Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. The main body of this paper assesses a leading recent theory of fairness, a theory put forward by John Broome. I discuss Broome's theory partly because of its prominence and partly because I think it points us in the right direction, even if it takes some missteps. In the course of discussing Broome's theory, I aim to cast light on the relation of fairness to consistency, equality, impartiality, desert, rights, and agreements. Indeed, before I start assessing Broome's theory, I (...) discuss two very popular conceptions of fairness that contrast with his. Focused correlation compares the degree of association within an evidence set to the degree of association in that evidence set given that some hypothesis is true. Wheeler and Scheines have shown that a difference in incremental confirmation of two evidence sets is robustly tracked by a difference in their focus correlation. In this essay, we generalize that tracking result by allowing for evidence having unequal relevance to the hypothesis. Some twenty years ago, when I submitted a dissertation proposal to explore connections between theologies of creation and views of (...) scientific knowledge in the seventeenth century, my doctoral committee was not initially enthusiastic—my idea might make a good dissertation in religion, but was it really history of science? I doubt I would have a similar experience today. Not only has the "warfare" thesis of science and religion been laid permanently to rest, historians have begun seriously to question whether it makes sense even to treat "religion" and "science" in an essentialist manner as separate ways of thinking that do not ordinarily interact. Many detailed case studies demonstrating a variety of fascinating, often important connections between science and religion have appeared from leading scholars in the past two decades. This trend continues in the latest volume of Osiris, which contains sixteen essays documenting various ways in which religious beliefs have influenced the actual content and presentation of science.The volume opens with two companion essays laying out the terrain. First, Brooke engages the new methodological and conceptual problems that confront historians following the demise of the "warfare" thesis. Then Stephen Wykstra offers criteria for sorting out the various roles for metaphysical and religious beliefs (which he distinguishes) in shaping scientific knowledge. The case studies begin with E. Jamil Ragep's essay on medieval Islamic astronomy, arguing that religion sometimes had a constructive role—a rather novel claim for Islamic science, he points out. Noah J. Efron and Menachem Fisch show how early modern Jewish exegetical practices influenced David b. Solomon Gans's interpretations of astronomical texts, and quite possibly his interpretation of nature also. A Christian astronomer is next, as Peter Barker and Bernard R. Goldstein detail how Johannes Kepler's theology contributed directly to the discovery of scientific laws. Maurice A. Finnocchiaro then reviews various accounts of the Galileo affair, finding far more conflict in the subsequent historiography of the events than in the trial itself.Moving from astronomy to natural philosophy, Margaret G. Cook's essay on Robert Boyle examines the web of connections between theology, the mechanical philosophy, and [End Page 277] "the Aristotelian philosophy that he sought to replace." Snobelen presents substantial evidence that the famous General Scholium, appended to the second edition of Isaac Newton's Principia, was a carefully worded declaration of Newton's heterodox theology. "A Trinitarian," Snobelen concludes, "could not have written the General Scholium" (186). He also shows the degree to which Newton's theology shaped his overall natural philosophy, decisively debunking the late Richard S. Westfall's view that such influences could not be found.The final seven essays are mainly devoted to nineteenth-century science. Michael J. Crowe documents several ways in which Christian beliefs about divine goodness and the Incarnation affected astronomy. This article compares the administrations of John Witherspoon (served from 1768 to 1794), Samuel Stanhope Smith (served from 1795 to 1812) and James McCosh (served from 1868 to 1888) at Princeton and examines their use of Scottish philosophy in restructuring the curriculum and reforming its institutional purpose. The Birth of American Law: An Italian Philosopher and the American Revolution tells the forgotten, untold story of the origins of U.S. law. A Border Disputeintegrates the latest work in logic and semantics into a theory of language learning and presents six worked examples of how that theory revolutionizes cognitive psychology. Macnamara's thesis is set against the background of a fresh analysis of the psychologism debate of the 19th-century, which led to the current standoff between logic and psychology. The book presents psychologism through the writings of John Stuart Mill and Immanuel Kant, and its rejection by Gottlob Frege and Edmund Husserl. It (...) then works out the general thesis that logic ideally presents a competence theory for part of human reasoning and explains how logical intuition is grounded in properties of the mind. The next six chapters present examples that illustrate the relevance of logic to psychology. These problems are all in the semantics of child language (the learning of proper names, personal pronouns, sortals or common nouns, quantifiers, and the truth-functional connectives) and reflect Macnamara's rich background in developmental psychology, particularly child language - a field, he points out, that embraces all of cognition. Technical problems raised by but not included in the examples in the main part of the text are dealt with in a separate chapter. The book concludes by describing laws in cognitive psychology, or the type of science made possible by Macnamara's new theory. In this article, I discuss how Samuel Stanhope Smith advanced Reidian themes in his moral philosophy and examine their reception by Presbyterian revivalists Ashbel Green, Samuel Miller, and Archibald Alexander. Smith, seventh president and moral philosophy professor of the College of New Jersey (1779–1812), has received marginal scholarly attention regarding his moral philosophy and rational theology, in comparison to his predecessor John Witherspoon. As an early American philosopher who drew on the ideals of the Scottish Enlightenment including Common Sense (...) philosophy, Smith faced heightened scrutiny from American revivalists regarding the danger his epistemology presented to the institution of religion. The Scottish School of Common Sense was widely praised and applied in nineteenth-century American moral philosophy, but before the more general American acceptance of Common Sense, Smith already appealed to Reidian themes in his methodology and treatment of external sensations, internal sensations, intellectual powers, and active powers of the human mind. In this paper, I argue that Smith's use of Reidian themes for grooming his student's morality conflicted with the educational expectations from revivalists on Princeton's board of trustees who demanded more attention on orthodox theology. I identify Smith's notions of causation, liberty, and the moral faculty as primary reasons for this tension over Princeton's educational purpose during the first decade of the nineteenth century. The most cursory examination of the history of artificial intelligence highlights numerous egregious claims of its researchers, especially in relation to a populist form of ‘strong’ computationalism which holds that any suitably programmed computer instantiates genuine conscious mental states purely in virtue of carrying out a specific series of computations. The argument presented herein is a simple development of that originally presented in Putnam’s (Representation & Reality, Bradford Books, Cambridge in 1988 ) monograph, “Representation & Reality”, which if correct, (...) has important implications for turing machine functionalism and the prospect of ‘conscious’ machines. In the paper, instead of seeking to develop Putnam’s claim that, “everything implements every finite state automata”, I will try to establish the weaker result that, “everything implements the specific machine Q on a particular input set ( x )”. Then, equating Q ( x ) to any putative AI program, I will show that conceding the ‘strong AI’ thesis for Q (crediting it with mental states and consciousness) opens the door to a vicious form of panpsychism whereby all open systems, (e.g. grass, rocks etc.), must instantiate conscious experience and hence that disembodied minds lurk everywhere. Gwen Bradford has plausibly argued that one attains achievement only if one does something one finds difficult. It is also plausible that one must attain achievement to be worthy of “agential” praise, praise that is appropriately directed to someone on the basis of things that redound to their credit. These claims pose a challenge to classical theists who direct agential praise to God, since classical theism arguably entails that none of God’s actions are difficult for God. I consider responses (...) to this challenge and commend a view accord- ing to which God’s loving character is not necessitated by God’s nature but is a contingent and difficult achievement. I argue that this view can still satisfy the explanatory ambitions of natural theology. (shrink)

The Alumni Office at Bradford University has been operating a PC based Alumni System using Dbase III Plus. This system is now breaking down due to the workload being placed upon it and a new system is required. The production of a new system has been undertaken by Martin Charlesworth, Timothy Hodgson and Ioanis Trikukis as an M.Sc. project. This report relates to that project. A system has been produced as a joint effort whereby each team member has produced (...) elements of the whole system. The result has been a system, which while not fuIIy complete, is in a state which can be used by the Alumni Office. The production of the system involved an analysis of the current system, the design of a new system and the implementation of the design. These stages are detailed in this report. The project has met its aims and its organisation has proved to be an effective method of working. (shrink)

The paper analyzes early colonial representations of the New World, connected with immigration of the first- and second-generation religious dissenters in what was to become America. Taking into account the well-documented influence of Puritans on American identity, the paper elaborates on the Puritans’ and Pilgrims’ mindsets as they arrived in the New World, connected not only with their religious beliefs but most of all with a practical need to organize themselves effectively. Be it in John Winthrop’s “A Modell of (...) Christian Charity,” William Bradford’s “Of Plymouth Plantation” or Samuel Danforth’s “New England’s Errand into the Wilderness,” the authors of these works clearly show how the Pilgrims and Puritans had to confront the experience of emigration/immigration and construct not only new ways of social organization but also new identity. The paper focuses on the immigrants’ perception of the New World, their own role and challenges they were faced with, and their thinking about the society they came from and were about to construct. It deals with their process of adjusting to the surroundings and discussing values they decided to promote for the sake of communal survival in the adverse conditions of the New World. (shrink)

Harrison, Helen Adelaide's first bishop, Francis Murphy, was baptised in Navan, County Meath, Ireland, on 24 May 1795. His parents were Arthur Murphy and Bridget nee Flood. Baptismal records suggest his siblings included John Joseph, Arthur, Catherine, John Joseph Michael and Christopher. It is unlikely that all of these survived for long because by the time Francis Murphy was Bishop of Adelaide, he was writing to 'my sister' and 'my brother'.

Why is pain bad? The most straightforward theory of pain's badness,dolorism, appeals to the phenomenal quality of displeasure. In spite of its explanatory appeal, the view is too straightforward to capture two central puzzles, namely pain that is enjoyed and pain that is not painful. These cases can be captured byconditionalism, which makes the badness of displeasure conditional on an agent's attitude. But conditionalism fails where dolorism succeeds with explanatory appeal. A new approach is proposed,reverse conditionalism, which maintains the explanatory (...) appeal of dolorism, but gives attitudes a value-defeating role. It is argued that this view does best in fulfilling the desiderata and capturing the cases. (shrink)

“Benefit to the world” and “Heaven’s intent” are not, as is often assumed, separate criteria for action in Mozi’s 墨子 ethics; they are the same in extension but not intension. When Mozi speaks in terms of “Heaven’s intent,” it is to highlight the criterion’s retrospective orientation and its scope; taking a cue from Heaven’s reactions to past deeds, agents specify the scope of “the world” by reference to the past performance of persons regarding benefit to the world.
