This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

Abstract:There is a storied history of Native and Indigenous feminisms on Turtle Island (North America). We are fortunate that many of those stories birthed from an ancestral tradition of storytelling and survivance were captured in the canonical feminist anthology This Bridge Called My Back: Writings of Radical Women of Color. In celebration and commemoration of 40 years since This Bridge was first published we visit with three of the books original Native and Indigenous contributors–Chrystos, Max Wolf Valerio, and Jo Carrillo–to (...) recount old as well as new stories as they explore what Native and Indigenous feminisms mean to them and their continued work for Indigenous visibility. The conversation provides a unique intergenerational vision for conceptualizing contemporary Native and Indigenous feminisms all the while building upon the legacy and path set forth by amazing Native and Indigenous women trailblazers. Originally motivated by a sophism, Pardo's discussion about the unity of mental propositions allows him to elaborate on his ideas about the nature of propositions. His option for a non-composite character of mental propositions is grounded in an original view about syncategorems: propositions have a syncategorematic signification, which allows them to signify aliquid aliqualiter, just by virtue of the mental copula, without the need of any added categorematic element. Pardo's general claim about the simplicity of mental propositions is (...) developed into several specific thesis about mental propositions: a) it is not judgement which gives its unity to mental propositions, but judicative acts always follow some previous apprehensive act that is simple in its own right; b) this simplicity is compatible with a certain kind of complexity, that can be explained in terms of the "causal history" of the acts of knowing; c) traditional conceptions about subject and predicate must be recast, while keeping their usual explicative power concerning logical properties; d) of course, the traditional conception about the copula has been modified, giving rise to a fully innovative conception of the nature of mental propositions. Nevertheless, this innovative conception of mental language seems still infected by certain "common sense" prejudices, which lead Pardo to propose also a provocative conception of vocal language, which I consider unnecessary. This article provides the foundation for a new predictive theory of animal learning that is based upon a simple logical model. The knowledge of experimental subjects at a given time is described using logical equations. These logical equations are then used to predict a subject’s response when presented with a known or a previously unknown situation. This new theory suc- cessfully anticipates phenomena that existing theories predict, as well as phenomena that they cannot. It provides a theoretical account for phenomena (...) that are beyond the domain of existing models, such as extinction and the detection of novelty, from which “external inhibition” can be explained. Examples of the methods applied to make predictions are given using previously published results. The present theory proposes a new way to envision the minimal functions of the nervous system, and provides possible new insights into the way that brains ultimately create and use knowledge about the world. The scientific understanding of cognition and consciousness is currently hampered by the lack of rigorous and universally accepted definitions that permit comparative studies. This paper proposes new functional and un- ambiguous definitions for cognition and consciousness in order to provide clearly defined boundaries within which general theories of cognition and consciousness may be developed. The proposed definitions are built upon the construction and manipulation of reality representation, decision making and learning and are scoped in terms of an underlying logical structure. (...) It is argued that the presentation of reality also necessitates the concept of ab- sence and the capacity to perform transitive inference. College cheating is prevalent, with rates ranging widely from 9 to 95% (Whitley, 1998). Research has been exclusively conducted with enrolled college students. This study examined the prevalence of cheating in a sample of college alumni, who risk less in disclosing academic dishonesty than current students. A total of 273 alumni reported on their prevalence and perceived severity of 19 cheating behaviors. The vast majority of participants (81.7%) report having engaged in some form of cheating during their undergraduate career. The (...) most common forms of cheating were “copying from another student's assignment” and “allowing others to copy from your assignment.” More students reported cheating in classes for their major than other classes. Males and females cheated at the same rates in classes for their major, and males reported higher rates of cheating than females in nonmajor classes. Respondents reported that their top reasons for cheating were “lack of time” and “to help a friend.”. (shrink)

La existencia de la pena estatal es un continuo en el devenir de la humanidad. También lo son los estudios que se encargan de su análisis y de su justificación. Sin embargo, tras tanto esfuerzo, las soluciones a los problemas de la teoría de la pena son tan variadas como variados son los autores que se han aproximado intelectualmente a ellos. Además, de entre todas las posiciones dogmáticas, ninguna parece llevar la delantera en la dialéctica académica actual. Frente a aquel (...) fenómeno, esta obra pretende arrancar el acercamiento a la institución punitiva desde su base, que no es otra que el comportamiento humano. Si aceptamos que el castigo estatal es una de las formas de control social de conductas, resulta interesante comenzar conociendo cómo se comporta el ser humano con relación a los fenómenos punitivos. Desde ese punto inicial se pueden confirmar empíricamente las intuiciones que se esconden tras una gran parte de las teorías de la pena y construir una justificación propia de la misma que, aceptando tanto la complejidad del comportamiento humano como la de los efectos del castigo en el mismo, reconozca una vigencia todavía muy fuerte (aunque también muy diversa) de las teorías tradicionalmente denominadas como prevención general negativa y positiva. Además, este modo de aproximación también consigue explicar la pervivencia del «irracional» pensamiento retributivo y el encaje de las más modernas teorías del fair play. En suma, facilita construir un modelo de justificación de la pena complejo y netamente consecuencialista fundamentado en realidades empíricamente constatables, lo que, por un lado, vacuna a esta posición frente a críticas puramente valorativas y, por otro, pretende que la discusión general se desarrolle sin perder de vista el mundo de lo fáctico.
