Theoretical ethics includes both metaethics (the meaning of moral terms) and normative ethics (ethical theories and principles). Practical ethics involves making decisions about every day real ethical problems, like decisions about euthanasia, what we should eat, climate change, treatment of animals, and how we should live. It utilizes ethical theories, like utilitarianism and Kantianism, and principles, but more broadly a process of reflective equilibrium and consistency to decide how to act and be.

The St Bartholomew's Day Massacre of 1572 polarised French constitutional ideas. Appearing on one side was a radicalised version of the French constitution. On the other side was the theory of royal absolutism systematically developed by Bodin. The central thesis of this book is that Bodin's absolutism was as unprecedented as the doctrine it opposed. Prior to the 1570s the mainstream of the French tradition had been tentatively constitutionalist and Bodin himself had given strong expression to that tendency in his (...) Methodus of 1566. His earlier theory of sovereignty, elaborated in that work, was implicitly adapted to a notion of limited supremacy. Professor Franklin's aim is to explain how this absolutist view was formed. In doing so, he has clarified many of the notorious obscurities in Bodin's thought and since much of the absolutist doctrine of the seventeenth century was either based on Bodin's theory or relied on similar assumptions, this study will be of great importance and interest to scholars of a later period. Résumé L’association entre industrie de la construction et sous-traitance est une évidence à la fin du XIXe siècle, tout comme aujourd’hui. Pourtant l’histoire des mutations du statut du sous-traitant et des formes du travail au forfait dans le bâtiment au début du XXe siècle est encore peu étudiée. Pour aborder cette question, cet article prend pour objet un virement institutionnel majeur dans la définition du « tâcheron » en France : la réforme sur les abus du marchandage dans la seconde (...) moitié des années 1930. Ce dispositif classifie et ordonne les relations entre les acteurs économiques aux intérêts divergents impliqués dans la chaîne de la sous-traitance : maître d’ouvrage, maître d’œuvre, sous-traitant, ouvriers travaillant pour le sous-traitant. Formalisant l’état des lieux de la jurisprudence et détaillant les modalités de la mise en œuvre du marchandage, il permet ainsi de s’interroger sur les caractères marquants d’une forme clé d’organisation du travail de la deuxième industrialisation. Professor Franklin shows how the humanist approach of Jean Bodin and other French jurists of the 16th century led to a break, at least in principle, with the intellectual authority of Roman law and to the attempt to reconstruct juristic science through a comparison and synthesis of all the juridical experience of the most famous states.

The search for the best wellness practice has promoted the development of devices integrating different technologies and guided meditation. However, the final effects on the electrical activity of the brain remain relatively sparse. Here, we have analyzed of the alpha and theta electroencephalographic oscillations during the realization of the arrest reaction when a chromotherapy session performed in a dedicated room [Rebalance device], with an ergonomic bed integrating pulsed-wave light stimulation, guided breathing, and body scan exercises. We demonstrated that the PWL (...) induced an evoked-related potential characterized by the N2-P3 components maximally recorded on the fronto-central areas and accompanied by an event-related synchronization of the delta–theta–alpha oscillations. The power of the alpha and theta oscillations was analyzed during repeated ARs testing realized along with the whole RB session. We showed that the power of the alpha and theta oscillations was significantly increased during the session in comparison to their values recorded before. Of the 14 participants, 11 and 6 showed a significant power increase of the alpha and theta oscillations, respectively. These increased powers were not observed in two different control groups who stayed passively outside or inside the RB room but without any type of stimulation. These preliminary results suggest that PWL chromotherapy and guided relaxation induce measurable electrical brain changes that could be beneficial under neuropsychiatric perspectives. (shrink)

Julian of Norwich emphasizes God’s eternal and unchanging love for humankind. Her visions show how God is not angry with our sins and so has no need to forgive us. God does not shame or blame us but excuses us and plans how to reward and compensate us for sin. In relation to Mother Jesus, we remain dear lovely children who need help, correction, and education. Although these remarks suggest to some that Julian must be soft on sin, (...) that she has no adequate appreciation of the worthiness of God or the dignity of human nature, I argue that this is far from the case. On the contrary, she makes Divine worthiness axiomatic and urges readers to live into it. She relocates human dignity not in its intrinsic value but in our centrality to God’s plan. She measures the seriousness of sin in terms of the real hard work it takes to rear us up out of it: crucifixion for Christ, the hell of being a sinner and the crucifixion of life-long penance for us. Nevertheless, the brightness of her visions dominates with her assurance that despite the sin-produced sufferings of this present life, all will be well. (shrink)

Dado o crescente aumento da ocorrência e da gravidade dos conflitos em ambientes escolares, o presente estudo dedica-se a observar como tem sido conduzida a iniciativa das Comissões Internas de Prevenção de Acidentes e Violências Escolares, tendo por cenário as escolas da rede pública estadual de Viamão, Rio Grande do Sul. A observação do aumento e do agravamento dos conflitos não se restringe aos ambientes escolares. De forma generalizada, é possível verificar que a sociedade tem sofrido crescentemente com situações de (...) conflito, o que se pode verificar com o volume cada vez maior de processos judiciais e com a escalada da violência e da criminalidade, por exemplo. No Município de Viamão, essas questões são bastante evidentes. Na condução das análises, a questão norteadora para a elaboração do problema de pesquisa busca investigar, como instrumental de gerenciamento de conflitos e violências em ambiente escolar, quais são os principais limites e potencialidades das CIPAVEs segundo a percepção dos integrantes das equipes gestoras das escolas investigadas. Para responder a essa questão, foram analisadas ocorrências registradas durante os anos de 2016, 2017 e 2018 pelas escolas da Rede Pública Estadual de Ensino do Município de Viamão, Estado do Rio Grande do Sul, na base de dados Mapeamento CIPAVE, política pública de iniciativa estadual voltada ao manejo de conflitos escolares. Também foram investigadas as percepções manifestadas por integrantes das respectivas equipes gestoras acerca do gerenciamento das ocorrências referidas. A estratégia metodológica desenhada para o estudo é descritiva, exploratório-sequencial, combinando as abordagens quantitativa e qualitativa. Inicialmente, a moldura teórica da pesquisa é delineada a partir de revisão bibliográfica acerca da gestão de conflitos escolares, subsidiando a análise dos dados registrados na base da CIPAVE, compondo um panorama interdisciplinar para instrumentalizar o exame dos casos que se destacaram, empreendendo visitações nas escolas e entrevistas com os gestores. Heidegger's later philosophy has often been regarded as a lapse into unintelligible mysticism. Following a brief reconstruction of Hutto & Satne’s paper we focus our critical comments on two issues. First we take up H&S’s claim that a non-representational form of ur-intentionality exists that performs essential work in setting the scene for content-involving forms of intentionality. We will take issue with the characterisation that H&S give of this non-representational form of intentionality. Part of our commentary will therefore be aimed at motivating an alternative account of how there can be intentionality without mental content, (...) which we have called skilled intentionality. Skilled intentionality is the individual’s selective openness and responsiveness to a rich landscape of affordances.A second issue we take up concerns the distinction between ur-intentionality and content-involving intentionality. We will argue that our notion of skilled intentionality as it is found in humans cuts across these two categories. Instead of distinguishing between different forms of intentionality we recommend focusing on how skilled intentionality takes different forms in different forms of life. (shrink)

According to the free energy principle biological agents resist a tendency to disorder in their interactions with a dynamically changing environment by keeping themselves in sensory and physiological states that are expected given their embodiment and the niche they inhabit :127–138, 2010. doi: 10.1038/nrn2787). Why would a biological agent that aims at minimising uncertainty in its encounters with the world ever be motivated to seek out novelty? Novelty for such an agent would arrive in the form of sensory and physiological (...) states that are unexpected. Such an agent ought therefore to avoid novel and surprising interactions with the world one might think. Yet humans and many other animals find play and other forms of novelty-seeking and exploration hugely rewarding. How can this be understood in frameworks for studying the mind that emphasise prediction error minimisation? This problem has been taken up in recent research concerned with epistemic action—actions an agent engages in to reduce uncertainty. However that work leaves two questions unanswered, which it is the aim of our paper to address. First, no account has been given yet of why it should feel good to the agent to engage the world playfully and with curiosity. Second an appeal is made to precision-estimation to explain epistemic action, yet it remains unclear how precision-weighting works in action more generally, or active inference. We argue that an answer to both questions may lie in the bodily states of an agent that track the rate at which free energy is being reduced. The recent literature on the predictive brain has connected the valence of emotional experiences to the rate of change in the reduction of prediction error :e1003094, 2013. doi: 10.1371/journal.pcbi.1003094; Van de Cruys, in Metzinger and Wiese Philosophy and predictive processing, vol 24, MIND Group, Frankfurt am Main, 2017. doi: 10.15502/9783958573253). In this literature valenced emotional experiences are hypothesised to be identical with changes in the rate at which prediction error is reduced. Experiences are negatively valenced when overall prediction error increases and are positively valenced when the sum of prediction errors decrease. We offer an ecological-enactive interpretation of the concept of valence and its connection to rate of change of prediction error. We show how rate of change should be understood in terms of embodied states of affordance-related action readiness. We then go on to apply this ecological-enactive account of error dynamics to provide an answer to the first question we have raised: It may explain why it should feel good to an agent to be curious and playful. Our ecological-enactive account also allows us to show how error dynamics may provide an answer to the second question we have raised regarding how precision-weighting works in active inference. An agent that is sensitive to rates of error reduction can tune precision on the fly. We show how this ability to tune precision on the go can allow agents to develop skills for adapting better and better to the unexpected, and search out opportunities for resolving uncertainty and progressing in its learning. This paper presents a novel account of focal stress and pitch contour in English dialogue. We argue that one should analyse and treat focus and pitch contour jointly, since (i) some pragmatic interpretations vary with contour (e.g., whether an utterance accepts or rejects; or whether it implicates a positive or negative answer); and (ii) there are utterances with identical prosodic focus that in the same context are infelicitous with one contour, but felicitous with another. We offer an account of two (...) distinct pitch contours that predicts the correct felicity judgements and implicatures, outclassing other models in empirical coverage or formality. Prosodic focus triggers a presupposition, where what is presupposed and how the presupposition is resolved depends on prosodic contour. If resolving the presupposition entails the proffered content, then the proffered content is uninteresting and hence the utterance is in-felicitous. Otherwise, resolving the presupposition may lead to an implicature. We regiment this account in SDRT. (shrink)

This is the first comprehensive treatment of Nietzsche's Philosophy of Art to appear in English. Julian Young argues that Nietzsche's thought about art can only be understood in the context of his wider philosophy. In particular, he discusses the dramatic changes in Nietzschean aesthetics against the background of the celebrated themes of the death of God, eternal recurrence and the idea of the Ubermensch. Young then divides Nietzsche's career, and his philosophy of art, into four distinct phases, but suggests (...) that these phases describe a circle. An attempt at world-affirmation is made in the central phases, but Nietzsche is predominantly influenced at the beginning and end of his career by a Schopenhauerian pessimism. At the beginning and end art is important because it 'redeems' us from life. This is a clear and lucid account of Nietzsche's philosophy of art. It combines exegesis, interpretation and criticism in a judicious balance, and will be essential reading for all scholars of philosophy and German studies with an interest in Nietzsche or aesthetics. In his first book, The Birth of Tragedy, Nietzsche observes that Greek tragedy gathered people together as a community in the sight of their gods, and argues that modernity can be rescued from 'nihilism' only through the revival of such a festival. This is commonly thought to be a view which did not survive the termination of Nietzsche's early Wagnerianism, but Julian Young argues, on the basis of an examination of all of Nietzsche's published works, that his religious communitarianism (...) in fact persists through all his writings. What follows, it is argued, is that the mature Nietzsche is neither an 'atheist', an 'individualist', nor an 'immoralist': he is a German philosopher belonging to a German tradition of conservative communitarianism - though to claim him as a proto-Nazi is radically mistaken. This important reassessment will be of interest to all Nietzsche scholars and to a wide range of readers in German philosophy. (shrink)

Much disease and disability is the result of lifestyle behaviours. For example, the contribution of imprudence in the form of smoking, poor diet, sedentary lifestyle, and drug and alcohol abuse to ill-health is now well established. More importantly, some of the greatest challenges facing humanity as a whole – climate change, terrorism, global poverty, depletion of resources, abuse of children, overpopulation – are the result of human behaviour. In this chapter, we will explore the possibility of using advances in the (...) cognitive sciences to develop strategies to intentionally manipulate human motivation and behaviour. While our arguments apply also to improving prudential motivation and behaviour in relation to health, we will focus on the more controversial instance: the deliberate targeted use of biomedicine to improve moral motivation and behaviour. We do this because the challenge of improving human morality is arguably the most important issue facing humankind (Persson and Savulescu, forthcoming). We will ask whether using the knowledge from the biological and cognitive sciences to influence motivation and behaviour erodes autonomy and, if so, whether this makes it wrong. (shrink)
