This dissertation evaluates the efforts of modern philosophers of aesthetics and politics to distinguish judgment from both cognition and volition. To see the rule under which any given particular is to be subsumed as a law fabricated and imposed by either God or reason is to characterize free judgment in terms of sovereignty. This generates the skeptical dilemma of an infinite regress of the legitimacy of the rule's application that can only be avoided by seeing the act of judgment as (...) an act of will. Such a voluntarist account of politics and judgment must in the end deny plurality for identity, and efface the categorical Aristotelian distinction between the public and the private. The rejection of the teleology of publicity is thus tied to the collapse of phronesis back into a Platonic techne that strives to produce society and man in the image of the eidos. ;Three "solutions" to this aporia are considered. The first is Hannah Arendt's appropriation for politics of Kant's aesthetic judgment, which allows for categorical distinctions between the public and the private and between judgment and the observance of rules. This project fails on account of the extreme formalism of that aesthetics. The second reads the third Critique as an allegory of politics. This too fails, as Kant's aesthetic community relies upon the productive legislation of the genius, a figure whose lineage reaches back to the half divine, half bestial figure of Machiavelli's founding prince. The third is a direct return to Aristotle. While his ethical philosophy offers us our best account of phronesis and epieikeia, it does not sufficiently engage the motivations for its own rejection. Hobbes, Locke, and Kant were not so taken with the model of mechanistic science that they simply forgot that in their common lives they regularly made judgments without the implicit or explicit guidance of a rule. The modern is better seen as a Weltanschauung, less a description that might be right or wrong than a desire. The alternative to the aporia of judgment is not found in the aesthetic but in a Wittgensteinian form of philosophical therapy. (shrink)

Kantian Courage considers how several figures in contemporary political theory--including John Rawls, Gilles Deleuze, and Tariq Ramadan--do just this as they continue Immanuel Kant's legacy.

This paper fundamentally deals with J. G. Fichte’s philosophical views, which reshapes intellectual-philosophical bases of the post-Enlightenment era and makes a strong criticism of Kantian thinking. Philosophically, Fichte’s philosophy, more representing a return to romanticism, will be debated on the basis of some concepts, among of which has been reason, science, tradition, religion, state, individual, and community. From his viewpoint, it will interrogate relationships among ego, morality and moral order. Based on these relationships, it will be tried to explain (...) what man’s moral nature is and how moral consciousness is conceptualized in Fichte’ thought. The debates between these concepts will provides basis for a political theory framed by Fichte. Also, it will indicate how a political theory there was developed, outlined by Fichte for German nation over two basic concepts, moral nature and moral consciousness. Taking account of all these discussions, in conclusion it will argue that his political theory had more liberal-conservative implications, along with nationalist ones. (shrink)

In this book, Stephen Acreman follows the development and reception of a hitherto under-analyzed concept central to modern and postmodern political theory: the Kantian ein erweiterte Denkungsart, or enlarged mentality. -/- While the enlarged mentality plays a major role in a number of key texts underpinning contemporary democratic theory, including works by Arendt, Gadamer, Habermas, and Lyotard, this is the first in-depth study of the concept encompassing and bringing together its full range of expressions. A number (...) of attempts to place the enlarged mentality at the service of particular ideals–the politics of empathy, of consensus, of agonistic contest, or of moral righteousness–are challenged and redirected. In its exploration of the enlarged mentality, the book asks what it means to assume a properly political stance, and, in giving as the answer ‘facing reality together’, it uncovers a political theory attentive to the facts and events that concern us, and uniquely well suited to the ecological politics of our time. The book will interest students of the Enlightenment, contemporary political theorists and philosophers, and a general audience concerned about the future of the relationship between Islam and the West. I argue that Rawls’ reading of Kant has been a major influence on the work of some contemporary Kantian scholars. Rawls’ influence on the new Kantian moral theory can be recognized in several points: a) the conception of philosophy as a “deeply practical project”, which leads to the adoption of a first-person approach to ethics; b) the reception of Kant’s philosophy within a pragmatic context, which leads to play down the metaphysical implications of Kant’s dualisms, in favor (...) of an interpretation which seems plausible within a political culture given in advance c) a characteristic interpretation of Kant’s moral constructivism, which while stressing the primacy of the right over the good, tries to specify the ways in which the good plays a role in morals, thereby opening a way to show the relevance of the empirical in Kant’s ethics d) an approach to Kant’s practical reason which stresses the complementarities between the Hypothetical and the Categorical Imperative, interpreted in the light of Rawls’ distinction between the Rational and the Reasonable; e) the central role played by the concept of “rational nature” in the new Kantian moral theory, which may likewise be related to Rawls’ concern for clarifying the conception of the person behind his approach to practical reason. WHEN Marx called Kant the "philosopher of the French Revolution," he did not have in mind the "jacobin" Kant who continued his enthusiastic support of the Revolution long after his freedom-loving younger contemporaries such as Schiller and Goethe had become disillusioned with its course. Marx’s image of Kant is in fact that of the "philosopher of the bourgeoisie" in its struggle for freedom from the constraints of the feudal order. The substitution of a socio-economic class for a political revolution (...) in these two phrases entails a dangerous reduction of politics to economics which typifies a caricatural Marxism. What is more, such a reduction of course distorts the object of analysis, be it the Kantian philosophy, the French Revolution, or our own contemporary socio-political context. (shrink)

The following is an introduction to a roundtable panel of the American Political Science Association meeting (Normative Political Theory Division) held September 2, 1994, in New York City. I set out some main themes in the "care/justice debate," and suggest that the impasse between care proponents and liberal, neo-Kantian thinkers is perpetuated by caricatured construals of these theories; salient differences come into relief by addressing the ethical and political applications of these moral perspectives.

This article suggests a Kantian reading of Rawls’s Political Liberalism. As much as Rawls distanced himself from a presentation of his theory in terms of a comprehensive Kantian moral doctrine, we ought to read it as a noncomprehensive Kantian moral-political theory. According to the latter approach, the liberal conception of justice is compatible with a plurality of comprehensive doctrines as long as they share the independently defined and grounded essentials of that conception of (...) justice—that is, as long as they are “reasonable,” to use the term that does most of the Kantian work. When John Rawls’ A Theory of Justice was published in 1971, it brought a strong, inspiring, and refreshing creative impetus in Anglo-Saxon philosophy. Since then, Rawls’ work has been criticized on several grounds, mainly related to its Kantian formalism. However, ideas and theories are not born and do not exist in a social and political vacuum. Read in different historical contexts they can reveal new meanings and deliver specific messages, which are tailored to specific audiences and (...) class='Hi'>political cultures. I argue in my paper that, reflecting this reality and my own life experience, Rawls’ conception of justice and of a well-ordered society always remains actual. An important part of this actuality is revealed in the manner in which the theory inspired Romanian society in its post-communist search for models of citizenship. It is also revealed by the message it delivers to today’s divided and polarized societies, where solidarity has been corroded by neoliberalism and a sense of fairness and reasonableness has been weakened by an increasingly noxious agonistic spirit. Political liberals argue that the classical conception of autonomy must be discarded because it is sectarian and metaphysical. This article rejects that a commitment to autonomy necessarily leads to sectarianism and questions the notion that respect for persons is separable from the commitment to autonomy. It defends a Kantian approach to autonomy, as belonging to the standpoint of practical reason, and argues that in this approach autonomy is a norm regulating how we should treat each other as opposed (...) to a good to be promoted. This approach also avoids the metaphysical idea of autonomy as self-origination of binding principles. (shrink)

Kant is often regarded as one of the founding fathers of modern liberal democracy. His political theory reaches its climax in the ground-breaking work, Perpetual Peace (1795), which sets out the basic framework for a world federation of states united by a system of international law. What is less well known is that two years earlier, in his Religion within the Bounds of Bare Reason (1793/1794), Kant had postulated a very different, explicitly religious path to the politics of (...) peace: he presents the idea of an “ethical community” as a necessary requirement for humanity to become “satisfactory to God”. While many recent scholars have noted the importance of Kant’s concept of the ethical community, few recognize the force of his argument that such a community is possible only if it takes the form of a church; as a result, the precise status of his proposal remains unclear and under-appreciated. He argues in Division One, Section IV, of Religion’s Third Piece that the idea of this community can become a reality only through a “church” that is characterized by four rational requirements: unity, integrity, freedom, and the changeability of all church rules except these four unchangeable marks. Prior to Section IV, Division One portrays this ethical community as having a political form, yet an essentially nonpolitical matter. He compares it with Jewish theocracy, but observes that the latter failed to be an ethical commonwealth because it was explicitly political. Whereas traditional theocracy replaces the political state of nature (which conforms to the law, “might makes right”) with an ethical state of nature (which conforms to the law that I call, “should makes good”), or attempts to synthesize them, non-coercive theocracy transcends this distinction through a new perspective: it unites humanity in a common vision of a divine legislator whose only law is inward, binding church members together like families, through the law of love. Whereas the legal rights supported by democracy and a system of international law can go a long way to prepare for world peace, Kant’s conviction is that it will be ultimately impossible without support from healthy religion. People don’t just compete, however; they also cooperate. John Roemer argues that attempts by orthodox game theorists to account for cooperation leave much to be desired. Unlike competing players, cooperating players take those actions that they would like others (...) to take—which Roemer calls “Kantian optimization.” Through rigorous reasoning and modeling, Roemer demonstrates a simpler theory of cooperative behavior than the standard model provides. In this short but intriguing book, Elisabeth Ellis tackles the problem that our political language is misleadingly full of clashes between conclusive political principles, when in fact our political actions necessarily take place in a world too complex and changing for such fixed answers. Drawing upon the work of Immanuel Kant, Ellis proposes to clarify our political talk and reasoning by replacing the language of conclusive principles with that of provisional reasoning. It is the aim of (...) the book to describe a theory of provisional politics derived from Kant's political writings, to show that provisional reasoning is a better tool for modern-day democratic politics than conclusive reasoning, and to demonstrate the effectiveness of provisional reasoning about political policies through a series of case studies of contemporary political issues.According to Ellis, to theorize provisionally is to "always leave open the possibility of entering into a rightful condition" . In particular, provisional theory takes as a given that agency and plurality are basic conditions of politics—not that they are "absolute precepts," but rather "conditions of principled political action as such" . The article considers the modern meaning of Kant’s doctrine of war. The author examines the context and content of the key provisions of Kant’s concept of perpetual peace. The author also reviews the ideological affinity between Kant and previous authors who proposed to build alliances of states as a means of preventing wars. It is noted that the French revolution and the wars caused by it, the peace treaty between France and Prussia served as the historical background for the conceptualization (...) of Kant’s project. In the second half of the 20th century, there is a growing attention to Kant’s ethical and political philosophy. Theorists of a wide variety of political and ethical schools, pay attention to Kant’s legacy and relate their own concepts to it. Kant’s idea of war is reconsidered by Michael Doyle, Jürgen Habermas, Ulrich Beck, Mary Kaldor, Brian Orend. Thus, Doyle tracks democratic peace theory back to Kant’s idea of the spread of republicanism. According to democratic peace theory, liberal democracies do not solve conflict among themselves by non-military methods. Habermas, Beck, Kaldor appreciate Kant as a key proponent of cosmopolitanism. For them, Kant’s project is important due to notion of supranational forms of cooperation. They share an understanding that peace will be promoted by an allied authority, which will be “governing without government” and will take responsibility for the functioning of the principles of pacification of international relations. Orend’s proves that Kant should be considered as a proponent of the just war theory. In addition, Orend develops a new area in just war theory – the concept of ius post bellum – and justifies regime change as the goal of just war. (shrink)

In times of a prevailing sense of crisis and disorder in modern politics, there is a growing sentiment that anger, despair or resignation are more appropriate attitudes to navigate the world than hope. Political philosophers have long shared this suspicion and shied away from theorising hope more systematically. The aim of this article is to resist this tendency by showing that hope constitutes an integral part of democratic politics in particular. In making this argument I draw on Kant’s conceptualisation (...) of hope as a psychological condition on action under circumstances where the chances of making a difference are dim. Given that the Kantian agent avoids the threat of despair in the pursuit of political goals by placing trust in her fellow citizens, hope has the potential to positively transform democratic practices. This article explores the relevance of ontological assumptions for justifications of agency and ethics. It critiques Kantian ethics for being based upon an ontological imaginary that starts from the substantialism of Newtonian physics. Substantialism shapes Western political philosophy’s view about who we are as subjects and how the world works. In this ontological imaginary, validation of ethics is based upon universality and abstractions. Furthermore, Kantian ethics underscores an anthropocentric and theocratic vision of how to govern societies. I (...) argue Kantian criteria are not only insufficient to make good choices but are also conducive to wrong ones, since they elicit self-appeasement in international intervention, and contribute to the conceptual repertoire of coloniality. I propose that an ontology of entanglements opens possibilities for overcoming the shortcomings of an ethos based upon abstractions and possibly for correcting some of its moral failures. In a quantum ontological imaginary, the validation of ethical choices relies instead upon the exploration of the apparatuses we deploy, as well as upon careful situational evaluation. Specific practices, rather than an abstract humanity, are the referents for devising such ethos. This position, I argue, resonates with the critical project of decoloniality and its acknowledgment of the political salience of ontological imaginaries. (shrink)

In this paper, I present the beginnings of a resemblance theory of representation. I start by surveying the contemporary philosophical debate surrounding musical representation and reveal that its main interlocutors share a conception of artistic representation as a mode of meaningful communication. I then show how conceiving of artistic representation in this way severely limits music’s possibilities as a medium for representation. Next, I propose an alternative conception of representation that, despite its widespread acceptance outside of the philosophy of (...) art, has been largely denigrated within it: namely, that representation fundamentally depends on structural resemblance. Finally, I demonstrate how conceiving of artistic representation as grounded upon structural resemblances, rather than as a mode of meaningful communication, provides us with a more accurate picture of both (a) how music represents and (b) how we perceive and appreciate musical representations. Journal of International Political Theory, Ahead of Print. The contemporary international regime of law and politics regarding human migration largely follows Immanuel Kant’s contradictory approach, supporting the cosmopolitical rights of humans to move and expect hospitality while privileging the rights of sovereign states to assert territorial security against movement. International Relations scholars informed by Jacques Derrida’s ethical theory argue that one may press this tension to positive dynamics through affirmation of the aporia that a secured home is (...) a requirement for the possibility of the hospitality that might undo conflict between migrants and emplaced citizens. Yet, the attraction of Derrida’s critical Kantianism and this revival of hospitality depends on asserting the primacy of habitation to how citizen subjects stand with respect to foreigners who move. It depends on neglecting how any assumption of home is not based on a given home but, rather, on movements to impose the boundaries and bounty of a home. No one faces the movement of others who seek to make home from the position of home but only also in movements of homemaking. Both the citizen and the migrant move in forms of imposition. And it is only in a politics of imposition that rights to move can be affirmed and gain respect. (shrink)

This chapter explores the relationship between republican democracy and justice by comparing Philip Pettit's notion of neo-republicanism with that of Immanuel Kant. It begins by describing a republican, political conception of justice as nondomination and explaining why the discourse of republicanism and that of theories of justice often remain at odds with one another. It then considers the basis of a republican conception of justice as nondomination and locates it within the principle of justification, along with Pettit's idea of (...) autonomy and respect. It also examines the notions of ‘arbitrariness’ and ‘domination’ as well as Pettit's ‘negative republicanism’ and its emphasis on legally and politically secure freedom of choice. The chapter argues that a Kantian interpretation of modern republicanism is more convincing than Pettit's ‘negative republicanism’. (shrink)

This dissertation defends the place of representation in music. Music’s status as a representational art has been hotly debated since the War of the Romantics, which pitted the Weimar progressives (Liszt, Wagner, &co.) against the Leipzig conservatives (the Schumanns, Brahms, &co.) in an intellectual struggle for what each side took to be the very future of music as an art. I side with the progressives, and argue that music can be and often is a representational medium. Correspondence (or resemblance) theories (...) of representation, such as the one I offer, have been much maligned in philosophy since the 1960s. Most theories assimilate representation under “meaning,” which has usually been thought to belong primarily to language. As a result, representational content has been taken to be purely conventional in the way that sentential meaning is. People want to know what music “means,” and these theories interpret this as “what does it refer to?” or “what propositions does it express?” I argue that propositional communication is only one (small) part of the issue. Once we overcome the bias of conceiving of musical works as essentially linguistic items, speech acts (performed) or sentence tokens (written), we can begin to take music on its own terms to discover how it represents—one way in which it “means.” The first step is to “naturalize” music’s representational content. Influenced by recent discussions in the philosophies of mind and science, I argue in Chapter 1 that composers represent extra-musical objects, events, and states of affairs through their works by exploiting antecedent relations (such as similarities in pitch, timbre, and structure) in order to secure reference to them. In Chapter 2, I survey and respond to the main challenges that those skeptical of music’s representational possibilities would raise against my theory of musical representation. In Chapter 3, I explore a number of ways through which music has been claimed to represent in order to show how my theory accounts for these diverse phenomena better than its conventionalist rivals, both in terms of the metaphysics and the epistemology. Chapter 4 extends this discussion by offering an account of how we perceive, understand, appreciate, and interpret sophisticated musical representations. I conclude by teasing out some of my theory’s implications and suggesting areas for further research. (shrink)

In the title of his 1980 Dewey Lectures, John Rawls announced that his theory of justice as fairness could be described as an example of “Kantian Constructivism in Moral Theory” (KC). Rawls flirted around 1980 with a strong commitment to Kantian autonomy, only to abandon it as unnecessary to the justification of his theory of justice. The chapter argues that this supposed opposition is based on a serious misunderstanding of Rawls's intellectual trajectory, and especially of (...) the way he understands the Kantian elements of his theory. It shows that, against the assumptions of the familiar debates, Rawls in and after KC, consistently held that the practical aims of constructivism and the philosophical goal of a fully rational justification are not in any sort of tension. Rawls's claims in Political Liberalism and after, and especially his distinction between his political and Kant's moral constructivism, in no way undermine this argument. (shrink)

This article shows that themethodologyof Mills’ ‘Black Radical Kantianism’ (BRK) represents a major plot twist for Kant studies as well as contemporary political philosophy utilizing Kantian ideas. BRK is no mere upgrade of Kant’s or Kantian ideal theory for racial justice. Mills’ methodology requires us to positboththat the real Kant and establishment Kantianism have been racist, sexist and Eurocentric;andthat only by first admitting and reckoning with the compatibility of white supremacy and liberal egalitarianism can we hope (...) to radicalize Kant or Kantianism. Levine’s Kantian reading of Rousseau’s social contract is a legitimate enterprise. Accordingly, he rightly distinguishes the a priori from the a posteriori elements of the work. The former becomes the ground of liberty, rebaptized as autonomy. The latter is devoted to a discussion of the relation of theory to practice.

This article examines where Kant stands on the question of the redistribution of wealth and income both nationally and globally. Kant is rightly seen as a radical reformer of the world order from a political standpoint seeking a republican, federative worldwide system; can he also be seen as wanting to bring about an equally dramatic shift from an economic perspective? To answer this question we have first of all to address the question of whether he is an egalitarian or (...) an inegalitarian at the national level. Certainly there are certain social and material inequalities within a civil society Kant is prepared to accept and there are some he is not. This would imply that he would affirm certain inequalities at an international level and that there are others upon which he would recommend action. Thus the question arises as to whether or not it is appropriate for Kantians to regard the current enormous inequalities in wealth and income between individuals living in different parts of the globe as scandalous and in need of change. The paper throughout relates the problem of distributive justice within the state to the problem of distributive justice amongst states, arguing that this approach is warranted by Kant's own method. Particular attention is paid to how Kant's own approach to political philosophy may be deployed to underpin a change to a distinctive type of international distributive justice. (shrink)

Deliberative or discursive models of democracy have recently enjoyed a revival in both political theory and policy practice. Against the picture of democracy as a procedure for aggregating and effectively meeting the given preference of individuals, deliberative theory offers a model of democracy as a forum through which judgements and preferences are formed and altered through reasoned dialogue between free and equal citizens. Much in the recent revival of deliberative democracy, especially that which comes through Habermas and (...) Rawls, has Kantian roots. Deliberative institutions are embodiments of the free public use of reason that Kant takes to define the enlightenment project. Within the Kantian model the public use of reason is incompatible with the use of rhetoric. While this paper rejects strong rhetorical criticisms of deliberative democracy which render all communication strategic, it argues that rhetorical studies of deliberation have highlighted features of deliberation which point to significant weaknesses in Kantian approaches to it. Two features are of particular importance: the role of testimony and judgements of credibility in deliberation; and the role of appeal to emotions in public discourse. Both from the Kantian perspective are potential sources of heteronomy. However, the appeal to testimony and emotion are features of public deliberation that cannot and should not be eliminated. For those committed to the enlightenment values that underlie the deliberative model of democracy the question is whether these rhetorical features of deliberation are incompatible with those values. The paper argues that they are compatible. It does so by defending an Aristotelian account of rhetoric in public deliberation which denies the Platonic contrast between reasoned discourse and rhetoric which the Kantian model inherits. The contemporary international regime of law and politics regarding human migration largely follows Immanuel Kant’s contradictory approach, supporting the cosmopolitical rights of humans to move and expect hospitality while privileging the rights of sovereign states to assert territorial security against movement. International Relations scholars informed by Jacques Derrida’s ethical theory argue that one may press this tension to positive dynamics through affirmation of the aporia that a secured home is a requirement for the possibility of the hospitality that might (...) undo conflict between migrants and emplaced citizens. Yet, the attraction of Derrida’s critical Kantianism and this revival of hospitality depends on asserting the primacy of habitation to how citizen subjects stand with respect to foreigners who move. It depends on neglecting how any assumption of home is not based on a given home but, rather, on movements to impose the boundaries and bounty of a home. No one faces the movement of others who seek to make home from the position of home but only also in movements of homemaking. Both the citizen and the migrant move in forms of imposition. And it is only in a politics of imposition that rights to move can be affirmed and gain respect. (shrink)

Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Border Crossings presents an effort to (...) remedy this situation, fully launching a new era in political theory. Thirteen scholars from around the world examine the various political traditions of West, South, and East Asia and engage in a reflective cross-cultural discussion that belies the assumptions of an Asian "essence" and of an unbridgeable gulf between West and non-West. The denial of essential differences does not, however, amount to an endorsement of essential sameness. As viewed and as practiced by contributors to this ground-breaking volume, comparative political theorizing must steer a course between uniformity and radical separation--this is the path of "border crossings.". Kant’s non-voluntarist conception of political obligation has led some philosophers to argue that he would reject self-government rights for indigenous peoples. Some recent scholarship suggests, however, that Kant’s critique of colonialism provides an argument in favor of granting self-government rights. Here I argue for a stronger conclusion: Kantian political theory not only can but must include sovereignty for indigenous peoples. Normally these rights are considered redress for historic injustice. On a Kantian view, however, I argue (...) that they are not remedial. Sovereignty rights are a necessary part of establishing perpetual peace. By failing to acknowledge the sovereignty of native groups, states once guilty of imperialism leave open the in principle possibility for future violence, even though no current conflict exists. Only in recognizing self-government rights can states truly commit to the cosmopolitan ideal. (shrink)

Political constructivism is associated with John Rawls more than any other contemporary philosopher. This chapter suggests that Rawls's political constructivism is better understood as a general method of justification which runs throughout his work as a whole, including his early work and A Theory of Justice. The chapter develops the general characterization of Rawls's political constructivism. Its main elements are taken in turn and developed with special attention to the two places where Rawls discusses the topic (...) in depth – his Dewey Lectures on Kantian Constructivism in Moral Theory and its substantially revised version called “Political Constructivism” (PL, Lecture III). The main elements include social role, sources, interpretive basis, representation and conclusion. Rawls endorsed a Kantian metaethical constructivism in part because it offered a way of more deeply characterizing how his previous political constructivism could be a live and distinct possibility. A traditional interpretation holds that Kant's political theory simply constitutes an account of the constraints which reason places on the state's authority to regulate external action. Alexander Kaufman argues that this traditional interpretation succeeds neither as a faithful reading of Kant's texts nor as a plausible, philosophically sound reconstruction of a `Kantian' political theory. Rather, he argues that Kant's political theory articulates a positive conception of the state's role.
