We discuss how the Arab Spring is a reflection of the resiliency of the human rights regime. In order to accomplish this, we explore the extent to which the Arab Spring represents norm diffusion among Middle East and North Africa states. Specifically, we examine the cases of Tunisia, Egypt, and Bahrain and consider how economic and demographic changes created space for human rights discourse in these countries. We find that, in the case of MENA states, the Arab Spring represents significant (...) pressure from below. Access to new forms of social media allowed civil society to organize, publicize, and protest relatively efficiently. Social media expanded the potential role of individuals and created newly empowered latent human rights activists who emerged as leaders of the norm diffusion process. The resulting diffusion of human rights norms in the Arab region represents one of the most significant expansions of the human rights regime since the regime’s inception. (shrink)

We argue that the post-9/11 environment has amounted to a substantive change in the longstanding United States relationship with the international human rights regime. We identify three distinct phases of that relationship, noting that in the most recent phase, since 9/11, the US has moved from passive support of the international human rights regime to a direct attack of that regime. Realist and liberal regime theories suggest that the human rights regime is relatively weak, and is unlikely to withstand such (...) an attack. We find that the regime has not only continued to persist, but has flourished even as US support has faltered. The human rights regime is surprisingly strong. We argue it is the ideological nature of the regime that explains its resilience, which suggests that constructivist theory is necessary to fully understand the human rights regime. (shrink)

ABSTRACT:In 1740, Joanna Stephens (fl. 1720–1741) produced a recipe for a tonic that she claimed cured bladder stones. Although she had the support of some notable and powerful men in the medical community and empirical evidence that her tonic worked, it took two years of petitioning, discussing, and even (unsuccessfully) crowd-sourcing before Parliament relented and awarded her the sum she requested to take her tonic public. Stephens’s interaction with the scientific community serves as a case study for how (...) epistemic credibility shapes how communities hear, interpret, and react to testimonies of knowledge claims from marginalized community members. Stephens’s position as an outsider, both qua woman and qua experimentalist, meant that she was effectively and almost immediately written out of her own story by learned and powerful men with who had both vested interests in the cure for the stone and epistemic prejudices that made it impossible for them to hear Stephens’s claim that she had made a discovery. The aim of this paper is to provide a characterization of ability theories of practice and, in this process, to defend Pierre Bourdieu’s ability theory against Stephen Turner’s objections. In part I, I outline ability theorists’ conception of practices together with their objections to claims about rule following and rule explanations. In part II, I turn to the question of what ability theorists take to be the alternative to rule following and rule explanations. Ability theorists have offered, and been ascribed, (...) somewhat different answers to this question, just as their replies, or positive accounts, have been heavily criticized by Turner. Due to this state of the debate, I focus on the positive account advanced by a single—and highly famous—ability theorist of practice, Pierre Bourdieu. Moreover, I show that despite Turner’s claims to the contrary, his arguments do not refute Bourdieu’s positive account. (shrink)

The development of AAC technologies is of critical importance to the many people who are unable to speak intelligibly due to a communication disorder, and to their many everyday interlocutors. Advances in digital technologies have revolutionized AAC, leading to devices that can “speak for” such individuals as aptly as it is illustrated in the case of the world famous physicist, Stephen Hawking. However, given their dependence on prefabricated language, current AAC devices are very limited in their ability to mediate everyday (...) interactions. We argue here that the limits of AAC are firstly theoretical — grounded in prosthetic models that imagine AAC devices as replacements for damaged body parts and in transmission models of language production as communication. In contrast, our multidisciplinary team aims to design pseudo-intelligent mediators of communication by blending strengths of human mediators with features of current AAC technologies. To inform the design process, we report here our initial situated studies focusing on the distributed nature of everyday communicative activities conducted with potential AAC/PIM users. Our analysis focuses on the discursive alignments of these participants and their interlocutors, attending especially to the various ways their personal aides function as human mediators. Specifically, we focus on mapping the communicative activity around each of these differently-abled individuals as they navigated a university campus. We profile the everyday interactional patterns within functional systems and across settings, and present close discourse analysis of one interaction to highlight the diverse roles personal aides adopted in mediating communication. Finally, we argue that attending to differently “abled” bodies as they move through everyday communicative environments pushes CHAT to more fully theorize physicality, individual mobilities, and the roles of bodies in the laminated assemblage of functional systems. _ Source: _Volume 46, Issue 1, pp 35 - 53 In a letter written at the end of July 1930, Jean Cavaillès singled out two of his successful students at the _Ecole Normale_, Merleau-Ponty and Lautman, “full of interest in the philosophy of mathematics”. While both would play an important role in French philosophy in the coming decades, one almost never thinks of their names together. Indeed, only rarely do we think of Merleau-Ponty and Cavaillès together. This paper will argue (...) against this rarity. Cavaillès would write a treatise on logic that in retrospect is often viewed to advance French philosophy—but precisely at the expense phenomenology. I will argue that this evaluation is overblown. Merleau-Ponty’s philosophy, on the other hand, is often viewed in opposition to this as defending a Husserlian account of perception, a view equally too narrow. Between them, instead, I argue, we can see both transforming the Husserlian account of a transcendental logic and a transcendental aesthetic. Both provide resources for understanding phenomenology as a dialectical and historically emergent theory. Notwithstanding Cavaillès initial characterization of Husserl’s “exhorbitant use of the Cogito”, or his “aggressive” description of acts, to use Merleau-Ponty’s term, the result, in both cases, focuses on phenomenology as an emergent experience of philosophy as an “architecture” of signs. This is the tenth volume of the Correspondence produced in the new edition of The Collected Works of Jeremy Bentham. The great majority of the letters have never before been published. They illustrate the composition, editing, publication, and reception of several of his works. The volume reveals Bentham's attempts to influence developments in France, the USA, Greece, Spain, Portugal, and South America. Despite Bentham's importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition (...) of his works was a poorly edited and incomplete one brought out within a decade or so of his death. The problem of holism in social science has, as Zahle and Collin, the editors of this volume note, a long history. It has revived, however, in a peculiar way, inspired by such things as the literature on corporate responsibility in ethics, the idea of supervenience, “Critical Realism” in sociology, ideas about emergence, the use of game-theoretic models to account for collective outcomes, and various notions of collective actors with collective intentions. These new inspirations interact with older problematics, such as the (...) micro–macro relation problem in sociology, the traditional argument that sentences such as “the crowd stormed the Bastille” have explanatory import apart from the import of sentences about the individual, and claims about reducibility of various kinds.This volume collects original papers by many of the main commentators on this set of topics and is an indispensable starting point for future discussion. This essay offers constructive criticism of the book “In Defense of Kant’s Religion” (2008), by Chris L. Firestone and Nathan Jacobs. Follow the link given here to see the published version of this article. In the same journal issue where that version appeared (Faith & Philosophy 29.2), Jacobs and Firestone each published essays that claimed to respond to my criticisms of their book; but for the most part they merely skirted around the points my article makes, often avoiding the key (...) issues (e.g., by imputing alleged "fallacies" to my paper and using these as excuses to avoid discussing the genuine issues), sometimes making claims that were simply false in the process. In Faith and Philosophy 29.3 (July 2012):340-346, I published a general response to the whole debate over their book, without going into the sad details of the tactics they employed. But in a footnote (p.342n) I referred the reader to a detailed, point-by-point rebuttal to their (non-)arguments, as an addendum to that article, that would be uploaded here on my academia. edu site. This version of my original paper uploaded here contains the identical text for the paper itself (i.e., the first 15 pages of the original typescript have not been changed); but I have added an Appendix (starting on p.16) that responds, point-by-point to the Firestone and Jacobs essays. Warning to the faint-hearted: this discussion should not be read by anyone who is considering giving up their study of philosophy on the grounds that philosophers typically waste their time merely talking past each other, because for such a person, reading the Appendix to the version of the paper uploaded here could be the straw that breaks the camel's back! As I wrote it, I found myself sometimes wishing I had not published a promise to provide such material, because it is an embarrassment to philosophy that philosophers sometimes treat each other in the way illustrated by the two essays I am responding to. I only hope that taking the trouble to publish such a detailed response will help some readers recognize how important it is to give one's interlocuter the benefit of the doubt wherever possible (as I have tried to do here, for Firestone and Jacobs--and I would welcome their detailed explanations, if they think I have not done so). This article considers the concept of the utopia from the point of view of garden design. It begins with an evocation of the `Jardin de Julie', the literary garden described in Rousseau and acutely analysed by Louis Marin. It then passes to a series of actual gardens created by the French contemporary designer Bernard Lassus, in which the use of landscape effects is seen as achieving similar dislocations of space and incitements to the imagination.

This corpus analysis of linguistic and semantic features in French parliamentary debates concerning online hate speech regulation, highlights tensions between state powers and private rights. Two key themes are identified: first, the _problem of definition_: how such online content is defined in the debates, and second, the _problem of regulation_: how the debates negotiate the supra-jurisdictional and individual jurisdiction issues involved, in regulating both the global online content and the responsibilities of the owners of the platforms who manage the content. For this analysis, the authors created a corpus of French National Assembly Examination Committee discussions and public sessions between July 2019 to January 2020 discussing the _Loi Avia _(Avia Law). The corpus was analysed using quali-quantitative methods. Overall, the study combines a top-down (global) and a bottom-up (local) analysis of the data, applying corpus semantic approaches (Lecolle et al. in Langages 210(2):35–54, 2018; Rastier in The Routledge handbook of semantics, Routledge, pp 507–522, 2015) to contextualize the analysis of the meta-discourse (Hyland in Meta-discourse: exploring interaction in writing, 1st ed. BackgroundFew studies have examined factors associated with willingness of people living with HIV to participate in HIV treatment clinical trials in Sub-Saharan Africa. We assessed the factors associated with participation of PLHIV in HIV treatment clinical trials research at a large urban clinical and research facility in Uganda.MethodsA mixed methods study was conducted at the Infectious Diseases Institute, adult HIV clinic between July 2016 and January 2017. Data were collected using structured questionnaires, focused group discussions with respondents categorised as either (...) participated or never participated in clinical trials and key informant interviews with IDI staff. A generalized linear model with a logit link function was used for multivariate analyses while the qualitative data were summarized using a thematic approach.ResultsWe enrolled a total of 202 and analysed 151 participants, 77 of whom were male with mean age of 41 years. The majority 127 expressed willingness to participate in treatment clinical trials if given an opportunity. At bivariate analysis, willingness to participate was significantly associated with respondents’ perception of a satisfactory compensation package, special status accorded and belief that their health status would improve while on the clinical trial. At multivariate analysis, a satisfactory compensation package and special status accorded in clinical trials remained significant. The qualitative data analysis confirmed these findings as participants valued the privilege of jumping the clinic waiting queues and spending less time in clinic, the wide range of free tests offered to trial participants, unrestricted access to senior physicians and regular communication from study team. Additionally, free meals offered during clinic visits meant that participants were not in a hurry to go back home. Barriers to participation included the perception that new drugs were being tested on them, fear of side effects like treatment failure and the uncertainty about privacy of their data.ConclusionWe found overwhelming willingness to participate in HIV treatment clinical trials. This was largely extrinsically influenced by the perceived material and health-related benefits. Investigators should pay attention to participants’ concerns for benefits which may override the need to understand study procedures and risks. (shrink)

We wish to describe and acknowledge the exceptional contributions to medical ethics, both in the UK and internationally, made by Edward Shotter1 who died at home on 3 July 2019. He was founder of the London Medical Group2 3 and instigator of similar student-led medical ethics groups throughout the UK; founder of the Institute of Medical Ethics4 and founder of the Journal of Medical Ethics. Ted Shotter transformed the study of medical ethics in the UK in the interests of patients (...) and professionals alike. In 1963, he established the pioneering ‘Medical Group’ model, an innovative bottom-up method whereby students in the health professions could gain a grounding in ethics that had previously been denied to the profession.5 It was with these Medical Groups that many of the leading figures in contemporary UK medical ethics and law began their careers in the subject including Sir Kenneth Calman, Sir Ian Kennedy, Professor Margaret Brazier OBE, Professor John Harris and Professor Sir Jonathan Montgomery to name but …. In his essay “Rand, Paterson, and the Problem of Anarchism,” which appeared in The Journal of Ayn Rand Studies (July 2013), Stephen Cox argues that the principles of consent and non-initiation of force on which anarchists rely are too strong, and would require undue violation of the principle of non-sacrifice unless modified. But properly interpreted, these principles do not generate the conflicts that Cox describes, and such modifications as are defensible still do not rule out anarchism; hence Cox's case against (...) anarchism fails. Aboutness has been studied from any number of angles. Brentano made it the defining feature of the mental. Phenomenologists try to pin down the aboutness-features of particular mental states. Materialists sometimes claim to have grounded aboutness in natural regularities. Attempts have even been made, in library science and information theory, to operationalize the notion. But it has played no real role in philosophical semantics. This is surprising; sentences have aboutness-properties if anything does. Aboutness is the first book to examine through (...) a philosophical lens the role of subject matter in meaning. A long-standing tradition sees meaning as truth-conditions, to be specified by listing the scenarios in which a sentence is true. Nothing is said about the principle of selection--about what in a scenario gets it onto the list. Subject matter is the missing link here. A sentence is true because of how matters stand where its subject matter is concerned. Stephen Yablo maintains that this is not just a feature of subject matter, but its essence. One indicates what a sentence is about by mapping out logical space according to its changing ways of being true or false. The notion of content that results--directed content--is brought to bear on a range of philosophical topics, including ontology, verisimilitude, knowledge, loose talk, assertive content, and philosophical methodology.
