Background Informed consent is often cited as the “cornerstone” of research ethics. Its intent is that participants enter research voluntarily, with an understanding of what their participation entails. Despite agreement on the necessity to obtain informed consent in research, opinions vary on the threshold of disclosure necessary and the best method to obtain consent. We aimed to investigate Australian researchers’ views on, and their experiences with, obtaining informed consent. Methods Semi-structured interviews were conducted with 23 researchers from NSW institutions, working (...) in various fields of research. Interviews were analysed and coded to identify themes. Results Researchers reported that consent involved information disclosure, understanding and a voluntary decision. They emphasised the variability of consent interactions, which were dependent on potential participants’ abilities and interests, study complexity and context. All researchers reported providing written information to potential participants, yet questioned the readability and utility of this information. The majority reported using signed consent forms to ‘operationalise’ consent and reported little awareness of, and lack of support in implementing more dynamic informed consent procedures, such as verbal informed consent, that was fit for the purposes of their studies. Views on Human Research Ethics Committees varied. Some reported inconsistent, arduous inputs on the information form and consent process. Others expressed reliance on HRECs for guidance, viewing them as institutional safeguards. Conclusions This study highlights the importance of transparent relationships, both between researchers and participants, and between researchers and HRECs. Where the relationship with study participants was reported as more robust, researchers felt that they were better able to ensure participants made better, more informed decisions. Where the relationship with HRECs was reported as more robust, researchers were more likely to view them as institutional safeguards, rather than as bureaucratic hindrances. Conscientious and mindful researchers are paramount to ensuring the procedure accommodates individual requirements. This study advocates that when designing ethical informed consent practices, researchers should be integrated as autonomous players with a positive input on the process, rather than, in the worst case, predatory recruiters to be curtailed by information forms and oversight. Arguably, there is no better place to acquire the civic capacities described in the previous chapter than in the theology or religious studies classroom. As individual religion courses emphasize different aspects of civic engagement, they serve a liberal arts education historically committed to producing good citizens; as these different approaches are themselves brought into shared conversation, religion provides a distinctive site for cultivating capacities of intellectual complexity, social framing, empathetic accountability, and motivated action, and thus for the broader civic project. This chapter illustrates how some of the aspects of teaching and learning in religion can advance the objectives described in chapter 1, attentive both to the function of these pedagogical methods to the study of religion and their potential to enhance education for civic engagement across the curriculum. Under the Canadian labour laws that govern workplace safety, wage, and other work conditions, ‘family’ workers are not covered by the law under special rules for agriculture. Among other legal exclusions, the family farm exclusion contributes to a dearth of basic work, health, and safety standards in the sector, despite the commercialization and industrialization of family farming activities. Through a focus on Alberta, Canada—where farm labour rules have only applied to agriculture since 2016—this article explores the family exclusion in relation (...) to family farming experiences with work and risk, based on interviews with farm operators, their family members, and farm employees in Alberta. While some participants continued to press for exemptions for farms from labour rules under the rationale that there is intrinsic safety within families, the findings also reveal how other participants have begun questioning this rationale, despite their overall support for the family farm exemption in Alberta. Using the lens of legal geography and critical perspectives on the family, we argue that the family is a significant but under-examined dynamic in the legal regimes governing farm labour and agricultural safety and health. Together, the law and dominant narratives about family farming treat farm operations as hyper-private domains, where operators have disproportionate power to dispose of their own work and the work of others how they wish. These legal geographies of hyper-privacy contribute to the indecent work conditions that characterize farm labour systems in Alberta and other jurisdictions. (shrink)

In contemporary discussions of the university’s public role, intellectual complexity often takes center stage. This account, however, rests on a particular understanding of civic engagement, one that views such engagement primarily in terms of constitutional rights, democratic processes, and deliberative discourse. Other understandings of public life apply a different calculus. Drawing on both traditional and liberatory models of intellectual development, the chapter suggests that teaching for civic engagement requires reflection on at least four basic capacities: intellectual complexity; recognition of social (...) location and diverse frames of reference; empathetic accountability; and motivated action. These four guiding objectives represent cumulative, mutually reinforcing capacities. Though it may be unreasonable to expect that any individual assignment could aim for all of these objectives, instructors do well to reflect on them as different aspects of a single, integrated approach to student development, attentive to the multifaceted reality of civic participation itself. From February 2020, the COVID-19 pandemic led to closures of educational institutions to reduce the spread of infectious disease. This forced the U.S. education system into a massive experiment with online education. Despite conducting online bioethics education for nearly twenty years, our bioethics program, a joint endeavor of Clarkson University and Icahn School of Medicine at Mount Sinai, was not immune to this disruption because our curriculum features intensive, one-week onsite courses. Even in the face of historic disruptions, it is (...) vital to ensure minimal interruptions to teaching and assessing students to provide effective education. This paper reviews the steps we took to successfully convert the onsite components of our curriculum to a synchronous online format, and it focuses on how we preserved instruction and assessment of practical skills that comprise these courses’ core. Managers reported that the greatest ethical challenge was fairly distributing resources across programs and services, whereas clinicians identified the effect of resource constraints on (...) patient care. Ethics committee chairpersons identified end-of-life care as the greatest ethical challenge, whereas patients identified obtaining fair, respectful, and caring treatment. Perspectives on ethical challenges varied depending on the respondent's role. Understanding these differences can help managers take practical steps to address these challenges. Much work has recently been done on Jane Addams, her writings, and the general atmosphere and thought associated with Hull House and other settlement places in American cities.1 But although we might think of Addams and her work as the center of the Hull House effort, many other women (and a few men) were involved in the efforts, and the strengths that they brought to bear on the activities in Chicago in the early part of the twentieth century need (...) to be delineated and, to some extent, given pride of place. Two women whose work was applauded by Addams at the time, but whose thought remains somewhat under investigated are Ellen Gates Starr and Julia Lathrop. The authors of this article are previous or current members of the Clinical Ethics Consultation Affairs (CECA) Committee, a standing committee of the American Society for Bioethics and Humanities (ASBH). The committee is composed of seasoned healthcare ethics consultants (HCECs), and it is charged with developing and disseminating education materials for HCECs and ethics committees. The purpose of this article is to describe the educational research and development processes behind our teaching materials, which culminated in a case studies book called (...) A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care (hereafter, the Study Guide). In this article, we also enumerate how the Study Guide could be used in teaching and learning, and we identify areas that are ripe for future work. (shrink)

Background: Managing HIV treatment is a complex multi-dimensional task because of a combination of factors such as stigma and discrimination of some populations who frequently get infected with HIV. In addition, patient-provider encounters have become increasingly multicultural, making effective communication and provision of ethically sound care a challenge. Purpose: This article explores ethical issues that health service providers in the United States and Botswana encountered in their interaction with patients in HIV care. Research design: A descriptive qualitative design was used (...) to collect data from health service providers and patients using focused group discussions. This article is based on responses from health service providers only. Participants and context: This article is based on 11 focused group discussions with a total sample of 71 service providers in seven US sites and one Botswana site. Ethical considerations: Ethical review boards at all the study sites reviewed the study protocol and approved it. Ethical review boards of the study’s coordinating centers, Rutgers University and the University of California at San Francisco, also approved it. The study participants provided a written informed consent to participate. Findings: HIV service providers encountered ethical challenges in all the four Beauchamp and Childress’ biomedical ethics of respect for patients’ autonomy, beneficence, justice, and nonmaleficence. Discussion: The finding that HIV service providers encounter ethical challenges in their interaction with patients is supported by prior studies. The ethical challenges are particularly prominent in multicultural care and resource-constrained care environments. Conclusion: Provision of HIV care is fraught with ethical challenges that tend to pose different issues depending on a given care environment. It is important that strong partnerships are developed among key stakeholders in HIV care. In addition, health service providers need to be provided with resources so they can provide quality and ethically sound care. (shrink)

This work positions queer youth suicide as deviant aperture into scandal within divine life through an ‘indecenting’ of kenotic agency located in the Incarnation itself. Refuting a heteronormative gaze that defines queer youth suicide as an expression of pathology, I present a disruptive coming out of God who redeems through scandal by posing these suicides as deaths for others. Drawing from two liberation theologians, I offer a construct of martyrdom within historical contexts of an excess of death that is capable (...) of carrying the weight of their agency within a destructive heteronormative reality. Applying Althaus-Reid’s method of ‘indecenting’ within their last deviant act, both vitiated and vindicated in this kenotic agency of God, queer youth suicide becomes a preferred vehicle of divine delight and reclamation. Although disruptive, this divine eloquence spills out everywhere, cracking open a theological praxis where no one ever falls outside of God, especially in death. (shrink)

Summary This paper notes and explores the attraction of Dugald Stewart's moral philosophy for women readers and a few women writers. Student lecture notes reveal the chronological development of his ideas, as he drew upon the works of Thomas Reid, Adam Smith, and Adam Ferguson, and responded to political events. Particular attention is paid to Stewart's comments relating to women and gender, through discussions of education, the institution of marriage, and population questions. After 1800, he shifted away from a (...) speculative conjectural history towards a philosophy of moral progress rooted in common sense philosophy and a belief in perfectibility. He taught a system of practical morality relevant to the education of children and strongly emphasised the importance of the association of ideas in childhood. For women readers, the message was contradictory in that he united an apparently conservative reinforcement of the relations of the sexes with a belief in the improvement of the condition of women through education in a modern, progressive, and commercial society. In this paper I offer an analysis, reconstruction and defense of Locke's account of personal identity. I begin with a detailed analysis of Locke's use of the term 'conscious' in its historical context. This term, which plays a central role in Locke's theory, had senses in the seventeenth century which it does not have today. In the light of this analysis, an interpretation of continuity of consciousness as the ancestral of memory is given. It is argued that this interpretation of (...) Locke's theory of personal identity does not involve an ontological commitment to immaterial substances, and Locke is defended against the historically important criticisms of Butler and Reid. In the conclusion I suggest that the account of the individuation of persons implicit in Locke's discussion of personal identity is similar to the account of contextual individuation given by Hintikka. The multifaceted work of the late Susan Leigh Star is explored through a selection of her writings and essays by friends and colleagues. Susan Leigh Star (1954–2010) was one of the most influential science studies scholars of the last several decades. In her work, Star highlighted the messy practices of discovering science, asking hard questions about the marginalizing as well as the liberating powers of science and technology. In the landmark work Sorting Things Out, Star and Geoffrey Bowker revealed the (...) social and ethical histories that are deeply embedded in classification systems. Star's most celebrated concept was the notion of boundary objects: representational forms—things or theories—that can be shared between different communities, with each holding its own understanding of the representation. Unfortunately, Leigh was unable to complete a work on the poetics of infrastructure that further developed the full range of her work. This volume collects articles by Star that set out some of her thinking on boundary objects, marginality, and infrastructure, together with essays by friends and colleagues from a range of disciplines—from philosophy of science to organization science—that testify to the wide-ranging influence of Star's work. Jane Addams had two romantic partnerships during her years as Head of Hull House, one with Ellen Gates Starr and the second with Mary Rozet Smith. This paper traces the story of these two relationships, highlighting their importance in sustaining her emotionally and examining to the extent possible the place of sexuality in both.

The science of religion, as a discipline distinct from theology emerging in the 19th century, from the beginning was closely related to the discourse on Darwinism. This article focusses on Max Müller, known as ‘The father of Comparative Religion’, who was involved in the Darwinian discourse, compared with Jane Ellen Harrison who emphasised the impact of the theory of evolution, approaching, however, the ‘scientific study of religion’ from a different viewpoint. This is the first collection of essays to evaluate John Dewey's pragmatist philosophy from a feminist perspective. The variety of feminist interpretations offered here ranges from Jane Addams's praise for his collegial efforts to resolve the problems of the inner city to contemporary comparisons of his approach with Addams's own critique of capitalism as patriarchal. In between are essays assessing Dewey's contributions to feminist theory and practice both in his lifetime and in regard to contemporary feminist approaches to education, (...) subjectivity, objectivity and truth, and social and political philosophy. At a time when feminists are questioning and developing alternatives to the scientistic value-free inquiry advocated by logical positivism, the myth of detached observation informing the epistemological turn, rationalistic ethics, and the model of an unattached, nonrelational subject, this book reminds us of Dewey's early and passionate opposition to the same assumptions and his reconstruction of philosophy as a "method of moral and political diagnoses and prognosis." It has often been remarked that Dewey's pragmatism provides a genuine alternative to the usual masculinist biases of Western philosophy, and the various essays in this book develop this claim more extensively. One antidote to moral distress is stronger moral agency—that is, an enhanced ability to act to bring about change. The Clinical Ethics Residency for Nurses, an educational program developed and run in two large northeastern academic medical centers with funding from the Health Resources and Services Administration, intended to strengthen nurses’ moral agency. Drawing on Improving Competencies in Clinical Ethics Consultation: An Education Guide, by the American Society for Bioethics and Humanities, and on the goals of the nursing profession, CERN (...) sought to change attitudes, increase knowledge, and develop skills to act on one's knowledge. One of the key insights the faculty members brought to the design of this program is that knowledge of clinical ethics is not enough to develop moral agency. In addition to lecture‐style classes, CERN employed a variety of methods based in adult learning theory, such as active application of ethics knowledge to patient scenarios in classroom discussion, simulation, and the clinical practicum. Overwhelmingly, the feedback from the participants (sixty‐seven over three years of the program) indicated that CERN achieved transformative learning. (shrink)

Some health care organizations allow physicians to withhold cardiopulmonary resuscitation from a patient, despite patient or surrogate requests that it be provided, when they believe it will be more harmful than beneficial. Such cases usually involve patients with terminal diagnoses whose medical teams argue that aggressive treatments are medically inappropriate or likely to be harmful. Although there is state-to-state variability and a considerable judicial gray area about the conditions and mechanisms for refusals to perform CPR, medical teams typically follow a (...) set of clearly defined procedures for these decisions. The procedures are based on the principle of nonmaleficence and typically include consultation with hospital ethics committees, reflecting the guidelines of relevant professional associations. Ethical debates about when CPR can and should be limited tend to rely more on discussions of theory, principles, and case studies than systematic empirical study of the situations in which such limitations are applied. Sociologists of bioethics call for empirical study, arguing that what ethicists and health professionals believe they are doing when they draft policies or invoke principles does not always mirror what is happening on the ground. In this article, we begin the task of modeling the empirical analyses sociologists call for, focusing on a cohort at Massachusetts General Hospital. We inductively analyzed ethics committee notes and medical records of nineteen patients whose surrogates did not accept the decision to withhold CPR. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Feminist Studies 41, no. 3. © 2015 by Kathryn Kein 671 Kathryn Kein Recovering Our Sense of Humor: New Directions in Feminist Humor Studies At the 2014 annual meeting of the American Studies Association (ASA), the Humor Studies Caucus held a panel titled “Female Comedians and the Critical Power of Laughter.” After listening to presentations on Gilda Radner, Lily Tomlin, and Black women comedians’ 1960s comedy albums, one audience (...) member asked the panel if the classic theories of humor—Freud’s theory of the joke, Bergson’s thoughts on laughter (all conceived of in relation to the work of men)—applied when analyzing female comedic performers. One panelist immediately responded that she found none of those theories useful to her work on female comedians, and that instead she used queer theory to aid her analysis. This exchange at ASA points to many of the questions that scholars of humor and feminism are currently facing as they work to address a dearth of scholarship dealing with women, feminism, and comedy. The nods in agreement around the room spoke to the notion that scholarship on the topic of women in comedy is not merely filling in gaps, but breaking new ground. With a few notable exceptions, scholars have been relatively silent on topics involving women and/in comedy.1 The meager 1.
