Algunos filósofos utilitaristas justifican proteger los derechos humanos por la utilidad que reportan, pero niegan que tal obligación pueda desplazar al deber ético más fundamental de procurar el bienestar. El trabajo argumenta que los derechos humanos son bienes cuyo valor moral es en parte independiente del bienestar que causan, y por tanto crean exigencias que pueden oponerse y superar a las razones para incrementar el bienestar global. A partir de esta idea se discute la suficiencia de una ética basada únicamente (...) en derechos, los conflictos de los derechos humanos entre sí y con otros bienes morales y la justificación de la inalienabilidad de los derechos humanos. Automated legal reasoning and its application in smart contracts and automated decisions are increasingly attracting interest. In this context, ethical and legal concerns make it necessary for automated reasoners to justify in human-understandable terms the advice given. Logic Programming, specially Answer Set Programming, has a rich semantics and has been used to very concisely express complex knowledge. However, modelling discretionality to act and other vague concepts such as ambiguity cannot be expressed in top-down execution models based on Prolog, and in (...) bottom-up execution models based on ASP the justifications are incomplete and/or not scalable. We propose to use s(CASP), a top-down execution model for predicate ASP, to model vague concepts following a set of patterns. We have implemented a framework, called s(LAW), to model, reason, and justify the applicable legislation and validate it by translating (and benchmarking) a representative use case, the criteria for the admission of students in the “Comunidad de Madrid”. Recommending the identity of bidders in public procurement auctions has a significant impact in many areas of public procurement, but it has not yet been studied in depth. A bidders recommender would be a very beneficial tool because a supplier can search appropriate tenders and, vice versa, a public procurement agency can discover automatically unknown companies which are suitable for its tender. This paper develops a pioneering algorithm to recommend potential bidders using a machine learning method, particularly a random forest (...) classifier. The bidders recommender is described theoretically, so it can be implemented or adapted to any particular situation. It has been successfully validated with a case study: an actual Spanish tender dataset which has 102,087 tenders from 2014 to 2020 and a company dataset which has 1,353,213 Spanish companies. Quantitative, graphical, and statistical descriptions of both datasets are presented. The results of the case study were satisfactory: the winning bidding company is within the recommended companies group, from 24% to 38% of the tenders, according to different test conditions and scenarios. ObjectiveCOVID-19 caused a complete stop in non-professional sports. The use of face masks for team sports is not a widely used measure in non-professional sports. The study aimed to evaluate the perception about using the mask and the adaptation difficulties related to training and competition in team sports following the FISICOVID-DXTGALEGO protocol.MethodsSeven hundred eighty-seven handball players from the Galician Handball Federation were followed during their return to participation after months of confinement through an electronic questionnaire of perception and experience on (...) the use of a mask.ResultsThere is an excellent adaptation to the mask in training and competition with medium and high correlations. The 86,41% of players reported an adaptation to the mask in 3 weeks with a three times a week training frequency. The negative opinion on the mask was drastically reduced after use. The 80,44% of players considered the use of a mask as an essential measure to resume competitions.ConclusionsIt is very feasible to adapt to training and compete with a mask in a short period. The use of a mask following these protocols changed previous opinions on the disadvantages of the mask during training and competition. (shrink)

The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

This study details the methodological process for creating a tool for the identification of COVID-19 potential contagion situations in sports and physical education before, during, and after practice and competition. It is a tool that implies an educational and methodological process with all the agents of the sports system. This tool identifies the large number of interactions occurring through sports action and everything that surrounds it in training, competition, and organization. The aim is to prepare contingency protocols based on an (...) exhaustive analysis, risk detection, and proposal of contingency measures trying to reduce the residual risk to a minimum. In the second part, the results of the implementation of this tool in the sports system of Galicia (Spain) are shown. The technicians have changed their perceptions about the coronavirus transmission in sports. They highlight the problem for returning to sports participation for athletes under 18 years in the pandemic context. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Joaquín M. Fuster is an eminent cognitive neuroscientist whose research over the last five decades has made fundamental contributions to our understanding of the neural structures underlying cognition and behaviour. This book provides his view on the eternal question of whether we have free will. Based on his seminal work on the functions of the prefrontal cortex in decision-making, planning, creativity, working memory, and language, Professor Fuster argues that the liberty or freedom to choose between alternatives is a function (...) of the cerebral cortex, under prefrontal control, in its reciprocal interaction with the environment. La primera parte de este artículo expone la interpretación praxeológica del concepto noológico de “acto”. En la segunda, se muestra la crítica que Antonio González Fernández hace de esta. Su objeción consiste en que los actos no pueden ser considerados cosas reales, sino solo el surgir de estas. A partir de dicha observación a la noología, González Fernández no solo da surgimiento a su praxeología (también conocida como hiparqueología), sino que su sistema filosófico comienza a ser cuestionado por no explicar (...) qué son, en el mundo de los hechos, los actos, más allá de la suposición de que ellos están ahí a pesar de ser invisibles. En la tercera y última sección se presentan algunas hipótesis para procurar solucionar ciertas objeciones al concepto praxeológico de “acto”, tales como el anteriormente mencionado y las aparentes circularidades y posibles contradicciones que hay al interior del sistema praxeológico. This chapter is a discussion of Class and Resemblance Nominalism. According to the traditional versions of these theories, properties are classes of particulars. Thus, the property of being red is the class of red particulars, and the property of being square is the class of square particulars. Several objections have been advanced against these theories, and one of the most powerful of such objections is the so-called Coextension Difficulty, according to which Class and Resemblance Nominalism have to wrongly identify distinct (...) but coextensive properties. After discussing the nature of Class and Resemblance Nominalism, some problems of these theories and how they can be deal with, the superiority of Class and Resemblance Nominalism over other theories of properties and the superiority of Resemblance Nominalism over Class Nominalism, I concentrate on the Coextension Difficulty. With respect to this I argue that Class and Resemblance Nominalism can be developed in such a way that they admit properties without identifying them with classes, and this allows them to avoid the Coextension Difficulty, since such versions of these theories are not forced to wrongly identify distinct but coextensive properties. Thus the Coextension Difficulty is not a lethal problem for Class and Resemblance Nominalism. (shrink)

In this paper I argue, contra Fraser MacBride, that conceptual analysis, and in particular the distinction between numerical and qualitative identity, can solve the Problem of Universals, whether understood as the One over Many or the as the Many over One. In this paper I show why the solutions needed to solve either version of the problem must be in terms of truthmakers, and that the distinction between numerical and qualitative identity is not sufficient to solve them.

En "Paraconsistencia y fundamentación de las matemáticas" se reformula un aspecto del programa formalista de Hilbert, problema clásico dentro del panorama de la filosofía de las matemáticas. Lo anterior se hace desde un enfoque no clásico de la lógica, particularmente desde LP de Priest. Finalizando el articulo se rescatan las virtudes de la reformulación de este problema clásico y se evalúa hasta qué punto puede ser posible hablar del programa formalista desde la luz de la aritmética inconsistente de Priest.

Traducción anotada de la más conocida de las obras de Avempace. En ella, el filósofo zaragozano plantea un estado ideal y utópico en el que todo debería estar regido por la verdad, la virtud y el amor entre los hombres. «El régimen del solitario» debe ser la imagen del régimen político del Estado perfecto, del Estado modelo. En esta obra aparece por primera vez como modelo el sabio solitario, al que invita a consagrarse a la sabiduría, a la virtud y (...) a la pura contemplación de la verdad, y que será el precedente de los robinsones europeos que surjan más tarde. La obra, muy difundida y citada en la Edad Media y el Renacimiento, resultaba en la actualidad poco accesible. Esta edición recoge la primera traducción, completamente actualizada, a la lengua europea. En ella se han tenido en cuenta las variantes de los manuscritos y las últimas investigaciones de los arabistas en torno al texto. La traducción se acompaña de notas y bibliografía exhaustiva y está precedida por una introducción amplia y detallada sobre la vida y el pensamiento científico y filosófico de Avempace. «El régimen del solitario» representa una de las obras clásicas de nuestra literatura. In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. Dazu muss man jedoch vorher den Grundzug des kritischen Unterschieds zwischen Kant und der leibniz-wolffschen Philosophie durch eine Diskussion über die Bedeutung des Begriffs des Transzendentalen erläutern. This book deals with the topic that has been understudied of what Bioethics of Displacement is and what are their implications, subverting the anthropocentric moral view for the resulting loving, knowing and experiencing from the displaced ones, those who have lost their center and offering a case study from the Salvadorian humanitarian crises that will shed a new light on how political decision-making works.

Sophists were active participants in ancient discussions about being or what-is at the most general level. This chapter discusses the contributions of Gorgias, Protagoras, Xeniades, and Lycophron in the context of the Eleatic philosophers Parmenides, Zeno, and Melissus. All of these figures share a serious commitment to ontological inquiry as well as a concern with the problems that arise when discussing being or what-is. They also share an approach to these problems that is at times paradoxical and self-undermining. -/- The (...) chapter begins with a brief discussion of Parmenides’ poem, a work that serves as an important backdrop for later ontology. It then covers Gorgias’ On Not-Being, a response to the Eleatics and a unique contribution in its own right. Gorgias’ work is then compared with that of Zeno and Melissus. Finally, the more limited evidence we have of Protagoras, Xeniades, and Lycophron’s ontological theorizing is discussed. (shrink)

This paper discusses two conceptions of the Filipino expression bahala na. The first implies a fatalistic attitude, while the second implies an open-minded attitude toward an uncertain future. We explore how these two conceptions may be used to frame and address the familiar philosophical puzzle about the compatibility of divine omniscience and human free will.

Whether Nietzsche’s genealogical critique of morality is best understood as an internal or as an external critique remains a matter of controversy. On the internalist interpretation (Ridley, Owen, Merrick ), the genealogical enterprise takes as its starting point the perspective being criticized, gradually revealing it to be untenable ‘from within.’ On the externalist interpretation (Leiter, and arguably Geuss, Williams, and Janaway ), this constraint is lifted; the starting point of the critique need not be the perspective being criticized, but may (...) be that of someone who already suspects the latter to be untenable. According to a common objection to ‘external critique’ interpretations, the limited-scope objection, since an external critique to a value-system could only work on an audience whose members were predisposed to abandon that system of values, ‘external critique’ interpretations impose a severe limitation on the transformative potential of Nietzsche’s project. ‘Internal critique’ interpretations, by contrast, can seem hard to reconcile with the polemical character of On the Genealogy of Morality (which lends the book its subtitle, Eine Streitschrift) and with Nietzsche’s frequent remarks to the effect his works were addressing a particular, ‘higher,’ kind of individual. -/- The overarching goal in this paper is to call into question the usefulness of the ‘internal-external’ or ‘immanent-transcendent’ dichotomy for understanding Nietzsche’s genealogical critique. I argue that the apparent usefulness of the distinction between external and internal critiques when approaching Nietzsche’s works rests on the assumption that any critique of values must itself be grounded on values that function as evaluative-critical standards. If the assumption is right, then one of two things, either the values that are deployed as standards coincide with those that are the target of critique, in which case the critique is internal, or they are not (etc.). Thus the assumption is liable to render us forgetful of a third possibility, that of a critical strategy that does not work by deploying (internal or external) values as standards of critical assessment, but by revealing something about the nature of value, and more precisely about the origin of any individual’s commitments to their values. -/- On the view that I defend, one of the crucial steps of Nietzsche’s genealogical method is to bring his reader to realize that any individual’s commitment to their values is expressive of and rooted in their commitment to preserve their way of life. Realizing this does not require that the reader abandon their own values. But it does require that they acknowledge that were they committed to a relevantly different way of life, they would subscribe to different values. And this, in turn, suffices to bring about a transformation in their understanding of and relationship to those commitments through the further realization that it is ultimately always up to them to undertake the project of taking distance from and ‘re-evaluating’ those values. Los distintos intentos por aclarar el concepto de justificación epistémica han dado lugar a los más intrincados debates en la epistemología analítica contemporánea. Da cuenta de ello la controversia entre el internismo y el externismo de la justificación, y las discusiones que han surgido allí entre el fiabilismo y la epistemología de la virtud. Estas disputas han tomado un nuevo aire tras el surgimiento de la tesis de la mente extendida propuesta por Clark y Chalmers (1998), que sugiere la posibilidad (...) de conocimiento extendido más allá de la mente o el cerebro individual del sujeto. El objetivo de este capítulo es mostrar y evaluar cómo un debate que en su origen fue epistemológico ha recibido influencia de una tesis metafísica, proveniente de la filosofía de la mente. En la primera parte de este capítulo identificaremos las principales corrientes que surgieron en el marco del debate sobre el internismo y el externismo de la justificación, esto es, grosso modo, el debate acerca de si la justificación de una creencia debe estar al alcance del sujeto (internismo) o si esa justificación se determina independientemente de tal alcance (externismo). Seguidamente, abordaremos este debate desde el punto de vista del fiabilismo y la epistemología de la virtud, y finalmente presentaremos las tesis de la mente extendida y la cognición distribuida para mostrar cómo estas tesis pueden ser influyentes en las discusiones epistemológicas entre posturas internistas y externistas. La «démythologisation» est une herméneutique philosophique forgée par Hans Jonas au début de son itinéraire intellectuel, afin d'interpréter existentiellement les récits mythologiques ainsi que les textes théologiques et philosophiques de l’Antiquité tardive. Il s’agissait d’abord d’une méthodologie d’objectivation et subjectivation pour comprendre l’expérience existentielle de l’homme gnostique face à la divinité et l’être dans le monde. Dans la suite, Jonas a développé l’herméneutique de la démythologisation par l’objectivation et la subjectivation par rapport aux textes néotestamentaires. Le mot démythologisation (Entmythologisierung) est (...) utilisé par lui pour la première fois en 1930 dans une étude philosophique, «Sur la structure herméneutique du dogme», pour comprendre le problème existentiel de la liberté chrétienne. Quelques années plus tard, il a développé une phénoménologie herméneutique, également par l’objectivation et la subjectivation, afin de comprendre l’être vivant et la particularité de l’homme dans la nature. Entre-temps, Hans Jonas a aussi utilisé l’herméneutique de la démythologisation par l’objectivation et la subjectivation pour critiquer la philosophie de Martin Heidegger et la théologie de Rudolf Bultmann dans plusieurs articles philosophiques par rapport au gnosticisme, à la théologie et à la démythologisation bultmannienne, ainsi que pour rédiger Le Concept de Dieu après Auschwitz. Sufficientarianism is a prominent approach to distributive justice in political philosophy and in policy analyses. However, it is virtually absent from the formal normative economics literature. We analyze sufficientarianism axiomatically in the context of the allocation of 0–1 normalized well-being in society. We present three characterizations of the core sufficientarian criterion, which counts the number of agents who attain a “good enough” level of well-being. The main characterization captures the “hybrid” nature of the criterion, which embodies at the same time (...) a threshold around which the worst off in society is prioritized, and an indifference to equality in other regions. The other two characterizations relate sufficientarianism, respectively, to a liberal principle of noninterference and to a classic neutrality property. (shrink)

Background and objectives: Definitions of medical futility, offered by healthcare professionals, bioethicists and other experts, have been rigorously debated by many investigators, but the perceptions of patients of futility have been explored only by a few. Patients were allowed to discuss their concerns about end-of-life care, so that their ideas about treatment futility or utility could be extrapolated by us.Methods: In this cross-sectional study, in-depth, semistructured interviews were conducted with 30 elderly people who were receiving outpatient care in a large, (...) urban Veterans Affairs medical centre in the US. Each of their healthcare providers was also interviewed. Participants were asked to consider four terms commonly used in advance directive forms and to discuss what these terms meant to them. Audiotapes of the open-ended interviews were transcribed and responses were coded and categorised by constant comparison, a commonly used qualitative method.Results: The following four factors were taken into account by the participants when discussing end-of-life interventions and outcomes: expected quality of life; emotional and financial costs of treatment; likelihood of treatment success; and expected effect on longevity.Conclusions: Although the terms “utility” or “futility” were not generally used by the participants, segments of speech indicating their perceptions of these terms were identified. Treatment was not always discussed in the same way by patients and providers, but seemed to reflect the same four concerns. Therefore, it may be fruitful for providers to focus on these concerns when discussing end-of-life treatment options with their patients. (shrink)
