Artificial intelligence (AI) is increasingly expected to disrupt the ordinary functioning of society. From how we fight wars or govern society, to how we work and play, and from how we create to how we teach and learn, there is almost no field of human activity which is believed to be entirely immune from the impact of this emerging technology. This poses a multifaceted problem when it comes to designing and understanding regulatory responses to AI. This article aims to: (i) (...) defend the need for a novel conceptual model for understanding the systemic legal disruption caused by new technologies such as AI; (ii) to situate this model in relation to preceding debates about the interaction of regulation with new technologies (particularly the ‘cyberlaw’ and ‘robolaw’ debates); and (iii) to set out a detailed model for understanding the legal disruption precipitated by AI, examining both pathways stemming from new affordances that can give rise to a regulatory ‘disruptive moment’, as well as the Legal Development, Displacement or Destruction that can ensue. The article proposes that this model of legal disruption can be broadly generalisable to understanding the legal effects and challenges of other emerging technologies. (shrink)

Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

This book offers an updated and comprehensive phenomenology of norms and normativity. It is the first volume that systematically tackles both the normativity of experiencing and various experiences of norms. Part I begins with a discussion of the methodological resources that phenomenology offers for the critique of epistemological, social and cultural norms. It argues that these resources are powerful and have largely been neglected in contemporary philosophy as well as social and human sciences. The second part deepens the discussion by (...) studying the existential and moral-philosophical foundations of practical normativity. It takes on the task of illuminating the origins of normativity and offers phenomenological alternatives to the neo-Kantian and neo-Hegelian approaches that dominate contemporary debates on the sources of normativity. The final part proceeds from practical normativity to the analysis of the guiding powers of values, perceptual norms, instincts and drives. These are different forms of intentionality that in various manners contribute to the constitution of human practices. Martin Heidegger und Hans Jantzen gehören zu den wichtigsten Vertretern der Philosophie und Kunstgeschichte des 20. Jahrhunderts. Seit den 1920er bis Ende der 1960er Jahre kritisierten sie vorherrschende, naturwissenschaftlich geprägte Auffassungen des Raums und entwickelten einen neuartigen Begriff. Dieser sogenannte künstlerische Raum sei ein freies Zusammenspiel von materiellen und immateriellen Bestandteilen, das als solches erst in der Wahrnehmung real wird. Die Autorin arbeitet dieses Verständnis heraus und stellt es in einen geistes- und zeitgeschichtlichen Kontext. Neben der Bedeutung der Bestandteile und (...) der Grenze für die Gestalt und die Wirkung des Raums kommt der des Lichts sowie Jantzens Diaphanie-Begriff besondere Aufmerksamkeit zu. Für die erörterte Raumbeschaffenheit werden Anhaltspunkte in der gotischen Kathedrale und in Werken der Bronzezeit, Dorik, Ottonik und Moderne sowie von Kindern und Laien festgestellt. Im Anschluss an zeitgenössische Theorien ergeben sich Übereinstimmungen mit dem Konzept des geopolitischen Groß-raums und einer erdbezogenen Ästhetik. Vor dem Hintergrund des Kunst- und Sprachbegriffs der Epoche wird abschließend Heideggers und Jantzens Ansicht untersucht, alle Kunst sei sprachlich, sowie inwiefern sich diese Sprachlichkeit räumlich manifestiert. He provides new, satisfying accounts of parts of our thought and talk that have resisted traditional methods of analysis, including what we mean when we talk about what is tasty, what we know, what will happen, what might be the case, and what we ought to do.

New technologies are the source of uncertainties about the applicability of moral and morally connotated concepts. These uncertainties sometimes call for conceptual engineering, but it is not often recognized when this is the case. We take this to be a missed opportunity, as a recognition that different researchers are working on the same kind of project can help solve methodological questions that one is likely to encounter. In this paper, we present three case studies where philosophers of technology implicitly engage (...) in conceptual engineering (without naming it as such). We subsequently reflect on the case studies to find out how these illustrate conceptual engineering as an appropriate method to deal with pressing concerns in the philosophy of technology. We have two main goals. We first want to contribute to the literature on conceptual engineering by presenting concrete examples of conceptual engineering in the philosophy of technology. This is especially relevant, because the technologies that are designed based on the conceptual work done by philosophers of technology potentially have crucial moral and social implications. Secondly, we want to make explicit what choices are made when doing this conceptual work. Making explicit that some of the implicit assumptions are, in fact, debated in the literature allows for reflection on these questions. Additionally, Fischer argues that we do not need genuine access to alternative possibilities in order for there to be a legitimate point to practical reasoning. Fischer's overall framework contains an argument for the contention that guidance control, and not regulative control, is associated with moral responsibility, a sketch of a comprehensive theory of moral responsibility (that ties together responsibility for actions, omissions, consequences, and character), and an account of the value of moral responsibility. I argue against the orthodox view of the relationship between propositional and doxastic justification. The view under criticism is: if p is propositionally justified for S in virtue of S's having reason R, and S believes p on the basis of R, then S's belief that p is doxastically justified. I then propose and evaluate alternative accounts of the relationship between propositional and doxastic justification, and conclude that we should explain propositional justification in terms of doxastic justification. If correct, this (...) proposal would constitute a significant advance in our understanding of the sources of epistemic justification. (shrink)

Intuition is sometimes derided as an abstruse or esoteric phenomenon akin to crystal-ball gazing. Such derision appears to be fuelled primarily by the suggestion, evidently endorsed by traditional rationalists such as Plato and Descartes, that intuition is a kind of direct, immediate apprehension akin to perception. This paper suggests that although the perceptual analogy has often been dismissed as encouraging a theoretically useless metaphor, a quasi-perceptualist view of intuition may enable rationalists to begin to meet the challenge of supplying a (...) theoretically satisfying treatment of their favoured epistemic source. It is argued, first, that intuitions and perceptual experiences are at a certain level of abstraction the same type of mental state, presentations, which are distinct from beliefs, hunches, inclinations, attractions, and seemings. The notion of a presentation is given a positive explication, which identifies its characteristic features, accounts for several of its substantive psychological roles, and systematically locates it in a threefold division among types of contentful states. Subsequently, it is argued that presentations, intuitive no less than sensory, are by their nature poised to play a distinctive epistemic role. Specifically, in the case of intuition, we encounter an intellectual state that is so structured as to provide justification without requiring justification in turn—something which may, thus, be thought of as ‘given’.
