The COVID-19 pandemic has led a number of countries to introduce restrictive ‘lockdown’ policies on their citizens in order to control infection spread. Immunity passports have been proposed as a way of easing the harms of such policies, and could be used in conjunction with other strategies for infection control. These passports would permit those who test positive for COVID-19 antibodies to return to some of their normal behaviours, such as travelling more freely and returning to work. The introduction of (...) immunity passports raises a number of practical and ethical challenges. In this paper, we seek to review the challenges relating to various practical considerations, fairness issues, the risk to social cooperation and the impact on people’s civil liberties. We make tentative recommendations for the ethical introduction of immunity passports. (shrink)

In 2008 the Australian Government introduced a national reform agenda to increase organ and tissue donation. Australia continues to perform poorly by international standards on measures of organ procurement, however. This paper outlines three proposals to improve donation rates and considers the empirical evidence available for each. A number of ethical objections frequently given to resist such proposals are also addressed. Firstly, it is recommended that Australia implement an ‘opt-out’ system of organ donation. Secondly, the existing veto rules should be (...) changed to better protect the wishes of those who wish to donate. Finally, a numer of incentives should be offered to increase donation rates; these could include incentives of financial value, but also non-financial incentives such as prioritisation for the receipt of organs for previous donors. Liberty-restricting measures have been implemented for centuries to limit the spread of infectious diseases. This article considers if and when it may be ethically acceptable to impose selective liberty-restricting measures in order to reduce the negative impacts of a pandemic by preventing particularly vulnerable groups of the community from contracting the disease. We argue that the commonly accepted explanation—that liberty restrictions may be justified to prevent harm to others when this is the least restrictive option—fails to adequately accommodate the complexity (...) of the issue or the difficult choices that must be made, as illustrated by the COVID-19 pandemic. We introduce a dualist consequentialist approach, weighing utility at both a population and individual level, which may provide a better framework for considering the justification for liberty restrictions. While liberty-restricting measures may be justified on the basis of significant benefits to the population and small costs for overall utility to individuals, the question of whether it is acceptable to discriminate should be considered separately. This is because the consequentialist approach does not adequately account for the value of equality. This value may be protected through the application of an additional proportionality test. An algorithm for making decisions is proposed. Ultimately whether selective liberty-restricting measures are imposed will depend on a range of factors, including how widespread infection is in the community, the level of risk and harm a society is willing to accept, and the efficacy and cost of other mitigation options. BackgroundApproximately 7% of the general population is affected by an orphan disease, which, in the United States, is defined as affecting fewer than 1 in 1500 people. Disease awareness is often low and time-to-diagnosis delayed. Different legislations worldwide have created incentives for pharmaceutical companies to develop drugs for orphan diseases. A journalistic article in Bloomberg Businessweek has claimed that pharmaceutical companies have tried marketing orphan drugs by placing a specific disease into the popular television series “House, M.D.” which features diagnostic (...) journeys and was produced between 2004 and 2012. This study aimed to describe the presentation of orphan diseases in the television series “House, M.D.”, to test in an exploratory fashion the hypothesis that treatable orphan conditions are overrepresented in “House, M.D.” and to discuss whether such marketing practices may or may not be ethical.MethodsA list of all medical cases depicted in the television series “House, M.D.” was obtained and classified as orphan or non-orphan according to the Orphanet database. The ratios of orphan diseases among all diseases, such with an orphan drug designation and such with an orphan drug approval by the FDA were then compared with conservative approximations of real world conditions (chi-squared tests for equality of proportions). STROBE criteria were respected.ResultsOut of a total of n = 181 different medical diagnoses, n = 42 (23.2%) were orphan diseases. The difference in percentages in between “House, M.D.” and reality was not statistically significant for orphan diseases overall (p = 0.96), yet was statistically significantly higher for both orphan diseases with one or more orphan drug designations (p = 0.0192) and such with one or more approved orphan drugs (p < 0.0001).ConclusionsOrphan diseases with a designated and/or approved orphan drug were overrepresented in the television series “House, M.D.” with statistical significance while orphan diseases overall were not. This may be explained by (so far) undocumented efforts of pharmaceutical companies to place their orphan drugs in the television series, as described in the article in Bloomberg Businessweek. Further research is needed into marketing practices in popular and emerging media formats. (shrink)

At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

In ‘Moral Luck,’ Bernard Williams famously argued that “there is a particularly important species of regret, which I shall call ‘agent-regret,’ which a person can feel only towards his past actions.” Much subsequent commentary has focused on Williams’s claim that agent-regret is not necessarily restricted to voluntary actions, and questioned whether such an attitude could be rationally justified. This focus, however, obscures a more fundamental set of questions raised by Williams’s discussion: what is the role in our moral psychology of (...) evaluative attitudes that relate essentially to past exercises of our agency—occurrences which, by their very nature, cannot be repeated? On a standard conception, regret is directed principally towards actions that resulted from suboptimal deliberation. On this view, the main point of regret is to guide us away from similar poor decisions in the future. But Williams’s key insight in ‘Moral Luck,’ I argue, is that there is a mode of evaluation of one’s past actions and decisions that does not track considerations one could and should have been responsive to at the time, and is for this reason essentially retrospective. From this perspective, the full significance of regret cannot be captured in terms of a disposition to deliberate better in the future. Rather, the particular kind of painful of consciousness of the past embodied in regret amounts to a reflective, and essentially backward-looking, insight into the contingency and finitude of our own agency—that I am a particular person leading a particular life, and that the possibility of leading a different life is now gone forever. I end by making some speculative comments about the intractable question whether it is ultimately good or desirable to be disposed to regret one’s past mistakes. (shrink)

The discussion of “Der Ister” was the last of these, although Heidegger continued to think and write about Hölderlin into the 1960s. William McNeill and Julia Davis’s recent translation of the “Ister”— volume —is the first of the Hölderlin lectures to appear in English.

Our paper is concerned with theories of direct perception in ecological psychology that first emerged in the second half of the twentieth century. Ecological psychology continues to be influential among philosophers and cognitive scientists today who defend a 4E (embodied, embedded, extended, enactive) approach to the scientific study of cognition. Ecological psychologists have experimentally investigated how animals are able to directly perceive their surrounding environment and what it affords to them. We pursue questions about direct perception through a discussion of (...) the ecological psychologist’s concept of affordances. In recent years, psychologists and philosophers have begun to mark out two explanatory roles for the affordance concept. In one role, affordances are cast as belonging to a shared, publicly available environment, and existing independent of the experience of any perceiving and acting animal. In a second role, affordances are described in phenomenological terms, in relation to an experiencing animal that has its own peculiar needs, interests and personal history. Our aim in this paper is to argue for a single phenomenological or experiential understanding of the affordance concept. We make our argument, first of all, based on William James’ concept of pure experience developed in his later, radical empiricist writings. James thought of pure experience as having a field structure that is organized by the selective interest and needs of the perceiver. We will argue however that James did not emphasize sufficiently the social and intersubjective character of the field of experience. Drawing on the phenomenologist Aron Gurwitsch, we will argue that psychological factors like individual needs and attention must be thought of as already confronted with a social reality. On the phenomenological reading of affordances we develop, direct perception of affordances is understood as taking place within an intersubjective world structured by human social and cultural life. In this paper I examine William Alston's work on the epistemology of religious belief, focusing on the threat to the epistemic status of Christian belief presented by awareness of religious diversity. I argue that Alston appears to misunderstand the epistemic significance of the ‘practical rationality’ of the Christian mystical practice. I suggest that this error is due to a more fundamental misunderstanding, regarding the significance of practical rationality, in Alston's ‘doxastic practice’ approach to epistemology ; an error that leads (...) to arbitrariness among the class of rational doxastic practices. I suggest how one might remedy this weakness, with an additional, epistemic, criterion that rational doxastic practices must satisfy. (shrink)

Is it Possible to Experiment with Thought? Ernst Mach’s Notion of Thought Experiment and its Pedagogical Context around 1900. The article tries to establish the crucial importance of the pedagogical dimension of Ernst Mach’s ideas on experimenting with thought. The focus on contemporary pedagogics demonstrates, first, that Mach’s didactic approach to physics is part of a much broader stream of pedagogical writings that transcends national and disciplinary borders and comprises a diversity of authors, e.g. Wilhelm Jerusalem, William James or (...) Alfred N. Whitehead; second, that the much‐heralded controversy between Mach and the French philosopher of science Pierre Duhem about thought experiments does not only revolve around epistemological issues but rather stems from their antagonist vision of teaching physics; and finally, third, that G. Stanley Hall’s psychogenetic theory of pedagogics bears a strong resemblance with the evolutionary naturalism of Machian epistemology and helps explaining key tenets of Mach’s conception of thought experiment. By establishing a broad convergence between the work of all these authors despite their different academic upbringing, background and nationality the article argues for a complex and historically fine‐grained vision of the relations between natural, social and human sciences going beyond dichotomies like ‘Erklären’ and ‘Verstehen’ or the ‘Two Cultures’. Cultural Choice and Musical Value, British musicologist and composer Julian Johnson defends the value of classical music in a commercialized culture fixated on the immediate gratification of popular music. At 130 pages divided into (...) six chapters, Johnson’s book is a reasonably accessible and engaging presentation of his topic. This short book contains relevant and sometimes controversial insights of interest to professional music educators. In this review I will provide a brief summary of the author’s primary arguments accompanied by critical commentary.Johnson argues that commercial forces in our society limit serious reflective discourse on music. The marketplace treats music as a commodity which derives its value from relative commercial success. In this context, classical music is relegated to one possible cultural choice among many legitimate options and is in danger of losing its distinctive features as an art form that transcends commercial concerns. Preference for particular musical products becomes an identity marker for an individual’s place within society, and criticism of a particular style of music is perceived as a personal attack. The process of turning classical music into a commodity has been aided by critics who have condemned the Western [End Page 96] canon as elitist, patriarchal, and arrogant. These critics have instead advocated a democratization of culture, placing greater emphasis on the validity of popular art forms and active participation in music-making rather than the more passive contemplation. Johnson describes this as a “pseudo-democratic” attack which encourages downward social mobility. When combined with the omnipresence of commercial culture, this approach undermines individual musical value by assuming the equal validity of all aesthetic judgments. Democracy is damaged when, refusing to discriminate between cultural products, society fails to recognize human individuality and excellence.Johnson is at his strongest when he argues for the importance of classical music fulfilling its function as art. The author argues that different types of music fulfill different functions. In contemporary society music is valued and chosen for how it is used. Music is described as “good” when it functions to provide background music for activities or when it successfully complements or enhances the listeners’ moods. Focusing solely on social use or reception, however, tends to neglect objective differences in the formal structure of music. This is the point at which Johnson begins to distinguish between classical and popular music. Popular music is composed to ensure a uniformity of affect, and deliberately avoids formal or harmonic complexity. As an aspect of popular culture, it is tied to contemporary fashion trends and rapidly becomes obsolete. Like other types of fashion, music becomes a means for expressing a current position within a larger social and cultural space. It is the music of youth; its commercial saturation of the culture blurs the boundaries between youth and adulthood. Johnson claims that the process of commercialization leads to a bland standardization. Classical music can also function as a type of popular music when it submits itself to market processes, but in doing so the music loses its distinctive features.In his discussion on popular music, Johnson presents what might be his most controversial claim: that popular music serves a pornographic function. He defines pornography as “the process by which the humane is reduced to the status of things” (p. 59) and argues that popular music takes pleasure in debasing humanity by reducing individuals to material commodities and denying the spiritual. This contention echoes Allan Bloom’s concern in The Closing of the American Mind that rock music desensitizes and debases youth by destroying imagination and deadening their capacity for passion and wonder. We would like to thank each of the commentators on our feature article for their thoughtful engagement with our arguments. All the commentaries raise important questions about our proposed justification for natural immunity exemptions to COVID-19 vaccine mandates. Thankfully, for some of the points raised, we can simply signal our agreement. For instance, Reiss is correct to highlight that our article did not address the important US-centric considerations she helpfully raises and fruitfully discusses. We also agree with Williams about the (...) need to provide a clear rationale for mandates, and to obtain different kinds of data in support of possible policies.Unfortunately, we lack the space to engage with every one of the more critical comments raised in this rich set of commentaries; as such, in this response, we shall focus on a discussion of hybrid immunity, which underlies a number of different arguments evident in the commentaries, before concluding with some reflections responding to Lipsitch’s concern about the appropriate standard of proof in this context. In ‘On McDowell's identity conception of truth’ , we suggested that McDowell's Identity Theory, according to which a proposition is true if and only if it is identical with a fact, is only fully understood when we realize that there are two identity claims involved. The first is that, when one thinks truly, the content of a whole thought is identical with a Tractarian Tatsachen – a complex fact constituted by simple Sachverhalte – and the second is that these simple (...) Sachverhalte are in turn identical with simple Fregean senses. 1As an example, we suggested that the complex content/proposition/Fregean sense is identical with the Tractarian Tatsachen constituted by the two Sachverhalte: the object's being a tiger and the object's being undernourished, both of which can be seen, as the second identity with simple Fregean senses requires, to present an object in a certain way – as being, in turn, a tiger and undernourished.In his response to our article, Julian Dodd raises three internal criticisms concerning the coherence of the view as a whole, as well as the interpretative criticism that, regardless of the internal coherence of the view, it is not McDowell's. We think that Dodd fails to appreciate the view we have developed in our article, so much so that he believes that his own proffered view of McDowell, articulated in the final section of his response, is an alternative to our own position when in fact it is simply a restatement of that position. Because this point is so fundamental, we begin below by spelling out exactly where Dodd's understanding of our view goes wrong and so why his interpretative criticism misses its target before addressing the internal criticisms concerning the coherence of the view as a …. Isdale, William; Savulescu, Julian The High Court of Australia, for the second time, recently found that the National School Chaplaincy and Student Welfare Program is funded unconstitutionally, and so is invalid in its current form. The program, though, can be reconstituted through tied grants to state governments. The question is, should it be? While the NSCSWP serves some legitimate policy objectives, the program in its pre-existing form is objectionable for at least two reasons.
