peer problems for children from families with a background of migration, in such a way that children who attend early external childcare for more than 1 year before the age of three show less problem behavior with peers than those who attend for less than a year. These findings have equity implications for children with a migration background living in Germany, especially as the proportion of these children is trending upwards. (shrink)
