In this study, we examine the belief bias effect in syllogistic reasoning under both standard presentation and in a condition where participants are required to respond within 10 seconds. As predicted, the requirement for rapid responding increased the amount of belief bias observed on the task and reduced the number of logically correct decisions, both effects being substantial and statistically significant. These findings were predicted by the dual-process account of reasoning, which posits that fast heuristic processes, responsible for belief bias, (...) compete with slower analytic processes that can lead to correct logical decisions. Requiring rapid responding thus differentially inhibits the operation of analytic reasoning processes, leading to the results observed. (shrink)

In his classic monograph, The Death of Contract, Grant Gilmore argued that Christopher Columbus Langdell, Oliver Wendell Holmes, and Samuel Williston trumped up the legal credentials for their classical bargain theory of contract law. Gilmore's analysis has been subjected to extensive criticism, but its specific, sustained, and fundamental charge that the bargain theory was based on a fraudulent misrepresentation of precedential authority has never been questioned. In this Essay, I argue that Gilmore's case against the classical theorists rests on (...) the suppressed premise that the precedential authority of cases resides in the express judicial reasoning used to decide them. In contrast, I argue that the classical theorists implicitly presuppose that the precedential authority of cases consists in the best theory that explains their outcomes, even if that theory is inconsistent with the case's express judicial reasoning. The classical view of precedential authority completely defuses Gilmore's charge of fraud. In Gilmore's view, merely demonstrating the inconsistency between the proposition for which the classical theorists cited a case and the express reasoning in that case suffices as proof of misrepresentation. But in the classical theorists' view, the express reasoning in a case is simply a theory of its precedential authority, which, like any theory, can be wrong. Thus, the classical theorists simply reject Gilmore's claim that a case cannot properly be cited for a proposition inconsistent with its express reasoning. The real dispute, then, between Gilmore and the classical theorists is over the nature of precedential authority and not the content of contract law. Having reframed the classic death-of-contract debate, I then trace these competing conceptions of precedential authority through the major schools of contemporary contract theory. I argue that a contract theory's embrace of one view instead of the other can be explained by the relative priority it accords to each of the two components in a conception of adjudicative legitimacy. A conception of adjudicative legitimacy consists in a theory of what it means for a decision to be based on law and a theory of what is required for law to be justified. I explain why theories according priority to the former tend to subscribe to the precedents-as-outcomes view, while theories according priority to the latter tend to favor the express reasoning view. The Essay concludes by arguing that the economic analysis of contract law subscribes to the precedents-as-outcomes view and therefore is the contemporary jurisprudential successor to the late nineteenth-century classical theorists. This paper delves into Jody Azzouni's ideas on the ontology of fictional characters. Azzouni interestingly maintains that even though fictional characters like Hermione Granger, Sherlock Holmes, and Mickey Mouse do not exist in reality, assertions about them can still be true. However, Azzouni dismisses the necessity of these characters to be ontologically real to validate the truth of sentences concerning them. Instead, Azzouni proposes that truth in speech and thought corresponds with the world, but not necessarily by attributing properties (...) and relations to tangible things in it. This stance opposes the conventional philosophical notion that every true statement must directly represent an aspect of reality. This paper scrutinizes Azzouni’s argument and appreciates his attempt to dissociate ontology from the truth in fictional discourse. Nonetheless, it also recognizes certain gaps in this perspective. The paper endeavors to refine and extend Azzouni's approach by introducing the concept of 'metaphysical explanation', which explains the truth of statements about fictional characters by correlating them to relevant acts of fiction, rather than positing the reality of fictional entities. This extension preserves the essence of Azzouni’s view while addressing its limitations, thus paving the way for a more comprehensive understanding of how we can talk truly about fictional characters without holding that such entities are real in any sense. Corporate volunteering is known to be an effective employee engagement initiative. However, despite the prominence of corporate social responsibility in academia and practice, research is yet to investigate whether and how CV may influence consumer perceptions of CSR image and subsequent consumer behaviour. Data collected using an online survey in Australia show perceived familiarity with a company’s CV programme to positively impact CSR image and firm image, partially mediated by others-centred attributions. CSR image, in turn, strengthens affective and cognitive loyalty (...) as well as word-of-mouth. Further analysis reveals the moderating effect of perceived leveraging of the corporate volunteering programme, customer status and the value individuals place on CSR. This article examines verbal humour in routine interactions within professional workplaces, using material recorded in four New Zealand government departments. The problem of defining humour is discussed, followed by a brief outline of the theoretical models which underpin the analysis of the various functions which humour serves in professional organizations. Humour can express positive affect in interaction. It can also facilitate or `licence' more negative interpersonal communicative intent. While politeness theory can account for the former, as a means of expressing (...) collegiality at work, or de-emphasizing power imbalances, in its standard form politeness theory does not explain barbed, competitive or confrontational humour. For this it is necessary to look to `the dark side of politeness'. An alternative perspective thus examines the extent to which humour functions, especially in unequal encounters, as an acceptable strategy to help superiors maintain a position of power but also as a strategy used by subordinates to licence challenges to the power structures within which they operate, and as a legitimizing strategy in attempts at subverting the repressive or coercive discourse of superiors. Although medical providers rely on similar tools to “treat” intersex and trans individuals, their enactment of medicalization practices varies. To deconstruct these complexities, we employ a comparative analysis of providers who specialize in intersex and trans medicine. While both sets of providers tend to hold essentialist ideologies about sex, gender, and sexuality, we argue they medicalize intersex and trans embodiments in different ways. Providers for intersex people are inclined to approach intersex as an emergency that necessitates medical attention, whereas providers (...) for trans people attempt to slow down their patients’ urgent requests for transitioning services. Building on conceptualizations of “giving gender,” we contend both sets of providers “give gender” by “giving sex.” In both cases too, providers shift their own responsibility for their medicalization practices onto others: parents in the case of intersex, or adult recipients of care in the case of trans. According to the accounts of most providers, successful medical interventions are achieved when a person adheres to heteronormative gender practices. (shrink)

Metacognition refers to any knowledge or cognitive process that monitors or controls cognition. We highlight similarities between metacognitive and executive control functions, and ask how these processes might be implemented in the human brain. A review of brain imaging studies reveals a circuitry of attentional networks involved in these control processes, with its source located in midfrontal areas. These areas are active during conflict resolution, error correction, and emotional regulation. A developmental approach to the organization of the anatomy involved in (...) executive control provides an added perspective on how these mechanisms are influenced by maturation and learning, and how they relate to metacognitive activity. Despite problems of subjectivity and objectivity in value assignments, values are actualized in human relationships with nature, sometimes by constructive activity depending on a natural support, sometimes by a sensitive, if an interpretive, appreciation of the characteristics of natural objects. The background concern of this paper is the well-rehearsed debate on the “theological turn” (or “veerings”) in French Phenomenology that was ignited by Dominique Janicaud some 25 years ago in his vociferous critique of several leading French thinkers. It also responds to subsequent contestations against Janicaud by numerous scholars defending these thinkers radicalising of phenomenology in their attempts to account for what Emanuel Levinas had “stirred up in the phenomenological field” by re-posing the question of the philosophical status of the (...) idea of God. What is pivotal to Janicaud in his exclusionary critique and drawing of phenomenological boundaries is to hold dearly to the method as Edmund Husserl intended. In doing so, only describable phenomena that appear (or are logically subtended to appear) provide the litmus for a bona fide phenomenology. In opening and broadening the method to include experiences of a transcendent, religious nature as the French thinkers do, orthodox Husserlian thinking places these projects into question. The purpose of this paper is to question these post-Husserlian thinkers with a more faithful reading of Husserl. I analyse three key areas to suggest a ‘divine limit’ to phenomena: first, the concept of “the phenomenon” as developed in Husserl’s project; second, the ‘status of the idea of God’ in Husserl’s writings; and third, the relevant philosophical discourse on God that emerges from the Janicaud-led debate through critical commentary on the phenomenology of the “inapparent”. As a consequence, God is argued to be a divine limit to Husserlian phenomenology, but not religious belief itself. (shrink)

The confounding effects of heterogeneity in biological psychiatry and psychiatric genetics have been widely discussed in the literature. We suggest an approach in which heterogeneity may be put to use in hypothesis testing, and may find application in evaluation of the Crespi & Badcock (C&B) imprinting hypothesis. Here we consider three potential sources of etiologic subtypes for analysis.

Liberal democracy needs a clear-eyed, robust defense to deal with the increasingly complex challenges it faces in the twenty-first century. Unfortunately much of contemporary liberal theory has rejected this endeavor for fear of appearing culturally hegemonic. Instead, liberal theorists have sought to gut liberalism of its ethical substance in order to render it more tolerant of non-liberal ways of life. This theoretical effort is misguided, however, because successful liberal democracy is an ethically demanding political regime that requires its citizenry to (...) display certain virtues and habits of mind. Against the grain of contemporary theory, philosopher Richard Rorty blends American pragmatism and romanticism to produce a comprehensive vision of liberal modernity that features a virtue-based conception of liberal democracy. In doing so, Rorty defends his pragmatic liberalism against a host of notable interlocutors, including Charles Taylor, Nancy Fraser, Hilary Putnam, Richard J. Bernstein, and Jean Bethke Elshtain. Philosophical ethics comprises metaethics, normative ethics and applied ethics. These have characteristically received analytic treatment by twentieth-century Anglo-American philosophy. But there has been disagreement over their interrelationship to one another and the relationship of analytical ethics to substantive morality – the making of moral judgments. I contend that the expertise philosophers have in either theoretical or applied ethics does not equip them to make sounder moral judgments on the problems of bioethics than nonphilosophers. One cannot "apply" theories like Kantianism or (...) consequentialism to get solutions to practical moral problems unless one knows which theory is correct, and that is a metaethical question over which there is no consensus. On the other hand, to presume to be able to reach solutions through neutral analysis of problems is unavoidably to beg controversial theoretical issues in the process. Thus, while analytical ethics can play an important clarificatory role in bioethics, it can neither provide, nor substitute for, moral wisdom. This is an attempt to clarify the relation between Schmitt and Hobbes by examining Hobbes's thinking about enemies and enmity. On the one hand, Hobbes shares a strong war/crime distinction with Schmitt. On the other hand, Hobbes never suggests that lethal enmity gives a ?meaningful? tension to human life. Hobbes also describes the way feverish human minds may imagine enemies where none exist. This is another non?Schmittian theme. Although Schmitt was a profoundly anti?Hobbesian thinker for these and other reasons, an (...) examination of Hobbes with the Schmittian question (?who is the enemy??) in mind, proves exceptionally fruitful, opening up aspects of Hobbes's political theory that have hitherto lingered in obscurity. “Nature knows best” is reconsidered from an ecological perspective which suggests that we ought to follow nature. The phrase “follow nature” has many meanings. In an absolute law-of-nature sense, persons invariably and necessarily act in accordance with natural laws, and thus cannot but follow nature. In an artifactual sense, all deliberate human conduct is viewed as unnatural, and thus it is impossible to follow nature. As a result, the answer to the question, whether we can and ought to follow nature, (...) must be sought in a relative sense according to which human conduct is sometimes more and sometimes less natural. Four specific relative senses are examined: a homeostatic sense, an imitative ethical sense, an axiological sense, and a tutorial sense. Nature can be followed in a homeostatic sense in which human conduct utilizes naturallaws for our well-being in a stable environment, but this following is nonmoral since the moral elements can be separated from it. Nature cannot be followed in an imitative ethical sense because nature itself is either amoral or, by some accounts, immoral. Guidance for inter-human ethical conduct, therefore, must be sought not in nature, but in human culture. Nevertheless, in an axiological sense, persons can and ought to follow nature by viewing it as an object of orienting interest and value. In this connection, three environments are distinguished for human well-being in whichwe can and ought to participate-the urban, the rural, and the wild. Finally, in a tutorial sense, persons can and ought to follow nature by letting it teach us son1ething of our human role, our place, and our appropriate character in the natural system as a whole. In this last sense, "following nature" is commended to anyone who seeks in his human conduct to maintain a good fit with the natural environment-a sense of following nature involving both efficiency and wisdom. (1) In a philosophically oriented analysis, I distinguish seven meaning levels of value, individual preference, market price, individual good, social preference, social good, organismic, and ecosystemic, and itemize twelve types of value carried by wildlands, economic, life support, recreational, scientific, genetic diversity, aesthetic, cultural syrubolization, historical, characterbuilding, therapeutic, religious, and intrinsic. What are Eric Mullis’s contributions to a pragmatist philosophy of dance? First, the work brings attention to aspects of dance in regional and religious contexts and to a selection of religious dance practices not typically addressed in the literature of dance philosophy, thus adding to the current scope of dance studies. This book’s main strength with respect to pragmatist philosophies is its efforts to apply existing theories of pragmatism to aspects of dance in a particular regional setting. This task is (...) accomplished with three aspects of the research: ecological study of Pentecostal dance, pragmatism in a selection of its manifestations with connections to philosophies of dance, and performance. In the final chapter, the scope is broadened with summary references to alternative theories of dance philosophy and their interdisciplinary relations to dance studies using pragmatist philosophies. The remainder of this essay examines selection of past and current studies that inform the state of dance philosophy with the aim of gathering a broader perspective on the state of dance philosophy. While there is no established long-term tradition of dance philosophy, a generation of twentieth-century scholars—Cohen, Arnheim, Sparshott, Goodman, Van Camp, Banes, Carroll, McFee, Foster, and Fraleigh, among others—has advanced recent philosophical discussion of dance. Systems TRC and TRCU of illative combinatory logic are introduced and shown to be equivalent in consistency strength and expressive power to Quine's set theory ‘New Foundations’ and the fragment NFU + Infinity of NF described by Jensen, respectively. Jensen demonstrated the consistency of NFU + Infinity relative to ZFC; the question of the consistency of NF remains open. TRC and TRCU are presented here as classical first-order theories, although they can be presented as equational theories; they are not constructive.
