Problems arise when applying the current procedural conceptualization of decision-making capacity to paediatric healthcare: Its emphasis on content-neutrality and rational cognition as well as its implicit assumption that capacity is an ability that resides within a person jeopardizes children’s position in decision-making. The purpose of the paper is to challenge this dominant account of capacity and provide an alternative for how capacity should be understood in paediatric care. First, the influence of developmental psychologist Jean Piaget upon the notion of capacity (...) is discussed, followed by an examination of Vygostky’s contextualist view on children’s development, which emphasizes social interactions and learning for decision-making capacity. In drawing parallels between autonomy and capacity, substantive approaches to relational autonomy are presented that underline the importance of the content of a decision. The authors then provide a relational reconceptualization of capacity that leads the focus away from the individual to include important social others such as parents and physicians. Within this new approach, the outcome of adults’ decision-making processes is accepted as a guiding factor for a good decision for the child. Integrative social contracts theory is a novel approach to normative questions and has been widely evaluated, discussed, and applied by academics and practitioners alike. While the "I" in ISCT leads the title, it has not received the analytical attention it deserves, especially since the "integrative" component in ISCT is multifaceted and at the conceptual core of the theory. In this paper we therefore take a closer look at two facets of integration. First, we examine the normative integration that takes place (...) in ISCT. For our analysis we draw on theories of legitimacy and obligation. Second, given that empirical inquiry is an important part of the normative integration, we take a closer look at how research that has applied or used ISCT has embraced the empirical components of the theory. Markets, corporations, shareholding, management, law, and ethics are all human constructs. A human element seems essential to their existence. Yet, the predominant conception of shareholders as used in academia as well as the business world is thin, generic, and inanimate. This article argues that a thick conception of shareholders as human beings is needed to legitimize and improve managerial decision making under value pluralism, accurately reflect empirical reality of capital markets, and meet moral demands to respect the dignity of the (...) human person. Drawing on the philosophical idea of thick evaluative concepts, the article explores how this idea can be applied to shareholders and begins to examine some of the implications of considering shareholders’ humanity for the responsibilities of and relationships between managers and shareholders. A common method for warranting the historical adequacy of philosophical claims is that of relying on historical case studies. This paper addresses the question as to what evidential support historical case studies can provide to philosophical claims and doctrines. It argues that in order to assess the evidential functions of historical case studies, we first need to understand the methodology involved in producing them. To this end, an account of historical reconstruction that emphasizes the narrative character of historical accounts and (...) the theory-laden character of historical facts is introduced. The main conclusion of this paper is that historical case studies are able to provide philosophical claims with some evidential support, but that, due to theory-ladenness, their evidential import is restricted. Relativism is often motivated in terms of certain types of disagreement. In this paper, we survey the philosophical debates over two such types: faultless disagreement in the case of gustatory conflict, and fundamental disagreement in the case of epistemic conflict. Each of the two discussions makes use of a implicit conception of judgement: brute judgement in the case of faultless disagreement, and rule-governed judgement in the case of fundamental disagreement. We show that the prevalent accounts work with unreasonably high levels (...) of idealization. We defend two claims. First, philosophical discussions of disagreement need to be de-idealized. Second, once a less idealized account of disagreement is available, both our conception of judgement and our understanding of relativism need to be revised. Our example is a case study in the Sociology of Scientific Knowledge: Steven Shapin and Simon Schaffer’s classic Leviathan and the Air-Pump. This case study gives a less idealized account of disagreement that conceptualizes judgements as situated. We argue that this conception can and should be applied to cases of gustatory and epistemic disagreement. The payoff will be a reformulation of relativism in terms of rationally resolvable yet contingent disagreements. (shrink)

The pragmatic inquiry process used in the Corporantes Pathfinder Notebook (CPN) enables students and others to discern their gifts, find purpose and direction in their lives, and seek a FIT between their values and various corporate cultures before making extensive commitments in their field of studies and their employment. Based on Peirce''s theory of Pragmatism the CPN fosters investigation, interpretation, and action resulting from reflected narratives written in response to a series of questions in the CPN. The CPN was used (...) successfully as a framework in a Business Ethics course for connecting career decisions to their personal lives. Other pedagogic activities were used such as case studies, role playing, service learning, team projects investigating ethical climates of corporations, as well as Socratic questioning and discussions of moral dilemmas to develop ethical sensitivity and understanding of ethical challenges and decisions. The CPN also has been used successfully by senior executives in over fifty applications. (shrink)

This paper presents a survey of the literature on the problem of contingency in science. The survey is structured around three challenges faced by current attempts at understanding the conflict between “contingentist” and “inevitabilist” interpretations of scientific knowledge and practice. First, the challenge of definition: it proves hard to define the positions that are at stake in a way that is both conceptually rigorous and does justice to the plethora of views on the issue. Second, the challenge of distinction: some (...) features of the debate suggest that the contingency issue may not be sufficiently distinct from other philosophical debates to constitute a genuine, independent philosophical problem. And third, the challenge of decidability: it remains unclear whether and how the conflict could be settled on the basis of empirical evidence from the actual history of science. The paper argues that in order to make progress in the present debate, we need to distinguish more systematically between different expressions that claims about contingency and inevitability in science can take. To this end, it introduces a taxonomy of different contingency and inevitability claims. The taxonomy has the structure of an ordered quadruple. Each contingency and each inevitability claim contains an answer to the following four questions: (how) are alternatives to current science possible, what types of alternatives are we talking about, how should the alternatives be assessed, and how different are they from actual science? Abstractabstract:This paper revisits debates on a tension in Cassirer's philosophy of culture. On the one hand, Cassirer describes a plurality of symbolic forms and claims that each needs to be assessed by its own internal standards of validity. On the other hand, he ranks the symbolic forms in terms of a developmental hierarchy and states that one form, mathematical natural science, constitutes the highest achievement of culture. In my paper, I do not seek to resolve this tension. Rather, I aim (...) to arrive at a better understanding of how it arises, and of the different options that it presents for understanding the development of culture. I discuss three recent attempts at resolving the tension, put forward by Sebastian Luft, Samatha Matherne, and Simon Truwant, respectively. Based on a reconstruction of Cassirer's system of symbolic forms that centralizes the concept of function, I show that the most promising of these attempts, formulated by Truwant, is not successful. I then turn to Cassirer's philosophy of the cultural sciences, the implications of which for the present problem have not yet been sufficiently explored. I argue that in this context, Cassirer develops the contours of an alternative to the function-based view of cultural development. I conclude that this alternative does not resolve the tension either, but that it allows for a reconceptualization of the teleology of culture as open. (shrink)

Background: Pediatric guidelines recommend that children and adolescents participate in a developmentally appropriate way in end-of-life decision making. Shared decision making in pediatrics is unique because of the triadic relationship of patient, parents, and physician. The involvement of the patient may vary on a continuum from no involvement to being the sole decision maker. However, the effects of child participation have not been thoroughly studied. The aims of this literature review are to identify studies on end-of-life decision making in pediatrics, (...) to explore patient participation, and to assess the effects of such participation. Methods: Five databases—PubMed, PsycInfo, Medline, CINAHL, and Sociological Abstract—were searched for empirical studies on end-of-life decision making in pediatrics. Selected articles fulfilling the criteria were assessed for type of decision, participants’ characteristics, reports on participation of the minor patient, and outcome. Results: Fifty-seven articles on end-of-life decision making in pediatrics were identified. The majority of papers (n = 43, 75%) investigated parents’ and clinicians’ perspectives, while only 14 articles (25%) included perspectives of children and adolescents. Twenty-two articles (39%) reported some details on various forms of children's participation (e.g., receive information, plan care details, consulted before or after a decision was made). Positive (e.g., respect for patient's preferences) and negative (e.g., conflict due to diverging opinions) effects of children's participation in end-of-life decision making were reported. Conclusions: This systematic review highlights the need for research to identify factors that contribute to a favorable participation of minors in decision-making processes, as well as strategies to solve possible conflicts. More research should take into account the dynamics in the triadic process of decision making and emphasize children and adolescents’ perspectives. A better understanding of how to meaningfully involve children and adolescents in end-of-life decision making could facilitate the practice of patient participation in pediatrics. (shrink)

Privacy issues surrounding the use of social media sites have been apparent over the past ten years. Use of such sites, particularly Facebook, has been increasing and recently business organizations have begun using Facebook as a means of connecting with potential customers or clients. This paper presents an empirical study of perceived privacy violations to examine factors that influence the expectations of privacy on Facebook. Results of the study suggest that the more important Facebook is to users, the more likely (...) they are to perceive privacy violations and the more likely those violations are to be considered serious. Background: Healthcare providers who are accountable for patient care safety and quality but who are not empowered to actualize them experience moral distress. Interventions to mitigate moral distress in the healthcare organization are needed. Objective: To evaluate the effect on moral distress and clinician empowerment of an established, health-system-wide intervention, Moral Distress Consultation. Methods: A quasi-experimental, mixed methods study using pre/post surveys, structured interviews, and evaluation of consult themes was used. Consults were requested by staff when moral distress was present. (...) The purpose of consultation is to identify the causes of moral distress, barriers to action, and strategies to improve the situation. Intervention participants were those who attended a moral distress consult. Control participants were staff surveyed prior to the consult. Interviews were conducted after the consult with willing participants and unit managers. Moral distress was measured using the Moral Distress Thermometer. Empowerment was measured using the Global Empowerment Scale. Results: Twenty-one consults were conducted. Analysis included 116 intervention and 30 control surveys, and 11 interviews. A small but significant decrease was found among intervention participants, especially intensive care staff. Empowerment was unchanged. Interview themes support the consult service as an effective mode for open discussion of difficult circumstances and an important aspect of a healthy work environment. Conclusions: Moral distress consultation is an organization-wide mechanism for addressing moral distress. Consultation does not resolve moral distress but helps staff identify strategies to improve the situation. Further studies including follow up may elucidate consultation effectiveness. (shrink)

To answer our question on what is a good answer to an ethical question, we asked three master teachers of business ethics to share their perspectives on a good answer. Their answers revealed stark differences—regarding the starting point of business ethics, the purpose of business, prioritization of analytical disciplines, and research methods—but also a common thread demanding that a good answer articulates a student's own moral voice. Moral voice is a genuine expression of an individual’s considered moral judgment that is reflective of personal values and cognizant of professional expectations. Cultivating the expression of moral voice goes beyond formal and theoretical proficiency to overcome human tendencies toward idealism, insincerity, and rationalization. Moral voice does not by itself fill the gap in business ethics pedagogy on the content of a good answer, but it demands that students support an answer that they can genuinely believe in while encouraging instructors to cultivate in their students sincerity and engagement, conscience, and a sense of self that are indispensable to genuine ethical commitment. A viatical settlement (or viatical) is a transaction in which an investor purchases the life insurance policy from a terminally ill person for a lump sum so that the investor can receive those benefits at the time of death. While there is an ongoing debate in the insurance and financial planning industry about viaticals, including the ethics of this practice, the focus has been predominantly on abuses in the course of buying and selling viaticals and less on the fundamental ethicality (...) of the economic idea behind viaticals. This paper offers a systematic ethical analysis of viaticals that leverages the distinction between the ethicality of an economic idea and the ethicality of economic reality to isolate and discuss the fundamental ethical problems of viaticals. By unpacking the evaluative content of our negative emotional reactions to viaticals, we show that, even under ideal circumstances, the economic idea of viaticals is, at its core, unethical. This paper analyzes the shifts in Wilhelm Windelband’s ‘critical philosophy of values’ as it developed hand in hand with his understanding of relativism. The paper has two goals. On the one hand, by analyzing the role that relativism played in his philosophical project, it seeks to contribute to a better understanding of Windelband's intellectual development in the context of historicism and Neo-Kantianism. On the other hand, by highlighting Windelband’s contribution to the understanding of relativism, it sheds light on an important (...) episode in the history of that problem. The paper distinguishes between three phases in Windelband’s thinking and shows that his views about relativism changed in close connection with his conception of history. The early Windelband thought that historicism was compatible with absolute validity because he was firmly convinced of historical progress. The mature Windelband rejected progress as a means for justifying validity and put the problem of relativism into sharp relief. In response to the failure of his mature philosophy to fend off relativism, the later Windelband strengthened the role of history again. The paper concludes that Windelband’s significance lies not in his arguments against relativism, but rather in having furthered philosophical understanding of the problems at stake. (shrink)

Over the past two decades, the phenomenon of socially responsible investing has become more widespread. However, knowledge about the individual socially responsible investor is largely limited to descriptive and comparative accounts. The question of "why do some investors practice socially responsible investing and others don't?" is therefore still largely unanswered. To address this shortcoming in the current literature, this paper develops a model of the decision to invest socially responsibly that is grounded in the cognition literature. The hypotheses proposed in (...) the model are tested with an experimental survey. The results indicate that the framing of the investing situation influences the likelihood of engagement in socially responsible investing and how much return the individuals are willing to sacrifice when choosing socially responsible over conventional investments. The study does not find support for a relationship between expectations about corporate social responsibility and the likelihood of engagement in socially responsible investing. (shrink)

This paper seeks to re-assess Dilthey’s descriptive psychology in light of the charge of “psychologism”. The paper has two goals. First, I seek to give a fine-grained reconstruction of Dilthey’s foundational project. I provide a systematic account of how Dilthey sought to ground the knowledge claims of the human sciences in inner experience. I place special emphasis on Dilthey’s concept of “articulation” which mediates between inner experience and psychological knowledge, as well as between individual psychology and knowledge about the socio-historical (...) world. Second, I re-assess the allegedly “psychologistic” aspects of Dilthey’s philosophy. I reconstruct how Dilthey’s critics Husserl, Windelband and Rickert understood psychologism, highlight commonalities between them and explain why Dilthey’s approach seemed “psychologistic” from their perspective. At the same time, I show that Dilthey’s philosophical thinking goes against the very presuppositions that the “psychologism”-charges are usually based upon. This chapter traces the development of relativist ideas in nineteenth-century debates about history and historical knowledge. It distinguishes between two contexts in which these ideas first emerged. First, the early-to-mid nineteenth-century encounter between speculative German idealism and professional historiography. Second, the late nineteenth-century debate between hermeneutic philosophy and orthodox Neo-Kantianism. The paper summarizes key differences between these two contexts: in the former, historical ontology and historical methodology formed a unity, in the latter, they came apart. As a result, the idea (...) of universal history became increasingly problematic. In light of these differences, the paper seeks to (partially) explain why it was only towards the late-nineteenth century that historical relativism became an explicit concern. (shrink)

This study is unique in that it presents the first empirically developed framework for use as a tool for measuring historical empathy. The Historical Empathy Measurement Tool (HEMT) was developed using a design-based research method with three iterative macrocycles of design, experiment, and retrospective analysis. The study involved question responses from 276 students in grade 8 studying WWI trench warfare. The research resulted in a framework of seven levels. (0) Non-response, (1) Facts, (2) Assumptions and Deficits, (3) General Comparison of (...) the Past and Present, (4) Emotional Comparison of the Past and Present, (5) Understanding Motives, Behaviors, Thoughts, & Emotions in the Past, and (6) Acknowledgement of Differences from those in the Past. In this paper I revisit nineteenth-century debates over historical objectivity and the political functions of historiography. I focus on two central contributors to these debates: Leopold von Ranke and Johann Gustav Droysen. In their takes on objectivity and subjectivity, impartiality and political engagement I reveal diametrically opposed solutions to shared concerns: how can historians reveal history to be meaningful without taking recourse to speculative philosophy? And how can they produce a knowledge that is relevant to the present when the project (...) of “exemplary” history has been abandoned? I put a special focus on the relativist themes in Ranke’s and Droysen’s answers to these questions. Ranke’s demand for impartiality leads him to think of all historical epochs as equally valid, while Droysen’s emphasis on the historian’s subjectivity relativizes historical truth. In order to explain why Ranke and Droysen nevertheless remained unfazed by the problem of historical relativism, I analyze their normative conceptions of the historian’s disciplinary ethos. I show that Ranke and Droysen think of objective impartiality and subjective partiality not only in methodological terms, but also in terms of justice and ethic duty. This normative element secures the professional study of history an ethical-political relevance for the present. (shrink)

Institutional investors control almost 60% of all assets under management worldwide and encompass a wide variety of organizations. Despite this reach, however, institutional investors have not received the normative scrutiny they merit beyond general discussions around their legally grounded fiduciary obligations to their beneficiaries. This paper offers a discussion of institutional investor ethical obligations in light of their specific attributes. The professionalization of the study of history in the Nineteenth Century made possible a new way of thinking about the history of philosophy: the thought emerged that philosophy itself might be relative to time, historical culture, and nationality. The simultaneous demise of speculative metaphysics scattered philosophers’ confidence that the historical variance of philosophical systems could be viewed in terms of the teleological self-realization of reason. Towards the late Nineteenth Century, philosophers began to explicitly address the worry that all philosophical systems (...) might have only relative validity. This paper compares two key figures in late-nineteenth-century debates concerning historical relativism: Wilhelm Windelband and Wilhelm Dilthey. Beneath the deep disagreements between these two authors, it reveals their common concern to immunize philosophy from the threat of historical relativism. The paper traces how both philosophers sought to fend off relativism by defending the idea of an ahistorical and permanent stratum of philosophical thinking. And it argues that although they succeeded in blocking historical versions of relativism, they did so at the cost of incurring a relativism vis-à-vis philosophical systems. This relativism turned out to be rooted not in the historicity of philosophy but in the timeless essence of philosophical reasoning itself. (shrink)

History Without Causality. How Contemporary Historical Epistemology Demarcates Itself From the Sociology of Scientific Knowledge. Contemporary proponents of historical epistemology often try to delimit their enterprise by demarcating it from the sociology of scientific knowledge and other sociologically oriented approaches in the history of science. Their criticism is directed against the use of causal explanations which are deemed to invite reductionism and lead to a totalizing perspective on science. In the present article I want to analyse this line of criticism (...) in what I consider are two paradigmatic works of contemporary historical epistemology: Lorraine Daston's und Peter Galison's Objectivity and Hans‐Jörg Rheinberger's Toward a History of Epistemic Things. I first present their arguments against the sociological and causal analysis of scientific knowledge and practice and then try to defend sociological work in the history of science against their charges. I will, however, not do so by defending causal explanations directly. Rather, I will show that the arguments against sociological analysis put forward in contemporary historical epistemology, as well as historical epistemology's own models of historical explanation and narration, bear problematic consequences. I argue that Daston, Galison and Rheinberger fail to create productive resonances between macro‐ and microhistorical perspectives, that they reproduce an internalist picture of scientific knowledge, and finally that Rheinberger's attempt to deconstruct the dichotomy between subject and object leads him to neglect questions about the political dimension of scientific research. This paper reconstructs the major transformations in the Marburg neo-Kantian account of experience. By focusing on the problem of ‘conceptualism’, it traces connections between four issues that are central to the transcendental projects of the Marburg philosophers: the interpretation of Kant, the critique of experiential givenness, the account of objective cognition in science, and the relation between scientific and pre-scientific experience. My historical narrative identifies two shifts. The first is from Cohen's conceptualist answer to the threat of subjectivism to Cassirer's (...) functionalist answer to empiricism. The second is from Cassirer's conceptualism about scientific experience to his symbolic non-conceptualism about everyday perception. My reconstruction reveals the fate of neo-Kantian conceptualism to be linked to the fate of pre-scientific perception and suggests that the continuing significance of the Marburg philosophers lies in their responses to the coming apart of the manifest and the scientific image. Fallgeschichten werden seit dem 18. Jahrhundert zunehmend genutzt, um juristisches, psychologisches und medizinisches Wissen einer grösseren Öffentlichkeit zu vermitteln. In den letzten zehn Jahren haben sie auch in den Geistes- und Sozialwissenschaften mehr Aufmerksamkeit erfahren. Die Diskussion über paradigmatische Fälle in diesem Band zielt darauf ab, Fallgeschichten in ihrer Funktion als besonders anschauliche oder lehrreiche Beispiele in verschiedenen historischen Kontexten zu untersuchen und zu vergleichen. Die in diesem Heft versammelten Texte gehen der Frage nach, wie Fälle dazu beitragen, Debatten zu (...) verdichten und Entwicklungen erzählbar zu machen, wie sie über den Einzelfall hinausgehendes Wissen generieren und so paradigmatischen Status erlangen. Neben konzeptuellen Gesichtspunkten widmen sich die Beiträge mehreren Forschungsfeldern, darunter der Rechts- und Medizingeschichte, der Geschichte der Geschichtsschreibung, literarischen Fällen, den Sozialwissenschaften und der Technikgeschichte. Das 'Sydrac le philosophe' zugeschriebene "Livre de la fontaines de toutes sciences" ist ein enzyklopadisches Werk, das wahrend des 13.-16. Jahrhunderts besonders in Frankreich und durch viele Ubersetzungen auch in anderen volkssprachlichen Literaturen Europas eine beachtliche Wirkung entfaltet hat. Thematisch breit gefachert, vermittelt es - in Form eines losen Dialoges zwischen dem Philosophen und Konig Boctus - religioses, ethisches, medizinisches und naturkundliches Wissen. Auch zu komplexen Problemen - Fragen zum astrologischen Wissen beispielsweise, das hier zum erstenmal in der Volkssprache detailliert (...) zuganglich gemacht wird - versucht der anonyme Verfasser stets, mit moglichst klaren Anworten Orientierung und Lebenshilfe zu geben.Mit dieser Edition wird die letzte terra incognita im Bereich der volkssprachlichen Enzyklopadien Frankreichs fur die Forschung zuganglich gemacht, nachdem die ubrigen Werke - Le Livre du Tresor von Brunetto Latini, L'Image du monde von Gossouin de Metz und der anonyme Dialog Placides et Timeo - inzwischen in modernen Ausgaben vorliegen. This paper analyses the methodological writings of the nineteenth century historian Johann Gustav Droysen. It explores how Droysen integrates the political and methodological aspects of historiography. The paper shows that Droysen relies on a procedure of “affirmative genealogy” which, in turn, is based on a concept of historical continuity. On Droysen’s account, historical continuity enables “historical understanding”. And the understanding of historical continuities provides the statesman – the “practical historian” – with a solid basis for political decision making.
