Recognizing Justice For Citizens With Cognitive Disabilities engages with the most prominent liberal theories of justice today in revealing the path toward equal justice for citizens with cognitive disabilities.

Writings by a thinker—a psychiatrist, a philosopher, a cybernetician, and a poet—whose ideas about mind and brain were far ahead of his time. Warren S. McCulloch was an original thinker, in many respects far ahead of his time. McCulloch, who was a psychiatrist, a philosopher, a teacher, a mathematician, and a poet, termed his work “experimental epistemology.” He said, “There is one answer, only one, toward which I've groped for thirty years: to find out how brains work.” Embodiments of (...) Mind, first published more than fifty years ago, teems with intriguing concepts about the mind/brain that are highly relevant to recent developments in neuroscience and neural networks. We face reality presented with the data of conscious experience and nothing else. The project of early modern philosophy was to build a complete theory of the world from this starting point, with no cheating. Crucial to this starting point is the data of conscious sensory experience – sense data. Attempts to avoid this project often argue that the very idea of sense data is confused. But the sense-data way of talking, the sense-data language, can be freed from every blemish (...) using ideas from contemporary metaontology. We can adopt a sense-data framework that vindicates the traditional claims of sense-data theories and leads to plausible theories of perception and color. We can, we should, and in a sense, we must. Yet when we do, we face the traditional problem of external world skepticism, head-on. The real challenge of skepticism is forced upon us; it cannot honestly be avoided using externalist tricks, burden of proof shifting, or other razzle dazzle. But the challenge can be met: we are rational to posit the external world as the best explanation of the many synchronic and diachronic patterns over our sense-data. This paper argues for all of these points and ends with a plea for analytic empiricism – a traditional sense-data version of empiricism that uses all of the tools of analytic philosophy while avoiding the more questionable doctrines of the Vienna Circle (phenomenalism, verificationism). Analytic empiricism is our last best hope for completing the great philosophical project of early modern philosophy. (shrink)

Marxism's collapse in the twentieth century profoundly altered the style and substance of Western European radical thought. To build a more robust form of democratic theory and action, prominent theorists moved to reject revolution, abandon class for more fragmented models of social action, and elevate the political over the social. Acknowledging the constructedness of society and politics, they chose the "symbolic" as a concept powerful enough to reinvent leftist thought outside a Marxist framework. Following Maurice Merleau-Ponty's Adventures of the Dialectic, (...) which reassessed philosophical Marxism at mid century, Warren Breckman critically revisits these thrilling experiments in the aftermath of Marxism. The post-Marxist idea of the symbolic is dynamic and complex, uncannily echoing the early German Romantics, who first advanced a modern conception of symbolism and the symbolic. Hegel and Marx denounced the Romantics for their otherworldly and nebulous posture, yet post-Marxist thinkers appreciated the rich potential of the ambiguities and paradoxes the Romantics first recognized. Mapping different ideas of the symbolic among contemporary thinkers, Breckman traces a fascinating reflection of Romantic themes and resonances, and he explores in depth the effort to reconcile a radical and democratic political agenda with a politics that does not privilege materialist understandings of the social. Engaging with the work of Claude Lévi-Strauss, Cornelius Castoriadis, Claude Lefort, Marcel Gauchet, Ernesto Laclau, Chantal Mouffe, and Slavoj Žižek, Breckman uniquely situates these important theorists within two hundred years of European thought and extends their profound relevance to today's political activism. Daniel Dennett’s Consciousness Explained is probably the most widely read book about consciousness ever written by a philosopher. Despite this, the book has had a surprisingly small influence on how most philosophers of mind view consciousness. This might be because many philosophers badly misunderstand the book. They claim it does not even attempt to explain consciousness, but instead denies its very existence. Outside of philosophy the book has had more influence, but is saddled by the same misunderstanding. Now, 30 years (...) after publication, Consciousness Explained deserves reconsideration from anyone interested in consciousness. Here I make a case for this. To start, I will clear up the central misunderstanding of the book. With that done, I will explain and update Dennett’s tantalizing approach to consciousness and the mind. The result brings us very, very close to explaining consciousness. Or so I will argue. (shrink)

Quietist Moral Realists accept that there are moral facts and properties, while aiming to avoid many of the explanatory burdens thought to fall on traditional moral realists. This chapter examines the forms that Quietist Moral Realism has taken and the challenges it has faced, in order to better assess its prospects. The best hope, this chapter argues, lies in a pragmatist approach that distinguishes the different functions of diverse areas of discourse. This paves the way for a form of Quietism (...) that does not simply remain quiet about the explanatory demands of metaethics, but rather is able to diagnose where they go wrong. By combining a neopragmatic analysis of the discourse with an easy approach to ontology, , we can develop a form of Quietist Moral Realism that is far stronger than critics of quietism have appreciated. Adam Smith writes favorably about innovation in Wealth of Nations while writing unfavorably about a figure associated with innovation: the projector. His criticism of projectors prompts many scholars to claim that Smith disapproves of entrepreneurship. But Smith criticizes the projector not because he acts as an entrepreneur but because he fails to meet Smith’s moral standards for entrepreneurship. In Theory of Moral Sentiments, Smith conceives of a framework for moral entrepreneurship based on prudence. The framework consists of two principles: first, (...) approach everyday matters with the general “tenor of conduct” that governs your life and trade, and second, approach life-changing matters with prudence and justice. Recognizing that Smith is concerned with the total effect that an entrepreneurial venture has on society beyond its immediate profits opens the door to engage with contemporary research that studies the ethical and moral externalities of entrepreneurship. ABSTRACTThis article explores agnotology and ways of not knowing in the context of gender in engineering. It presents an empirically-emergent, three-part typology of ways of not knowing about gender based on interviews with engineering professors, and contributes to the growing body of scholarship on agnotology. Just as knowledge is inseparable from issues of power, so too are areas of non-knowledge, and it is important to understand how, and to what ends, non-knowing is produced. Once upon a time, logical conventionalism was the most popular philosophical theory of logic. It was heavily favored by empiricists, logical positivists, and naturalists. According to logical conventionalism, linguistic conventions explain logical truth, validity, and modality. And conventions themselves are merely syntactic rules of language use, including inference rules. Logical conventionalism promised to eliminate mystery from the philosophy of logic by showing that both the metaphysics and epistemology of logic fit into a scientific picture of reality. For naturalists of all (...) stripes, this was paradise. Alas, paradise was lost. By the end of the twentieth century, logical conventionalism had been almost universally abandoned. But more recently, it has been revitalized. This chapter provides an overview of logical conventionalism and its history, clears away misunderstandings, and briefly responds to both the canonical objections to conventionalism (from Quine, Dummett, Boghossian, and many others) as well as new objections (from Field and Golan). Because of the “all-or-none” character of nervous activity, neural events and the relations among them can be treated by means of propositional logic. It is found that the behavior of every net can be described in these terms, with the addition of more complicated logical means for nets containing circles; and that for any logical expression satisfying certain conditions, one can find a net behaving in the fashion it describes. It is shown that many particular choices among possible neurophysiological assumptions (...) are equivalent, in the sense that for every net behaving under one assumption, there exists another net which behaves under the other and gives the same results, although perhaps not in the same time. STS scholarship has produced important insights about relationships between the roles of peer review and the social construction of knowledge. Yet, barriers related to access have been a continual challenge for such work. This article overcomes some past access challenges and explores peer review normativities operating in the new discipline of Engineering Education. In doing so, it contributes new insights about disciplinary development, interdisciplinarity, and peer review as a site of knowledge construction. In particular, it draws attention to an aspect (...) of peer review not previously discussed – how peer review normativities are shaped by disciplinary origins. A content analysis of peer review documentation revealed that a hyperfocus on methods, which can be traced back to disciplinary origins, continues to be a guiding normativity. However, interviews with editors revealed that they do not acknowledge that normativity. Implications of those findings and their misalignment are discussed, as are contrasts with the history of other disciplines. (shrink)

Key figures such as Edmund Husserl, his sons Wolfgang and Gerhart, Max Scheler, Edith Stein, Adolf Reinach, Martin Heidegger, and others are included in this collection of materials. Drawing on a variety of philosophical, theoretical and methodological approaches, the book examines how researchers relate to and with their participants before, during, and after the collection and/or production of data; reimagining the rights of participants, the role/s of participants, the concept/s of "participant" itself.

International Law in Context is a pedagogy-forward textbook. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. It covers (...) the various actors within the system, the theories that help explain their behavior, and the principles and sources of law they create. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. Part Three is a capstone section that asks students to weave together everything they have learned in Parts One and Two. Students will engage in normative development regarding climate change, including the existing international treaty regime and U.S. implementation options, and the law of war in the modern age. The cornerstone of this book is its organization. The text groups material into conceptual frameworks that promote understanding and retention. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Under this umbrella, the author discusses (a) State Jurisdiction; (b) The Reception of International Law into the Domestic Sphere; (c) The Qualification as a State Forum or State Litigant (i.e., Recognition of States & Governments); and (d) Protections Afforded Within the Forum: Sovereign, Diplomatic, and Consular Immunity. A typical coursebook might locate this material in four different chapters. The conceptual framework approach, however, allows students to see the big picture and the relationship between concepts. In addition to the frameworks, there are several other innovative pedagogical devices that support student learning. There are Foundation Questions that initially direct readers through the material and cumulatively help students confirm whether they have grasped key takeaways from each section. There also are Assessment Sets in each section, which provide students with immediate opportunities to apply material and gauge their understanding, and "Why Is This Important (a/k/a WITI Moment)" prompts designed to delve deeper into the underpinnings and consequences of various rules. Musical experience and practice always involve relationships with other people, which can place limitations on how we listen to and act upon music. In Music and Ethical Responsibility, Jeff Warren challenges current approaches to music and ethics, drawing upon philosopher Emmanuel Levinas's theory that ethics is the responsibilities that arise from (...) our encounters with other people. Warren examines ethical responsibilities in musical experiences including performing other people's music, noise, negotiating musical meaning, and improvisation. The measurement of sensory intensity has had a long history, attracting the attention of investigators from many disciplines including physiology, psychology, physics, mathematics, philosophy, and even chemistry. While there has been a continuing doubt by some that sensation has the properties necessary for measurement, experiments designed to obtain estimates of sensory intensity have found that a general rule applies: Equal stimulus ratios produce equal sensory ratios. Theories concerning the basis for this simple psychophysical rule are discussed, with emphasis given to (...) the physical correlate theory, which considers judgments of subjective magnitudes to be based upon estimates of physical dimensions that vary regularly with changes in degree of stimulation. For the most thoroughly investigated sensory scales, brightness and loudness, the physical correlate is considered to be distance. Our “tacit knowledge” of the sensory effects of changing distance plays an essential role in matching motor activities to environmental conditions and in ensuring accurate perceptual evaluations through brightness and loudness constancies. In psychophysical experiments, subjects apparently use this same tacit knowledge when required to estimate relative subjective magnitudes. The evidence related to the physical correlate theory is summarized, and it is concluded that, while under appropriate conditions we demonstrate considerable skill in evaluating environmental relationships, we are quite unable to estimate the neurophysiological nature or quantity of sensory response. A psychophysics devoted to studying conditions required for accuracy and conditions producing errors in the perception of environmental relationships would seem to be more valuable than one devoted to subjective magnitudes. Maimonides requires the multitude to observe many ceremonial commandments, while Spinoza makes no such demand. This chapter focuses on some of the main points of agreement between Maimonides and Spinoza on true religion, the religion of reason, or philosophic religion. True religion includes also piety, that is, moral conduct, which follows from the rational life. The piety of the philosopher and the non‐philosopher both consist in doing good to others. Maimonides’ approach to true religion adumbrates Spinoza's. Spinoza's concept of amor (...) Dei intellectualis echoes Maimonides’ concept of the passionate intellectual love of God. Spinoza's concept of piety is adumbrated in Maimonides. The Maimonidean thrust of Spinoza's concept of true religion is evident in his discussion of “the divine Law” or, more precisely, “the natural divine Law” and the summum bonum in TTP4. In Maimonides’ language, true religion is based on the intelligibilia and popular religion on generally accepted opinions. (shrink)

This chapter investigates forgiveness through a phenomenological inflected analysis of its temporal constitution as an inter-subjective self-constitution. A central claim to phenomenological thinking is the recognition of temporality as fundamental to the constitution of human subjectivity. The intentionality of forgiveness directs the offender as its primary object in view of her past wrongdoing. The conjunction of repudiation and responsibility plays itself out along two intersecting distinctions: between act and self, and between the past and present/future. An interpretation of shame within (...) the etiology of self-repudiation is then reported. The assumption of responsibility by the offender does not separate the past misconduct. Bitterness mobilises the offender to responsibility, and demands of the offender that he or she recognize and respect the victim. The offender accepts the burden of his or her past wrong into the compass of the person he or she is today and thus becomes the living questionability of his or her own wrongdoing. (shrink)

Attending--patient contemplation focused on a particular being--is a central ethical activity that has not been recognized by any of the main moral systems in the European philosophical tradition. That tradition has imagined that the moral agent is primarily a problem solver and world changer when what might be needed most is a witness. Moral theory has been agonized by dualism--motivation is analyzed into beliefs and desires, descriptions of facts and dissatisfactions with them, while action is represented as an effort to (...) lessen dissatisfaction by altering the empirical world. In Attending Warren Heiti traces an alternative genealogy of ethics, drawing from the Platonism recovered by Simone Weil and developed in the work of Iris Murdoch, John McDowell, and Jan Zwicky. According to Weil, virtue is knowledge, knowledge is embodied, and the knower is nested in an ecosystem of relationships. Instead of analyzing and solving theoretical problems, Heiti aims to clarify the terrain by setting up objects of attention from more than one discipline, including not only philosophy but also literature, psychology, film, and visual art. The traditional picture captures one important type of ethical activity: faced with a moral problem, one looks to a general rule to furnish the solution. But not all problems conform to this model. Heiti offers an alternative: to see what is needed, one attends to the particular being. (shrink)

Warren Quinn was widely regarded as a moral philosopher of remarkable talent. This collection of his most important contributions to moral philosophy and the philosophy of action has been edited for publication by Philippa Foot. Quinn laid out the foundations for an anti-utilitarian moral philosophy that was critical of much contemporary work in ethics, such as the anti-realism of Gilbert Harman and the neo-subjectivism of Bernard Williams. Quinn's own distinctive moral theory is developed in the discussion of substantial, practical (...) moral issues. For example, there are important pieces here on the permissibility of abortion, the justification of punishing criminals when no particular good seems likely to result, and on the distinction between killing and allowing to die, a distinction crucial to the subject of euthanasia and other topics in medical ethics. Western philosophers, from the ancient Greeks to contemporary thinkers, gave the concept of “person” great importance in their discussions. They saw it as crucial to our understanding of our world and our place in it. Prompted by tragedy — a loved one’s descent into dementia — Warren Bourgeois explored Western philosophical ideas to discover what constitutes a “person.” (...) The first edition of Persons — What Philosophers Say About You was the result of his search. This new second edition focuses on making this material easily available and accessible to students, and has been redesigned as an introduction to the philosophy of mind and its history, concentrating on the central concept of “person” in contemporary controversies concerning abortion, euthanasia, genetic engineering, and human rights. Bourgeois has mined Western philosophy for ideas students can apply today as technology challenges their beliefs about what we are.
