In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. This paper investigates the norm of presupposition, as one pervasive type of indirect speech act. It argues against the view that sees presuppositions as an indirect counterpart of the direct speech act of assertion and proposes instead that they are much more similar to the direct speech act of assumption. More concretely, it suggests that the norm that governs presuppositions is not an epistemic or doxastic attitude such as knowledge, justified belief, or mere belief; it's a practical attitude, most plausibly (...) the attitude of rational acceptance. This view has important ramifications well beyond debates in philosophy of language and linguistics. It affects not only our view of which speech act sequences are fine and which are off; it bears on whether presuppositions can function as testimony, whether they can be lies, and whether they are ontologically committal, thus addressing central topics in epistemology, ethics, and metaphysics. This paper raises an open critical discussion on some key notions in Michael Ruse’s philosophy. These include the conceptual elements of scientific explanation, the difference between epistemic and cultural values, the epistemological status of science and religion in explaining nature, the compatibility or incompatibility between Darwinian thought and Christian thought, and especially between evolutionary theory and creationism, the key importance of admitting or not admitting supernatural causality when qualifying an explanation as scientific, the role played by the divinity in the (...) argumentation about the compatibility or incompatibility between science and religion, the convenience of not understanding the Abrahamic god from an ontological perspective but from a psychological one, etc. It ends by proposing certain conclusions that could perhaps contribute to contrast and enrich his philosophy. This is the first critical edition and study of a unique and important Muslim polemic against Christians and Jews. The Book of Disputation was written in Arabic by a Mudejar (subject Muslim living under Christian rule in late medieval Iberia) and offers new insight into the cultural and intellectual life of this Muslim minority. The text advances arguments drawn from natural philosophy-largely from Aristotle and Averroes-along with more traditional revealed sources such as the Qur'an and the Bible. Mudejar communities suffered (...) a diminution of religious and political intelligentsia over time. This text, however, highlights the author's particular conception of the world as the creation of God in his defense of Islam, demonstrates the vitality of intellectual life among Muslims in medieval Christian Iberia, and documents the continued cultivation of natural philosophy within these Muslim communities. Nuestra hipótesis consiste en que, lejos de ser un factor de mera articulación formal, la ring-composition cumple con una función dramática pues cohesiona, con su juego de paralelismos, las alusiones a los misterios con el fin de presentar (...) la acción como un ritual iniciático fallido. ¿Hay requisitos epistemológicos para la posesión de conceptos? Aunque nuestra intuición apunta claramente a una relación muy estrecha entre condiciones de posesión de conceptos y ciertos tipos de conocimiento, posiciones naturalistas en filosofía —como la defendida por Jerry Fodor— traen consigo una visión según la cual los conceptos que un sujeto posee son independientes metafísica y conceptualmente de las capacidades epistémicas de dicho sujeto. En este artículo argumentaré que, tal y como el análisis del dogmatismo de Pryor puede mostrar, las (...) teorías de la justificación epistémica proporcionan, desde un punto de vista general, apoyo independiente a la idea intuitiva de requisitos epistemológicos para la posesión de conceptos. El corpus de manuscritos árabes de los musulmanes de los territorios cristianos de la península ibérica medieval y temprano-moderna (mudéjares y moriscos) ha sido generalmente estudiado en menor medida que sus escritos en romance en caracteres latinos o árabes (aljamiado). Este artículo discute los nuevos datos en el códice misceláneo Árabe 1668 (El Escorial), copiado en 928 (=1522) probablemente por musulmanes en los territorios cristianos. MS Escorial Árabe 1668 no es totalmente desconocido por los estudiosos, pero han sido pocos los (...) intentos por investigar sus extraordinarios contenidos, que hasta ahora han permanecido en gran medida sin identificar. Destacable es la copia en árabe de la historia universal de ʿAbd al-Malik ibn Ḥabīb (s. IX), el Kitāb al-Taʾrīkh [La historia], considerada como el ejemplar más antiguo de literatura árabe en al-Andalus y que se preserva solamente en un único manuscrito árabe en Oxford. Además, MS Escorial Árabe 1668 contiene un número importante de narrativas adaptadas en aljamiado que ya se conocían, pero de las cuales aún no se habían identificado los originales árabes en circulación entre los musulmanes peninsulares. Estos materiales amplían los datos ya existentes de la producción tardía de manuscritos árabes de los musulmanes peninsulares y la preservación dentro de sus comunidades de originales provenientes de al-Andalus, el norte de África y el oriente islámico, algunos de los cuales contienen miniaturas. En el MS Escorial Árabe 1668 también encontramos un sermón árabe-Aljamiado (waʿẓ) que arroja luz sobre las reuniones de musulmanes que a veces se celebraron de forma clandestina debido a las crecientes restricciones impuestas a sus comunidades por los cristianos. While the very existence of global literary studies as an institutionalised field is not yet fully established, the global turn in various disciplines in the humanities and the social sciences has been gaining traction in recent years. This book aims to contribute to the field of global literary studies with a more inclusive and decentralising approach. Specifically, it responds to a double demand: the need for expanding openness to other ways of seeing the global literary space by including multiple literary (...) and cultural traditions and other interdisciplinary perspectives in the discussion, and the need for conceptual models and different case studies that will help develop a global approach in four key avenues of research: global translation flows and translation policies, the post-1989 novel as a global form, global literary environments, and a global perspective on film and cinema history. Gathering contributions from international scholars with expertise in various areas of research, the volume is structured around five target concepts: space, scale, time, connectivity, and agency. Digital transformation has allowed to offer additional services - which complement the main product - both in terms of use, emotional and relationship terms. Focused on a traditionally rational insurance customer offering a value that explores the customer's emotions, from co-creating with the user, allows brand differentiation. Given this idea, this document has three purposes. First, identify the role of expectations and the perceived quality of the customer's digital experience. Secondly, to identify the relationship between experience and satisfaction gained in (...) private insurance web areas. Third, identify the most valued digital attributes by the user. A sample of 4,178 customers registered was analyzed using the partial least squares technique. The model is highly predictive to customer experience and evidence the important relationship between the WOW effect and satisfaction, as well as the weak but doble role that expectations play on insurance digital self-service. The model demonstrates that expectations are only relevant before web consumption, because during the process it is the perceived digital quality, in particular the usefulness, information and technology, that offer a true customer experience. This article offers high academic value because it more accurately defines the determinants of the digital insurance customer experience and its effect on customer satisfaction in digital services. While expectations influence attitude before service, this research reveals that perceived digital quality is what delivers a true customer experience. Strategically, the implications are immediate in the field of business as it shows the importance of co-creation in digital design, not only because of the significant savings in implementation costs but also because it guarantees a greater experience, essential in the loyalty of its customers. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

This paper argues that the vitalist monisms of Anne Conway and Margaret Cavendish. Even though Conway is often cited as a proponent of a thoroughgoing ‘spiritualist’ ontology and Cavendish as the advocate of a similarly thoroughgoing materialism, their views turn out to be much closer than they may initially seem. Apart from highlighting the more radical nature of Conway’s position, such a reframing also has the added advantage of bringing the similarities between her own ‘spiritual’ monism and the vitalist ‘materialisms’ (...) of her time into sharper relief. As F. Wunderlich emphasizes, the notion of subtle matter pervaded the natural sciences of the seventeenth and the eighteenth centuries. The chapter provides a brief sketch of Cavendish’s ‘materialism’ and compares it to Conway’s view of created substance, drawing out a number of relevant similarities. It asks what may have motivated Conway and Cavendish to move beyond the materialism-immaterialism divide by ‘spiritualizing’ matter in this way. (shrink)

This article develops the argument that non-cosmopolitan considerations of justice justify relief of sovereign debt for highly indebted poor states. In particular, the article claims that considerations of national determination warrant some debt-forgiveness in the backdrop of unfair terms of global interaction. In a context of inequality, poor countries cannot generally afford to disregard the costs of ignoring the interests of the wealthiest states. Patterns of unbalanced interaction undermine national self-determination by limiting the poor countries' effective capacity to choose between (...) different policies to achieve development and other worthy goals. In concrete, this article suggests that unequal terms of interaction constrain national self-determination by making of sovereign debt an 'escape mechanism' in the absence of rival alternatives to palliate the effects of underdevelopment and related afflictions, despite the causes of sovereign debt being partly domestic, possibly. Thus, this paper views national self-determination as dependent on the availability of acceptable (non-unbearably burdensome) policy options on the part of states. (shrink)

On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations. It offers an (...) account of moral certainty, which is linked to a view of moral competence. Contrary to the views propounded by philosophers who emphasise the importance of moral principles, it is argued that moral agency is first and foremost a matter of having certain capacities. The book takes an anti-intellectualist stance and remains close to concrete practices. According to some authors, Latour’s attention to politics during the last decades is the result of his proposing a different approach to politics that entails, with respect to his overall project, one of two situations. Either his epistemological proposal has suffered a “normative turn”—which necessarily breaks with the previous assumptions of Actor-Network Theory (ANT); or, if ANT’s view on technosciences remains valid, his political proposal becomes not possible as a new normative approach. In this paper, I will focus on the (...) critique voiced by John Law, as well as Graham Harman. I will argue that this is a false dilemma because there has not been a change in Latour’s conceptual basis, nor a lack of coherence within his thought that would undermine the democratic commitment of his Political Epistemology. I will justify this by exposing the fact that Latour’s overall project, as part of Science Studies, has not lately followed a “political” but an “ontological” turn, which has been underling his works since the very beginning of ANT. The aim of this paper is to explore the identity of the teacher as a dialectical being that is in permanent construction, to identify some obstacles teachers might find in this process while operating in an institutional framework, and the effects these could have upon the teacher and the goals she pursues with her students. By ruling out the idea of identity as an autonomous self that can be constructed with no ties with its context, we propose that identity is (...) dialogical and is built through the relationships we establish with others. This fact situates the relationship between the student and the teacher at the center of pedagogical practices and allows us to establish the ideas of teacher presence and integrity as central elements for the moral development of students. In this context, we identify the excessive institutionalization of the role of the teacher as a cause for the reduction of identity and a defensive retreat to the possible outcomes of being judged by strictly formal criteria, wh... Bayesian epistemology provides a popular and powerful framework for modeling rational norms on credences, including how rational agents should respond to evidence. The framework is built on the assumption that ideally rational agents have credences, or degrees of belief, that are representable by numbers that obey the axioms of probability. From there, further constraints are proposed regarding which credence assignments are rationally permissible, and how rational agents’ credences should change upon learning new evidence. While the details are hotly disputed, all (...) flavors of Bayesianism purport to give us norms of ideal rationality. This raises the question of how exactly these norms apply to you and me, since perfect compliance with those ideal norms is out of reach for human thinkers. A common response is that Bayesian norms are ideals that human reasoners are supposed to approximate – the closer they come to being ideally rational, the better. To make this claim plausible, we need to make it more precise. In what sense is it better to be closer to ideally rational, and what is an appropriate measure of such closeness? The successes of the human genome project and genomics research programs portend great potential to improve upon health and enhance life. As scientific advancements continue, bioethicists and policy makers deliberate over the social and ethical implications of genetic and genomic technologies and information (ggT/I). The application of ggT/I to human reproduction raises conceptual and moral questions about being human and the links between offspring, parents, and society. Given ggT/I’s ability to significantly affect the biological constitution of humans and future human (...) generations thinking through such issues is fundamental to ethical and policy analysis. By means of a systematic literature review and accompanying content analysis, this paper highlights the dominant ethical concerns raised within recent bioethics discourse over the use of ggT/I for human reproduction. Based on these findings it aso offers a framework through which, and demarcates where, religious perspectives can add value to genethics debates and policy deliberation. (shrink)
