In their excellent monograph, Crimes, Harms and Wrongs, Andrew Simester and Andreas von Hirsch argue for an account of legitimate criminalisation based on wrongfulness, the Harm Principle and the Offence Principle, while they reject an independent anti-paternalism principle. To put it at its simplest my aim in the present paper is to examine the relationship between ‘the harms’ and ‘the wrongs’ of the authors’ title. I begin by comparing the authors’ version of the Harm and Offence Principle with some other (...) influential accounts. After examining the role wrongfulness plays in their work, I ask what there is left for their Harm and Offence Principles to do. In the light of the understanding and foundations of the Harm and Offence Principles proposed by the authors, I suggest that the answer is little or nothing. The wrongfulness constraint the authors place on their Offence Principle comes close to swallowing it up entirely. Furthermore the part of their Offence Principle that is not thus swallowed by wrongfulness leaves the account with a commitment that is probably best dropped. As far as their Harm Principle is concerned I suggest that the authors’ account of ‘harm’ is so broad that it lacks the resources to distinguish harm-based reasons from wrongfulness- or immorality-based reasons in any principled way. Among other things, I ask in this context, first, whether one can be harmed as one’s character deteriorates and, secondly, whether one is harmed by virtue of the serious wrong one does to another. What really drives the authors’ account of legitimate criminalisation, I believe, is wrongfulness together with an important, amorphous set of potential defeating conditions. They themselves accept such a picture so far as paternalism is concerned. I conclude that their account, which I think has considerable force, would lose little of any significance were their Harm and Offence Principles simply excised. More generally I suspect that a strong role for wrongfulness in an account of legitimate criminalisation is likely to put into serious question the plausibility of an independent principled role for harm and offence. In this paper, we explore best practices for asynchronous discussions in graduate online bioethics education. We explain that online approaches have advantages and challenges in contrast to in-person discussions. Online challenges are lack of visual or auditory cues and technical access. Advantages include extended opportunities for specific focus, thoughtful reflection, and critical review. We found no significant review of related best practices in bioethics. Our more general literature review of graduate education and online approaches, plus experience in our own bioethics (...) graduate program, suggest provisional best practices that we detail. We reason that online graduate discussion provisionally should aim for a “community of inquiry” framework that incorporates cognitive, social, and teaching “presences,” as well as a learning presence. However, we also note unresolved concerns about whether the framework sufficiently addresses learning, is complete, and captures communicative functions. Drawing further on the literature, we also suggest best practices for instructor feedback to students about their discussion performance, including that remarks should be timely and specific. Summaries from two courses in our graduate bioethics program illustrate how we implement discussion strategies. Finally, we review assessment strategies and suggest that embedded formative assessments in discussion support and demonstrate deeper learning. Limitations in generalizability include that our review targets asynchronous and text-based online discussion, our program assessments do not necessarily detail best practices, student expectations and approaches could be rather particular to our program, and specific bioethics content in principle could alter best practices. In a much cited phrase in the famous English ‘Child B’ case, Mr Justice Laws intimated that in life and death cases of scarce resources it is not sufficient for health care decision-makers to ‘toll the bell of tight resources’: they must also explain the system of priorities they are using. Although overturned in the Court of Appeal, the important question remains of the extent to which health-care decision-makers have a duty to give reasons for their decisions. In this paper, (...) I examine the philosophical foundations of the legal obligation to give reasons in English law. Why are judges sometimes supportive of the imposition of a duty to give reasons and sometimes not? What is it about the context of life and death health care allocation problems that makes it unsuitable in their view for such a duty; and is this stance justified? What is it to give a reason for a decision? I examine Frederick Schauer’s account of reason-giving in terms of generalisation and commitment and I suggest that it provides an overstated account of what giving a reason commits one to. I go on to examine an idea of judicial creation: that where value judgements are “inexpressible” there is a strong reason not to impose a duty to give reasons on to public bodies. The strongest case for a duty to give reasons is in terms of the value of respect for citizens. I argue that there is nothing in the very nature of reason-giving that ought to preclude the imposition of such a duty in this context, but concede that there is a serious danger of legalism that could result in a hamstringing of health care decision-making. Culture plays an important role in defining ethics standards because dissimilar cultures socialize their people differently, according to what is acceptable behaviour. The potential significance of ethnic groups for marketing justifies inquiry into the moral judgments, standards, and rules of conduct exercised in marketing decisions and situations arising from decisions whether or not to focus on individual ethnic groups within an economy. Identifying and targeting ethnic groups for marketing purposes are tasks fraught with many ethical difficulties. In a multicultural society (...) consisting of a dominant group and many diverse, minority groups defined by ethnicity, these problems can be expected to increase substantially. Consequently, marketers may include minority ethnic consumers in their mainstream marketing programs. In itself, this has ethical consequences. Alternatively, if marketers seek to target individual minority ethnic groups within the same economy a further set of ethical consequences needs to be considered. This paper reviews the concepts of ethnicity and ethnic groups and their relevance for marketing strategy within an economy where there is a dominant group and also significant minority ethnic groups. The ethical consequences for minority communities arising from the use of non-ethnic, mainstream marketing programs are examined. An alternative approach, ethnic marketing, is also examined and its ethical consequences in terms of other groups within the one country appraised. The ethical dilemma and tradeoffs facing marketers within advanced, culturally diverse countries are then considered. (shrink)

In this review essay Stanton Wortham explores how philosophy of education should both turn inward, engaging with concepts and arguments developed in academic philosophy, and outward, encouraging educational publics to apply philosophical approaches to educational policy and practice. He develops his account with reference to two recent ambitious projects: The Oxford Handbook of Philosophy of Education, edited by Harvey Siegel, and the two-volume yearbook of the National Society for the Study of Education (NSSE), titled Why Do We Educate? edited (...) by Gary Fenstermacher (series editor), David Coulter and John Wiens (volume 1), and Mark Smylie (volume 2). These two projects initially appear to be opposed, with the Handbook emphasizing elite philosophy and the Yearbook emphasizing public engagement. Wortham argues that each project is in fact more complex, and that they are in some respects complementary. He concludes by making a case against a simple hierarchy of basic and applied knowledge and calling for a more heterogeneous philosophy of education. (shrink)

Locke’s views on toleration and natural law have recently received a ‘reassessment’ at the hands of John William Tate. This article demonstrates some of the many and various ways in which Tate has mangled Locke’s positions and misconstrued the views of interpreters of Locke whose interpretations he finds uncongenial. It finds that there are no textual grounds for Tate’s claims and invites readers to reassess whether and how far they ought to be taken seriously.

The Transcendentalists’ passion for social equality stemmed from their belief in spiritual friendship—transcending differences in social situation, gender, class, theology, and race. Together, their fight for justice changed the American sociopolitical landscape. A frequent criticism of Richard Vallee’s “pluri-propositionalism” is that it multiplies propositions beyond necessity. I argue that this criticism, recently voiced by Robert Stanton and Arthur Sullivan, is based in misconceptions about propositions are and how they help us classify utterances and the mental states and events that lead to them, relying for the most part on extended discussions of examples.

Timothy Stanton is the latest in a line of Locke scholars who, in focusing on Locke's theological commitments, have sought to place these at the center of his political philosophy. Stanton insists that those who interpret Locke's political philosophy in more material terms, centered on individual liberty, government authority, and the need to reconcile both via consent, apply to it a misleading "picture" and fail to perceive its essentials. By showing that this is precisely how Locke himself intended (...) his political philosophy to be understood, with the theology substantially removed, this article shows how Stanton is profoundly mistaken in his interpretation of Locke. The material for this book was originally presented as the Stanton Lectures in the Philosophy of Religion at Cambridge in 1963. Its argument operates on a number of levels. Superficially, though explicitly, it is a defence of Wittgenstein and his followers against two charges, first, of ignoring the larger questions of epistemology discussed by their predecessors, and second, of removing philosophy from any concern with the practical issues of life. Cameron and Williamson have provided a provocative and timely review of the ethical questions prompted by the birth of Dolly. The question Cameron and Williamson seek to address is “In the world of Dolly, when does a human embryo acquire respect?”. Their initial discussion sets the scene by providing a valuable overview of attitudes towards the embryo, summarising various religious, scientific, and philosophical viewpoints. They then ask, “What has Dolly changed?” and identify five changes, the first being that fertilisation is (...) no longer required to create an embryo. Following this analysis they then ask when an embryo created other than by fertilisation begins to acquire respect. Ronald Preston wrote little of feminism, and feminism appears to have ignored Preston. There is much, however, in Preston's work which feminists would have found sympathetic, as well as some areas for acute disagreement. This article discusses what Preston did write about feminism, and goes on to examine areas of common approach: the hermeneutic of suspicion, social ethics, and a priori commitments. It also, briefly, discusses areas of disagreement: common consensus, universalism, and eschatological realism. John MacFarlane explores how we might make sense of the idea that truth is relative. He provides new, satisfying accounts of parts of our thought and talk that have resisted traditional methods of analysis, including what we mean when we talk about what is tasty, what we know, what will happen, what might be the case, and what we ought to do.

What is data? That question is the fundamental investigation of this dissertation. I have developed a methodology from social-scientific processes to explore how different people understand the concept of data, rather than to rely on my own philosophical intuitions or thought experiments about the “nature” of data. The evidence I have gathered as to different individuals' constructions of data can be used to inform further inquiry of data and the design of information systems. My research demonstrates that people have different (...) constructions of data. The methodology of the SDFN, created for this dissertation, has proven able to probe those understandings. The SDFN, loosely based on a DFD and combined with ideas from SNA, provides a way of discovering practical definitions of hard-to-operationalize terms like data. The process of repeatedly categorizing various items as data allows the methodology to explore how participants actually use the term, rather than relying on theoretical dictionary-based definitions. Analysis of the interviews found three different constructions of data: data as communications, a container for meaning; data as subjective observations, sense-impressions filtered by knowledge; and data as objective facts, measurements revealing the relationships of reality. This article illustrates one way in which philosophical inquiry and empirical research can be combined to illuminate processes like learning and social identification. Over the past 20 years, my empirical work in classrooms and communities has drawn on philosophical discussions about how knowledge is interconnected with social relationships and how we should conceptualize multiple levels of explanation. Both empirical research and philosophy can be done in various ways, and I offer no comprehensive account of how the two relate. I focus (...) instead on one central goal of my work—to clear away assumptions that commonly limit our view of human activity and to offer alternative conceptualizations that open new pathways for thought and action. In pursuing this goal I have drawn on philosophical accounts of knowledge, identity and scientific explanation, as well as on philosophical methods for interrogating assumptions. My empirical analyses also provide philosophers useful cases to think with. Empirical research enriched by philosophical insights and methods can combine tools from both traditions to clear away unproductive assumptions and advance our understandings of the human world. According to situated cognition theory, cognitive accomplishments rely in part on structures and processes outside the individual. This article argues that interactional structures—particularly those created through language use—can make essential contributions to situated cognition in rational academic discourse. Most cognitive accomplishments rely in part on language, and language in use always has both representational and interactional functions. The article analyzes one classroom conversation, in order to illustrate how the interactional functions of speech can facilitate the cognitive accomplishments speakers make through (...) that speech. By showing how closely cognition and interaction can interrelate, the article both supports theories of situated cognition and shows how cognition in at least some educational contexts cannot be extricated from enduring social structures and the construction of social identity. This paper explores the transformation of Twitter from the traditional developer based command and control into something strangely democratic: a social construction of utility, a twisting of this once unique service to serve the needs and desires, ever evolving, of its users. We explore changes in the social constructions of Twitter and use recent research in the Philosophy of Data to suggest potential explanations.

This paper explores recent research done into the philosophy of data. The research utilizes experimental philosophy ideas combined with Information Technology methodologies to assess participants' philosophies of data. Reusing the concept of the Data Flow Diagram, I suggest a methodology of experimental philosophy that allows participants to categorize flows into data, information, and knowledge in order to explore their practical understanding instead of their theoretical understanding. In order to understand the many different ontologies of data, information, and knowledge out there, this paper will describe part of the problem space in terms of other disciplines and make an argument for the establishment of this new philosophical field. Social psychologists have been in the forefront of the development of modern theories of cigarette smoking and obesity. These theories are reductionist: they account for behavior in purely physiological terms and regard cognitive, value, personality, and social class factors as secondary or irrelevant. Yet, from their beginnings, these theories have failed to account for major aspects of the behaviors under investigation, aspects apparently related to personal intention and social background. While it may seem suprising that work by social psychologists denies (...) social and psychological reality, the theories discussed here actually reflect broader trends in social psychology, trends with rather large implications for our ideas about individual and social efforts at change. What psychological and philosophical significance should we attach to recent efforts at computer simulations of human cognitive capacities? In answering this question, I find it useful to distinguish what I will call "strong" AI from "weak" or "cautious" AI. According to weak AI, the principal value of the computer in the study of the mind is that it gives us a very powerful tool. For example, it enables us to formulate and test hypotheses in a more rigorous and precise fashion. (...) Normative requirements are often overlooked, but they are central features of the normative world. Rationality is often thought to consist in acting for reasons, but following normative requirements is also a major part of rationality. In particular, correct reasoning – both theoretical and practical – is governed by normative requirements rather than by reasons. This article explains the nature of normative requirements, and gives examples of their importance.
