This paper argues for a novel understanding of the relationship between law and coercion. It firstly refutes Kenneth Himma’s claim that the authorisation of coercive enforcement mechanisms is a conceptually necessary feature of law. It then claims that the best way to understand the law is as coercion-apt. The “coercion-aptness” of law is clarified, in part, by appealing to an essential distinction between law and morality: Whereas it can be reasonable for the law to appeal to coercive means in order (...) to motivate compliance, it seems decidedly unreasonable for morality to do so. In this discussion of Emad Atiq's article "There are No Easy Counterexamples to Legal Anti-Positivism" I pose three challenges to his construction of an Inclusive Anti-positivism. I firstly argue that, contra Atiq, the moral facts that both ground IAP and allow it to satisfy the extensional challenge are sometimes reducible to social facts. In Section II, I briefly discuss internal- and external-to-practice appraisals of legal norms. Using detailed propostitions and a theory of cognitive significance, he introduces an alternative interpretation of reference that will be relevant to metaphysicians, philosophers of science and philosophers of language and may come to (...) be recognised as the definitive statement on the tensed theory of time. Norman Kemp Smith's Commentary elucidates not only textural questions and minor issues, but also the central problems which arise, he contends, from the conflicting tendencies of Kant's own thinking. Background:Attention to ethical leadership in nursing has diminished over the past several decades.Objectives:The aim of our study was to investigate how frontline nurses and formal nurse leaders envision ethical nursing leadership.Research design:Meta-ethnography was used to guide our analysis and synthesis of four studies that explored the notion of ethical nursing leadership.Participants and research context:These four original studies were conducted from 1999-2008 in Canada with 601 participants.Ethical considerations:Ethical approval from the original studies covered future analysis.Findings:Using the analytic strategy of lines-of-argument, we (...) found that 1) ethical nursing leadership must be responsive to practitioners and to the contextual system in which they and formal nurse leaders work, and 2) ethical nursing leadership requires receiving and providing support to increase the capacity to practice and discuss ethics in the day-to-day.Discussion and conclusion:Formal nurse leaders play a critical, yet often neglected role, in providing ethical leadership and supporting ethical nursing practice at the point of patient care. After acquiring knowledge of the neuroscience of learning, memory, stress and emotions, teachers incorporate more cognitive engagement and student-centered practices into their lessons. However, the role understanding neuroscience plays in teachers own affective and motivational competencies has not yet been investigated. The goal of this study was to investigate how learning neuroscience effected teachers’ self-efficacy, beliefs in their ability to teach effectively, self-responsibility and other components of teacher motivation. A pilot training-of-trainers program was designed and delivered in Liberia combining basic (...) neuroscience with information on social, emotional, behavioral and mental health issues faced by students. Tier I of the professional development was a 2 weeks workshop led by a visiting neuroscientist. A subset of the 24 Tier I secondary science teachers formed a Leadership Team who adapted the content to the Liberian context and subsequently led additional workshops and follow-up sessions for the Tier II secondary science teachers. Science teachers in both tiers completed the affective-motivational scales from the internationally vetted, multiscale Innovative Teaching for Effective Learning Teacher Knowledge Survey from the OECD. Tier II teachers completed the survey in a pre-post-delayed post design. Tier I teachers completed the survey after the workshop with their attitudes at that time and separately with retrospective projections of their pre-workshop attitudes. Ten of the 92 Tier II teachers participated in structured interviews at follow-up. Statistical analysis of survey data demonstrated improved teacher self-efficacy, self-responsibility for student outcomes, and motivation to teach. Qualitatively, teachers expressed more confidence in their ability to motivate students, engage them through active learning, and manage the class through positive rather than negative reinforcement. Teachers’ own self-regulation improved as they made efforts to build supporting relationships with students. Together, these results demonstrated that (i) teacher affective-motivational attitudes can be altered with professional development, (ii) basic neuroscience, as knowledge of how students learn, can improve teacher competency, and (iii) a training-of-trainers model can be effective in a low and middle income country for disseminating neuroscience knowledge, increasing teachers’ knowledge of students’ social and emotional needs, and promoting educational improvement. A ‘lottery belief’ is a belief that a particular ticket has lost a large, fair lottery, based on nothing more than the odds against it winning. The lottery paradox brings out a tension between the idea that lottery beliefs are justified and the idea that that one can always justifiably believe the deductive consequences of things that one justifiably believes – what is sometimes called the principle of closure. Many philosophers have treated the lottery paradox as an argument against the (...) second idea – but I make a case here that it is the first idea that should be given up. Linguistic dependencies between non‐adjacent words have been shown to cause comprehension difficulty, compared with local dependencies. According to one class of sentence comprehension accounts, non‐local dependencies are difficult because they require the retrieval of the first dependent from memory when the second dependent is encountered. According to these memory‐based accounts, making the first dependent accessible at the time when the second dependent is encountered should help alleviate the difficulty associated with the processing of non‐local dependencies. In a dual‐task paradigm, participants (...) read sentences that did or did not contain a non‐local dependency (i.e., object‐ and subject‐extracted cleft constructions) while simultaneously remembering a word. The memory task was aimed at making the word held in memory accessible throughout the sentence. In an object‐extracted cleft (e.g., It was Ellen whom John consulted…), the object (Ellen) must be retrieved from memory when consulted is encountered. In the critical manipulation, the memory word was identical to the verb's object (ELLEN). In these conditions, the extraction effect was reduced in the comprehension accuracy data and eliminated in the reading time data. These results add to the body of evidence supporting memory‐based accounts of syntactic complexity. (shrink)

Within the field of multispecies ethnography, a lingering question remains regarding how we can understand the nonhuman side of the human–nonhuman encounter. Many authors have ventured into this topic on a theoretical level, but none have proposed an effective methodological approach for how to achieve their goals. After examining the pitfalls experienced when acting as a volunteer at an animal shelter, I propose that in order to get closer to the feline gaze, we must first utilize an understanding of a (...) cat’s sensory capabilities. Recognizing that a cat’s subjectivities are necessarily mediated by their bodies, understanding how they perceive the world involves a sensory experiential methodology. Highlighting the many contributions of phenomenological frameworks along with their limitations, I argue that getting closer to the feline gaze means appreciating species differences rather than arguing for the shared qualities held across species. Because of the species barrier, an interdisciplinary approach must meld phenomenological with ethological methods to grasp the interspecies relationships created by the cat–human encounter. (shrink)

The complex and dynamic nature of systems pose a particular challenge to researchers and require the use of a research methodology designed to deal with such systems. The properties of fit, relevance, understandability, generality, control, workability, generalizability, and modifiability make Glaserian grounded theory and grounded action particularly well suited for studying systems. These methods are innovative, systemic, and sophisticated enough to reveal the underlying complexities of systems and plan actions that address their complex, dynamic nature while remaining grounded in what (...) is occurring within the systems as they change over time. Exhaustive study on Pañcadaśi, verse compendium on Advaita philosophy by Madhva, 13th cent.

This article deals with the prospect of genetically enhancing intelligence. We identify and contrast social attitudes (disapproval) to the use of future genetic technology with social attitudes (approval) for environmental methods of enhancing intelligence. Using various forms of the argument that the means by which enhancement is achieved has moral significance, we look for differences that could justify the different attitudes. We find that the different attitudes cannot be ethically justified. We predict that the lack of ethical justification for distinguishing (...) between means of enhancement is likely to result in the eventual acceptance of genetic enhancement of intelligence. This article analyzes the comparative history of the law and practice of abortion and assisted reproduction in the United States to consider the interplay between medical paternalism and legal paternalism. It supplements existing critiques of paternalism as harmful to women's equality with the medical perspective, as revealed through the writings of Alan F. Guttmacher, to consider when legal regulation might be warranted.

The term “principle of sufficient reason” (PSR) was coined by Leibniz, and he is often regarded as its paradigmatic proponent. But as Leibniz himself often insisted, he was by no means the first philosopher to appeal to the idea that everything must have a reason. Histories of the principle attribute versions of it to various ancient authors. A few of these studies include—or at least do not exclude—medieval philosophers; one finds the PSR in Abelard, another finds it in Aquinas. And (...) while Leibniz retains pride of place in these histories, Spinoza is sometimes said to precede him “in appreciating the importance of the Principle and placing it at the center of his philosophical system.” In this paper, the author argues that the same should be said of the Islamic philosopher Avicenna. Writing 600 years before his early modern counterparts, Avicenna routinely and consistently appeals to the PSR in generating his metaphysical system. The paper aims first to establish that Avicenna deserves a position of prominence in histories of the PSR, and then to consider how he addresses certain challenges to the PSR, especially the threat posed by necessitarianism. Deleuze argued that a fundamental mutation in the concept of time occurred in Kant. In antiquity, the concept of time was subordinated to the concept of movement: time was a ‘measure’ of movement. In Kant, this relation is inverted: time is no longer subordinated to movement but assumes an autonomy of its own: time becomes "the pure and empty form" of everything that moves and changes. What is essential in the theory of time is not the distinction between objective ‘clock (...) time’ (or physical time) and the subjective experience of ‘time consciousness,’ since both of them measure movements, whether the movement of extensive objects or intensive states. What is fundamental is rather the relation between time and movement, since time can only assume its own concept when it ceases to be subordinate to movement, whether that movement is objective or subjective. This article examines how Kant inverted the relation between time and movement, and how Deleuze’s own theory of time builds on Kant’s revolution and extends it further. (shrink)

Introduction The provision of abortion services in the Republic of Ireland is legally restricted. Recent legislation that has been implemented allows for abortion if there is a real and substantial risk to the woman's life, but in general Irish women must travel abroad for abortion services. The aims of this study were to investigate the clinical experiences of Irish obstetric non-consultant hospital doctors that work in this environment and to assess their attitudes towards termination of pregnancy. Methods We conducted an (...) online cross-sectional descriptive survey of 184 Irish obstetric NCHDs. Quantitate and qualitative analysis was performed. Results There was a 28% response rate. 88% of respondents thought that ToP should be permitted for fatal fetal abnormality if the parents choose, 96% if the woman's health is severely affected and 86% in cases of rape and incest. Over 90% of respondents believed a woman's health suffers because of the need to travel abroad to undergo a ToP. Physical, psychological and social reasons were explored. The research also highlights that obstetric trainees are actively involved in the provision of preabortion and postabortion care. Conclusions The clinical experiences and opinions of the respondents suggest that the current legal availability of abortion in Ireland is insufficient to guide best clinical practice and does not represent the views of those that provide obstetric care. The current study examined youths’ and their parents’ perceptions concerning participation in an investigation of spontaneous and induced pain during recovery from laparoscopic appendectomy. Youth and their parents independently completed surveys about their study participation. On a scale from 0 to 10, both parents and youth rated their experience as positive. Among youth, experience ratings did not differ by pain severity and survey responses did not differ by age. Most youth reported that they would tell another youth to participate. Women are everywhere in Dune, especially the members of the Bene Gesserit Sisterhood. In the Dune universe, the Bene Gesserit give girls so much practice in honing their skills that it almost guarantees they will grow into supremely confident women who trust their bodies to follow through on any action they desire. The Bene Gesserit in Dune represent a fulfillment of the ideal of the liberated women Beauvoir and Young describe. If women were “given the opportunity to use their full (...) bodily capacities in free and open engagement with the world” and encouraged “to develop specific bodily skills,” they could overcome some of the challenges in a sexist society and make their goals a reality. Dualism has cast a long shadow in Western philosophy, making human bodies out to be burdens entrapping the minds within. In particular, the female body has been treated as a nuisance, even by feminists. (shrink)

According to the standard story of action, a story that can be traced back at least to David Hume , actions are those bodily movements that are caused and rationalized by a pair of mental states: a desire for some end, where ends can be thought of as ways the world could be, and a belief that something the agent can just do, namely, move her body in the way to be explained, has some suitable chance of making the world (...) the relevant way. My concern in this paper is with the claim that knowledge is a mental state – a claim that Williamson places front and centre in Knowledge and Its Limits. While I am not by any means convinced that the claim is false, I do think it carries certain costs that have not been widely appreciated. One source of resistance to this claim derives from internalism about the mental – the view, roughly speaking, that one’s mental states are determined by one’s (...) internal physical state. In order to know that something is the case it is not, in general, enough for one’s internal physical state to be a certain way – the wider world must also be a certain way. If we accept that knowledge is a mental state, we must give up internalism. One might think that this is no cost, since much recent work in the philosophy of mind has, in any case, converged on the view that internalism is false. This thought, though, is too quick. As I will argue here, the claim that knowledge is a mental state would take us to a view much further from internalism than anything philosophers of mind have converged upon. (shrink)

At first glance, Tommy Curry’s project in Another white Man’s Burden may seem like a strange undertaking. While American philosophers have been writing more frequently on Royce over the past decade, he remains a fairly peripheral figure. Those of us in Society for the Advancement of American Philosophy circles may be able to recognize terms like “Beloved Community” or “Loyalty to Loyalty” readily, but we would be hard-pressed to gain an audience for conversations about them at the American Philosophical Association’s (...) regional meetings. Royce rarely ends up on undergraduate syllabuses, and few people read Royce in the greater philosophical community. Royce is not Aristotle, Kant, or even Dewey. He is a... (shrink)

In this paper, I offer reasons for thinking that two prominent sceptical arguments in the literature – the underdetermination-based sceptical argument and the closure-based sceptical argument – are less philosophically interesting than is commonly supposed. The underdetermination-based argument begs the question against a non-sceptic and can be dismissed with little fanfare. The closure-based argument, though perhaps not question-begging per se, does rest upon contentious assumptions that a non-sceptic is under no pressure to accept.

This volume puts together twelve new essays by scholars who have done groundbreaking work in epistemology over the past four decades. Unfortunately, the editor’s brief introduction offers only a sketchy presentation of the papers and their background. Given the variety and complexity of the issues tackled, one would have expected a more detailed account of the nature and developments of the epistemological theories and arguments put forward and discussed by the contributors. The absence of such an account is all the (...) more surprising considering that the editor does not himself contribute a paper to the volume. (shrink)

There is increasing emphasis on the need for collaboration between practice and academic leaders in health care research. However, many problems can arise owing to differences between academic and clinical goals and timelines. In order for research to move forward it is important to name and address these issues early in a project. In this article we use an example of a participatory action research study of ethical practice in nursing to highlight some of the issues that are not frequently (...) discussed and we identify the impact of things not-named. Further, we offer our insights to others who wish to be partners in research between academic and practice settings. These findings have wide implications for ameliorating misunderstandings that may develop between nurse leaders in light of collaborative research, as well as for participatory action research. “The contemporary” is a phrase in frequent use in artworld discourse as a placeholder term for broader, world-picturing concepts such as “the contemporary condition” or “contemporaneity”. Brief references to key texts by philosophers such as Giorgio Agamben, Jacques Rancière, and Peter Osborne often tend to suffice as indicating the outer limits of theoretical discussion. In an attempt to add some depth to the discourse, this paper outlines my approach to these questions, then explores in some detail what these three theorists (...) have had to say in recent years about contemporaneity in general and contemporary art in particular, and about the links between both. It also examines key essays by Jean-Luc Nancy, Néstor García Canclini, as well as the artist-theorist Jean-Phillipe Antoine, each of whom have contributed significantly to these debates. The analysis moves from Agamben’s poetic evocation of “contemporariness” as a Nietzschean experience of “untimeliness” in relation to one’s times, through Nancy’s emphasis on art’s constant recursion to its origins, Rancière’s attribution of dissensus to the current regime of art, Osborne’s insistence on contemporary art’s “post-conceptual” character, to Canclini’s preference for a “post-autonomous” art, which captures the world at the point of its coming into being. I conclude by echoing Antoine’s call for artists and others to think historically, to “knit together a specific variety of times”, a task that is especially pressing when presentist immanence strives to encompasses everything. The disagreement between philosophers about the scientific worth of the evolutionary behavioral sciences (evolutionary psychology, human behavioral ecology, etc.) is in part due to the fact that critics and advocates of these sciences characterize them very differently. In this article, by analyzing quantitatively the citations made in the articles published in Evolution & Human Behavior between January 2000 and December 2002, we provide some evidence that undermines the characterization of the evolutionary behavioral sciences put forward by their critics.
