In my paper, I will argue that in the liberal tradition of thinking, illiberal practices of minority groups cannot be supported without interventions that already liberalize illiberal cultures. For example, positive group rights have to be evaluated in ways that demand democratization. Moreover, nonintervention with conditions, such as the right of exit, will fail to be noninterventive if taken seriously because illiberal treatment of individuals diminishes their ability to actualize their rights of exit. In addition, nonintervention as a basis of (...) cultural preservation is based on a view of culture that is misleading in portraying minority cultures as entities where changes in the group could be differentiated into internal and external. I will claim that intervention is not as intrusive as often perceived, and, moreover, can be crucial for the wellbeing of women. (shrink)

This article is intended to raise the question of whether sacrifice can be regarded as constituting a deep ethical structure in the relationship between patient and carer. The significance of sacrifice in a patient-carer relationship cannot, however, be fully understood from the standpoint of the consistently utilitarian ethic that characterizes today’s ethical discourse. Deontological ethics, with its universal principles, also does not provide a suitable point of departure. Ethical recommendations and codices are important and can serve as general sources of (...) knowledge when making decisions, but they should be supplemented by an ethic that takes into consideration contextual and situational factors that make every encounter between patient and carer unique. Caring science research literature presents, on the whole, general agreement on the importance of responsibility and devotion with regard to sense of duty, warmth and genuine engagement in caring. That sacrifice may also constitute an important ethical element in the patient-carer relationship is, however, a contradictory and little considered theme. Caring science literature that deals with sacrifice/self-sacrifice indicates contradictory import. It is nevertheless interesting to notice that both the negative and the positive aspects bring out the importance of the concept for the professional character of caring. The tradition of ideas in medieval Christian mysticism with reference to Lévinas’ ethic of responsibility offers a deeper perspective in which the meaningfulness of sacrifice in the caring relationship can be sought. The theme of sacrifice is not of interest merely as a carer’s ethical outlook, but sacrifice can also be understood as a potential process of transformation towards health. The instinctive or conscious experience of sacrifice on the part of the individual patient can, on a symbolic level, be regarded as analogous to the cultic or religious sacrifice aiming at atonement. Sacrifice appears to the patient as an act of transformation to achieve atonement and healing. Atonement then implies finding meaningfulness in one’s suffering. The concept of sacrifice, understood in a novel way, opens up a deeper dimension in the understanding of suffering and makes caring in ‘the patient’s world’ possible. (shrink)

Once symbolized by a burning armchair, experimental philosophy has in recent years shifted away from its original hostility to traditional methods. Starting with a brief historical review of the experimentalist challenge to traditional philosophical practice, this chapter looks at research undercutting that challenge, and at ways in which experimental work has evolved to complement and strengthen traditional approaches to philosophical questions.

Cécile Laborde has argued that the freedom we think of as ‘freedom of religion’ should be understood as a bundle of separate and relatively independent freedoms. I criticise that approach by pointing out that it is insufficiently sensitive to facts about the sorts of entities that liberal states are. I argue that states have good reasons to mould phenomena such as religion into easily governable monoliths. If this is a problem from the normative point of view, it is not due (...) to descriptively inadequate accounts of religion, but a problem with a lack of realism about the sort of institutions states are. My conclusion is a three-way disjunction: either one must reckon with liberal states’ historically determined limitations in the management of changing social phenomena, or one should direct one’s frustration at the marriage of liberalism and the state, or the very existence of states is normatively problematic. The paper addresses the issue of a relatively new institution of criminal procedural law in Latvia. The article is relevant due to the need for an effective mechanism for the objective possibility of realization of the right person for the completion of the criminal process in a reasonable time. Analysis of the European Court of Human Rights has allowed some conclusions that should be considered when investigating criminal cases.

There is an intuitive connection between well-being and happiness. Accordingly, many theories of well-being hold that well-being consists in (either unqualified or properly qualified) happiness. Traditional happiness-based theories are subject, however, to several important objections. The goal in this chapter is to offer a new happiness-based theory that is immune to the main objections raised against traditional happiness-based theories. The authors’ own fitting happiness theory of well-being can be seen as the combination of the following claims. The first is that (...) happiness consists in a broadly positive balance of affective states such as emotions, moods, and sensory pleasures. The second is that emotions, moods, and sensory pleasures are different kinds of perceptual experiences of evaluative properties. The third claim is that, insofar as happiness is constituted by states that have fittingness conditions, it is possible to assess happiness itself as fitting or unfitting. The last claim is that well-being consists in fitting happiness thus defined. (shrink)

This work is the first monograph devoted to the interpretation of Aristotle’s theory of chance in Physics II 4-6 and its implications and projections in other treatises, including an original and comprehensive account of the Aristotelian conception of chance, of accidental causality in the realm of nature, and of accidental causality in the realm of human action. One of the main interpretative issues around Aristotle’s discussion of chance is its relation to the four causes and to teleology. In this sense, (...) it is particularly difficult to find the common features which fortune (tyche) and spontaneity (automaton) share. This work, offers such an interpretation of Aristotle’s general concept of chance (i.e. common to fortune and spontaneity), which shows clearly its relation with his theory of causality (Phys. II 3), with teleology, and with the application of this theory to the study of nature. It also shows how fortune and spontaneity can be interpreted consistently with this general characterization of chance, and how the specific differences between them can be accounted for paying attention to the different structures of causality in the realm of nature and in the realm of human action. Regarding the specific concept of spontaneity (automaton), a crux interpretum, the book offers one of the few independent discussions this issue in Aristotelian literature, and proposes a sub-classification in two kinds of spontaneity based on an analysis of Aristotle’s different examples and characterizations: ‘mixed spontaneity’ (which shares some features with fortune), and ‘pure spontaneity’ (which takes place strictly in the realm of nature). These different structures had not been recognized in specialized literature before. The problem of chance has projections into Aristotle’s natural philosophy, as well as into Aristotle’s theory of action and practical philosophy. This ample perspective of Aristotle’s work, and of the different explanatory models and ontological structures therein involved, constitutes an interesting groundwork for future developments in some or many of these realms of investigation. Our view is that the folk concept of knowing how is more complicated than many epistemologists assume. We present four studies that go some way towards supporting our view—that the folk concept of knowledge-how is a philosophical hybrid, comprising both intellectualist and anti-intellectualist features. One upshot is, if we are going to award a presumptive status to philosophical theories of know-how that best accord with the folk concept, it ought to go to those that combine intellectualist and anti-intellectualist elements.

Is there more to the recent surge in political realism than just a debate on how best to continue doing what political theorists are already doing? I use two recent books, by Michael Freeden and Matt Sleat, as a testing ground for realism’s claims about its import on the discipline. I argue that both book take realism beyond the Methodenstreit, though each in a different direction: Freeden’s takes us in the realm of meta-metatheory, Sleat’s is a genuine exercise in grounding (...) liberal normative theory in a non-moralistic way. I conclude with wider methodological observations. I argue that unlike communitarianism (the previous contender for the discipline’s renewal), realism has the potential to open new vistas, though their novelty is to a large extent relative to the last forty years or so: realism is best thought of as a return to a more traditional way of doing political philosophy. Do salient normative claims about politics require moral premises? Political moralists think they do, political realists think they do not. We defend the viability of realism in a two-pronged way. First, we show that a number of recent attacks on realism, as well as realist responses to those attacks, unduly conflate distinctively political normativity and non-moral political normativity. Second, we argue that Alex Worsnip and Jonathan Leader-Maynard’s recent attack on realist arguments for a distinctively political normativity depends on assuming moralism (...) as the default view, which places an excessive burden on the viability of realism, and so begs the question. Our discussion, though, does not address the relative merits of realism and moralism, so its upshot is relatively ecumenical: moralism need not be the view that all apt normative political judgments are moral judgments, and realism need not be the view that no apt normative political judgments are moral judgments. From Physical World to Transcendent God(s): Mediatory Functions of Beauty in Plato, Dante and Rupa Gosvami -/- Dragana Jagušić -/- In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels (...) of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. El presente trabajo se centra en identificar si, dentro del debate actual sobre el rol de la tecnología y sus implicancias en la vida de las personas, la filosofía de Langdon Winner indaga en la naturaleza y el significado de las construcciones artificiales desde una posición determinista. De modo que, buscaremos descubrir los caminos argumentales que propone Langdon Winner para explicar cómo se elige y se construye un sistema técnico que involucra a los humanos como partes de su funcionamiento. Entendiendo (...) que un sistema técnico es una forma de vida. En primer lugar, abordaremos el debate sobre sobre el papel de la tecnología y sus implicancias ético- políticas, para esto compararemos las principales teorías que son parte del debate antes mencionado: la teoría instrumental, la teoría sustantivista, la teoría crítica y el determinismo tecnológico. En segundo lugar, analizaremos el rol de la tecnología en el pensamiento de Langdon Winner. Podemos resaltar tres formas, que se relacionan entre sí, en que Winner considera a la tecnología como fenómeno político, como forma de vida y como técnica incontrolada. En tercer lugar, buscaremos demostrar que su teoría no pertenece al determinismo tecnológico. Para esto, abordaremos el determinismo como problema filosófico luego explicaremos en qué consiste el determinismo tecnológico y las condiciones que debe cumplir una teoría para ser enmarcada como determinista. Para, finalmente, contrastar estas condiciones con la teoría filosófica de Langdon Winner y definir si puede o no ser considerada determinista. (shrink)
