Evidence from a growing number of studies suggests leader character as a means to advance leadership knowledge and practice. Based on this evidence, we propose a process model depicting how leader character manifests in ethical leadership that has positive psychological and performance outcomes for leaders, along with the moderating effect of leaders’ self-control on the character strength–ethical leadership–outcomes relationships. We tested this model using multisource data from 218 U.S. Air Force officers and their subordinates and superiors. Findings provide initial support (...) for leader character as a mechanism triggering positive outcomes such that only when officers reported a high level of self-control did their honesty/humility, empathy, and moral courage manifest in ethical leadership, associated with higher levels of psychological flourishing and in-role performance. [Edited from Conclusion section:] We have looked at various challenging issues to do with getting connectionism to cope with high-level cognitive activities such a reasoning and natural language understanding. The issues are to do with various facets of generalization that are not commonly noted. We have been concerned in particular with the special forms these issues take in the arena of propositional attitude processing. The main problems we have looked at are: (1) The need to construct explicit representations of (...) generalizations, not just generalize correctly to individual cases; (2) The need to be able to match two or more complex short-term information structures, to enable rapid generalization from recent examples rather than from long-term memories; (3) The need to represent and reason with anomalous combinations of concepts; (4) The need to perform embedded reasoning. This presents special problems for systems using non-concatenative representations (as in mainstream connectionist approaches). We also touched on vague quantification in attitude report complements. Neither this topic nor that of analogies between short-term structures (point 2) has been adequately addressed in the symbolic framework, let alone in connectionism. -/- The opportunities and problems covered are put forward as things worth being optimistic about or pessimistic about, respectively. They are not put forward as decisive arguments for or against connectionism. The hope is that this chapter contributes to a greater understanding of the connectionist/symbolist gap by presenting some unusual issues and by throwing new light on some well known ones. (shrink)

In The Media and Modernity, Thompson develops an interactional theory of communication media that distinguishes between three basic types of interaction: face-to-face interaction, mediated interaction, and mediated quasi-interaction. In the light of the digital revolution and the growth of the internet, this paper introduces a fourth type: mediated online interaction. Drawing on Goffman’s distinction between front regions and back regions, Thompson shows how mediated quasi-interaction and mediated online interaction create new opportunities for the leakage of information and symbolic content from (...) back regions into front regions, with consequences that can be embarrassing, damaging and, on occasion, hugely disruptive. The growing role of mediated quasi-interaction and mediated online interaction has reconstituted the political field so that political life now unfolds in an information environment that is much more difficult to control, creating a permanently unstable arena in which leaks, revelations and disclosures are always capable of disrupting the most well-laid plans. Scientists often find difficulty in engaging in formal public debate about transcientific social issues. Although science is a highly disputatious institution, public argumentation amongst scientists follows very different conventional practices from those that rule in political and legal arenas. Amongst other differentiating features, scientific disputes are typically conducted in writing rather than orally, they are not sharply polarised or formally adversarial, they are seldom addressed to a specific proposition, and they do not reach decisive closure. As a result, the rhetorical (...) style that scientists learn from participation in such practises is not well adapted to the established format of socio-political 'debate'. For scientists to contribute effectively to such debates, they must learn new ways of making their particular type of knowledge convincing in unfamiliar intellectual and social contexts. (shrink)

The present study expands the systematic measurement of consumers’ sentiments towards business ethical practices to the international arena. Data for the Business Ethics Index (BEI) were gathered in three countries of the European Union (UK, Germany, Spain). The Germans were the most pessimistic while the British were the most optimistic about the future ethical behaviour of businesses.

This article examines the characteristics of a new form of visibility which has become a pervasive feature of the modern world and which is linked to the development of communication media. With the development of the media, the visibility of individuals, actions and events is severed from the sharing of a common locale: one no longer has to be present in the same spatial-temporal setting in order to see the other or to witness an action or event. The rise of (...) this new form of mediated visibility has transformed the relations between visibility and power. Thanks to mediated visibility, political rulers are able to appear before their subjects in ways and on a scale that never existed previously. Skilful politicians exploit this to their advantage; with the help of their PR consultants and communications advisers, they seek to create and sustain a basis of support by managing their visibility in the mediated arena of modern politics. But mediated visibility is a double-edged sword: it also creates new risks for political leaders, who find themselves exposed to new kinds of dangers. Hence the visibility created by the media becomes the source of a new and distinctive kind of fragility. However much political leaders try to manage their visibility, they cannot completely control it: mediated visibility can slip out of their grasp and can, on occasion, work against them. (shrink)

Thesis: The exclusion of organized labor/management issues from the principal arenas for business ethics study and discussions needs to be remedied. The paper develops this thesis in three steps: 1) Exclusion: A careful examination of select textbooks, journals, and conferences provides evidence as to the virtual absence of unions and such crucial organized labor/management issues as labor organizing and collective bargaining; 2) Inclusion: A series of brief arguments favoring inclusion of these issues in business ethics based on the notion of (...) privileged institutions, adversarial posturing, the societal benefits, and globalization; 3) Suggestions: Some practical, cooperative initiatives involving the academy, management and labor, such as, labor officials as guest speakers and members of business school committees, internships in labor organizations, training workshops in business ethics for labor leaders, fora for joint management/labor discussions of issues each group faces in the economy and the legislatures. How much context-sensitivity is there in English? Cappelen and Lepore’s answer: Not very much. On their view, context-sensitivity is confined to a ‘Basic List’, ‘plus or minus a bit’, that includes pronouns, demonstratives, temporal and spatial adverbs like ‘here’, ‘now’, and ‘yesterday’, and a short list of context dependent nouns and adjectives. Shockingly, the authors claim that ‘Lepore is ready’, ‘Cappelen has had enough’, and ‘Cappelen is quite tall,’ have a context-invariant meaning. Nor is that meaning incomplete, in the sense (...) of being something that can only be given a truth value relative to an enrichment. No, simultaneous utterances of ‘Lepore is ready’ always express the same proposition—that Lepore is ready—one that is true or false. When is it true? Cagily, the authors inform us that it is true if and only if Lepore is ready. One might wish to inquire further as to when Lepore is ready. For example: ‘If Lepore is ready for breakfast but not ready to learn to play golf, is Lepore ready?’ and ‘Given that I am always ready for a fulfilling relationship, am I ever not ready?’ Whenever they are faced with questions such as these, the authors defer to the arena of metaphysics, where they admit to being ‘rank amateurs’. The recent challenge of Dynamical Systems Theory to the social sciences, is based largely on the beliefthat processes in the social arena can be considered as analogous to those of the natural world, and that in consequence general theoretical advances in explaining the latter might with advantage be applied to the former. This paper aims to show that claims for Dynamical Systems Theory with respect to the understanding or measurement of social processes would be premature; the reasons for this (...) lying not only in the unfamiliarity and operational difficulties of Dynamical Systems Theory in itself, but also in the problematic nature and history of our usage of the term ‘social process’. Reviewing some examples of such usage from Sociology and Social Psychology, it is concluded that Dynamical Systems Theory might serve as a catalyst for a re-examination of existing orthodoxies and major concepts, but that progress would be retarded by the uncritical application of it's terminology, concepts, and techniques of mathematical modelling, without this prior and demanding first step. Cognitive science is ready for a major reconceptualization. This is not at all because efforts by its practitioners have failed, but rather because so much progress has been made. The need for reconceptualization arises from the fact that this progress has come at greater cost than necessary, largely because of more or less philosophical (at least metatheoretical) straightjackets still worn - whether wittingly or not - by those doing the work. These bonds are extremely hard to break. Even some of (...) those who have directed powerful arguments against them have failed entirely to shake them off. The bonds are often attributed to the work of René Descartes, but they are really much older than that. If even in the present effort, I fail entirely to remove the straightjacket myself (even though I am making every attempt to get it off), this will testify to its tight grip. The straightjacket I am thinking about, of course, is the vague picture of the human situation that imagines centralized, internal minds in control of bodily machines. While almost no one in the contemporary cognitive science arena imagines minds to be the kind of thing Descartes took them to be - instantiations of a unique, fully non-material substance - there is nevertheless a deep resistance, even among the most fervent professed "materialists," to giving up this picture. In what follows, I shall try to offer an approach which on the one hand capitalizes on the excellent progress that has been made in cognitive science in the last few decades, and which on the other hand offers a general approach that may help at some level in the attempt to shake "Cartesian" bonds. The approach, as the alert reader already knows from the title of the essay, is an "ecological" approach. (shrink)

In psychoanalytic theory, the notion of the person inevitably evokes the notion of subjectivity. Not that the former can be reduced to the latter; but if psychoanalytic theory is anything more a certain type of therapeutic practice, it is indeed a theory of the subject or a theory of the subjective relation. We should perhaps begin by specifying that the subjective relation must be understood as a complex whole: an intrapsychic relation, that is, a relation between the various instances that (...) make up the subject, and at the same time an inter subjective relation, that is, a relation between (at least) two subjects. These two aspects are both inseparable and conflictual. They are inseparable because the self cannot exist, cannot construct itself without the other (whether this be a parental other or a peer). They are conflictual for at least two reasons. On the one hand, because the intrapsychic relation is by definition an arena of conflict: the conflict that opposes the Ego to the contradictory but equally tyrannical demands of the Id - which translates its attachment to the body and testifies to its inherent drives - and of the Superego, which represents its rootedness in the social and cultural sphere. And on the other hand, because this subject, which is thus divided within itself, must undergo the trial of bringing its desire face to face with the desire of the others with whom it is destined to live. The psychoanalytic theory of the subject is therefore the theory of a doubly heterogeneous relation: there is the heterogeneity of the components of the self, which go, once again, from their anchorage in somatic drives to the most ethereal expressions of the ideal; and there is the heterogeneity of the relation between this self and the self of the other. Moreover, this double heterogeneity is not limited to the matter of components: after all, these, one might think, would ideally be open to reabsorption into the homogeneity of the individual. On the contrary, this heterogeneity gives rise to a double rationality or double logic. Psychic causality - to borrow André Green's expression - is also driven by the conflict that opposes what in psychoanalysis are known as the primary processes, which Freud has described in chapter 7 of the Traumdeutung and which govern the formation and organization of the dream images, to the secondary processes, which are those processes that govern our daytime thoughts. Psychic causality is formed by the struggle for hegemony between these two logics, each of which is itself acted upon by an antagonism between what Freud, at the end of his life, called Eros and Thanatos, the urge for Life and the drive toward death or destruction. “Living involves being exposed to pain every second—not necessarily as an insistent reality, but always as a possibility,” writes Arne Vetlesen in _A Philosophy of Pain_, a thought-provoking look at an inevitable and essential aspect of the human condition. Here, Vetlesen addresses pain in many forms, including the pain inflicted during torture; the pain suffered in disease; the pain accompanying anxiety, grief, and depression; and the pain brought by violence. He examines the dual nature of pain: how we attempt to (...) avoid it as much as possible in our daily lives, and yet conversely, we obtain a thrill from seeking it. Vetlesen’s analysis of pain is revealing, plumbing the very center of many of our most intense and complicated emotions. He looks at pain within different arenas of modern life such as family and work, and he specifically probes at a very common modern phenomenon, the idea of pushing oneself to the limit. Engaging throughout with the ideas of thinkers such as Søren Kierkegaard, Sigmund Freud, Martin Heidegger, Jean-Paul Sartre, Maurice Merleau-Ponty, Max Horkheimer, Theodor Adorno, Alice Miller, Susan Sontag, and Melanie Klein, _A Philosophy of Pain_ asks which came first, thinking or feeling, and explores the concept and possibility of empathy. Vetlesen offers an original and insightful perspective on something that all of us suffer and endure—from a sprained ankle to a broken heart. Connectionist attention to variables has been too restricted in two ways. First, it has not exploited certain ways of doing without variables in the symbolic arena. One variable-avoidance method, that of logical combinators, is particularly well established there. Secondly, the attention has been largely restricted to variables in long-term rules embodied in connection weight patterns. However, short-lived bodies of information, such as sentence interpretations or inference products, may involve quantification. Therefore short-lived activation patterns may need to achieve the effect (...) of variables. The paper is mainly a theoretical analysis of some benefits and drawbacks of using logical combinators to avoid variables in short-lived connectionist encodings without loss of expressive power. The paper also includes a brief survey of some possible methods for avoiding variables other than by using combinators. (shrink)

This paper explores the reasons that led many Catholics to support the candidacy of Donald Trump in the 2016 and 2020 presidential elections in the United States and the role played by the leadership of the U.S. Catholic bishops in the electoral process. Also explored are the outlines of an alternative approach, shaped by the more holistic “consistent ethic of life” contained in the teachings of Pope Francis. Attention is given to how this Francis-inspired alternative could provide a model for (...) more constructive and prophetic engagement of the U.S. Catholic Church in the political arena. Abstract.In a previous issue of Zygon (Carvalho 2007), I explored the role of scientists—especially those engaging the science‐religion dialogue—within the arena of global equity health, world poverty, and human rights. I contended that experimental biologists, who might have reduced agency because of their professional workload or lack of individual resources, can still unite into collective forces with other scientists as well as human rights organizations, medical doctors, and political and civic leaders to foster progressive change in our world. In (...) this article, I present some recent findings from research on three emerging viruses—HIV, dengue, and rotavirus—to explore the factors that lead to the geographical expansion of these viruses and the increase in frequency of the infectious diseases they cause. I show how these viruses are generating problems for geopolitical stability, human rights, and equity health care for developing nations that are already experiencing a growing poverty crisis. I suggest some avenues of future research for the scientific community for the movement toward resolution of these problems and indicate where the science‐religion field can be of additional aid. Published in the Series Encyclopedia of Indian Religions, this volume is devoted to Christianity in India, where it has had a long presence, going back to the time of the apostles of Jesus Christ. Divided into two parts, this volume focuses on the history, origin, organizations and local engagements, belief system, worship practices, Rites, Rituals, Christian life, Contributions, Spirituality and a few of the main doctrinal items. The Second Part covers the doctrinal and theological arena. It examines the earlier (...) phase of the history of Christianity starting with the traditional belief of the arrival of St. Thomas in AD 52, moving to the periods of its association with the Chaldean church, the Portuguese, the Dutch, English and so on. This volume highlights the missionary activities of persons like St. Francis Xavier, the creative contributions made to the inter-religious dialogue by such people as Roberto de Nobili (1577-1656) and Swami Abhishiktananda (1910-1973), the linguistic and educational contributions of some of the pioneers like the German Jesuit Johanne Ernst Hanxleden (known as Arnos Padiri) (1681-1732), Herman Gundert (1814-1893), St. Elias Kuriakos Chavara (1805-1871), and, a fortiori, the enormous contributions in the healthcare area throughout the country. Caring for and serving the socio-economically marginalized ones, the peripheralized people formed an integral part of the Christian activity In India, as it is done even today. This is highlighted very much in the volume. It, further, explores the contact India had with European Christianity, showing that European Christianity proved to have wider influence in the Norther part of India, unlike India’s early episodic encounters with Palestinian and Persian forms of Christianity, which had deep influence in the Southern part of India. The volume also highlights the inner struggle among the followers resulting even in its division originating at the Synod of Diamper in 1599 manifesting, by and large, the Church-state ‘love and hate’ relationships. In fine, in spite of the drawbacks of putting the herculean task of two thousand years of history in eight hundred pages or so, this volume gives a rather comprehensive view of Christianity in India especially to those who are unfamiliar with its life and dynamics in the Indian context. The wide range of photographs, especially of the churches revealing the architectural beauty and multiplicity along with the ensample of art and paintings and pilgrimage centers adds to the enrichment of the volume. Taking organisational responses to the ?organ retention scandals? in the United Kingdom and Australia as a starting point, this paper considers the role of social welfare workers within the medico-legal system. Official responses to the inquiries of the late 1990s have focused on issues of consent and process-transparency, leaving unaddressed concerns expressed by the bereaved about the impact of organ retention on both their experience of grief and on the deceased themselves. A review of grief and embodiment literature suggests that (...) such concerns are consistent with the significance of relationship, attachment and identity within grief resolution?however that last problematic term is defined. The case example of an Australian coronial jurisdiction which has attempted to deal with some of these issues through mandating the discussion of autopsy and organ retention processes by grief counsellors with bereaved families is then provided. A distinction is drawn between these discussions and the seeking of consent. The discussion concludes by considering the ambiguous nature of the social welfare role within this contested field, suggesting that this ambiguity, while perhaps a source of flexibility in practice, may itself relate to a lack of clear information about the needs of the bereaved. This paper contributes to the development of that knowledge and offers some necessarily tentative recommendations regarding social welfare practice in this challenging arena. (shrink)

The paper makes use of two frameworks to develop a discussion on the merits of delaying agreement in partnership contexts. The first framework — the Arenas of Power — is helpful in understanding the different contexts in which negotiation and discussion take place. Four Arenas are identified, depending on the potential for agreement between parties who may hold very different worldview perspectives, and the power distribution between the various parties involved. Each leads to different ways of working, and to different (...) goals in terms of what can constructively be agreed and what could prove false or artificial. The second framework develops the idea of alethic pluralism through the use of Wilber’s four quadrants. The two frameworks are then related to four processes taken by ‘alternative’ systems of knowledge which illustrate examples of how things play out in and between the Arenas: annihilation, systematic exclusion/segregation, assimilation, and integration/accommodation. Several approaches are then outlined which can be used in these Arenas. They include Drama Theory (a development of Games Theory which has proved particularly useful in settings where there are dilemmas facing the parties which cannot be resolved through rational analysis), Principled Negotiation and Whole Systems Interventions. A number of practical examples are given which develop and enrich the argument, including cases where delaying agreement has proved beneficial, and cases where premature agreement has proved problematic. Ovid's two versions of his encounter with a woman at the races in the Circus Maximus are re-read together as celebrations of the spectacle of the spectators in the arena. The analytical approaches of "Everyday Life" collage and "Foucauldian panopticism" structure are shown to "over-achieve." Ovid dramatizes personal politics at the Circus in a sustained display of the self-reflexive poetics of erotic metaphor. When elegiac amor is acted out as a race, victory and favor are eroticized, steering between crude (...) explicitness and bland circumlocution, into an expert triumph of sexual asymmetry. Ovid finds a version of femineus amor which brings his poem to a climax, and a climax to his poem, in spite of public decency and myriad spectators. Every quirk, routine, or landmark of the ludi circenses, including the parade of the gods, is included as a challenge for Ovid's poetic chariot, another lap in the race-or another race, re-run according to a fresh strategy. What is your highest ideal? What code do you live by? We all know that these differ from person to person. Artists, scientists, social activists, farmers, executives, and athletes are guided by very different ideals. Nonetheless for hundreds of years philosophers have sought a single, overriding ideal that should guide everyone, always, everywhere, and after centuries of debate we’re no closer to an answer. In _How Should We Live?_, John Kekes offers a refreshing alternative, one in which we eschew (...) absolute ideals and instead consider our lives as they really are, day by day, subject to countless vicissitudes and unforeseen obstacles. Kekes argues that ideal theories are abstractions from the realities of everyday life and its problems. The well-known arenas where absolute ideals conflict—dramatic moral controversies about complex problems involved in abortion, euthanasia, plea bargaining, privacy, and other hotly debated topics—should not be the primary concerns of moral thinking. Instead, he focuses on the simpler problems of ordinary lives in ordinary circumstances. In each chapter he presents the conflicts that a real person—a schoolteacher, lawyer, father, or nurse, for example—is likely to face. He then uses their situations to shed light on the mundane issues we all must deal with in everyday life, such as how we use our limited time, energy, or money; how we balance short- and long-term satisfactions; how we deal with conflicting loyalties; how we control our emotions; how we deal with people we dislike; and so on. Along the way he engages some of our most important theorists, including Donald Davidson, Thomas Nagel, Christine Korsgaard, Harry Frankfurt, Charles Taylor, Alasdair MacIntyre, and Bernard Williams, ultimately showing that no ideal—whether autonomy, love, duty, happiness, or truthfulness—trumps any other. No single ideal can always guide how we overcome the many different problems that stand in the way of living as we should. Rather than rejecting such ideals, _How Should We Live? _offers a way of balancing them by a practical and pluralistic approach—rather than a theory—that helps us cope with our problems and come closer to what our lives should be. Leaders and managers of today's multinational corporations face a plethora of problems and issues directly attributable to the fact that they are operating in an international context. With work-sites, plants and/or customers based in another country, or even several countries, representing a vast spectrum of cultural differences, international trade and offshore operations, coupled with increased globalisation in respect to political, social and economic realities, contribute to new dilemmas that these leaders must deal with. Not the least of these being a (...) Code of Ethics and ethical decision making.This paper examines the differences in culture between a group of managers from the United States and similar group from Croatia using Hofstede's theory of International Cultures. The study explores how these cultural dimensions may help in our understanding of the differences in reported whistleblowing. The authors then postulate four hypotheses regarding various aspects of whistleblowing. These Hypotheses were than tested using a survey administered to a sample of U.S.A. and Croatian managers. Finally, the paper discusses the findings and practical implications for contemporary managers in the international arena. (shrink)

No, simultaneous utterances of ‘Lepore is ready’ always express the same proposition—that Lepore is ready—one that is true or false. When is it true? Cagily, the authors inform us that it is true if and only if Lepore is ready. One might wish to inquire further as to when Lepore is ready. For example: ‘If Lepore is ready for breakfast but not ready to learn to play golf, is Lepore ready?’ and ‘Given that I am always ready for a fulfilling relationship, am I ever not ready?’ Whenever they are faced with questions such as these, the authors defer to the arena of metaphysics, where they admit to being ‘rank amateurs’. Despite the venerable place that "justice" occupies in social scientific theory and research, little effort has been made to see how members of society themselves define and use the concept when confronted with determining "what has happened" in some social arena, theorizing about why it happened, and deciding what should ensue. We take an ethnomethodological approach to justice, attempting to recover it as a feature of practical activity or a "phenomenon of order." Our analysis involves an actual videotaped jury (...) deliberation. In his classic study of decision making by juries, Garfinkel observed that jurors changed their reliance on commonsense reasoning very little, even though they were instructed to adhere to official and legal criteria for guilt. The vacillation between commonsense reasoning and using official criteria creates a tension; in our data this tension is manifested as the choice between adhering to law and procedural rules and providing "justice." By articulating this tension as a puzzle, several of the jurors prepare the way for using "justice," and then use this concept in formal ways which, along with other discursive patterns and strategies, constitute the deliberation as a structured, concerted activity. We show four stages in the use of the term justice as it is embedded in jurors' practical reasoning. (shrink)

Nanomedicine is a rapidly growing field in the academic as well as commercial arena. While some had predicted nanomedicine sales to reach $20.1 billion in 2011, the actual growth was much more rapid, with the global nanomedicine market being valued at $53 billion in 2009, and forecast to increase at an annual growth rate of 13.5% to reach more than $100 billion in 2014. In 2006, more than 130 nanotechnology-based drugs and delivery systems had entered preclinical, clinical, or commercial (...) development. The European Medicines Agency reviewed 18 marketing authorization applications for nanomedicines in 2010. In 2011, 22 drugs that had been approved by the FDA, and 87 Phase I and Phase II clinical trials were listed in the U.S. National Institutes of Health data base, www.clinicaltrials.gov. Although the fastest growing areas of nanomedicine are applications in medical imaging and diagnosis using contrast-enhancing agents, most nanomedicine research and commercialization is in the area of cancer drug therapy, including nano gold shells. Recollection is an intellectual activity through which fundamental differences of experience, either between a plurality of individuals or within one individual at different stages of development, are comprehended and internally resolved. Together with the process of natural dialectic, recollection is the basis of Hegel’s theory of education and cultural solidification. It would, of course, be quite impossible in a single essay to enter into all the details and ramifications of this theory, and so we shall deal only with the basic (...) concept. Moreover, we shall emphasize the role of the individual, not so much to counter the gross miscomprehensions of Hegel’s thought which result when the activity of cultural enlightenment is generalized and ascribed to conceptually mystified world-historical processes, but simply to provide the proper arena for the functioning of this activity. For it is always the individual who internalizes the elaborated wealth of human spiritual capacities as best he can, and who through so doing is materially empowered to promote the education of others in turn. Current research suggests that nonclinical forensic psychologists[sup1] are appearing increasingly more often in the legal arena. We argue that many of the ethical dilemmas that face these psychologists differ from those encountered by clinical forensic psychologists. To test the accuracy of this assertion, 37 nonclinical forensic psychologists were surveyed to identify some of the ethical issues and dilemmas they have encountered while engaging in expert testimony or pretrial consulting. Respondents were asked also about how they have resolved these ethical (...) issues and whether they were aware of the "Specialty Guidelines for Forensic Psychologists" (Committee on Ethical Guidelines for Forensic Psychologists, 1991). Results of the survey are discussed in terms of the need for additional regulatory guidelines or professional standards that speak directly to the ethical issues confronting nonclinical, forensic expert witnesses and consultants. Current policy in relation to special needs prioritises early intervention and inclusive education, at least as 'good intentions'. This article argues for a paradigmatic shift away from individualist models of learning and disability. The social context of play is emphasised as the crucial arena for realising such good intentions, as long as it is geared to responding to, and developing, the self-determination, control, and identity of young disabled children becoming disabled adults in a disabling society.

Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. Sentimental novels (...) turn on the contrast between the passive victim status of the heroine and the active libidinal quest of the rake-villain. As Cathy Davidson points out, this fiction is "about silence, subservience, stasis (the accepted attributes of women as traditionally defined) in contradistinction to conflicting impulses toward independence, action, and self expression (the ideals of the new American nation)." The seduction plot diverts attention from this disparity by establishing an affective solidarity between heroine and reader and elevating the ruined woman to a tragic status. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgements on her behalf. Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. The common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Norman's sentimental strategy proved so powerful that men on trial for killing their wive's seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. Scholars such as Wai Chee Dimock have argued for a focus "on the historical and historically shifting relations between law and literature" - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). Going further, we would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. Thus, we see no need to characterize - and indeed reject the depiction of - law as "a limited arena" in which ideas of morality have little place. This project, then, responds to Gregg Crane's call for attention to "the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice." The extended story of Amelia Norman not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. The article comprises a conceptual framework to analyze the strengths and weaknesses of a global health convention. The analyses are inspired by Lawrence Gostin's suggested Framework Convention on Global Health. The analytical model takes a starting-point in events tentatively following a logic sequence: Input (global health funding), Processes (coordination, cooperation, accountability, allocation of aid), Output (definition of basic survival needs), Outcome (access to health services), and Impact (health for all). It then examines to what degree binding international regulations can create (...) order in such a sequence of events. We conclude that a global health convention could be an appropriate instrument to deal with some of the problems of global health. We also show that some of the tasks preceding a convention approach might be to muster international support for supra-national health regulations, negotiate compromises between existing stakeholders in the global health arena, and to utilize WHO as a platform for further discussions on a global health convention. Global health is a concept which in recent years has evoked a lot of interest from both academics, politicians, celebrities, and the media. The term “global health” implies a globally shared responsibility to provide health as a public good through an expansive number of initiatives. This emerging era of consciousness about our international interdependence, regardless of a problem’s geographic location or type of disease, may be a good moment for exploring the strengths and weaknesses of an international law approach to (...) global health challenges: a global health convention.The most prominent global health initiatives are the Millennium Development Goals, the 2005 Paris Declaration Process on Aid Effectiveness on the need for alignment and coordination, and the 2008 Accra High Level Forum on Aid Effectiveness. These instruments have yet to prove their value, and the funds annually disbursed, approximately $25 billion in 2009, could have better effect if the negotiated principles from the PDP and the AHLF were followed. The lack of adequate resources to accommodate higher staff-to-resident ratios adds additional urgency to the goal of identifying more costeffective mechanisms to provide care oversight. The ever expanding array of electronic monitoring technologies in the clinical research arena demands a conceptual and pragmatic framework for the resolution of ethical tensions inherent in the use of such innovative tools. CareMedia is a (...) project that explores the utility of video, audio and sensor technologies as a continuous real-time assessment and outcomes measurement tool. In this paper, the authors describe the seminal ethical challenges encountered during the implementation phase of this project, namely privacy and confidentiality protection, and the strategies employed to resolve the ethical tensions by applying principles of the interest theory of rights. InDriven from New Orleans, John Arena focuses on the contradictory role of nonprofits in facilitating the consensual removal of poor, black residents from inner-city spaces as the result of the privatisation and demolition of public housing. His account is constructive for delving into the on-the-ground struggles around public housing and the complexities of urban politics, and, more importantly, for situating the housing question at the heart of working-class struggles. His emphasis on how the gradual construction of consent was (...) imperative in paving the way for the sudden application of coercive force in the aftermath of Katrina is also a welcome correction to arguments that tend to see the post-Katrina policies as the cause célèbre of the striking and rapid reconfiguration of New Orleans. Arena, however, falls short of providing a historicised analysis of urban politics and the politics of nonprofits. (shrink)
