In lieu of an abstract, here is a brief excerpt of the content:Room for Maneuver When Raising Critical DoubtJan Albert Van Laar1When interlocutors start talking at cross-purposes it becomes less likely that they will be able to resolve their initial difference of opinion (Van Eemeren and Grootendorst 1992, 125). How much room should we give a party for rephrasing or revising her adversary’s standpoint in a manner that suits her individual purposes in the dialogue? Certainly, as textbooks in argumentation and (...) critical thinking make clear, we should steer clear of erecting and attacking straw men (Ennis 1996, 172; Govier 1985, 109–12; Groarke, Tindale, and Fisher 1997, 123). Still, a critic in a discussion or debate should be given some room to maneuver in order to rephrase the arguer’s position in her own words or to get at the underlying position of the arguer. In this article, I will be dealing with this issue from the pragma-dialectical perspective of strategic maneuvering between the shared dialectical objective of resolving a difference of opinion and the individual rhetorical objective of persuading the other side. According to existing accounts of the straw man fallacy (Talisse and Aikin 2006; Van Eemeren and Grootendorst 1992; Walton 1996), the criterion for fallaciousness resides in whether or not the critic misrepresents or distorts the arguer’s actual position. In this article I intend to provide more detailed guidelines for critics: a critic distorts or [End Page 195] misrepresents a position when she changes the formulation or nature of the arguer’s standpoint, even though this contribution by her cannot be reconstructed as containing a proposal for a change that might be acceptable to the arguer.In section 2 I will elaborate on the notion of confrontational maneuvering, that is, of strategic maneuvering between the dialectical and rhetorical goals that arise from the confrontation stage of a critical discussion. In section 3 I will characterize the form of maneuvering where an antagonist reformulates or modifies the protagonist’s standpoint in an opportune way. In section 4 I will examine the conditions under which applications of maneuvering of this kind can be sound and legitimate from a dialectical perspective and relate these conditions to the straw man fallacy. In section 5 the results of the preceding sections will be applied to a case.2. Confrontational ManeuveringIn argumentative discourse, participants typically try to achieve two kinds of objectives. First, they try to be dialectically reasonable, and second, they are out for some kind of personal triumph. The act, by the critic, of reformulating or revising the arguer’s standpoint will be dealt with from this dual perspective of strategic maneuvering (Van Eemeren and Houtlosser 2000, 2003). In order to analyze and evaluate the maneuver under discussion, I will elaborate in this section, first, on the notion of critical discussion in order to clarify the meaning of dialectical reasonableness and fallaciousness; second, on the importance of reconstruction for understanding argumentative discourse; third, on the notion of a confrontation stage; and fourth, on the distinction between direct and indirect maneuvering. These notions will be applied as follows: critics have some room for maneuvering when raising critical doubt, even when they change the arguer’s position or formulation, because there are contexts of utterance within confrontations where such a contribution does allow for a reconstruction in such a way that the result is not a direct and fallacious confrontational maneuver but, rather, an indirect and dialectically reasonable one.According to the pragma-dialectical methodology developed by Van Eemeren and Grootendorst (1984, 1992, 2004), an argumentative discourse must be reconstructed and evaluated from the perspective of a critical discussion. A critical discussion is a normative procedure that starts from a difference of opinion and that is solely aimed at resolving this dispute on the merits of the case (as perceived by the participants). The ancient Stoics had an uneven track record with regard to women’s standing. On the one hand, they recognized women as fully capable of rationality and virtue. On the other hand, they continued to hold that women’s roles were in the home. These views are consistent, given Stoic value theory, but are unacceptable on liberal feminist grounds. Stoic value theory, given different emphasis on the ethical role of choice, is shown to be capable of satisfying the liberal feminist requirement that (...) autonomy must be respected. Many fans of Diogenes of Sinope laud his parrhesia, free speech used for critique. However, Diogenes abused not only the powerful but also the socially marginalized. We argue that interpreters of Diogenes cannot explain away the undeniably troublesome things that Diogenes said about those at the margins. But we also argue that Diogenes ought nonetheless to be preserved. Some of his chreiai can be reminders of how to be courageous and fight for the downtrodden, and others can serve as reminders (...) of how easily those aspirations can be forgotten. We offer a variety of ways to interpret Diogenes, especially since the figure of Diogenes is an historical composite from centuries of sources. But we arrive at a position of loving antagonism toward Diogenes, loving Cynic commitments to autarkeia and against wealth and power, and disapproving when Cynics fell short of their commitments and critical aspirations. Properly understood, foundationalism as a meta‐epistemic theory is consistent with skepticism. This article outlines five possible points of overlap between the two views, and shows that arguments against foundationalism posited on its inability to refute skepticism are improperly framed.

This chapter focuses on one of the common fallacies in Western philosophy: free speech fallacy (FS). The FS consists in thinking one's political right to freedom of expression includes protection from criticism. Those who commit this fallacy allege that critical scrutiny is either tantamount to censorship or equivalent to the imposition of one's views on others. The error in the fallacy is that the freedom of expression includes critical expressions. The trouble with the argument is that freedom of expression does (...) not mean freedom from criticism. The first distortion concerns the logical consequences of criticism. The second distortion confuses logical implications of criticism with the criticism itself. This chapter deals with one of the common fallacies in Western philosophy called “Straw Man”. How one can straw man someone's view or argument happens in many ways. The chapter focuses on three ways. The first is the representational straw man fallacy. The second form of the straw man fallacy is that of the selectional straw man, or better the weak man. The third is what we will call the hollow man. The straw manning requires a form of misrepresentation of (...) the overall intellectual situation in an area of dispute. Straw man arguments not only produce bad argumentative results at the times they are given, but they have lasting repercussions on the communities they convince. Straw manning depends on us being unaware of a misrepresentation of opponents, and the only way to detect that is to know what the correct representation is. (shrink)

It can be tempting to think of affect as a matter of the present moment – a reaction, a feeling, an experience or engagement that unfolds right now. This paper will make the case that affect is better thought of as not only temporally extended but as saturated with temporality, especially with the past. In and through affectivity, concrete, ongoing history continues to weigh on present comportment. In order to spell this out, I sketch a Heidegger-inspired perspective. It revolves around (...) two claims. The first is that we should understand what Heidegger calls 'Befindlichkeit' (findingness) as radical situatedness. Affectivity is a matter of 'finding oneself' constellated – thrown – into the world in ways that outrun what an individual or collective might grasp and process. The second claim is that the temporal dimension, as a relatedness to the past, takes precedence in affect's situatedness. Key to affect is the way in which the past continues to hold sway over present comportment, collectively and individually. In order to articulate this perspective, it is important to overcome the idea that affect must be understood mainly in terms of feeling or experiential states of other kinds. Better suited to grasp the idea of findingness is the concept of 'disclosive posture', as proposed by Katherine Withy. I suggest that this notion should be put at the fore of a phenomenological approach to situated affectivity. (shrink)

A broad assumption in argumentation theory is that argumentation primarily regards resolving, confronting, or managing disagreement. This assumption is so fundamental that even when there does not appear to be any real disagreement, the disagreement is suggested to be present at some other level. Some have questioned this assumption (most prominently, Perelman and Olbrechts-Tyteca, and Doury), but most are reluctant to give up on the key idea that persuasion, the core of argumentation theory, can only regard disagreements. We argue here (...) that this assumption is false. Argument may be as much about strengthening or maintaining agreement as it is about disagreement. Once we see how argument is possible and manifestly enacted under conditions of agreement, then we have tools to explain otherwise curious fallacies and argumentative phenomena. (shrink)

The paper examines the interplays between logic and politics in the Polish School of Logic starting from 1914. The Polish School of Logic flourished between 1920 and 1939. Philosophically, it was influenced by Kazimierz Twardowski (1866–1938). For Twardowski logic is fundamental for every kind of human activity, professional and private and this means that every argument should be formulated and proceed by correct inferential rules. These rules involve semiotics, formal logic and methodology of science. The paper shows how this position (...) was shared by Twardowski’s students, including Jan Łukasiewicz, Stanisław Leśniewski, Kazimierz Ajdukiewicz and Tadeusz Kotrabiński, as well as by the next generation of logicians and philosophers and especially by Alfred Tarski. These authors considered logic, philosophy and science as completely neutral with respect to politics and ideology but they also considered logical skills as indispensable in political activities. We introduce a cyclic proof system for the two-way alternation-free modal μ-calculus. The system manipulates one-sided Gentzen sequents and locally deals with the backwards modalities by allowing analytic applications of the cut rule. The global effect of backwards modalities on traces is handled by making the semantics relative to a specific strategy of the opponent in the evaluation game. This allows us to augment sequents by so-called trace atoms, describing traces that the proponent can construct against the opponent’s strategy. The (...) idea for trace atoms comes from Vardi’s reduction of alternating two-way automata to deterministic one-way automata. Using the multi-focus annotations introduced earlier by Marti and Venema, we turn this trace-based system into a path-based system. We prove that our system is sound for all sequents and complete for sequents not containing trace atoms. (shrink)

Higher-order logic, with its type-theoretic apparatus known as the simple theory of types (STT), has increasingly come to be employed in theorizing about properties, relations, and states of affairs—or ‘intensional entities’ for short. This paper argues against this employment of STT and offers an alternative: ordinal type theory (OTT). Very roughly, STT and OTT can be regarded as complementary simplifications of the ‘ramified theory of types’ outlined in the Introduction to Principia Mathematica (on a realist reading). While STT, understood as (...) a theory of intensional entities, retains the Fregean division of properties and relations into a multiplicity of categories according to their adicities and ‘input types’ and discards the division of intensional entities into different ‘orders’, OTT takes the opposite approach: it retains the hierarchy of orders (though with some modifications) and discards the categorisation of properties and relations according to their adicities and input types. In contrast to STT, this latter approach avoids intensional counterparts of the Epimenides and related paradoxes. Fundamental intensional entities lie at the base of the proposed hierarchy and are also given a prominent part to play in the individuation of non-fundamental intensional entities. (shrink)

By and large, the conditional connective in three-valued logic has two different functions. First, by means of a deduction theorem, it can express a specific relation of logical consequence in the logical language itself. Second, it can represent natural language structures such as "if/then'' or "implies''. This chapter surveys both approaches, shows why none of them will typically end up with a three-valued material conditional, and elaborates on connections to probabilistic reasoning.

International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts to discussion twenty-five (...) considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

This book provides for the first time a complete history of the doctrine of the transcendentals and shows its importance for the understanding of philosophy in the Middle Ages.

Evidence-Based Medicine has little consideration for mechanisms and philosophers of science and medicine have recently made pleas to increase the place of mechanisms in the medical evidence hierarchy. However, in this debate the notions of mechanisms seem to be limited to 'mechanistic processes' and 'complex-systems mechanisms,' understood as 'componential causal systems'. I believe that this will not do full justice to how mechanisms are used in biological, psychological and social sciences and, consequently, in a more biopsychosocial approach to medicine. Here, (...) I propose, following (Kuorikoski, 2009), to pay more attention to 'abstract forms of interaction' mechanisms. The present work scrutinized review articles on depression and medically unexplained pain, which are considered to be of multifactorial pathogenesis, for their use of mechanisms. In review articles on these disorders there seemed to be a range of uses between more 'abstract forms of interaction' and 'componential causal system' mechanisms. I therefore propose to expand the notions of mechanisms considered in medicine to include that of more 'abstract forms of interaction' to better explain and manage biopsychosocial disorders. Niels Bohr and Philosophy of Physics: Twenty-First Century Perspectives examines the work, influences and legacy of the Nobel Prize physicist and philosopher of experiment Niels Bohr. Kearns (2021) reconstructs Berkeley’s (1713) Master Argument as a formally valid argument against the Materialist Thesis, with the key premise the Distinct Conceivability Thesis, namely the thesis that truths about sensible objects having or lacking thinkable qualities are (distinctly) conceivable and as its conclusion that all sensible objects are conceived. It will be shown that Distinct Conceivability Thesis entails the Reduction Thesis, which states that de dicto propositional (ordinary or distinct) conceivability reduces to de re propositional (ordinary or distinct) conceivability. A number of well-developed theories shed light on the question, under what circumstances our beliefs enjoy epistemic justification. Yet, comparatively little is known about epistemic defeat--when new information causes the loss of epistemic justification. This book proposes and defends a detailed account of epistemic defeaters. The main kinds of defeaters are analyzed in detail and integrated into a general framework that aims to explain how beliefs lose justification. It is argued that defeaters introduce incompatibilities into a noetic system and thereby (...) prompt a structured re-evaluation process that makes a justified reinstatement of the defeated belief impossible. The account is then applied to the topic of disagreement, where it is used in an argument for conciliationism, as well as a new explanation for higher-order defeat. Throughout the book, the notion of defeat is the center of attention, while a number of new issues are discussed at the intersections of defeat and justification. Specifically, new problems are raised for broadly internalist accounts of defeat, a fully descriptive reliabilist account of defeat is provided, and the case for normative defeat is revisited. Abstract Epistemic infinitism is certainly not a majority view in contemporary epistemology. While there are some examples of infinitism in the history of philosophy, more work needs to be done mining this history in order to provide a richer understanding of how infinitism might be formulated internal to different philosophical frameworks. Accordingly, we argue that the philosophy of Emmanuel Levinas can be read as operating according to an ?impure? model of epistemic infinitism. The infinite obligation inaugurated by the ?face to (...) face encounter? with the Other yields an approach to the ethics of belief that accords with infinitism. This reading of Levinas brings his ethical thought into dialogue with contemporary epistemology as well as provides an historical example of infinitism within the current debates. (shrink)

G. A. Cohen’s Rescuing Justice and Equality proposes that both concepts need rescuing from the work of John Rawls. Especially, it is concerned with Rawls’ famous second principle of justice according to which social primary goods should be distributed equally unless an unequal distribution is to the benefit of the worst off. The question is why this would ever be necessary if all parties are just. Cohen and I agree that Rawls cannot really justify inequalities on the basis given. But (...) he also thinks equality is the correct analysis of justice, though he provides no actual direct arguments for this. He does, however, provide a striking analytical argument claiming that fundamental principles of justice must be fact insensitive, and that Rawls’s view of justice violates this requirement. I argue that the requirement is itself misconceived and that principles of justice cannot possibly be fact insensitive in the sense developed by Cohen. Few philosophers share this view of Cohen’s—which I argue is due to several conceptual mistakes. With these ironed out, the contractarian view, broadly speaking, is seen to be plausible and powerful. Meanwhile Cohen appears to embrace intuitionism, a stance that cannot possibly be acceptable in social philosophy. In the end, Cohen is successful in arguing that Rawls cannot have what he wants, but neither is Cohen successful in claiming that justice is equality. (shrink)

Humanitarian aid’s psycho-therapeutic turn in the 1990s was mirrored by the increasing emotionalization and subjectivation of fund-raising campaigns. In order to grasp the depth of this interconnectedness, this article argues that in both cases what we see is the post-Fordist production paradigm at work; namely, as Hardt and Negri put it, the direct production of subjectivity and social relations. To explore this, the therapeutic and mental health approach in humanitarian aid is juxtaposed with the more general phenomenon of psychologization. This (...) allows us to see that the psychologized production of subjectivity has a problematic waste-product as it reduces the human to Homo sacer, to use Giorgi Agamben’s term. Drawing out a double matrix of a de-psychologizing psychologization connected to a politicizing de-politicization, it will further become possible to understand psycho-therapeutic humanitarianism as a case of how, in these times of globalization, psychology, subjectivity and money are all interrelated. We introduce a family of local ranks $D_Q$ depending on a finite set Q of pairs of the form $(\varphi (x,y),q(y)),$ where $\varphi (x,y)$ is a formula and $q(y)$ is a global type. We prove that in any NSOP $_1$ theory these ranks satisfy some desirable properties; in particular, $D_Q(x=x)<\omega $ for any finite tuple of variables x and any Q, if $q\supseteq p$ is a Kim-forking extension of types, then $D_Q(q) (...) Kim-non-forking extension, then $D_Q(q)=D_Q(p)$ for every Q that involves only invariant types whose Morley powers are -stationary. We give natural examples of families of invariant types satisfying this property in some NSOP $_1$ theories. We also answer a question of Granger about equivalence of dividing and dividing finitely in the theory $T_\infty $ of vector spaces with a generic bilinear form. We conclude that forking equals dividing in $T_\infty $, strengthening an earlier observation that $T_\infty $ satisfies the existence axiom for forking independence. Finally, we slightly modify our definitions and go beyond NSOP $_1$ to find out that our local ranks are bounded by the well-known ranks: the inp-rank (burden), and hence, in particular, by the dp-rank. Therefore, our local ranks are finite provided that the dp-rank is finite, for example, if T is dp-minimal. Hence, our notion of rank identifies a non-trivial class of theories containing all NSOP $_1$ and NTP $_2$ theories. (shrink)
