The middle of the second until the middle of the first century BCE is one of the most creative periods in the history of human thought, and an important part of this was the interaction between Roman jurists and Hellenistic philosophers. In this highly original book, René Brouwer shows how jurists transformed the study of law into a science with the help of philosophical methods and concepts, such as division, rules and persons, and also how philosophers came to share (...) the jurists' preoccupations with cases and private property. The relevance of this cross-fertilization for present-day law and philosophy cannot be overestimated: in law, its legacy includes the academic study of law and the Western models of dispute resolution, while in philosophy, the method of casuistry and the concept of just property. This volume, edited by René Brouwer and Emmanuele Vimercati, deals with the debate about fate, providence and free will in the early Imperial age. This debate is rekindled in the 1st century CE during emperor Augustus' rule and ends in the 3rd century CE with Plotinus and Origen, when the different positions in the debate were more or less fully developed. The book aims to show how in this period the notions of fate, providence and freedom were developed and (...) debated, not only within and between the main philosophical schools, that is Stoicism, Aristotelianism, and Platonism, but also in the interaction with other, "religious" movements, here understood in the general sense of groups of people sharing beliefs in and worship of (a) superhuman controlling power(s), such as Gnosticism, Hermetism as well as Judaism and Christianity. Gerald Odonis' logic is generous in its acceptance of ontological counterparts of linguistic expressions. He claims that universals have an objective status and are independent of our mental operations. This article takes a closer look at his views on the meaning of what he calls esse tertio adiacens, i.e., the type of being expressed in propositions of the form 'S is P'. To a certain extent Odonis' analysis resembles Peter of Spain's account of compositio. Unlike his predecessor, however, Odonis thinks (...) that the 'being' used in any true statement, regardless of whether the subject exists or not, is univocal. It turns out that Odonis' account is more in line with John Duns Scotus' intensionalist theory of propositional composition. (shrink)

For centuries, inconsistencies were seen as a hindrance to good reasoning, and their role in the sciences was ignored. In recent years, however, logicians as well as philosophers and historians have showed a growing interest in the matter. Central to this change were the advent of paraconsistent logics, the shift in attention from finished theories to construction processes, and the recognition that most scientific theories were at some point either internally inconsistent or incompatible with other accepted findings. The new interest (...) gave rise to important questions. How is `logical anarchy' avoided? Is it ever rational to accept an inconsistent theory? In what sense, if any, can inconsistent theories be considered as true? The present collection of papers is the first to deal with this kind of questions. Luitzen Egburtus Jan Brouwer founded a school of thought whose aim was to include mathematics within the framework of intuitionistic philosophy; mathematics was to be regarded as an essentially free development of the human mind. What emerged diverged considerably at some points from tradition, but intuitionism has survived well the struggle between contending schools in the foundations of mathematics and exact philosophy. Originally published in 1981, this monograph contains a series of lectures dealing with most of the fundamental topics (...) such as choice sequences, the continuum, the fan theorem, order and well-order. As euthanasia has become a widely debated issue in many Western countries, hospitals and nursing homes especially are increasingly being confronted with this ethically sensitive societal issue. The focus of this paper is how healthcare institutions can deal with euthanasia requests on an organizational level by means of a written institutional ethics policy. The general aim is to make a critical analysis whether these policies can be considered as organizational-ethical instruments that support healthcare institutions to take their institutional responsibility for (...) dealing with euthanasia requests. By means of an interpretative analysis, we conducted a process of reinterpretation of results of former Belgian empirical studies on written institutional ethics policies on euthanasia in dialogue with the existing international literature. The study findings revealed that legal regulations, ethical and care-oriented aspects strongly affected the development, the content, and the impact of written institutional ethics policies on euthanasia. Hence, these three cornerstones—law, care and ethics—constituted the basis for the empirical-based organizational-ethical framework for written institutional ethics policies on euthanasia that is presented in this paper. However, having a euthanasia policy does not automatically lead to more legal transparency, or to a more professional and ethical care practice. The study findings suggest that the development and implementation of an ethics policy on euthanasia as an organizational-ethical instrument should be considered as a dynamic process. Administrators and ethics committees must take responsibility to actively create an ethical climate supporting care providers who have to deal with ethical dilemmas in their practice. (shrink)

This paper presents and illustrates a formal logic for the abduction of singular hypotheses. The logic has a semantics and a dynamic proof theory that is sound and complete with respect to the semantics. The logic presupposes that, with respect to a specific application, the set of explananda and the set of possible explanantia are disjoint . Where an explanandum can be explained by different explanantia, the logic allows only for the abduction of their disjunction.

In this paper, I present two ampliative adaptive logics: LA and LAk. LA is an adaptive logic for abduction that enables one to generate explanatory hypotheses from a set of observational statements and a set of background assumptions. LAk is based on LA and has the peculiar property that it selects those explanatory hypotheses that are empirically most successful. The aim of LAk is to capture the notion of empirical progress as studied by Theo Kuipers.

In 2020, due to the Nightingale year and COVID‐19 crisis, nursing is in the public eye more than ever. Nurses often are being seen as compassionate helpers. The public image of nursing, however, also consists of stereotypes such as nursing being a ‘doing’ profession and care being a ‘female’ characteristic. Next to that, nursing is associated with images from the past, such as ‘the lady with the lamp’. Therefore, in the public eye at least, the nursing identity seems a simple (...) and straightforward enough construct, but nothing less is true. Looking at what a professional identity consists of, historic and social developments influence a group identity as a construct. In addition, individual, professional and contemporary societal moralities, including stereotypes, play its role. Nurses themselves reinforce stereotypes in order to fit into what is expected, even when they believe professional behaviour encompasses other features. They may do so individually as well as in a group context. But nursing actually seems to be better off when viewed upon as a diverse, autonomous profession. Moral values such as compassion motivate nurses to enter the profession. Research shows that if such values are addressed in daily practice, nursing could perhaps be saved from nurses leaving the profession because of feeling unfulfilled. Another aspect concerns the huge nursing body of knowledge. If seen as the ground on which nursing behaviour is standing, it would contribute to a different image of nursing than simplified stereotypes, which do not acknowledge the complex nature of the profession. This paper challenges the idea that the nursing identity is unchangeable and the notion that ‘a nurse will always be a nurse’. By doing so, the paper contributes to a debate on the supposed ‘true’ nature of the nursing identity and opens a discussion on the need for it to change. (shrink)

Objectives To describe the form and content of ethics policies on euthanasia in Flemish nursing homes and to determine the possible influence of religious affiliation on policy content. Methods Content analysis of euthanasia policy documents. Results Of the 737 nursing homes we contacted, 612 (83%) completed and returned the questionnaire. Of 92 (15%) nursing homes that reported to have a euthanasia policy, 85 (92%) provided a copy of their policy. Nursing homes applied the euthanasia law with additional palliative procedures and (...) interdisciplinary deliberations. More Catholic nursing homes compared to non-Catholic nursing homes did not permit euthanasia. Policies described several phases of the euthanasia care process as well as involvement of caregivers, patients, and relatives; ethical issues; support for caregivers; reporting; and procedures for handling advance directives. Conclusion Our study revealed that euthanasia requests from patients are seriously considered in euthanasia policies of nursing homes, with great attention for palliative care and interdisciplinary cooperation. Detection of genetic aberrations in prenatal samples, obtained through amniocentesis or chorion villus biopsy, is increasingly performed using chromosomal microarray, a technique that can uncover both aneuploidies and copy number variants throughout the genome. Despite the obvious benefits of CMA, the decision on implementing the technology is complicated by ethical issues concerning variant interpretation and reporting. In Belgium, uniform guidelines were composed and a shared database for prenatal CMA findings was established. This Belgian approach sparks discussion: it is evidence-based, prevents (...) inconsistencies and avoids parental anxiety, but can be considered paternalistic. Here, we reflect on the cultural and moral bases of the Belgian reporting system of prenatally detected variants. (shrink)

Though the social world is real and objective, the way that social facts arise out of other facts is in an important way shaped by human thought, talk and behaviour. Building on recent work in social ontology, I describe a mechanism whereby this distinctive malleability of social facts, combined with the possibility of basic human error, makes it possible for a consistent physical reality to ground an inconsistent social reality. I explore various ways of resisting the prima facie case for (...) social inconsistency. I conclude, however, that the prima facie case survives scrutiny, and draw out some of the ramifications. In this paper, I argue that logic hasan important role to play in the methodological studyof creativity. I also argue, however, that onlyspecial kinds of logic enable one to understand thereasoning involved in creative processes. I show thatdeductive and ampliative adaptive logics areappropriate tools in this respect.

It is generally agreed upon today that scientific reasoning, like everyday reasoning, proceeds in a dynamic way: inferences derived at some stage in the reasoning process may at a later stage be rejected. This dynamics may be extrinsic or intrinsic. I shall call it extrinsic when previously derived conclusions are rejected on non-logical grounds, and intrinsic when their rejection is based on a purely logical analysis.

In the early eighties, philosophers of science came to the conviction that discovery and creativity form an integral part of scientific rationality. Ever since, the?positivists? have been criticised for their neglect of these topics. It is the aim of this paper to show that the positivists' approach to scientific discovery is not only much richer than is commonly recognized, but that they even defended an important thesis which some of the `friends of discovery' seem to have forgotten. Contrary to what (...) is generally accepted, I shall also show that there is no reason at all why the positivists should have ignored discovery. (shrink)

Many philosophers believe that luck egalitarianism captures “desert-like” intuitions about justice. Some even think that luck egalitariansm distributes goods in accordance with desert. In this paper, we argue that this is wrong. Desertism conflicts with luck egalitarianism in three important contexts, and, in these contexts, desertism renders the proper moral judgment. First, compared to desertism, luck egalitarianism is sometimes too stingy: it fails to justly compensate people for their socially valuable contributions—when those contributions arose from “option luck”. Second, luck egalitarianism (...) is sometimes too restrictive: it fails to justly compensate people who make a social contribution when that contribution arose from “brute luck”. Third, luck egalitarianism is too limited in scope: it cannot diagnose economic injustice arising independently of comparative levels of justice. The lesson of this paper is that luck egalitarians should consider supplementing their theory with desert considerations. Or, even better, consider desertism as a superior alternative to their theory. (shrink)

In this paper, I present the modal adaptive logic $AJ^{r}$ (based on S5) as well as the discussive logic $D_{2}^{r}$ that is defined from it. $D_{2}^{r}$ is a (nonmonotonic) alternative for Jaśkowski's paraconsistent system D₂. Like D₂, $D_{2}^{r}$ validates all single-premise rules of Classical Logic. However, for formulas that behave consistently, $D_{2}^{r}$ moreover validates all multiple-premise rules of Classical Logic. Importantly, and unlike in the case of D₂, this does not require the introduction of discussive connectives. The theory of collective agency and intentionality is a flourishing field of research, and our understanding of these phenomena has arguably increased greatly in recent years. Extant theories, however, are still ill-equipped to explain certain aspects of collective intentionality. In this article we draw attention to two such underappreciated aspects: the failure of the intentional states of collectives to supervene on the intentional states of their members, and the role of non-human factors in collective agency and intentionality. We propose a (...) theory of collective intentionality which builds on the ‘interpretationist’ tradition in metasemantics and the philosophy of mind as initiated by David Lewis and recently developed further by Robbie Williams. The collective-level analogue of interpretationism turns out to look different in some ways from the individual-level theory, but is well-suited to accommodating phenomena such as hybrid collective intentionality. Complemented with Kit Fine’s theory of variable embodiment, such a theory also provides a diachronic account of intentional collectives. (shrink)
