This paper examines the market response to the events leading up to the passage of Section 1502 of the Dodd-Frank Wall Street Reform and Consumer Protection Act to explore whether investors value mandatory human rights disclosures of conflict mineral usage. Using a sample of 3639 US registrants from January 1, 2008 to September 30, 2014, we document a significant negative stock market reaction to the passage of the Act. Using a sample of 1206 filers, we also find a negative market (...) reaction to conflict mineral disclosures under the Act. The market reaction is more negative and limited to companies that source their minerals from the DRC and adjoining countries, companies with prior records of human rights violations, and companies with ambiguous disclosures. However, the market appears to reward firms that use risk-mitigation strategies. This paper provides preliminary evidence that the mandatory disclosure of conflict mineral information on Form SD poses a threat to firms’ legitimacy, resulting in a net cost to investors. The results of this study provide economic justification for companies with poor records of conflict mineral sourcing to improve their practices for the purpose of avoiding the high costs that will arise if they are forced to disclose human rights abuses related to conflict mineral use. We examine the influence of face-based judgments of CFO and CEO honesty on earnings management for the largest publicly traded companies in America. After controlling for incentives and opportunities to manage earnings, CFOs perceived to be less honest engage in higher levels of accruals earnings management and real earnings management. The beneficial impact of perceived honesty on earnings quality is most pronounced when both the CFO and the CEO are perceived to be more honest. Findings are consistent with our conjecture (...) that both the CFO and CEO contribute to a firm’s financial reporting environment. (shrink)

Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. I investigate three questions about algorithmic neutrality: What is it? Is it possible? And when we have it in mind, what can we learn about algorithmic bias?

Fallibilists claim that one can know a proposition on the basis of evidence that supports it even if the evidence doesn't guarantee its truth. Jessica Brown offers a compelling defence of this view against infallibilists, who claim that it is contradictory to claim to know and yet to admit the possibility of error.

According to the Desiderative Lockean Thesis, there are necessary and sufficient conditions, stated in the terms of decision theory, for when one is truly said to want. What one is truly said to want, it turns out, varies remarkably by context—and to an underappreciated degree. To explain this context-sensitivity—and closure properties of wanting—I advance a Desiderative Lockean view that is distinctive in having two context-sensitive parameters.

Such *strongly conflicting desire ascriptions* are, I show, wrongly predicted incompatible by standard semantics. I then object to possible solutions, and give my own, based on *some-things-considered desire*. Considering the fun of the concert, but ignoring the drive, you want to see the concert; considering the boredom of the drive, but ignoring the concert, you don’t want to take the (...) drive. In a new interpretation, Garrett Wallace Brown considers Kant's cosmopolitan thought as a form of international constitutional jurisprudence that requires minimal legal demands. He explores and defends topics such as cosmopolitan law, cosmopolitan right, the laws of hospitality, a Kantian federation of states, a cosmopolitan epistemology of culture and a possible normative basis for a Kantian form of global distributive justice.

Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features and practical considerations . The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues (...) that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue. (shrink)

This essay is primarily an exposition of a Lacanian view of subjectivity, as one that is literally informed by the fact of speaking. The genesis within speaking is related to a possible bridge between the social and the subjective that has troubled psychology for decades. The inherence of alterity to the structuration of the subject is described as part of this exposition. This intrinsic otherness as a self-difference and as a framing of the speaking act is described as a way (...) to reexamine recalcitrance and everyday problems in diversity. It is argued that diversity, far from being a dalliance or trite new set of rules for civil behavior, taps into a problematic of the subject. Ways of understanding the encounter with the other, as might follow from Lacan's work, are articulated within the context of religious law and of the social contract in current late capitalist society. Ron Giere’s recent book Scientific perspectivism sets out an account of science that attempts to forge a via media between two popular extremes: absolutist, objectivist realism on the one hand, and social constructivism or skeptical anti-realism on the other. The key for Giere is to treat both scientific observation and scientific theories as perspectives, which are limited, partial, contingent, context-, agent- and purpose-dependent, and pluralism-friendly, while nonetheless world-oriented and modestly realist. Giere’s perspectivism bears significant similarity to earlier ideas of Paul (...) Feyerabend and John Dewey. Comparing these to Giere’s work not only uncovers a consilience of ideas, but also can help to fill out Giere’s account in places where it is not fully developed, as well as helping us understand the work of these earlier authors and their continuing relevance to contemporary concerns in philosophy of science.Keywords: Ronald Giere; Paul Feyerabend; John Dewey; Perspectivism; Pragmatism; Pluralism. I defend the thesis that most or all perceptual experiences are infused with imaginative contributions. While the idea is not new, it has few supporters. I begin by developing a framework for the underlying debate. Central to that framework is the claim that a perceptual experience is infused with imagination if and only if there are self-generated contributions to that experience that have ampliative effect on its phenomenal and directed elements. Self-generated ingredients to experience are produced by the subject as (...) opposed to being received from the world. Some form of stored content is an obvious starting point. Ampliative effects are aspects of perceptual experience that outstrip the content the senses get from the world. This conceptual framework is applied to three case studies: object-sameness and object-kind recognition (section 2), memory colour (section 3), and perceptual constancy and amodal completion (section 4). If the three cases and my overall analysis are accepted (a substantive if), then we have a forceful inductive argument for perception being infused with imagination. (shrink)

Meet Tega. Blue, fluffy, and AI-enabled, Tega is a relational robot: a robot designed to form relationships with humans. Created to aid in early childhood education, Tega talks with children, plays educational games with them, solves puzzles, and helps in creative activities like making up stories and drawing. Children are drawn to Tega, describing him as a friend, and attributing thoughts and feelings to him ("he's kind," "if you just left him here and nobody came to play with him, he (...) might be sad"). Scholars and members of the public alike have raised the alarm about relational robots, worrying that the relationships that people, and especially children, form with such robots are objectionably inauthentic. We, members of an interdisciplinary team that developed and studies Tega, make this inauthenticity worry precise and offer practical recommendations for addressing it. We distinguish two kinds of (in)authenticity -- inauthenticity as unreality, and inauthenticity as deception -- arguing that neither is just what others have thought it is. With our distinction in hand, we argue that the authenticity concern can be met only through co-design methods -- methods that give stakeholders of all kinds (e.g. parents, educators, and children themselves) a genuine say in how relational robots are built. The thesis advanced in this book is that feeling and cognition actualize through a process that originates in older brain formations and develops outward through limbic and cortical fields through the self-concept and private space into (as) the world. An iteration of this transition deposits acts, objects, feelings and utterances. Value is a mode of conceptual feeling that depends on the dominant phase in this transition: from desire through interest to object worth. Among the topics covered are subjective time and (...) change, the epochal nature of objects and their temporal extensibility and the evolution of value from inorganic matter into organic form. The theory of microgenesis informs this work. According to this theory, acts and objects evolve in milliseconds through phases that replicate patterns in forebrain evolution. The progression in the actualization of the mind/brain state is from archaic to recent in brain formation, from unity to diversity, from past to present and from mind to world. An account is given of the diversity of felt experience avoiding the reductionist moves characteristic of biological materialism and the inherent dualism of psychoanalytic and related theories. This book is intended for any reader interested in the psychology of the inner life and philosophy of mind, including philosophers, psychologists, psychiatrists and others with an interest in problems of value and moral feeling. This paper responds to an argument from Botin which claims that Russellian physicalism is committed to the view that either (i) our phenomenal concepts do not reveal anything essential about phenomenal properties (following Goff, Botin calls this the ‘opaque’ account of phenomenal concepts), or that (ii) phenomenal concepts are capable of revealing at least some of the essence of phenomenal properties—making phenomenal concepts ‘translucent’ if some-but-not-all-revealing or ‘transparent’ if all-revealing—but this entails that phenomenal properties are fundamental, which violates physicalism. I (...) argue that Botin is wrong that Russellian physicalists are committed to the view that physical and phenomenal concepts must have similarly qualitative/phenomenal modes of presentation or contents, since Russellian physicalists assume that we do not possess concepts which specifically refer to non-phenomenal categorical properties. If we were to acquire concepts for non-phenomenal categorical properties, they would need to have categorical contents and modes of presentation, but need not have qualitative/phenomenal contents and modes of presentation. Given this, Russellian physicalists can embrace a translucent account of phenomenal concepts, and hold that our phenomenal concepts more-or-less accurately tell us about certain sorts of non-fundamental properties which are both physical and categorical. Animal welfare has a long history of disregard. While in recent decades the study of animal welfare has become a scientific discipline of its own, the difficulty of measuring animal welfare can still be vastly underestimated. There are three primary theories, or perspectives, on animal welfare - biological functioning, natural living and affective state. These come with their own diverse methods of measurement, each providing a limited perspective on an aspect of welfare. This paper describes a perspectival pluralist account of (...) animal welfare, in which all three theoretical perspectives and their multiple measures are necessary to understand this complex phenomenon and provide a full picture of animal welfare. Social Theory and the Political Imaginary: Practice, Critique and History is an innovative work of synthesis, critique, and analysis. It presages a social theory perspective that recognises the constitutive significance of the political imaginary in modernity. Social theory's current dilemmas are explored through a series of interlinked asssessments of some of its recent substantial strands, specifically, Luc Boltanski's pragmatism and the wider 'practical turn', the perspectives of multiple modernities and global modernity, the outlook of social and political imaginaries, and critical (...) social theory. The political imaginary's reconfigurations are evident in the tensions of global modernity and original social theory interpretations are advanced of landmark instances of twenty-first century social contestation: the Hong Kong protests conditioned by threats to civil freedoms and a lack of self-determination, the radical democratic practices of anti-austerity movements contesting capitalist globalisation's injustices, and the inverted cosmopolitanism of the 2005 French Riots challenging the oppression and inequalities experienced by immigrant communities and marginalised youth. These incisive applications of social theory and complementary conceptual innovations illuminate the vicissitudes of social struggles, political forms, and theoretical perspectives. Similarly, reflection on the political imaginary is found to enable a necessary rethinking of the interrelationship of practice, critique and history. (shrink)

This unique textbook utilizes an integrated, case-based approach to explore how the domains of bioethics, public health and the social sciences impact individual patients and populations. It provides a structured framework suitable for both educators (including course directors and others engaged in curricular design) and for medical and health professions students to use in classroom settings across a range of clinical areas and allied health professions and for independent study. The textbook opens with an introduction, describing the intersection of ethics (...) and public health in clinical practice and the six key themes that inform the book's core learning objectives, followed by a guide to using the book. It then presents 22 case studies that address a broad spectrum of patient populations, clinical settings, and disease pathologies. Each pair of cases shares a core concept in bioethics or public health, from community perspectives and end-of-life care to medical mistakes and stigma and marginalization. They engage learners in rigorous clinical and ethical reasoning by prompting readers to make choices based on available information and then providing additional information to challenge assumptions, simulating clinical decision-making. In addition to providing a unique, detailed clinical scenario, each case is presented in a consistent format, which includes learning objectives, questions and responses for self-directed learning, questions and responses for group discussion, references, and suggested further reading. All cases integrate the six themes of patient- and family-centered care; evidence-based practice; structural competency; biases in decision-making; cultural humility and awareness of the culture of medicine; and justice, social responsibility and advocacy. This chapter explores perspectivism in the American Pragmatist tradition. On the one hand, the thematization of perspectivism in contemporary epistemology and philosophy of science can benefit from resources in the American Pragmatist philosophical tradition. On the other hand, the Pragmatists have interesting and innovative, pluralistic views that can be illuminated through the lens of perspectivism. I pursue this inquiry primarily through examining relevant sources from the Pragmatist tradition. I will illustrate productive engagements between pragmatism and perspectivism in three areas: in (...) the pragmatists’ fallibilistic theories of inquiry and truth, in their pluralistic metaphysics, and in their views on cultural pluralism. While there are some potential sticking points between pragmatism and perspectivism, particularly around the visual metaphor of perspective, these philosophical approaches nonetheless have much to learn from each other. Perspectivism is in danger of falling between the horns of pernicious relativism and a platitudinous view of the limits of human perception and cognition. The pragmatists accounts of truth and reality open the possibility of a more thoroughgoing perspectivism. I will follow this thread through Charles S. Peirce’s, William James’, and John Dewey’s theories of inquiry and truth, Peirce’s evolutionary metaphysics, James’ radical pluralism, Dewey’s cultural naturalism, Richard Rorty’s anti-essentialism, Jane Addams’ standpoint epistemology, W.E.B. Du Bois’ theory of race consciousness, Horace Kallen’s and Alain LeRoy Locke’s cultural pluralism, and Mary Parker Follett’s account of pluralistic integration. (shrink)

Abstract The principal aim of this paper is to give a positive analysis of self-deception. I argue that self-deception is a species ?self-emplotment?. Through narrative self-emplotment one groups the events of one's life thematically in order to understand and monitor oneself. I argue that self-emplotment is an unextraordinary feature of mental life that is a precondition of agency. Self-emplotment, however, proceeds according to certain norms, some of which provide apparent justification for self-deceptive activity. A secondary aim of the paper is (...) to sketch the common characteristics between self-deception and self-knowledge. The framework of self-emplotment from which self-deception can emerge is also the framework that delivers self-knowledge; to the extent that the activity of self-emplotment is partially constitutive of what it means to possess self-knowledge, the self-deceiver may be closer to a state of self-knowledge than the person who fails to engage in significant introspective narrative. Aristotle's treatment of the choice between the political and contemplative lives (in EN I 5 and X 7-8) can seem awkward. To offer one explanation of this, I argue that when he invokes self-sufficience (autarkeia) as a criterion for this choice, he appeals to two different and incompatible specifications of "lacking nothing." On one specification, suitable to a human being living as a political animal and thus seeking to realize his end as an engaged citizen of a polis, a person (...) lacks nothing by possessing a wide range of goods that directly require other people. On the other, more suitable to a god or a beast, a person lacks nothing by having no need of goods that directly require other people. The ambiguity of this criterion renders the choice between the political and contemplative lives difficult. (shrink)

The Lily's Tongue offers a nuanced, sustained reading of what Maughan-Brown calls the "Lily Discourses"--four discourses that Kierkegaard wrote about the instruction in the Gospel of Matthew to "consider the lilies." Kierkegaard suggests that the lilies are "authoritative" rather than merely "figural" or "metaphorical." The aim of this book is to explore what exactly Kierkegaard means by asking, How do texts speak with authority? In Maughan-Brown's reading, Kierkegaard argues that the key to a text's authority is in the (...) act of reading itself. No text can have authority unless the reader grants it that authority. That is because, paradoxically, no text can avoid or escape the use of figural language. If the lilies speak authoritatively it is precisely because they are also figural. Texts do not speak directly; their tongue is always the lily's tongue. Drawing on the work of Kant, Hegel, Nietzsche, Benjamin, and Derrida, The Lily's Tongue situates Kierkegaard's reading of Matthew at the intersection of theological, philosophical, political, and literary investigations of figural language. It uniquely contributes to the ongoing discussion of Kierkegaard's theory and practice of "indirect communication" by introducing four pivotal signed discourses into this debate. In so doing, Maughan-Brown reveals a groundbreaking theory of figure--one that ultimately requires a renewed reading of the major pseudonymous works. (shrink)

In arguing against the likelihood of consciousness in non-human animals, Descartes advances a slippery slope argument that if thought were attributed to any one animal, it would have to be attributed to all, which is absurd. This paper examines the foundations of Thomas Willis’ comparative neuroanatomy against the background of Descartes’ slippery slope argument against animal consciousness. Inspired by Gassendi’s ideas about the corporeal soul, Thomas Willis distinguished between neural circuitry responsible for reflex behaviour and that responsible for cognitively or (...) consciously mediated behaviour. This afforded Willis a non-arbitrary basis for distinguishing between animals with thought and consciousness and those without, a methodology which retains currency for neuroscience today. (shrink)

Health care begins as an act of conscience, which urges a response to the sick and holds caregivers accountable to moral standards that public authorities ultimately do not define. Conscience nonetheless expresses itself as a type of dialogue within oneself that is influenced by dialogue with others, especially with society in the form of civil law and professional standards. A well-formed conscience for health care relates the foundations of morality to health care practices and contributes sound moral judgment about them (...) to the common good. Some current health care policies and medical education presume a distorted view of conscience as personal sentiment. These policies circumvent serious discussion and possible resolution of society's most vexing bioethics controversies. (shrink)

Many legal arguments pertaining to equal rights for gay and lesbian families have relied upon empirical research on the `healthy' childraising environment of these families. While neither disputing recent legal gains nor diminishing their importance, this article looks at some of the conceptual categories that drive this research. The limitations of such research, as salutary as it is, are typically understood in terms of their obvious political context. Such research avoids highlighting any differences between gay/lesbian families and traditional families because (...) an emphasis on such differences feeds cultural stereotypes that are damaging to non-traditional families. This article takes a different tack, looking at how the concepts that frame research are based in binaries and fantasies about families and sex that we argue are too limiting. It assumes that the elision of sexuality within such studies is symptomatic of a broader repression of a variety of meanings of family. In response, the article brings in queer theory and psychoanalysis to broaden our approach to understanding new forms of family and kinship initiated by gay and lesbian families. The article addresses single household lesbian families that are most frequently the object of empirical research. (shrink)

Polus admires orators for the tyrannical power they have. However, Socrates argues that orators and tyrants lack power worth having: the ability to satisfy one's wishes or wants (boulēseis). He distinguishes wanting from thinking best, and grants that orators and tyrants do what they think best while denying that they do what they want. His account is often thought to involve two conflicting requirements: wants must be attributable to the wanter from their own perspective (to count as their desires), but (...) wants must also be directed at objects that are genuinely good (in order for failure to satisfy them to matter). We offer an account of wanting as reflective, coherent desire, which allows Socrates to satisfy both desiderata. We then explain why he thinks that orators and tyrants want to act justly, though they do greater injustices than anyone else and so frustrate their own wants more than anyone else. (shrink)
