ZusammenfassungDie Odysseus-Verfügung ist als besondere Form der Patientenverfügung zumindest in der Literatur hinlänglich bekannt. Die Verwendung des Begriffs und damit sein Gegenstandsbereich sind hingegen noch immer umstritten. Zudem wird oft nicht beachtet, dass es innerhalb dieses Gegenstandsbereichs Varianten von OVs zu differenzieren gilt, die sich auch in ihrer moralischen Rechtfertigung unterscheiden. Nicht zuletzt ist die Grundstrukturstruktur dieser Rechtfertigung umstritten. Vor diesem Hintergrund plädieren wir im Folgenden zunächst für eine Eingrenzung des Begriffs, mit der argumentative und klinisch-praktische Verwirrungen vermieden werden können. (...) Anschließend betrachten wir zwei Varianten von – Zwang legitimierenden – OVs, die sich in der individuellen Kompetenz des Destinatärs unterscheiden. Schließlich zeigen wir, dass deren Rechtfertigung ungeachtet des Umstandes, dass OVs auf Wiedererlangung der Urteils- und Steuerungsfähigkeit des Patienten angelegt sind, weder in einer gemutmaßten noch gar in einer faktischen retrospektiven Billigung von Zwang durch den Patienten liegt. Die primäre Legitimationsgrundlage von OVs besteht vielmehr in der ex ante erfolgenden Autorisierung durch den Betroffenen selbst. Die hier einzuräumende Autorität wiederum basiert auf dem Recht jeder Person auf lebensplanerische Selbstbestimmung. Der Ausdruck Phänomenologie ist heute höchst vieldeutig geworden. Husserl hat seit 1905 eine immer stärkere Wendung zum Idealismus kantischer Prägung hin vollzogen, durch die er den Boden der Phänomenologie, wie er sie begründet hatte, verlassen hat. Eine ähnliche Abweichung von der ursprünglichen Idee der Phänomenologie findet sich bei vielen anderen "Phänomenologen." Die "realistische Phänomenologie", deren Vorläufer von Platon an und Klassiker von Husserl bis Schwarz in dieser ersten umfangreichen deutschsprachigen Anthologie zu Wort kommen, ist kein System, sondern eine Anwendung der (...) philosophischen Urmethoden, wie sie alle großen Philosophen tatsächlich anwandten, wenn sie ihre entscheidenden Entdeckungen machten. Mögen auch von Philosophen generell andere Methoden bewußt zugrunde gelegt werden, in dem Moment, in dem diese Einsichten gewonnen werden, liegt tatsächlich zu allen Zeiten jener letzte, fruchtbare Kontakt mit "den Sachen selbst" vor, der den Sinn der phänomenologischen Methode ausmacht, wie sie von den Meistern der realistischen Phänomenologie nur bewußter und systematischer angewandt wird als von vielen früheren Denkern. Nichts wäre darum irriger als in der phänomenologischen Betrachtungsweise eine Reduktion der Welt auf bloße "Phänomene" zu erblicken oder gar eine bloße Deskription der "Erscheinung" der Dinge. The place of chemistry in the metaphysics of science may be viewed as peripheral compared to physics and biology. However, a metaphysics of science that disregards chemistry would be incomplete and ill-informed. This Element establishes this claim by showing how key metaphysical issues are informed by drawing on chemistry. Five metaphysical topics are investigated: natural kinds, scientific realism, reduction, laws and causation. I argue that molecules may not have structure in isolation. I support this by investigating how quantum models identify structure for isolated molecules. Specifically, I distinguish between two sets of models: those that identify structure in isolation and those that do not. The former identify structure because they presuppose structural information about the target system via the Born- Oppenheimer approximation. However, it is an idealisation to assume structure in isolation because there is no empirical evidence of this. In fact, whenever (...) structure is empirically examined it is always partially determined by factors that are absent in isolation. Together with the growing empirical evidence that isolated molecules behave in non-classical ways, this shows that the quantum models that do not identify structure are more faithful representations of isolated molecules. Whether or not quantum physics can account for molecular structure is a matter of considerable controversy. Three of the problems raised in this regard are the problems of molecular structure. We argue that these problems are just special cases of the measurement problem of quantum mechanics: insofar as the measurement problem is solved, the problems of molecular structure are resolved as well. In addition, we explore one consequence of our argument: that claims about the reduction or emergence of molecular structure (...) cannot be settled independently of the choice of a particular resolution to the measurement problem. Specifically, we consider how three standard putative solutions to the measurement problem inform our under- standing of a molecule in isolation, as well as of chemistry’s relation to quantum physics. It can be tempting to think of affect as a matter of the present moment – a reaction, a feeling, an experience or engagement that unfolds right now. This paper will make the case that affect is better thought of as not only temporally extended but as saturated with temporality, especially with the past. In and through affectivity, concrete, ongoing history continues to weigh on present comportment. In order to spell this out, I sketch a Heidegger-inspired perspective. It revolves around (...) two claims. The first is that we should understand what Heidegger calls 'Befindlichkeit' (findingness) as radical situatedness. Affectivity is a matter of 'finding oneself' constellated – thrown – into the world in ways that outrun what an individual or collective might grasp and process. The second claim is that the temporal dimension, as a relatedness to the past, takes precedence in affect's situatedness. Key to affect is the way in which the past continues to hold sway over present comportment, collectively and individually. In order to articulate this perspective, it is important to overcome the idea that affect must be understood mainly in terms of feeling or experiential states of other kinds. Better suited to grasp the idea of findingness is the concept of 'disclosive posture', as proposed by Katherine Withy. I suggest that this notion should be put at the fore of a phenomenological approach to situated affectivity. (shrink)

The term "method" of realist phenomenology and philosophy can refer to three kinds of things which are being explored extensively in this work: (1) Kinds of philosophical knowledge used to return to things themselves: intellectual "vision" of necessary intelligible essences, insights into necessary states of affairs, knowledge of less than necessary essences, knowledge of existence as such, of the ego cogitans and of a concretely existing world, other persons, and the absolute being, deductive forms of reasoning, and others. (2) Ways (...) to achieve such knowledge: such as various types of distinctions, asking proper questions, correct use of analogies, and replies to objections. (3) Finally, these methods include several "tricks" and devices such as methodic doubt and epoché; these are subordinated to the other methods, and neither necessary nor universal tools of all philosophical knowledge. Eine kritische Analyse der Einwände verschiedenster alternativer Wahrheitstheorien (Evidenztheorie, Kohärenztheorie, Konsens- und Diskurstheorie, pragmatische Wahrheitstheorien, existentialistisch-heideggerianische, Jasper'sche, wittgensteinianische und andere) überwindet die Einwände gegen die klassische Korrespondenztheorie durch einen vertieften Begriff des Sachverhalts. Auch in der Verteidigung der Korrespondenztheorie durch Tarski, Popper, Albert und andere neuere Verfechter müssen diverse Mängel überwunden werden, um zu erkennen, daß sich jene schlichte Urgegebenheit der (...) The paper examines the interplays between logic and politics in the Polish School of Logic starting from 1914. The Polish School of Logic flourished between 1920 and 1939. Philosophically, it was influenced by Kazimierz Twardowski (1866–1938). For Twardowski logic is fundamental for every kind of human activity, professional and private and this means that every argument should be formulated and proceed by correct inferential rules. These rules involve semiotics, formal logic and methodology of science. The paper shows how this position (...) was shared by Twardowski’s students, including Jan Łukasiewicz, Stanisław Leśniewski, Kazimierz Ajdukiewicz and Tadeusz Kotrabiński, as well as by the next generation of logicians and philosophers and especially by Alfred Tarski. These authors considered logic, philosophy and science as completely neutral with respect to politics and ideology but they also considered logical skills as indispensable in political activities. Using an enactive approach to trail runners’ activity, this study sought to identify and characterize runners’ phenomenological gestalts, which are forms of experience that synthesize the heterogeneous sensorimotor, cognitive and emotional information that emerges in race situations. By an in-depth examination of their meaningful experiences, we were able to highlight the different typologies of interactions between bodily processes (e.g., sensations, pains), behaviors (e.g., actions, strategies) and environment (e.g., meteorological conditions, route profile). Ten non-professional runners who ran an ultra-trail running race (...) (330 kilometers, 24,000 meters of elevation gain) volunteered to participate in the study. Data were collected in two steps: (1) collection of past activity traces (i.e., race maps, field notes and self-assessment scales) and (2) enactive interviews using the past activity traces in which the runners were invited to relive their experience and describe their activity. The enactive interviews were coded using the course-of-experience methodology to identify the phenomenological gestalts that emerged from activity and scaffolded the runners’ courses of experience. The results revealed that runners typically enact three phenomenological gestalts: controlling global ease, enduring general fatigue and experiencing difficult situations, and feeling freedom in the running pace. These phenomenological gestalts were made up of specific behaviors, involvements and meaningful situated elements that portrayed various ways of achieving an ultra-endurance performance in the race situation. They also highlighted how runners enact a meaningful world by acting in relation to the fluctuations in physical sensations and environmental conditions during an ultra-trail race. Practical applications for preparation, race management and sports psychology interventions are proposed to enrich the existing recommendations. In conclusion, this approach provides new research perspectives by offering a more holistic grasp of activity in trail running through an in-depth analysis of athletes’ experience. In doing so, we may expect that runners can connect these typical gestalts to their own personal experiences and stories as trail runners in order to sustain a viable approach to their sport. We introduce a cyclic proof system for the two-way alternation-free modal μ-calculus. The system manipulates one-sided Gentzen sequents and locally deals with the backwards modalities by allowing analytic applications of the cut rule. The global effect of backwards modalities on traces is handled by making the semantics relative to a specific strategy of the opponent in the evaluation game. This allows us to augment sequents by so-called trace atoms, describing traces that the proponent can construct against the opponent’s strategy. The (...) idea for trace atoms comes from Vardi’s reduction of alternating two-way automata to deterministic one-way automata. Using the multi-focus annotations introduced earlier by Marti and Venema, we turn this trace-based system into a path-based system. We prove that our system is sound for all sequents and complete for sequents not containing trace atoms. (shrink)

Higher-order logic, with its type-theoretic apparatus known as the simple theory of types (STT), has increasingly come to be employed in theorizing about properties, relations, and states of affairs—or ‘intensional entities’ for short. This paper argues against this employment of STT and offers an alternative: ordinal type theory (OTT). Very roughly, STT and OTT can be regarded as complementary simplifications of the ‘ramified theory of types’ outlined in the Introduction to Principia Mathematica (on a realist reading). While STT, understood as (...) a theory of intensional entities, retains the Fregean division of properties and relations into a multiplicity of categories according to their adicities and ‘input types’ and discards the division of intensional entities into different ‘orders’, OTT takes the opposite approach: it retains the hierarchy of orders (though with some modifications) and discards the categorisation of properties and relations according to their adicities and input types. In contrast to STT, this latter approach avoids intensional counterparts of the Epimenides and related paradoxes. Fundamental intensional entities lie at the base of the proposed hierarchy and are also given a prominent part to play in the individuation of non-fundamental intensional entities. (shrink)

By and large, the conditional connective in three-valued logic has two different functions. First, by means of a deduction theorem, it can express a specific relation of logical consequence in the logical language itself. Second, it can represent natural language structures such as "if/then'' or "implies''. This chapter surveys both approaches, shows why none of them will typically end up with a three-valued material conditional, and elaborates on connections to probabilistic reasoning.

International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts to discussion twenty-five (...) considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

Debates on the moral status of human embryos have been highly and continuously controversial. For many, these controversies have turned into a fruitless scholastical endeavor. However, recent developments and insights in cellular biology have cast further doubt on one of the core points of dissent: the argument from potentiality. In this article we want to show in a nonscholastical way why this argument cannot possibly survive. Getting once more into the intricacies of status debates is a must in our eyes. (...) In everyday situations, and particularly in some sport and working contexts, humans face an inherently unpredictable and uncertain environment. All sorts of unpredictable and unexpected things happen but typically people are able to skillfully adapt. In this paper, we address two key questions in cognitive science. First, how is an agent able to bring its previously learned skill to bear on a novel situation? Second, how can an agent be both sensitive to the particularity of a given situation, while remaining (...) flexibly poised for many other possibilities for action? We will argue that both the sensitivity to novel situations and the sensitivity to a multiplicity of action possibilities are enabled by the property of skilled agency that we will call metastable attunement. We characterize a skilled agent’s flexible interactions with a dynamically changing environment in terms of metastable dynamics in agent-environment systems. What we find in metastability is the realization of two competing tendencies: the tendency of the agent to express their intrinsic dynamics and the tendency to search for new possibilities. Metastably attuned agents are ready to engage with a multiplicity of affordances, allowing for a balance between stability and flexibility. On the one hand, agents are able to exploit affordances they are attuned to, while at the same time being ready to flexibly explore for other affordances. Metastable attunement allows agents to smoothly transition between these possible configurations so as to adapt their behaviour to what the particular situation requires. We go on to describe the role metastability plays in learning of new skills, and in skilful behaviour more generally. Finally, drawing upon work in art, architecture and sports science, we develop a number of perspectives on how to investigate metastable attunement in real life situations. (shrink)

Evidence-Based Medicine has little consideration for mechanisms and philosophers of science and medicine have recently made pleas to increase the place of mechanisms in the medical evidence hierarchy. However, in this debate the notions of mechanisms seem to be limited to 'mechanistic processes' and 'complex-systems mechanisms,' understood as 'componential causal systems'. I believe that this will not do full justice to how mechanisms are used in biological, psychological and social sciences and, consequently, in a more biopsychosocial approach to medicine. Here, (...) I propose, following (Kuorikoski, 2009), to pay more attention to 'abstract forms of interaction' mechanisms. The present work scrutinized review articles on depression and medically unexplained pain, which are considered to be of multifactorial pathogenesis, for their use of mechanisms. In review articles on these disorders there seemed to be a range of uses between more 'abstract forms of interaction' and 'componential causal system' mechanisms. I therefore propose to expand the notions of mechanisms considered in medicine to include that of more 'abstract forms of interaction' to better explain and manage biopsychosocial disorders. A number of well-developed theories shed light on the question, under what circumstances our beliefs enjoy epistemic justification. Yet, comparatively little is known about epistemic defeat--when new information causes the loss of epistemic justification. This book proposes and defends a detailed account of epistemic defeaters. The main kinds of defeaters are analyzed in detail and integrated into a general framework that aims to explain how beliefs lose justification. It is argued that defeaters introduce incompatibilities into a noetic system and thereby (...) prompt a structured re-evaluation process that makes a justified reinstatement of the defeated belief impossible. The account is then applied to the topic of disagreement, where it is used in an argument for conciliationism, as well as a new explanation for higher-order defeat. Throughout the book, the notion of defeat is the center of attention, while a number of new issues are discussed at the intersections of defeat and justification. Specifically, new problems are raised for broadly internalist accounts of defeat, a fully descriptive reliabilist account of defeat is provided, and the case for normative defeat is revisited. Kearns (2021) reconstructs Berkeley’s (1713) Master Argument as a formally valid argument against the Materialist Thesis, with the key premise the Distinct Conceivability Thesis, namely the thesis that truths about sensible objects having or lacking thinkable qualities are (distinctly) conceivable and as its conclusion that all sensible objects are conceived. It will be shown that Distinct Conceivability Thesis entails the Reduction Thesis, which states that de dicto propositional (ordinary or distinct) conceivability reduces to de re propositional (ordinary or distinct) conceivability. While Kearns (2021) set out to avoid the confusion of a de re claim with a de dicto claim, which Prior (1955) accused Berkeley of, Kearns can be accused of making a similar conceptual confusion. G. A. Cohen’s Rescuing Justice and Equality proposes that both concepts need rescuing from the work of John Rawls. Especially, it is concerned with Rawls’ famous second principle of justice according to which social primary goods should be distributed equally unless an unequal distribution is to the benefit of the worst off. The question is why this would ever be necessary if all parties are just. Cohen and I agree that Rawls cannot really justify inequalities on the basis given. But (...) he also thinks equality is the correct analysis of justice, though he provides no actual direct arguments for this. He does, however, provide a striking analytical argument claiming that fundamental principles of justice must be fact insensitive, and that Rawls’s view of justice violates this requirement. I argue that the requirement is itself misconceived and that principles of justice cannot possibly be fact insensitive in the sense developed by Cohen. Few philosophers share this view of Cohen’s—which I argue is due to several conceptual mistakes. With these ironed out, the contractarian view, broadly speaking, is seen to be plausible and powerful. Meanwhile Cohen appears to embrace intuitionism, a stance that cannot possibly be acceptable in social philosophy. In the end, Cohen is successful in arguing that Rawls cannot have what he wants, but neither is Cohen successful in claiming that justice is equality. (shrink)

Humanitarian aid’s psycho-therapeutic turn in the 1990s was mirrored by the increasing emotionalization and subjectivation of fund-raising campaigns. In order to grasp the depth of this interconnectedness, this article argues that in both cases what we see is the post-Fordist production paradigm at work; namely, as Hardt and Negri put it, the direct production of subjectivity and social relations. To explore this, the therapeutic and mental health approach in humanitarian aid is juxtaposed with the more general phenomenon of psychologization. This (...) allows us to see that the psychologized production of subjectivity has a problematic waste-product as it reduces the human to Homo sacer, to use Giorgi Agamben’s term. Drawing out a double matrix of a de-psychologizing psychologization connected to a politicizing de-politicization, it will further become possible to understand psycho-therapeutic humanitarianism as a case of how, in these times of globalization, psychology, subjectivity and money are all interrelated. We prove that in any NSOP $_1$ theory these ranks satisfy some desirable properties; in particular, $D_Q(x=x)<\omega $ for any finite tuple of variables x and any Q, if $q\supseteq p$ is a Kim-forking extension of types, then $D_Q(q) (...) Kim-non-forking extension, then $D_Q(q)=D_Q(p)$ for every Q that involves only invariant types whose Morley powers are -stationary. We give natural examples of families of invariant types satisfying this property in some NSOP $_1$ theories. We also answer a question of Granger about equivalence of dividing and dividing finitely in the theory $T_\infty $ of vector spaces with a generic bilinear form. We conclude that forking equals dividing in $T_\infty $, strengthening an earlier observation that $T_\infty $ satisfies the existence axiom for forking independence. Finally, we slightly modify our definitions and go beyond NSOP $_1$ to find out that our local ranks are bounded by the well-known ranks: the inp-rank (burden), and hence, in particular, by the dp-rank. Therefore, our local ranks are finite provided that the dp-rank is finite, for example, if T is dp-minimal. Hence, our notion of rank identifies a non-trivial class of theories containing all NSOP $_1$ and NTP $_2$ theories. (shrink)

Although this book primarily offers an analysis and description of the conception of man in Comenius’s work, it may also serve the reader as a more general introduction to his philosophical conception. The author shows that, in spite of the fact that Comenius has received no small amount of academic attention, funded studies or monographs in English language remain in single figures. (...)
