The Catholic Church proscribes methods of birth control other than sexual abstinence. Although the U.S. Food and Drug Administration (FDA) recognizes abstinence as an acceptable method of birth control in research studies, some pharmaceutical companies mandate the use of artificial contraceptive techniques to avoid pregnancy as a condition for participation in their studies. These requirements are unacceptable at Catholic health care institutions, leading to conflicts among institutional review boards, clinical investigators, and sponsors. Subjects may feel coerced by such mandates to (...) adopt contraceptive techniques inconsistent with their personal situation and beliefs; women committed to celibacy or who engage exclusively in non-heterosexual activities are negatively impacted. We propose principles to insure informed consent to safeguard the rights of research subjects at Catholic institutions while mitigating this ethical conflict. At the same time, our proposal respects the interests of pharmaceutical research agencies and Catholic moral precepts, and fully abides by regulatory guidance. (shrink)

The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of (...) the NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. This conception of intentional action provides a stronger foundation for natural law theory. (shrink)

In Intention and her subsequent essays that addressed human action, Elizabeth Anscombe made signal contributions to the Aristotelian-Thomistic tradition, and to western philosophy more broadly. The new natural law theory of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators mistakenly claims to be consonant with Anscombe’s work. A central reason for this misappropriation lies in the failure to understand the ways in which Anscombe does and does not deploy a “first-person perspective” in analyzing intentional action. O'Brien, Roderick Among the treasures at the Congregational Archives of the Sisters of St Joseph of the Sacred Heart in North Sydney is a booklet, a hymnal: a collection of hymns and sacred songs attributed to Fr Julian Tenison Woods.1 The purpose of this short article is to introduce one of those hymns, and provide some information about poetry and songs in Woods's life and mission. I am grateful to the archivist for making this booklet available. Introducing this (...) particular hymn, 'Longing to Go', also gives us some insight into Woods's spirituality regarding death and regarding mission. (shrink)

There was a significant monetary cost associated with establishing Catholicism in colonial Western Australia. The bishops and clergy funded the development of the local Catholic Church through donations from European benefactors, offerings from the congregation, and sponsorship from the Colonial and British Governments. As donations from Europe were variable and the resident Catholic population were largely poor, the government grants were the most reliable income for the Diocese of Perth. The government issued grants to support the establishment of congregations, schools, (...) and social welfare institutions. The development of congregations in new settlements was the Catholic Church's core ministry and the government issued stipends to Catholic chaplains to administer spiritual care to settlers and convicts in particular districts. Government grants were based on the census results and the Catholic Church was required to establish local church congregations and recruit clergy, and demonstrate an ability to contribute towards the maintenance of both. From 1852 to 1886, Bishops Joseph Serra, Rosendo Salvado and Martin Griver took charge of establishing congregations, managing clergy and lobbying the governors and other civil officials to fund colonial chaplaincies. The government also expected that the chaplains would promote moral and social order among the ex-convicts transported from Britain. (shrink)

There is a rather disturbing argument that it is wrong for us ever to smile and be glad, in light of our knowledge of horrors happening everywhere all the time. The paper's primary aim is to respond to the challenge this argument presents and to see what can be said for being happy in spite of it. Drawing from the works of Tolstoy, Joseph Butler, and others, the author develops two or three lines of response to the argument against (...) happiness. One line of response makes heavy use of what human nature is like and what some of our limitations are. The second line of response considers the consequences of the fact that we naturallycease to be moved by things we are used to. The third line explores the idea that it is justifiable to be happy in the midst of suffering if you yourself are sufferingtoo. The author believes that these lines of argument may answer to some degree the argument against happiness. (shrink)

O'Brien & Opie's admirably sharp hypothesis gains some of its force by ignoring distinctions in murky areas. I attempt to agitate the waters by suggesting that process and vehicle theories are not so different, that classicism can support a vehicle theory, and that several of the key concepts underlying their theory are less clear than depicted. The connection to information I find especially tenuous. Finally, I address the implications of their theory for unconscious thought.

This paper addresses the question “what connection is there between our answer to the question of what we are, and the question, what our actions are?” Suppose that actions are reflexive changes of agents. On that supposition, there would be a direct connection between the answers to those two questions. An action of mine will be a reflexive change of me, and what I am will fix the nature of those changes. I hold that supposition to be true and consider (...) reasons in favor of believing it. However, the paper is not primarily aimed at defense of that thesis. It rather concerned with exploring what consequences accepting it has for the competing notions of what we are, given what we ordinarily think actions are, and bringing to light a tension between thinking of actions as reflexive changes of agents in this way, and a kind of causal understanding of actions that is prevalent. What emerges is that we should shift where we start our theorizing: we cannot assume that action theory primarily involves the task of characterizing the relation between an agent and changes caused, rather than a characterization of a particular kind of relation between the agent and herself. How was the world generated and how does matter continue to be ordered so that the world can continue functioning? Questions like these have existed as long as humanity has been capable of rational thought. In antiquity, Plato's Timaeus introduced the concept of the Demiurge, or Craftsman-god, to answer them. This lucid and wide-ranging book argues that the concept of the Demiurge was highly influential on the many discussions operating in Middle Platonist, Gnostic, Hermetic and Christian contexts in the first (...) three centuries AD. It explores key metaphysical problems such as the origin of evil, the relationship between matter and the First Principle and the deployment of ever-increasing numbers of secondary deities to insulate the First Principle from the sensible world. In this paper I describe the imaginary community of Gullible. Gulliblians are led by moral pressures to believe whatever they are told and, in the scenario that I sketch, this leads to them having widespread contradictory beliefs. This community is nevertheless intelligible to us given what we know about their situation and their moral code. Davidson, however, holds there to be what I call a logicist constraint on interpretation: thinkers can only be interpreted if a good proportion of their beliefs (...) are rational and, for Davidson, rationality entails logical consistency. The possibility of Gullible therefore forces us to reject this logicist aspect of Davidson’s account of interpretation and intelligibility. (shrink)

Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. What is God doing about a world marked by conflict and division? What about a world in which our technologies promise great good but also threaten our existence? What is God doing in a world where the demands for accumulation and acquisition create division and despair? Can Christians hope to be of positive influence in a world that does not always support, reflect, or even understand Christian commitments? Christian ethics often raises such questions as these, and the possible answers vary (...) widely. Paul's Letter to the Ephesians is a tremendous resource for exploring a faithful response to perhaps the toughest question of all: what is God doing about evil? The role of Christian ethics is to take seriously the challenge that, whatever God is doing, God calls us to participate in a distinctive task that embraces our own commitments and labors within the divine purpose. Most models of corporate social responsibility revolve around the controversy as to whether business is a single dimensional entity of profit maximization or a multi-dimensional entity serving greater societal interests. Furthermore, the models are mostly descriptive in nature and are based on the experiences of western countries. There has been little attempt to develop a model that accounts for corporate social responsibility in diverse environments with differing socio-cultural and market settings. In this paper an attempt has been made to fill (...) this gap by developing a two-dimensional model of corporate social responsibility and empirically testing its validity in the context of two dissimilar cultures – Australia and Bangladesh. The two dimensions are the span of corporate responsibility and the range of outcomes of social commitments of businesses. The test results confirm the validity of the two-dimensional model in the two environments. The Factor analysis revealed two leading dimensions. Cluster analysis pointed to two distinctive clusters of managers in both Australia and Bangladesh, one consisting of managers with a broad contemporary concept of social responsibility, and the other with a limited narrow view. The paper concludes that corporate social responsibility is two-dimensional and universal in nature and that differing cultural and market settings in which managers operate may have little impact on the ethical perceptions of corporate managers. O'Brien provides a critical assessment of Ernest Mandel's 1975 monograph Late Capitalism. In so doing, he offers a historical narrative that puts into question Mandel's framing of 'waves' of capitalist development as a process of capital accumulation that was dependent upon uneven development in the Third World. O'Brien starts by problematising Mandel's argument that an initial concentration of money, capital and bullion in the hands of Europeans explains combined and uneven development. He goes on to demonstrate that Mandel's (...) notion of imperialism as a necessary conduit for the flow of surplus capital from industrialising Europe does not stand up to the historical evidence. In fact, O'Brien maintains an alternative thesis, namely that these marginalised regions were insuffciently penetrated by European capital. (shrink)

While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. We propose using a bi-axial map as a heuristic for categorizing different dynamics involved in the relationship between quality and popularity. The east–west axis represents the degree to which an agent’s decision is influenced by those of other agents. This ranges from the extreme western edge, where an agent learns individually (no outside influence), to the extreme eastern edge, where an agent is influenced by a large number of other agents. The vertical axis represents how easy or difficult it is (...) for an agent to discern the relative quality of available choices. When a case study is located on the map, it becomes easier to select the range of tools to use for understanding and predicting the relation between quality and popularity. (shrink)

Hume is usually taken to have an evidentialist account of testimonial belief: one is justified in believing what someone says if one has empincal evidence that they have been reliable in the past. This account is impartialist: such evidence is required no matter who the person is, or what refotions she may have to you. I, however, argue that Hume has another account of testimony, one grounded in sympathy. This account is partialist, in that empincal evidence is not required in (...) order for one to be justified in believing some of the assertions of one's friends. (shrink)

ANALOGY has not just to do with the abstruse details and niceties of metaphysics but rather underlies the structure of all metaphysical thought. It is the heart of metaphysics. No system of metaphysics can discard it, without prejudice to the richness and variety of being. Without analogy there is elimination and over-simplification. Metaphysics is far from being a straightforward science; it is highly complex and its method and style of argument are not easy to master. Its field of inquiry is (...) wide. Stobaeus records a placitum where Empedocles says that the world is destroyed by the domination in turn of Love and of Strife. The placitum makes perfectly good sense in the context of Empedocles' belief that Love and Strife produce, in turn, a non-cosmic state of total unity (Love) and of total separation (Strife). But for over two hundred years scholars have been unable to hear that simple message. Sturz (1805) emended the text so as to make it fit the non-cyclical (...) interpretation of Empedocles that he had taken over from the pages of Tiedemann (1791). When Diels included Stobaeus' text in his edition of Aetius, in the "Doxographi graeci" (1879), he failed to remove the emendation, although his own reconstruction of the chapter heading in Aetius made the emendation impossible. Twenty years later, Diels saw the light, and printed Stobaeus' placitum, unemended, in his "Poetarum philosophorum fragmenta" (1901) and in successive editions of his "Fragmente der Vorsokratiker" (from 1903 onwards). But Kranz resurrected the emendation in the "Nachträge" to his sixth edition of the "Fragmente der Vorsokratiker" (1951). The emended placitum is used again by Uvo Hölscher (1965) to support a non-cyclical interpretation of Empedocles and is repeated in the latest collection of the fragments and testimonia (Brad Inwood, 1992). Hölscher fails to appreciate that the text that he uses to support his reconstruction is merely Sturz's translation into Greek of the non-cyclical interpretation of Empedocles proposed by Tiedemann at the end of the eighteenth century.
