This book is the first comprehensive treatment in recent decades of silence and silencing in psychoanalysis from clinical and research perspectives, as well as in philosophy, theology, linguistics, and musicology.

In recent years, the ethical impact of AI has been increasingly scrutinized, with public scandals emerging over biased outcomes, lack of transparency, and the misuse of data. This has led to a growing mistrust of AI and increased calls for mandated ethical audits of algorithms. Current proposals for ethical assessment of algorithms are either too high level to be put into practice without further guidance, or they focus on very specific and technical notions of fairness or transparency that do not (...) consider multiple stakeholders or the broader social context. In this article, we present an auditing framework to guide the ethical assessment of an algorithm. The audit instrument itself is comprised of three elements: a list of possible interests of stakeholders affected by the algorithm, an assessment of metrics that describe key ethically salient features of the algorithm, and a relevancy matrix that connects the assessed metrics to stakeholder interests. The proposed audit instrument yields an ethical evaluation of an algorithm that could be used by regulators and others interested in doing due diligence, while paying careful attention to the complex societal context within which the algorithm is deployed. The paper highlights some related features of allegorical interpretations of Odysseus and Abraham. Both figures were interpreted as souls on a quest. The affinity between exegetical depic­tions of these quests may have prompted the later synthesis of ancient readings regarding Odys­seus’ intellectual pursuits. The comparison of Penelope and her maids to philosophy and lesser dis­ciplines influenced Philo’s image of Abraham as the husband of wisdom, and the mirror image of Philo himself as the husband of philosophy. There are grounds to (...) question whether Philo’s exegesis subsequently formed a background against which Odysseus’ pursuits were expounded. Among the similarities between his Abraham and Eustathios’ Odysseus the philosopher, the portrayal of these characters as stargazers is the most conspicuous. (shrink)

Medjuzavisnost udruzenih drzava smanjuje njihovu nezavisnost, a sirenje transnacionalih fenomena izmice kontroli nacionalne drzave, tako da je nacionalni suverenitet doveden u pitanje i zasluzuje da se ponovo ispita. Prvo cemo se osvrnuti na Kantov projekat za vecni mir koji predvidja i inspirise udruzivanje drzava (...) u savremeno doba, zatim cemo se baviti suverenitetom nacionalnih drzava s obzirom na njihovo clanstvo u medjunarodnim organizacijama i vojnim savezima koji su stvoreni u dvadesetom veku i na kraju s obzirom na globalizaciju i regionalno udruzivanje drzava. Over the past 10 years, Cognitive Linguistics has taken a quantitative turn. Yet, concerns have been raised that this preoccupation with quantification and modelling may not bring us any closer to understanding how language works. We show that this objection is unfounded, especially if we rely on modelling techniques based on biologically and psychologically plausible learning algorithms. These make it possible to take a quantitative approach, while generating and testing specific hypotheses that will advance our understanding of how knowledge of (...) language emerges from exposure to usage. In this paper, we reconsider the notion of epistemic trespassing and attempt to explore possible scenarios in which it could lead to positive outcomes in scientific research and information dissemination. As we will point out, some of the significant discoveries in the history of science would not have been possible were it not for the epistemic trespassers, whose shift in paradigm changed the approach to specific issues for the better. Furthermore, we will present instances where individuals, often labeled as ‘trespassers’ (...) – those who venture into fields outside their expertise – can be considered trustworthy and reliable sources of testimony. Consequently, epistemic trespassing turned out to be essential for the advancement of science. Epistemic trespassing in our age is virtually inevitable – whether it be from a political perspective (to preserve democratic values) or due to purely practical reasons (i.e. searching for information online). There are interdisciplinary fields where a strictly negative characterization of epistemic trespassing would question their methodology since these disciplines rely on experts from various fields. For these reasons, we advocate for a more charitable approach to epistemic trespassing and greater public education to help them distinguish between correct and false information. (shrink)

The argument from causal closure of the physical is usually considered the most powerful argument in favor of the ontological doctrine of physicalism. Many authors, most notably Papineau, assume that CCP implies that physicalism is supported by physics. I demonstrate, however, that physical science has no bias in the ontological debate between proponents of physicalism and dualism. I show that the arguments offered for CCP are effective only against the accounts of mental causation based on the action of the mental (...) forces of a Newtonian nature, i.e. those which manifest themselves by causing accelerations. However, it is conceivable and possible that mental causation is manifested through the redistribution of energy, momentum and other conserved quantities in the system, brought about by altering the state probability distribution within the living system and leading to anomalous correlations of neural processes. After arguing that a probabilistic, interactionist model of mental causation is conceivable, which renders the argument from causal closure of the physical ineffective, I point to some basic features that such a model must have in order to be intelligible. At the same time, I indicate the way that conclusive testing of CCP can be done within the theoretical framework of physics. (shrink)

I argue here that certain species of war, namely humanitarian military interventions (HMIs), can be obligatory within particular contexts. Specifically, I look at the notion of HMIs through the lens of just war theory and argue that when a minimal account of jus ad bellum implies that an intervention is permissible, it also implies that it is obligatory. I begin by clarifying the jus ad bellum conditions (such as just cause, right intentions, etc.) under which an intervention is permissible. I (...) then turn to the claim that permissibility necessitates obligation, by first showing that whenever an intervention is permissible, it is also minimally decent. Second, I show that minimally decent actions are morally obligatory by arguing that the notion of minimal decency is a conceptual bridge between negative and positive duties. Third, I argue that performing minimally decent actions is necessary for a state to be just. Ultimately, my conclusion arises from the following observation: if a humanitarian crisis is bad enough for one to hold that it is permissible to breach sovereignty of a nation, then it is bad enough to hold that there is an obligation to intervene. The answer to the fine-tuning problem of the universe has been traditionally sought in terms of either design or multiverse. In philosophy circles, this is sometimes expanded by adding the option of explanatory nihilism – the claim that there is no explanation for statements of that high level of generality: fine-tunings are brute facts. In this paper, we consider the fourth option which, at least in principle, is available to us: co-evolution of the universe and obsevers. Although conceptual roots of (...) this approach could be found already in ancient stoicism, it is still the least investigated explanatory option for resolving the problem of empirical fine tunings. We offer two preliminary models along which the co-evolution hypothesis could be developed further. They are still on the level of speculative metaphysics, but there are opportunities along the way to generate predictions which are in principle testable, especially in the domain of large-scale numerical simulations. Infants have been shown to rely both on auditory and visual cues when processing speech. We investigated the impact of COVID-related changes, in particular of face masks, in early word segmentation abilities. Following up on our previous study demonstrating that, by 4 months, infants already segmented targets presented auditorily at utterance-edge position, and, using the same visual familiarization paradigm, 7–9-month-old infants performed an auditory and an audiovisual word segmentation experiment in two conditions: without and with an FFP2 face mask. Analysis (...) of acoustic and visual cues showed changes in face-masked speech affecting the amount, weight, and location of cues. Utterance-edge position displayed more salient cues than utterance-medial position, but the cues were attenuated in face-masked speech. Results revealed no evidence for segmentation, not even at edge position, regardless of mask condition and auditory or visual speech presentation. However, in the audiovisual experiment, infants attended more to the screen during the test trials when familiarized with without mask speech. Also, the infants attended more to the mouth and less to the eyes in without mask than with mask. In addition, evidence for an advantage of the utterance-edge position in emerging segmentation abilities was found. Thus, audiovisual information provided some support to developing word segmentation. We compared 7–9-monthers segmentation ability observed in the Butler and Frota pre-COVID study with the current auditory without mask data. Mean looking time for edge was significantly higher than unfamiliar in the pre-COVID study only. Measures of cognitive and language development obtained with the CSBS scales showed that the infants of the current study scored significantly lower than the same-age infants from the CSBS normative data. Our results suggest an overall effect of the pandemic on early segmentation abilities and language development, calling for longitudinal studies to determine how development proceeds. (shrink)

Over the last 102 years, a lot of discussion was being held about the psychoanalytic conception of the “death drive,” but still with inconclusive results. In this paper, we start with a brief review of Freud’s conception, followed by a comprised overview of its subsequent support or criticisms. The core of our argument is a systematic review of current biochemical research about two proposed manifestations of the “death drive,” which could hopefully move the discussion to the realm of science. It (...) was already established that drive satisfaction leads to the secretion of beta-endorphins, and research evidence also shows that the same biochemical mechanisms get activated in the case of masochism and the gambling disorder but only if they are preceded by chronic frustration of the essential drives. We conclude that the actual situation is more complex than Freud hypothesized, and that a fundamental revision of the psychoanalytic drive theory is necessary. (shrink)

The contemporary global crisis can be explored in different perspectives. This text focuses on constitutionalism. It asks whether constitutionalism still matters. Responding to this question requires revisiting the basic analytical and normative concepts that shape individual autonomy, polity, law and democracy in the context of globalization. Part I of the article introduces the question of the crisis of constitutionalism. It briefly explores the dispute between proponents of state and post-state constitutionalism, and proceeds with an analysis of societal constitutionalism. The critical (...) reading of this theory prepares the ground for a positive normative argument. Part II of the article argues for the return to the moral core of constitutionalism. It defends the claim that justice at the global stage requires establishing a minimum common denominator that would be composed of universalizable substantive principles. The institutional question follows. Its focus should be on the authoritative identification, protection and advancement of the core values of constitutionalism in the social and legal-political realms of the world society. (shrink)

In this paper, I suggest that for some proposed solutions to global justice problems, incompatibility with the necessary features of international law is a reason to reject them. I illustrate this by discussing the problem raised by the case of unjust combatants, that is, combatants lacking a just cause for war. I argue that the principle of inequality of combatants, which suggests that we ought to prohibit those without a just cause for war from fighting, is not only a bad (...) international legal principle, but also a bad principle of global justice. War has changed so much that it barely resembles the paradigmatic cases of armed conflict that just war theories and international humanitarian law seemed to have had in mind even a few decades ago. The changing character of war includes not only the use of new technology such as drones, but probably more problematically the changing temporal and spatial scope of war and the changing character of actors in war. These changes give rise to worries about what counts as war (...) and thus what norms to use in evaluating a particular conflict. In this paper, I develop an argument that the changing character of war gives us reasons to take reductionist revisions of just war theory seriously. By reductionist theories of war I mean those revisions within the just war tradition that suggest that we can use ordinary peacetime interpersonal analyses of moral responsibility and liability to harm to decide what justice requires in times of war. Davidovic asks what gives the international community the authority to punish some crimes? On one prominent view some crimes (genome, torture) are so heinous that the international community, so long as its procedures are fair, is justified in prosecuting them. Another view contends that heinousness alone is not enough to justify international prosecution: what is needed is an account of why the international community, in particular, has standing to hold the perpetrators to account. Davidovic raises concerns about both of these (...) views and then defends her own account. On her view, the heinousness of the crimes is relevant, but what makes these crimes the business of the international community is that the community in fact recognizes certain norms against especially heinous crimes. If the international community fails to prosecute and punish those who perpetrate these crimes, this impunity undermines the rule of law, and thereby hinders the maintenance of peace the the protection of human rights. Democracy is in serious difficulties. Three features of the crisis stand out. First is the dominant culture of disillusionment in democracy, which transpires as the mistrust in constitutionalist institutions and values. Second, political authority, both at domestic and international levels, is largely substituted by the rule of non-transparent and unpredictable social powers. Third, democratic states are deprived of much of their capacity to govern, but they retain a non-negligible capacity to coerce.The article is structured as follows. Section I introduces Karl (...) Collective crime is an act committed by a significant number of the members of a group, in the name of all members of that group, with the support of the majority of group members, and against individuals targeted on the basis of their belonging to a different group.The central claim is that all members of the group in whose name collective crime is committed share responsibility for it. This book's special (...) interest is with analytical and normative defense of arguments that purport to explain reasons for, and the character of, responsibility of decent people. Those who did not intend, support, or committed wrong, are still accountable in a non-vicarious manner. One of the main challenges that the arriving paradigm of Internet of Things brings to society is providing and securing individual privacy. There are lots of obstacles which prevents us from successfully confronting such a challenge. In this paper we are going to deal with one such obstacle, and that is the bounded rationality of humans as participants in the environment of Internet of Things. We argue that the ethical approach to the vision of the Internet of Things has to (...) include the notion of bounded rationality. Bounded rationality of users impedes the possibility of giving informed consent. Informed consent is required when getting permission for collecting and using somebody’s personal information. Lastly, we discuss the need for a paternalistic approach of maximum possible default privacy settings without asking for consent, given the seriousness of all potential risks. (shrink)

Autonomy, understood as self-rule, is almost routinely accepted as one of the core liberal concepts. Still, a closer view reveals that both the status and meaning of autonomy are controversial. The text departs from a short summary of the main theoretical disputes surrounding the concept. A critique of the standard internalist account is followed by an attempt to offer reasons for accepting a relational reading of autonomy. The central question of the text is context-specific. It asks about the possibility and (...) meaning of liberal autonomy in a society whose past is marked by mass regime-sponsored crimes. The background assumption is that mass crime leaves actors in heteronomous condition. At stake is reestablishing individual autonomies of two types of actors, whose group-specific identities have been created by crime: the ethical community of those who share collective identity with victims, and the ethical community of those who share collective identity with perpetrators. nema. In this article I ask how moral relativism applies to the analysis of responsibility for mass crime. The focus is on the critical reading of two influential relativist attempts to offer a theoretically consistent response to the challenges imposed by extreme criminal practices. First, I explore Gilbert Harman’s analytical effort to conceptualize the reach of moral discourse. According to Harman, mass crime creates a contextually specific relationship to which moral judgments do not apply any more. Second, I analyze the inability (...) thesis, which claims that the agents of mass crime are not able to distinguish between right and wrong. Richard Arneson, Michael Zimmerman and Geoffrey Scarre do not deny the moral wrongness of crime. However, having introduced the claim of authenticity as a specific feature of the inability thesis, they maintain that killers are not responsible. I argue that these positions do not hold. The relativist failure to properly conceptualize responsibility for mass crime follows from the mistaken view of moral autonomy, which then leads to the erroneous explanation of the establishment, authority and justification of moral judgments. Meaningful human control over AI is exalted as a key tool for assuring safety, dignity, and responsibility for AI and automated decision-systems. It is a central topic especially in fields that deal with the use of AI for decisions that could cause significant harm, like AI-enabled weapons systems. This paper argues that discussions regarding meaningful human control commonly fail to identify the purpose behind the call for meaningful human control and that stating that purpose is a necessary step in deciding (...) how best to institutionalize meaningful human control over AI. Once commonly held, the claim that international prosecutions have a valuable role to play in transitional processes has in recent years come under attack. This attack has generally been grounded in the assertion that inter-national criminal prosecutions undermine reconciliation.I believe that the international criminal prosecutions in general and the International Criminal Court (ICC) in particular can play a meaningful role in sustaining peace and making transitional periods smoother and faster. However, the role the ICC can play in the transitional processes (...) is undermined by attempts to muddle the criminal process with reconciliatory and restorative aims . Traditionally, in deciding whether some strategy or action in war is proportionate and necessary and thus permissible both international law and just war theory focus exclusively on civilian deaths and the destruction of civilian infrastructure. I argue in this paper that any argument that can explain why we should care about collateral killing and damage to infrastructure can also explain why collateral displacement matters. I argue that displacement is a foreseeable near-proximate cause of lethal harm to civilians and is relevant (...) for proportionality and necessity calculi. Accepting my argument has significant consequences for what we are permitted to do in war and for what obligations we have towards refugees that result from our actions in war. (shrink)

Post-conflict criminal prosecutions for the worst of crimes can play a meaningful role in achieving transitional justice. This once-common view has recently been the subject of widespread criticism that is rooted in the belief that criminal prosecutions undermine reconciliation. This has lead some scholars to argue that we must either abandon criminal prosecutions post-conflict or that we ought to use them for more general transitional justice aims, like restorative justice. This article argues against abandoning criminal prosecutions post conflict and against (...) subsuming criminal justice aims under restorative or reconciliatory aims. When post-conflict criminal prosecutions are properly structured and practiced they can bolster respect for the international, regional and domestic rule of law and in that way limit conflict in a number of important ways.
