The United States Sentencing Commission’s guidelines for the sentencing of organizations found guilty of violating federal laws recently became effective. Dramatically increased penalties are possible under these gudelines, but so too is a substantial reduction in the penalties imposed on organizations that have an effective program in place to prevent and detect violations. This provides corporations with a tremendous new incentive in inaugurate organizational ethics audits both to avoid violations in the first instance and to reduce the penalty imposed in (...) the event that a violation occurs. We argue, however, that there have always been very good reasons for organizations to conduct such audits, which emphasize the identification of the organizational factors that create incentives for unethical behavior. It is difficult to talk about ethics in Australia these days, because the different metamoral languages make it difficult for people to communicate on moral matters; there are no generally accepted criteria for assessing the meaning and truth of moral propositions; and witness talks larger in these matters than theoretical expertise, and the ideals that favour the acceptance of credible role models are no longer generally accepted. We should not assume that we can say anything meaningful about business ethics. One (...) reason for this arises from the Australian experience of the ''80s: the fruits of a profound cynicism are now with us, as prominent figures find themselves in court to defend their actions, and seem amazed that they are accused of doing anything wrong at all. We may want to stop something like this from happening again, but if the language of business ethics meant nothing to these people, how can we hope that it will mean much to us, or to future generations? A second reason arises from the nature of ethics itself. Business ethics, after all, does not exist in a vacuum; its language will not mean much to people who do not agree on what they mean whenever they talk about right and wrong. Some people, for example, measure the rightness or wrongness of actions in terms of their consequences; for others, on the other hand, some actions are wrong, no mater what the consequences. How are they to talk to each other? What is at issue here is what ethical propositions mean, and how one can measure their truth. And there is another reason. As Socrates pointed out long ago, ethics is not a theoretical science, which can be taught and learnt as dispassionately as mathematics. It is practical, and so engages teacher and pupil in an entirely different way: one cannot say one thing, and do another. It is contended that margolis has neglected an important criterion of moral cognitivism: he is quite right in asserting that a cognitive theory, Beyond maintaining that we know moral propositions to be right or wrong and that we are competent so to judge, Must specify the mode of nonpropositional knowledge on which the propositional assertion is based--But his acceptance of naturalism and intuitionism as types (...) of cognitivism indicates that, For him at least, A cognitivist does not need to know what goodness is. It is the point of hill's reply that moral cognitivism ultimately rests on knowing goodness, And that therefore neither naturalism nor intuitionism are morally cognitive at all. (shrink)

The "natural law" worldview developed over the course of almost two thousand years beginning with Plato and Aristotle and culminating with St. Thomas Aquinas in the thirteenth century. This tradition holds that the world is ordered, intelligible and good, that there are objective moral truths which we can know and that human beings can achieve true happiness only by following our inborn nature, which draws us toward our own perfection. Most accounts of the natural law are based on a God-centered (...) understanding of the world. After the Natural Law traces this tradition from Plato and Aristotle to Thomas Aquinas and then describes how and why modern philosophers such as Descartes, Locke and Hobbes began to chip away at this foundation. The book argues that natural law is a necessary foundation for our most important moral and political values – freedom, human rights, equality, responsibility and human dignity, among others. Without a theory of natural law, these values lose their coherence: we literally cannot make sense of them given the assumptions of modern philosophy. Part I of the book traces the development of natural law theory from Plato and Aristotle through the crowning achievement of Thomas Aquinas. Part II explores how modern philosophers have systematically chipped away at the only coherent foundation for these values. As a result, our most important moral and political ideals today are incoherent. Modern political and moral thinkers have been led either to dilute the meaning of such terms as freedom or the moral good – or abandon these ideas altogether. Thus, modern philosophy and political thought are leading us either toward anarchy or totalitarianism. Hill, John Sixty years ago, in 1958, a novel was published posthumously in Italy, 'Il Gattopardo', by Giuseppe Tomasi di Lampedusa.It was a masterpiece that soon became a bestseller and the basis of Visconti's cinema classic. It recounts the impact on a Sicilian aristocratic family of Garibaldi's invasion in 1860, with Sicily's incorporation into the Kingdom of Sardinia and, subsequently, the formation of the Kingdom of Italy. In particular, it portrays the reaction to all this on the part of Don (...) Fabrizio, Prince of Salina, as the state he knows - the Kingdom of the Two Sicilies - collapses around him, and a new state, run by 'new men', compels his adjustment to a new reality. (shrink)

In his recent book, The Opacity of Mind, Peter Carruthers advances a skeptical theory of self-knowledge, integrating results from experimental psychology and cognitive science.1 In this essay, I want to suggest that the situation is not quite as dire as Carruthers makes it out to be. I respond to Carruthers by advancing a constitutive theory of self-knowledge. I argue that self-knowledge, so understood, is not only compatible with the empirical research that Carruthers utilizes, but also helps to make sense of (...) these results. (shrink)

Hill, John In a previous article, I broached the subject of priesthood as style, along the lines taken by Christoph Theobald and other contemporary French theologians.1 In that article I argued for a priestly style that fitted in with Theobald's vision of the Christian life as apprenticeship to Christ's own style of hospitable and eschatological messianism, and that also addressed current charges of clericalism and infantilism. The growing secularization of society makes Christian moral education ever more difficult. Many well-meaning approaches to Christian moral education make it ineffective, if not counterproductive. This seems to have occurred because Christians have accepted an unreal polarization of morality, and have consented to do battle for one of the poles. The author of this essay argues for a via media which would be more truly human and so more truly Christian.

Hill, John As Manfred Hauke has pointed out in a recent article, the question of whether the priest should face the people or not during Mass is more than a matter of personal taste or liturgical prejudice. If the Mass is a meal, then the participants should in some way surround what is a table; if it is a sacrifice, then the priest should lead the people in prayer, facing the east across what is an altar. This is a choice (...) that has been strongly stressed by Klaus Gamber, and supported by Joseph Ratzinger, in opposition to the increasing tendency to see the Mass as a meal. (shrink)

Hill, John This is not an essay in deportment, but an effort, at a deeper level, to relate the Catholic priesthood to a changing society, in which its standing has suffered much because of the unacceptable conduct of some priests in recent years. There is a way of understanding style that has been developed by theologians since Vatican II; we shall examine their ideas shortly. While they do not mention him, their ideas are close to the famous declaration of the (...) great French naturalist, the Comte de Buffon, in a discourse on style delivered to the Academie francaise on 25 August 1753: 'Ces choses sont hors de l'homme, le style est l'homme meme'. Many remember this as 'The style is the man'. However you translate it, it is a statement about more than how you wear your wig or bow to a lady. It is about 'the man himself', who reveals himself in his style. (shrink)

I intend, in this article, to outline an argument against the indiscriminate use of the word, 'clericalism'. I do not dispute that something answering to the word does exist, but I argue that it should be used more carefully; that we should aim for a reasonable precision in its use, avoiding confusion between connotation and denotation,1 on the one hand, and between the condition itself and its manifestations, on the other. It is with the last consideration that I begin.

Shoaf, University of Florida Anglo-Saxon poems and fragments seem to preserve a long-standing Germanic code of heroic values, but John Hill shows that these values are probably not much older than the poems (...) that record and advance them. In the first book-length application of anthropological research to Old English heroic literature, Hill demonstrates that the loyalties and values celebrated in "The Battle of Brunanburh," "The Battle of Maldon," and numerous other heroic episodes in Old English literature are not aspects of an archaic or ancient ethical life but instead political models serving the interests of West Saxon kingship and hegemony. Using the much more complicated Beowulf as an illuminating counterpoint, Hill works out the development in the heroic literature of these new ideals. Employing anthropological and psychoanalytic perspectives, Hill reopens for study an important subject of Old English literature long thought settled, and he provides a window onto the process of Anglo-Saxon state formation that should appeal to medievalists in both literary studies and history. In the years following the end of the Second World War Carol Reed directed three films, Odd Man Out, The Third Man, and The Man Between, that all dealt with individuals somehow cast alone into post-war urban environments that shared certain characteristics of division and violence. This article argues that they can be usefully analysed through the lens of Walter Benjamin's notion of the creaturely, especially through Eric Santner's explication of the concept. It considers the films from three aspects of (...) Santner's creaturely life: natural history, the state of exception, and undeadness. These qualities of the creaturely as an analysis of the human condition help to encompass some of the strangeness of Reed's apparently conventional film narratives. The films' characters can be seen as overtly modelling a kind of Benjaminian natural history, the history of the brutal twentieth century, in which the vulnerable, mortal, dying human beings at the centre of these tales stumble around in rea... Hill, John In a previous article, I discussed the arguments and tactics of those who are variously called 'restorationists' and 'reformers of the reform', in the liturgical areas of the reservation of the Blessed Sacrament, the eastward position (or otherwise) of the priest at Mass and liturgical translation. In this article, I wish to go more deeply into their arguments, specifically by examining the language they use. John Stuart Mill is the father of modern liberalism. His most remembered work, On Liberty, which was published in 1859, changed the course of the liberal tradition. What is less well-known is that his ideas have profoundly influenced the American constitutional rights tradition of the latter half of the twentieth century. Mill's 'harm principle' inspired the constitutional right to privacy recognized in Griswold v Connecticut, Roe vs Wade and other cases. His defense of freedom of expression influenced Justices Holmes, Brandeis, (...) Douglas, Brennan and others and led to greatly expanded freedom of speech in the twentieth century. Finally, Mill was an ardent feminist whose last important work, The Subjection of Women, was a full-scale and, for its time, radical defense of complete gender equality. This is a book for lawyers who want to understand the intellectual origins of modern constitutional rights, and for political philosophers interested in the constitutional implications of Mill's conception of freedom.
