Republicanism is an approach within political theory that seeks to secure the values of political liberty and non-domination. Yet, in historical practice, early modern republics developed empires and secured their liberty through policies that dominated others. This contradiction presents challenges for how neo-Roman theorists understand ideals of liberty and political freedom. This article argues that the historical practices of slavery and empire developed concurrently with the normative ideals of republican liberty. One of the most distinctive rituals of Roman imperial accession was the adlocutio, the speech delivered by the new emperor to a military assembly, which can be documented from the first to the fifth centuries a.d. This article seeks to explain the extraordinary endurance of this neglected genre of speech by examining its origins, setting and content. After outlining the unusual nature of the accession adlocutio when set against both earlier and contemporary Mediterranean practice, the first half of this article (...) traces its origins to the military culture of the late Roman Republic. In particular, the adlocutio is related to two other rituals which rose to new prominence in the era of the Civil Wars: the acclamation of the victorious general as imperator and the granting of military gifts. In the second part of this article, the setting for the typical adlocutio of the Imperial era is discussed using the often-problematic evidence of our ancient historical sources. The content of the speech itself is then reconstructed primarily through a close reading of our one surviving example, the brief address of Leo I preserved by Peter the Patrician. Finally, the evidence for the origins and content of the speech are brought together in an argument for the speech's survival as a useful tool for emperors seeking to establish a permanent bond with the soldiers they commanded. The early nineteenth century was a time between empires in German-speaking lands, following the collapse of the holy Roman empire in 1806. This was also the time at which modern concepts of nations, nationalism, and the state entered theological discourse, bound together with emerging notions of world historical progress. From this time until the First World War, the task of conceptualizing national identity and the nature of the ‘Christian state’ became a pressing theological problem. This essay seeks to locate Schleiermacher’s (...) reflections on the Christian state within this developing problematic. Schleiermacher’s philosophical and theological works closely engaged emerging ideas of the nation, state, and historical progress. However, he departed from the more totalizing affirmations of national spirit and the Christian state of many of his contemporaries, arguing for a more limited conception of the state as a point of transition in the ongoing historical development of the reign of God. Several recent attempts to develop models of moral reasoning have attempted to use some form of casuistry as a way to resolve the moral controversies of clinical ethics. One of the best known models of casuistry is that of Jonsen and Toulmin who attempt to transpose a particular model of casuistry, that of Roman Catholic confessional practice, to contemporary moral disputes. This attempt is flawed in that it fails to understand both the history of the model it seeks to transpose (...) and the morally pluralistic context of secular, postmodern society. The practice of casuistry which Jonsen and Toulmin wish to revive is a practice set in the context of a community with a shared set of moral values and structures of moral authority. Without a set of common moral values and rankings, and a moral authority to interpret cases the casuistry of the postmodern age will be pluralistic; that is, there will be many casuistries not just one. Robert Coover’s Novel, The Public Buming, merges fantasy, history, and popular myth to respond to the American Cold War culture surrounding the trial of Ethal and Julius Rosenberg. While serving as a postmodern response to, and rewrite of, the Cold War ideological narratives, Coover’s novel also raises theoretical and practical questions concerning the author’s agency in the twentieth century. This article makes use of the language theories of Bruce Andrews, Mikhail Bakhtin, and Charles Peirce to consider how Coover’s fiction addresses (...) the conflict between the public and private self, authorial discourse and collective ideological discourse. Coover’s novel reflects on these tensions, foregrounding the erosion of an autonomous concept of self and a Romantic notion of autotelic creation. Beginning with the complexities involved in the definition of the modern European Community identity, the author proceeds to examine the historical dimensions of the development of Europe as a continent. The Roman and Greek antecedents are recognised and the emergence of Constantinople as a pivotal consideration is discussed. By the early 16th century, what Europe meant is explained in more comprehensive terms than those that prevail today. The unity of Christendom under the papacy is identified as germane to the political (...) unity of Europe as a continent. The Reformation unleashed a process of disintegration and division into national and religious states that has taken centuries to begin to heal. Recognising the failure of modern European structures to secure cohesion among its member countries, the article recognises an attempt to develop unity in diversity: based on the notion of economic collaboration berween trading cities. This notion was very much a feature of the Hanseatic League of the middle-ages, and indeed a founding principle of the Greek city confederacy. History remains a potent and pertinent dimension in our understanding of Europe as a continental concept. (shrink)

Against the background of some positions taken up in a recent document of the Pontifical Biblical Commission, the article studies Raymond Brown’s attempt to combine mainstream historical‐critical exegesis of the Bible with a Roman Catholic theological pre‐understanding. Particular reference is made to his handling of issues connected with the virginal conception of Jesus. Some of his religious presuppositions such as those concerning the relation between faith and reason, and the development of doctrine, are presented. Biblical criticism in Brown’s understanding is (...) an essentially historical discipline which has as its principal object the literal sense of the text, that is, what the text meant when it was written. His religious presuppositions make the practice of the discipline ineliminable in an integral hermeneutic. From an analysis of his treatment of the virginal conception, it is argued that Catholic pre‐understanding and historical criticism, when combined, inevitably result in a two‐stage hermeneutic. In a first stage appeal is made to presuppostions common to all practitioners of historical criticism. In a second stage religious presuppostions come into play. The distinction between these two stages is seen as more fundamental than Brown’s better known distinction between the literal and more‐than‐literal senses of the text. It is argued that the relation between the two stages is to be understood in chalcedonian terms as exemplifying the dialectic of faith and reason: they must be distinguished, but cannot be separated. Brown’s grasp of an incarnational economy of salvation is presented in terms of David H. Kelsy’s concept of a discrimen, and emerges as fundamental for an ecclesial hermeneutic of the Bible. Questions about the place of the historical‐critical method, the promise of alternative approaches and the role of hermeneutical theory can only be adequately addressed in terms of it. (shrink)

An examination of traditional sources for the Roman Catholic under-standing of marriage reveals that the ends of marriage might be ordered differently, given different contexts. This permits one working within that tradition to see marriage as a political and cultural entity existing independently of the individuals who participate in it. Marriage is also the standard with respect to which sexual activity is judged to be proper or not, a standard that applies to all human beings by virtue of their rational (...) nature. Understanding this allows one to understand how some people, including some of the mentally handicapped, might legitimately be prevented from marrying and even from engaging in genital sexual activity. It also allows one to solve some theoretical difficulties regarding contraception and homosexuality and connected with the fact that sterile couples cannot procreate and yet are permitted to marry. In 1993, Pope John Paul II issued his encyclical letter Veritatis Splendor, which addresses issues in fundamental moral theology. The encyclical must be understood against the background of ongoing debates since Pope Paul VI's 1968 encyclical on birth control (Humanae Vitae). It is not clear what the impact of Veritatis Splendor will be. (...) In the third century AD, under the pressure of plagues, external invasion, rising army costs, and usurpation, the Roman emperors incrementally debased the silver coinage that was produced at their imperial mints and incrementally took over civic mints. The debasement, from 2.7 g of silver to 0.04 g of silver in the equivalent of a denarius from 160–274 ad, was accompanied by worries from emperors, mint-workers, and bankers about the value of the currency; however, the total loss of purchasing power (...) of the Roman coinage from the same era was 50–70 %, far less than would be expected from the change in metallic content, if it were the primary source of value. The currency reform of Aurelian in 274 ad, despite raising metallic values of coins, was followed by at least a 90 % reduction in the purchasing power of the silver coinage from 274–301 ad, the year of Diocletian’s Edict on Maximum Prices, showing a paradoxically inverse relationship between metallic value and purchasing power. Based on this quandary, I argue that the Roman silver coinage of the third century CE became a fiat currency in some respects, deriving its guarantee from imperial iconography and assurances rather than from bullion value. The fiat nature of the silver coinage was largely present in usage as a medium of exchange for those without as much long-term interest in maintaining liquid stores of value; this is indicated by the differential debasement of the denarius and aureus; imperial actions and hoarding practices indicate the extent to which the currency was accepted at nominal value. I examine the reactions of different social groups in order to determine the perceived value of the Roman coinage during this time, and in order to understand the paradoxical collapse in the currency’s value in the late third century. To demonstrate this, I will present the applicable elements of the modern concept of “fiat” to this context through portrayal of emperors and usurpers on coins, use coin hoard data to determine the effect of Gresham’s Law, and examine historical and papyrological accounts of currency reforms. I will also use evidence of the expansion of taxes in kind and the rejection of nominal value by both emperor and subjects to argue that the inflation following Aurelian’s reform resulted from an invalidation of the trust in imperial fiat. Se analizan primero los conceptos de memoria e historia, y la forma como el Holocausto transformó sus tareas en el siglo xx; luego se examinan dos modelos de responsabilidad propuestos por Iris Marion Young, y se propone cómo usarlos en la justicia transicional. The Lewis-Sider argument from vagueness is one of the most powerful objections against restricted composition. Many have resisted the argument by rejecting its key premise, namely that existence is not vague. In this paper, I argue that this strategy is ineffective as a response to vagueness-based objections against restricted composition. To that end, I formulate a new argument against restricted composition: the argument from determinate vagueness. Unlike the Lewis-Sider argument, my argument doesn’t require accepting that existence is not vague, but (...) only that it is not vague in a specific way, which, I argue, is entailed by restricted composition. I show that the rejection of this species of vague existence follows from assumptions even friends of vague existence should be happy to accept. (shrink)

Colombia es el país donde por primera vez se legisló sobre eutanasia en América Latina y el Caribe, en el sentido de despenalizar o legalizar su práctica. La novedad del caso colombiano está en la vía jurídica mediante la cual se despenalizó el “homicidio por piedad”, denominación tipificada en el Código Penal para la eutanasia. Como se explicará en el capítulo correspondiente, la eutanasia en Colombia se despenaliza mediante una sentencia de la Corte Constitucional, máximo organismo del poder judicial del (...) país, sin pasar antes por el Congreso de la República (rama legislativa). Este artilugio jurídico fue el mismo que se utilizó en los EUA, en la década del setenta del siglo pasado, para hacer ver el aborto como si fuera un derecho derivado de la Constitución (caso Roe vs. Wade), que sin embargo fue corregido por la misma Corte Suprema de ese país en 2022. En la sentencia Dows vs. Jackson se indica que el aborto no es un derecho constitucional y que los organismos judiciales no son competentes para regular sobre esa materia y sobre otras análogas. Una de ellas es la eutanasia. Luego de una introducción donde se expone parte de la historia de la eutanasia, se pasa a la terminología relacionada con ella. Algunos argumentos a favor de la eutanasia son examinados para mostrar lo que hay detrás de cada uno y concluir por qué su práctica no es una buena idea. En la parte central del libro se hace una reflexión sobre la valoración ética que se puede hacer del acto eutanásico. Posteriormente se ofrecen unas reflexiones sobre la cultura de la muerte, pero sobre todo del sentido que el sufrimiento puede tener para el ser humano. Antes de las conclusiones el lector encontrará dos ensayos sobre la eutanasia en el mundo y en Colombia, que procuran aportar datos para una mejor comprensión de la situación. En el último capítulo se incluye un estudio breve sobre lo que dicen las religiones de la eutanasia. Las conclusiones se aprovechan para mostrar cómo la medicina paliativa y los cuidados paliativos son el mejor recurso médico que hace innecesario el que alguien pueda plantearse la aplicación de la eutanasia. La línea divisoria entre lo bueno y lo malo está cada vez más difuminada, pero lo más grave está en que pareciera que esta circunstancia no interesa mayormente a ningún estamento, ni al público en general. La narcosis sobre la bondad o maldad lleva a acciones poco razonadas, pero sí muy cargadas de emotividad y sentimiento; parecería que lo más importante es lo que “se siente” y no lo que se puede pensar. Las filosofías de la modernidad y la posmodernidad (...) han contribuido al olvido de algunos conceptos clave que se ve necesario recordar: bien, libertad, finalidad, naturaleza, ley natural, hábitos, sindéresis. Sobre este último hábito innato se hace una corta reflexión descriptiva y se propone volver a ponerlo en la intencionalidad educativa, pues se juzga que sus beneficios son insoslayables para estructurar del acto humano y hacer mejor su valoración ética. Se concluye que la sindéresis, como hábito de los primeros principios del intelecto práctico, facilita la acción para orientar al ser humano a los bienes verdaderos, conformes a su naturaleza; propicia la integración que se da en el acto libre entre la inteligencia y la voluntad; y puede intervenir también en la tarea de hacer valoraciones éticas en cada una de sus etapas: dando claridad al objeto del acto, calibrando la legitimidad de la intención y evaluando las circunstancias en el contexto global de la acción. We provide two programmatic frameworks for integrating philosophical research on understanding with complementary work in computer science, psychology, and neuroscience. First, philosophical theories of understanding have consequences about how agents should reason if they are to understand that can then be evaluated empirically by their concordance with findings in scientific studies of reasoning. Second, these studies use a multitude of explanations, and a philosophical theory of understanding is well suited to integrating these explanations in illuminating ways.

Models are of central importance in many scientific contexts. The centrality of models such as inflationary models in cosmology, general-circulation models of the global climate, the double-helix model of DNA, evolutionary models in biology, agent-based models in the social sciences, and general-equilibrium models of markets in their respective domains is a case in point (the Other Internet Resources section at the end of this entry contains links to online resources that discuss these models). Scientists spend significant amounts of time building, (...) testing, comparing, and revising models, and much journal space is dedicated to interpreting and discussing the implications of models. Issues of institutional identity and integrity in Roman Catholic health care institutions have been addressed at the level of individual institutions as well as by organizations of Catholic health care providers and at various levels in the Church hierarchy. The papers by Carol Taylor, C.S.F.N, Thomas Shannon, Kevin O’Rourke, O.P., Gerard Magill in this volume provide a significant contribution to concerns of Roman Catholic health care institutions as they face the challenges of providing health care in a secular, pluralistic, (...) market-driven economy. One way to understand institutional integrity is as a measure of the coherence between what an institution identifies as its commitments (its stated moral character), what an institution does (its manifest moral character) and an institution’s fundamental moral commitments (its deep moral character). The essays in this volume support this model of integrity. Although it is not their explicit focus, the four essays together provide a vision of institutional integrity for Catholic health care institutions. Each author focuses on one of the three central aspects of integrity: what one identifies as one’s commitments (Taylor), how one's actions reflect one’s values (Shannon and Magill), and what one is or what one values at a deep level (O’Rourke). I will offer a brief overview of the ways in which the integrity of Catholic health care institutions has been addressed. Then I will consider the four essays and show how each offers an analysis of one of the three critical elements of integrity. (shrink)

La "posición original" es un aspecto fundamental de la teoría de la justicia de John Rawls, así como el concepto del "velo de ignorancia". El análisis se divide en tres momentos: en el primero, se expone la posición original de Rawls, en el segundo se contrasta la teoría de la razonabilidad de Scanlon con el papel que tiene la razonabilidad en la teoría de Rawls y en el tercero se exploran los señalamientos de Habermas y Benhabib al velo de ignorancia.

Although several important methodologies implicitly assume the truth of epistemic conservatism, the view that holding a belief confers some measure of justification on the belief, recent criticisms have led some to conclude that epistemic conservatism is an implausible view. That conclusion is mistaken. In this article, I propose a new formulation of epistemic conservatism that is not susceptible to the criticisms leveled at earlier formulations of epistemic conservatism. In addition to withstanding these criticisms, this formulation of epistemic conservatism has several (...) benefits. First, this formulation has the benefits of earlier formulations of epistemic conservatism, that is to say it makes sense of our intuitions about justification in regard to both memory beliefs and beliefs for which we have forgotten our evidence. Second, it provides a good way of responding to the skeptic’s challenge concerning the possibility of possessing knowledge of the external world posed by the Alternative Hypotheses argument. Third, it provides responses to both forms of a new skeptical problem plaguing basic knowledge structure theories, the Problem of Easy Knowledge formulated by Stewart Cohen. I argue that given the many benefits of this formulation of epistemic conservatism and the fact that it is not vulnerable to the criticisms that undermine earlier formulations of epistemic conservatism, this formulation of epistemic conservatism is a plausible view to maintain. This paper investigates the semantics of implicit comparatives (Alice is tall compared to Bob) and its connections to the semantics of explicit comparatives (Alice is taller than Bob) and sentences with adjectives in plain positive form (Alice is tall). We consider evidence from two experiments that tested judgments about these three kinds of sentence, and provide a semantics for implicit comparatives from the perspective of degree semantics.

It is a commonplace that liberalism and religious belief conflict. Liberalism, its proponents and critics maintain, requires the privatization of religious belief, since liberals often argue that citizens of faith must repress their fundamental commitments when participating in public life. Critics of liberalism complain that privatization is objectionable because it requires citizens of faith to violate their integrity. The liberal political tradition has always sought to carve out social space for individuals to live by their own lights. If liberalism requires (...) citizens to violate their integrity, liberals have cause for concern. I seek to rebut this integrity objection to liberalism. I focus on the dominant form of philosophical liberalism: public reason liberalism. I argue that the integrity objection undermines the mainstream conception of public reason liberalism, but not public reason liberalism itself. The paper opens by outlining the structure of public reason liberalism and the integrity objection (§§2 and 3). It then analyses two versions of the objection and argues that the second version is successful against the mainstream conception of public reason (§4). I argue in response that public reason liberalism need not endorse principles of restraint—the civic restrictions on religious expression typically associated with it. I then sketch a conception of public reason liberalism that eschews principles of restraint (§5). This alternative promises to reconcile public reason liberals and their faith-friendly critics by putting the integrity objection to rest. (shrink)

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

You can perceive things, in many respects, as they really are. For example, you can correctly see a coin as circular from most angles. Nonetheless, your perception of the world is perspectival. The coin looks different when slanted than when head-on, and there is some respect in which the slanted coin looks similar to a head-on ellipse. Many hold that perception is perspectival because you perceive certain properties that correspond to the “looks” of things. I argue that this view is (...) misguided. I consider the two standard versions of this view. What I call the PLURALIST APPROACH fails to give a unified account of the perspectival character of perception, while what I call the PERSPECTIVAL PROPERTIES APPROACH violates central commitments of contemporary psychology. I propose instead that perception is perspectival because of the way perceptual states are structured from their parts. (shrink)
