Increased technological and pharmacological interventions in patient care when patient outcomes are uncertain have been linked to the escalation in moral and ethical dilemmas experienced by health care providers in acute care settings. Health care research has shown that facilities that are able to attract and retain nursing staff in a competitive environment and provide high quality care have the capacity for nurses to process and resolve moral and ethical dilemmas. This article reports on the findings of a systematic review (...) of the empirical literature (1980 — February 2007) on the effects of unresolved moral distress and poor ethical climate on nurse turnover. Articles were sought to answer the review question: Does unresolved moral distress and a poor organizational ethical climate increase nurse turnover? Nine articles met the criteria of the review process. Although the prevailing sentiment was that poor ethical climate and moral distress caused staff turnover, definitive answers to the review question remain elusive because there are limited data that confidently support this statement. In this "for and against" book, ethicists Lori Watson and Jessica Flanigan debate the criminalization of sex work. Watson argues for a sex equality approach to prostitution in which buyers are criminalized and sellers are decriminalized, known as the Nordic Model. Flanigan argues that sex work should be fully decriminalized because decriminalization ensures respect for sex workers' and clients' rights, and is more effective than alternative policies.

When subjects violate epistemic standards or norms, we sometimes judge them blameworthy rather than blameless. For instance, we might judge a subject blameworthy for dogmatically continuing to believe a claim even after receiving evidence which undermines it. Indeed, the idea that one may be blameworthy for belief is appealed to throughout the contemporary epistemic literature. In some cases, a subject seems blameworthy for believing as she does even though it seems prima facie implausible that she is morally blameworthy or professionally (...) blameworthy. Such cases raise the question of whether one can be blameworthy for a belief in a specifically epistemic sense rather than in some already recognised sense, such as being morally or professionally blameworthy. A number of authors have recently argued that there is a moral or social sense in which one ought to conform one’s beliefs to the evidence. In this paper, I argue that even while accepting that there are moral and social norms governing belief, there are cases in which a subject is blameworthy for a belief but isn’t plausibly morally or socially blameworthy. If this latter view is correct, then we may need to develop a new account of blame which can be applied to beliefs which are not morally or socially blameworthy. (shrink)

Public officials should compensate the victims of wrongful conviction and enforcement. The same considerations in favor of compensating people for wrongful conviction and enforcement in other cases support officials’ payment of reparations to the victims of unjust enforcement practices related to the drug war. First, we defend the claim that people who are convicted and incarcerated because of an unjust law are wrongfully convicted. Although their convictions do not currently qualify as wrongful convictions in the legal sense, we argue that (...) the same reasons for legally recognizing other wrongful convictions support conceiving of these cases as wrongful convictions. If so, then people who suffered wrongful convictions associated with unjust laws, like others who were wrongfully convicted, are entitled to compensation and reparation. We then argue that America’s drug laws are unjust laws. Therefore, people who were convicted of nonviolent drug offenses are entitled to compensation. (shrink)

Since antiquity, philosophers and engineers have tried to take life’s measure by reproducing it. Aiming to reenact Creation, at least in part, these experimenters have hoped to understand the links between body and spirit, matter and mind, mechanism and consciousness. Both the special sciences and ordinary experience suggest that there are metaphysically emergent entities and features: macroscopic goings-on (including mountains, trees, humans, and sculptures, and their characteristic properties) which depend on, yet are distinct from and distinctively efficacious with respect to, lower-level physical configurations and features. These appearances give rise to two key questions. First, what is metaphysical emergence, more precisely? Second, is there any metaphysical emergence, in principle and moreover in fact? Metaphysical Emergence provides clear and systematic answers to (...) these questions. Wilson argues that there are two, and only two, forms of metaphysical emergence of the sort seemingly at issue in the target cases: 'Weak' emergence, whereby a dependent feature has a proper subset of the powers of the feature upon it depends, and 'Strong' emergence, whereby a dependent feature has a power not had by the feature upon which it depends. Weak emergence unifies and illuminates seemingly diverse accounts of non-reductive physicalism; Strong emergence does the same as regards seemingly diverse anti-physicalist views positing fundamental novelty at higher levels of compositional complexity. After defending the in-principle viability of each form of emergence, Wilson considers whether complex systems, ordinary objects, consciousness, and free will are actually metaphysically emergent. An approach to explaining the nature and source of logic and its laws with a rich historical tradition takes the laws of logic to be laws of thought. This view seems intuitively compelling, after all, logic seems to be intimately related with how we think. But how exactly should we understand it? And what arguments can we give in favour? I will propose one line of argument for the claim that the laws of logic are laws of thought. I will (...) motivate the claim that there is a certain phenomenon, namely, that there are logical principles which are immune to rational doubt. I will then give an argument to the best explanation; I will argue that the best explanation of this phenomenon is to take the laws of logic to be constitutive-normative laws of thought. The proposal, and some responses to potential objections, will have a notably Kantian flavour. (shrink)

Technologies to rapidly alert people when they have been in contact with someone carrying the coronavirus SARS-CoV-2 are part of a strategy to bring the pandemic under control. Currently, at least 47 contact-tracing apps are available globally. They are already in use in Australia, South Korea and Singapore, for instance. And many other governments are testing or considering them. Here we set out 16 questions to assess whether — and to what extent — a contact-tracing app is ethically justifiable.

Vetter's Potentiality is an exposition and development of a new account of possibility and necessity, given in terms of potentialities. In this critical notice, I give an outline of some of the key claims of the book. I then raise some issues for the extent to which Vetter's view can accommodate genuine de re modalities, especially those of possible existence and non-existence.

In 'Lying and Insincerity', Andreas Stokke argues for the superiority of the Stalnakerian account of lying on the basis of its ability to accommodate the intuition that bald-faced lies are genuine lies. In this paper I question this and other predictions of the Stalnakerian account, arguing that they hinge crucially on how we sharpen our understanding of two technical terms: assertion and official common ground. I survey a number of potential precisifications, arguing that none provide a clear and non-circular metric (...) for verifying the predictions at issue. Because the options I consider are not exhaustive, it is possible for Stalnakerian theorists to provide a robust metric for testing the theory in controversial cases. My aim is to put pressure on them to do so, and to show that—until then—the Stalnakerian approach has no clear advantage over the Gricean approach. (shrink)

Als lesender Jäger und Sammler durchforstete Benjamin Texte von Goethe, Marx, Kafka, Freud und vielen weiteren Autoren. Angesichts der Heterogenität seiner Quellen ist erstaunlich, dass sich in der Art seiner Lektüre methodische Eigenheiten wiederholen. Burkhardt Lindner hat diesen Zugriff auf andere Autoren als Entwendung beschrieben, mit der Benjamin "den fremden Text sich anverwandelt (...) oder abstößt und damit in die eigenen Denkerfahrungen einsenkt". Der Band erkundet verschiedene Dimensionen dieses Verfahrens und schärft den Begriff der Entwendung durch Einzelanalysen. So werden Denk- und Schreibweisen sichtbar, die bislang nicht als ein von Benjamin werkübergreifend angewendetes Verfahren aufgearbeitet wurden. The volume investigates the various angles of this practice, sharpens the notion of "Entwendung" by means of single case studies. Many if not all evidential languages have a mirative evidential: an indirect evidential that can, in some contexts, mark mirativity (the expression of speaker surprise) instead of indirect evidence. We address several questions posed by this systematic polysemy: What is the affinity between indirect evidence and speaker surprise? What conditions the two interpretations? And how do mirative evidentials relate to other mirative markers? We propose a unified analysis of mirative evidentials where indirect evidentiality and mirativity involve a common epistemic component. (...) The idea that one can blamelessly violate a norm is central to ethics and epistemology. The paper examines the prospects for an account of blameless norm violation applicable both to norms governing action and norms governing belief. In doing so, I remain neutral on just what are the norms governing action and belief. I examine three leading suggestions for understanding blameless violation of a norm which is not overridden by another norm: doxastic accounts; epistemic accounts; and appeal to expected value. (...) We see that all of these accounts face problems when understood as accounts of blameless norm violation applicable to both belief and action. This leaves a variety of options including seeking an alternative account of blameless norm violation common to belief and action; concluding that we cannot determine the correct account of blameless norm violation independently of what are the norms of belief; and abandoning the project of finding a common account of blameless norm violation common to ethics and epistemology. Self-control is integral to successful human agency. Without it we cannot extend our agency across time and secure central social, moral, and personal goods. But self-control is not a unitary capacity. In the first part of this paper we provide a taxonomy of self-control and trace its connections to agency and the self. In part two, we turn our attention to the external conditions that support successful agency and the exercise of self-control. We argue that what we call moral security (...) is a critical foundation for agency. Parts three and four explore what happens to agency when moral security is lacking, as in the case of those subject to racism, and those living in poverty. The disadvantages suffered by those who are poor, in a racial minority or other oppressed group, or suffering mental illness or addiction, are often attributed to a lack of individual self-control or personal responsibility. In particular, members of these groups are often seen as irresponsibly focused on short-term pleasures over long-term good, a view underwritten by particular psychological theories of self-control. We explore how narratives about racism and poverty undermine moral security, and limit and distort the possibility of synchronic and diachronic self-control. Where moral security is undermined, the connection between self-control and diachronic goods often fails to obtain and agency contracts accordingly. We close with some preliminary reflections on the implications for responsibility. (shrink)

According to received wisdom, Kant takes the laws of logic to be normative laws of thought. This has been challenged by Tolley (2006). In this paper, I defend the received wisdom, but with an important modification: Kant's logical laws are constitutive norms for thought. The laws of logic do tell us what thinking is, not because all thoughts are in conformity with logical laws, but because all thoughts are, by nature, subject to the standard of logic.

This volume is about the notion of 'defeat' in philosophy. The idea is that someone who has some knowledge, or a justified belief, can lose this knowledge or justified belief if they acquire a 'defeater' - evidence that undermines it. The contributors examine the role of defeat not just in epistemology but in practical reasoning and ethics.

Typically, fair machine learning research focuses on a single decision maker and assumes that the underlying population is stationary. However, many of the critical domains motivating this work are characterized by competitive marketplaces with many decision makers. Realistically, we might expect only a subset of them to adopt any non-compulsory fairness-conscious policy, a situation that political philosophers call partial compliance. This possibility raises important questions: how does partial compliance and the consequent strategic behavior of decision subjects affect the allocation outcomes? (...) If k% of employers were to voluntarily adopt a fairness-promoting intervention, should we expect k% progress (in aggregate) towards the benefits of universal adoption, or will the dynamics of partial compliance wash out the hoped-for benefits? How might adopting a global (versus local) perspective impact the conclusions of an auditor? In this paper, we propose a simple model of an employment market, leveraging simulation as a tool to explore the impact of both interaction effects and incentive effects on outcomes and auditing metrics. Our key findings are that at equilibrium: (1) partial compliance by k% of employers can result in far less than proportional (k%) progress towards the full compliance outcomes; (2) the gap is more severe when fair employers match global (vs local) statistics; (3) choices of local vs global statistics can paint dramatically different pictures of the performance vis-a-vis fairness desiderata of compliant versus non-compliant employers; (4) partial compliance based on local parity measures can induce extreme segregation. Finally, we discuss implications for auditors and insights concerning the design of regulatory frameworks. (shrink)

I problematize Grounding-based formulations of physicalism. More specifically, I argue, first, that motivations for adopting a Grounding-based formulation of physicalism are unsound; second, that a Grounding-based formulation lacks illuminating content, and that attempts to imbue Grounding with content by taking it to be a strict partial order are unuseful and problematic ; third, that conceptions of Grounding as constitutively connected to metaphysical explanation conflate metaphysics and epistemology, are ultimately either circular or self-undermining, and controversially assume that physical dependence is incompatible (...) with explanatory gaps; fourth, that in order to appropriately distinguish physicalism from strong emergentism, a Grounding-based formulation must introduce one and likely two primitives in addition to Grounding; and fifth, that understanding physical dependence in terms of Grounding gives rise to ‘spandrel’ questions, including, e.g., “What Grounds Grounding?”, which arise only due to the overly abstract nature of Grounding. Proponents of evolutionary debunking arguments aim to show that certain genealogical explanations of our moral faculties, if true, undermine our claim to moral knowledge. Criticisms of these arguments generally take the debunker’s genealogical explanation for granted. The task of the anti-debunker is thought to be that of reconciling the truth of this hypothesis with moral knowledge. In this paper, I shift the critical focus instead to the debunker’s empirical hypothesis and argue that the skeptical strength of an evolutionary debunking argument (...) is dependent upon the evidence for that hypothesis—evidence which, upon further inspection, proves far from compelling. Following that, however, I suggest that the same considerations which spell trouble for the empirical hypotheses of traditional debunking arguments can also be taken to give rise to an alternative—and better supported—style of debunking argument. This chapter explores the prospects for justifying the somewhat widespread, somewhat firmly held sense that there is some moral advantage to untruthfully implicating over lying. I call this the "Difference Intuition." I define lying in terms of asserting, but remain open about what precise definition best captures our ordinary notion. I define implicating as one way of meaning something without asserting it. I narrow down the kind of untruthful implicating that should be compared with lying for purposes of evaluating whether (...) there is a moral difference between them. Just as lying requires a robust form of assertion, so the kind of untruthful implicating to be compared with lying requires a robust form of implicating. Next, I set out various ways of sharpening the Difference Intuition and survey a range of approaches to justifying one class of sharpenings. I finish by sketching an approach to justifying an alternative sharpening of the Difference Intuition, which is inspired by John Stuart Mill's discussion of lying. (shrink)

In this paper, I take up the question of how epistemic injustices can be resisted. Miranda Fricker, who introduced the term to describe situations in which subjects are wronged as knowers, has initially advocated an individualist, virtue-based account to counteract epistemic injustices. Epistemic injustices, however, do not merely operate at an individual level but are rooted in social practices and structures. Arguably therefore, individually virtuous epistemic conduct is not enough to uproot patterns of epistemic injustice. Institutional change and collective actions (...) are needed. Recently, Elizabeth Anderson has proposed such a structural remedy. Diagnosing patterns of social segregation that track existing inequalities to be the principal structural cause of epistemic injustices, Anderson suggests that integration is required to achieve epistemic justice. Pace Anderson, I argue that certain segregated spaces —namely spaces provided by subaltern counter-publics— can function and, in fact, have historically functioned as important sites of epistemic resistance. In particular, I argue that even if integration is sharply distinguished from assimilation, Anderson’s proposal insufficiently acknowledges the subversive potential of those spaces, in which shielded from the gaze of the oppressors, marginally situated subjects can assemble and question hegemonic epistemic practices. To what degree has biology influenced and shaped the development of moral systems? One way to determine the extent to which human moral systems might be the product of natural selection is to explore behaviour in other species that is analogous and perhaps homologous to our own. Many non-human primates, for example, have similar methods to humans for resolving, managing, and preventing conflicts of interests within their groups. Such methods, which include reciprocity and food sharing, reconciliation, consolation, conflict intervention, and (...) mediation, are the very building blocks of moral systems in that they are based on and facilitate cohesion among individuals and reflect a concerted effort by community members to find shared solutions to social conflict. Furthermore, these methods of resource distribution and conflict resolution often require or make use of capacities for empathy, sympathy, and sometimes even community concern. Non-human primates in societies in which such mechanisms are present may not be exactly moral beings, but they do show signs of a sense of social regularity that -- just like the norms and rules underlying human moral conduct -- promotes a mutually satisfactory modus vivendi.
