According to the traditional theory, a person S performed an action a freely only if S could have done otherwise, that is, only if S had alternatives. One may adopt a combined view of free will that sanctions both the traditional and source theories. Each stage depends upon the former and deepens the original ontology, while still introducing novel elements. For example, in Being and Nothingness, the in-itself, which is the source of our world-making, develops in the Critique into the practico-inert, which is the world made artifact, and (...) in The Family Idiot, both the in-itself and the practico-inert unite to become the Spirit of the Age, joining our adventure with nature to that of our adventure with our family and our history. What is the appropriate degree of abstraction from existing social facts when engaging in normative political theory? Through a focus on American Indian and other indigenous claims over historically expropriated lands, this essay argues that highly abstracted forms of normative analysis can often misunderstand the core moral problems at stake in real cases, and that they can pose moral dangers when they do so. As argued, the hard moral issues involved in indigenous land claims within countries such as Canada and (...) the United States often have far more to do with questions about competing uses for public lands than with abstract property theory as such. The essay argues that normative theorists will often do more social good, and pose fewer dangers, when they pay close attention to the real moral challenges that social actors face on the ground than when they become captured by abstract questions with ambiguous practical importance. Using the work of Robert A. Kagan's intellectual contribution on the intensification of law, leading authorities in the study of the politics of regulation and litigation examine the consequences of the expansion and intensification of law, both in the United States and the rest of the world. Part One considers bureaucratic legalism, a terrain in which popular and political discourse often conceives as a pitched battle between business and government, and in which claims about quantity—"too much" and "too little"—take center (...) stage. Here, the contributors examine the many ways in which regulators and the regulated cooperate, and the extent to which regulated entities internalize norms and practices associated with bureaucratic. Part Two considers adversarial legalism, a term that even among academics is often reduced to "litigiousness." The chapters in this section show that adversarial legalism is a much more complex, contingent, and multi-sided phenomenon than the popular debate over litigiousness suggests. Part III examines Kagan's core concepts in a comparative framework. Although some sometimes treat adversarial legalism as an American disease, scholars are increasingly finding it proliferating elsewhere, and debating whether it can take a prominent role in nations quite different in tradition and political structure from the United States. Across the globe, law and legalism in all its forms, bureaucratic and adversarial, is becoming more intense, and thus more central to politics, public policy and everyday life. The rationale for pursuing the development and use of Germ-Line selection and modification techniques is examined in this essay. The argument is put forth that it is the moral obligation of the medical profession to make available to the public any technology that can cure or prevent pathology leading to death and disability, in both the present and future generations. Society should pursue the development of strategies for preventing or correcting, at the Germ-Line level, genetic features that will lead to, (...) or enhance, pathological conditions. Because prenatal screening and even early embryo screening and selection can prevent only a subset of known genetic disorders, direct genetic intervention is the only way in which certain couples can exercise their rights to reproductive health. On May 14, 1940, Otto Neurath and Marie Reidemeister fled from the harbour of Scheveningen in The Hague to England. It was the last boat that could escape from Holland before the German occupiers took the city. Years earlier, in 1934, they had fled the same danger from Vienna to Holland. Otto Neurath can be seen as the godfather of today's infographics. In the Gesellschafts- und Wirtschaftsmuseum (Social & Economic Museum) that he founded in Vienna, developments in various areas of (...) society were shown by means of pictorial statistics to a broad audience - rich and poor, literate and illiterate. At the Museum, Otto Neurath acted as the scientific director and inspirer, Marie Reidemeister as the 'Transformer' of data into sketches, and Gerd Arntz as the head of the graphics department which designed pictograms and layouts. These three continued that work in Holland under the acronym Isotype (International System Of TYpographic Picture Education). After internment as 'enemy aliens' on the Isle of Man, Neurath & Reidemeister were able to continue their work in the UK. Through Wolfgang Foges and his book packaging firm Adprint, they were commissioned to design Isotype charts for books supported by the Ministry of Information during the war - what might be called 'soft propaganda'. From 1942, Isotypes were supplied for information about the embryonic welfare state (Beveridge Plan), for illustrated books about Britain's allies (USA and USSR), and on what British democracy should look like after the war. This book illustrates around 250 Isotypes from these publications and provides information about the producers, authors, editors, and designers, and not least about the working relationship between the Isotype Institute and Adprint. The examples presented show the remarkable quality of the graphics, produced under less than ideal circumstances during wartime. (shrink)

This paper examines the role of ?situations? in John Dewey's philosophy of logic. To do this properly it is necessary to contrast Dewey's conception of experience and mentality with views characteristic of modern epistemology. The primary difference is that, rather than treat experience as peripheral and or external to mental functions (reason, etc.), we should treat experience as a field in and as a part of which thinking takes place. Experience in this broad sense subsumes theory and fact, hypothesis and (...) evidence, reason and observation, thought and perception. Logic in this view is a formal study of the generic features of all possible kinds of experience in this broad (thick, deep, wide, multifaceted) sense. The goal of this paper is to explain what Dewey thinks a situation is in the context of this view of experience, and to argue for the fundamental importance of that idea for logic and philosophy in general. It was probably written in the mid-1940s, after the second edition of Korzybski's Science and Sanity and The Philosophy of Literary Form, both published in 1941; perhaps at roughly the same time as the more extended discussions of behaviorism and Korzybski in A Grammar of Motives, published in 1945; and before the full development of Burke's ideas about persuasion, identification, and dialectical symmetry in A Rhetoric of Motives, published in 1950. In this article, I set forth my understanding of reciprocal causality between God and finite entities in three stages, beginning with Aristotle’s analysis of change in this world. Afterwards, I examine the way in which Aquinas used the causal scheme of Aristotle in his Christian understanding of the God-world relationship. Finally, I indicate how both Aristotle’s philosophy and Aquinas’s approach to the God-world relationship should be rethought so as to be more in line with contemporary scientific understanding of the evolution (...) of life from non-life and the emergence of progressively higher-order life-systems out of lower-order life-systems within creation. This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons (...) to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

Objective: The objective of the current study was to maximise the amount of information children and adolescents understand about the risks and benefits associated with participation in a biomedical research study.Design: Participants were presented with one of six hypothetical research protocols describing how to fix a fractured thigh using either a “standard” cast or “new” pins procedure. Risks and benefits associated with each of the treatment options were manipulated so that for each one of the six protocols there was either (...) a correct or ambiguous choice.Participants and setting: Two hundred and fifty one children, ages 6–15 , and 237 adults were interviewed while waiting for a clinic appointment at the Hospital for Sick Children.Results: Using standardised procedures and questionnaires, it was determined that most participants, regardless of age group, were able to understand the basic purpose and procedures involved in the research, and most were able to choose the “correct” operation. The younger children, however, showed an overall preference for a cast operation, whereas the older participants were more likely to choose the pins.Conclusions: By creating age appropriate modules of information, children as young as six years can understand potentially difficult and complex concepts such as the risks and benefits associated with participation in biomedical research. It appears, however, that different criteria were used for treatment preference, regardless of associated risks; older participants tended to opt for mobility whereas younger participants stayed with the more familiar cast operation.
