Aristotle divided arguments that persuade into the rhetorical (which happen to persuade), the dialectical (which are strong so ought to persuade to some degree) and the demonstrative (which must persuade if rightly understood). Dialectical arguments were long neglected, partly because Aristotle did not write a book about them. But in the sixteenth and seventeenth century late scholastic authors such as Medina, Cano and Soto developed a sound theory of probable arguments, those that have logical and not merely psychological force (...) but fall short of demonstration. Informed by late medieval treatments of the law of evidence and problems in moral theology and aleatory contracts, they considered the reasons that could render legal, moral, theological, commercial and historical arguments strong though not demonstrative. At the same time, demonstrative arguments became better understood as Galileo and other figures of the Scientific Revolution used mathematical proof in arguments in physics. Originally published in 1980. Dogen was the founder of the Soto School of Zen and one of the most influential thinkers in the history of Japanese Buddhism. When originally published, this historical and textual study was the first to examine in detail the line of continuity between Dogen and his Chinese predecessors, through his Chinese master, Ju-ching.

James Tully sees the emergence of modern constitutionalism as the intellectual legacy of writers such as Hobbes, Bodin and Locke. For Tully, modern constitutionalism not only centralizes authority, it also excludes diversity. Tully’s work represents a significant part of the growing antipathy towards uniformity and the universalising tendencies of the modern organization, which, he believes, underwrite a loss of local empowerment. In this respect his thinking and that of the communitarians is consistent with contemporary disenchantment with, not to mention (...) resistance to globalization. Globalization, or the tendency to inter‐national uniformity in culture and increasing integration into a global system of economics and power, appears to promote an analogous universalising conformity across borders, while centralizing economic if not political power and control in certain trans‐national corporations. Hernando de Soto, the Peruvian economist, gives us a very different perspective on the motley of overlapping jurisdictions and argues that diversity of systems, customs and rules with respect to property has conspired to maintain the entrenched poverty of the developing world. He argues that it is the unified, codified and integrated systems of the West that have allowed these societies to mobilize capital to escape the endemic widespread poverty of the pre‐capitalist age. In the course of this paper I seek to compare and evaluate the competing claims of Tully and de Soto. (shrink)

Los textos acerca del tiempo de Edmund Husserl (1859-1938) se organizan en torno a tres núcleos temáticos. En una primero época, en las Lecciones de fenomenología de la conciencia interna del tiempo (1904-1905), el hilo conductor es la pregunta acerca de cómo la percepción de un objeto que dura (tiempo objetivo) es constituida por una conciencia que vive en el tiempo inmanete y cómo esta es el resultado de un plano anterior -conciencia interna-. En un segundo momento, en los manuscritos (...) de Bernau (1917-1918) y en los textos sobre el carácter pasivo de los procesos de la conciencia (1921), Husserl profundiza en la relación entre conciencia, reflexión y temporalidad, y destaca la pasividad con la que se llevan a cabo las operaciones de constitución de la conciencia. Por último, en los manuscritos C (1929-1934) introducirá la noción de presente viviente como centro desde el que pensar toda la temporalidad. A la par que una investigación sobre el carácter eternamente enigmático del tiempo, los análisis de Jusserl revelan el ser fundamentalmente temporal de nuestra conciencia, en un ejercicio riguroso de pensamiento que lleva a la fenomenología hasta los límites de su potencial descriptivo. Moral philosophy is the study of what morality is and what it requires of us. As Socrates said, it's about "how we ought to live"-and why. It would be helpful if we could begin with a simple, uncontroversial definition of what morality is. Unfortunately, we cannot. There are many rival theories, each expounding a different conception of what it means to live morally, and any definition that goes beyond Socrates's simple formula-tion is bound to offend at least one of them. Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

For this 1897 publication, the American philosopher William James brought together ten essays, some of which were originally talks given to Ivy League societies. Accessible to a broader audience, these non-technical essays illustrate the author's pragmatic approach to belief and morality, arguing for faith and action in spite of uncertainty. James thought his audiences suffered 'paralysis of their native capacity for faith' while awaiting scientific grounds for belief. His response consisted in an attitude of 'radical empiricism', which deals (...) practically rather than ideologically with real-world phenomena. When facing a 'momentous' decision about belief, he says, we both can and must choose the best hypothesis. The first four essays apply this principle to religious faith, and the rest explore the pragmatic approach to such topics as determinism, ethics and individual achievement. James developed his ideas further in The Varieties of Religious Experience and Pragmatism, both of which are reissued in this series. (shrink)

The Gifford Lectures were established in 1885 at the universities of St Andrews, Glasgow, Aberdeen and Edinburgh to promote the discussion of 'Natural Theology in the widest sense of the term - in other words, the knowledge of God', and some of the world's most influential thinkers have delivered them. The 1901–2 lectures given in Edinburgh by American philosopher William James are considered by many to be the greatest in the series. The lectures were published in book form in (...) 1902 and have been reprinted many times. James, who was educated in the United States and Europe, and spent much of his career teaching philosophy at Harvard, was very influential in the development of modern psychology, and in these twenty lectures he explores the personal experience of religion. One of the most influential men of his time, philosopher, psychologist, educator, and author William James (1842-1910) helped lead the transition from a predominantly European-centered nineteenth-century philosophy to a new "pragmatic" American philosophy. Helping to pave the way was his seminal book Pragmatism (1907), in which he included a chapter on "Truth," an essay which provoked severe criticism. In response, he wrote the present work, an attempt to bring together all he had ever written on the theory of knowledge, (...) including an article on the function of cognition, later polemic and expository contributions, and some replies to previous criticism. We have several intuitive paradigms of defeating evidence. For example, let E be the fact that Ernie tells me that the notorious pet Precious is a bird. This supports the premise F, that Precious can fly. However, Orna gives me *opposing* evidence. She says that Precious is a dog. Alternatively, defeating evidence might not oppose Ernie's testimony in that direct way. There might be other ways for it to weaken the support that Ernie's testimony gives me for believing F, without (...) the new evidence itself intuitively constituting reasons to believe one way or the other about Precious's flight ability. An example: Ursula tells me that Ernie has no idea what Precious's species is; he's just guessing. She may not herself want to or be in a position to weigh in about Precious's real species or flight ability. I call defeating evidence of this sort *undermining evidence. (shrink)

En cada contexto son diversas las formas de ser niña y niño. El objetivo de este artículo es reflexionar sobre los significados que implica el “ser migrante” para las niñas y los niños peruanos en Chile, considerando los procesos de integración social desde la perspectiva generacional y cómo cambia el concepto de infancia en contextos transnacionales. Mediante observación participante y entrevistas semiestructuradas con 16 niñas y niños peruanos, de 9 a 16 años de edad, se concluye que existe cierta idealización (...) de las formas de expresión de la infancia en Perú. Mientras que en Chile, las niñas y los niños migrantes sienten que las diferencias con sus pares chilenos se transforman en relaciones de desigualdad, conflicto y negociación. Además, la inserción escolar promueve la integración a determinados modelos de infancia construidos normativamente desde el mundo adulto y chileno, que dejan poco espacio para la diversidad cultural de las infancias transnacionales.
