‘Organisational failure’ is central to medical ethics. In the National Health Service (NHS), we usually examine failures at hospital level. We have had around 100 hospital inquiries since the first in 1969, into Ely Hospital, Cardiff. This year, we had the Ockenden Report into Shrewsbury and Telford Hospital. Last year, we had the Outram Inquiry into West Suffolk Hospital. In 2020, the James Inquiry into Ian Paterson. And, before that, Morecombe Bay, Gosport War Memorial, Mid Staffordshire, Liverpool Community (...) Health, Winterbourne View, Anthony Ledward, Stoke Mandeville, Bristol Royal Infirmary and so on. As Taylor says, these reports teach us clinical failure usually has an institutional setting and that blaming individuals overlooks working ‘culture’. They have also led to: (a) new regulatory bodies to manage, investigate and improve NHS standards, (b) new codes of conduct to mandate reporting of serious accidents—backed up by the Whistle-blower’s Act and explicit statutory duties of disclosure, (c) root cause analysis to encourage consistent investigations so we can learn from reliable data and (d) new ‘Speaking Up Guardians’ and a Patient Safety Commissioner to encourage informal discussion about patient safety. In the target article, Bowers et al. dispute deep artificial neural network (ANN) models as the currently leading models of human vision without producing alternatives. They eschew the use of public benchmarking platforms to compare vision models with the brain and behavior, and they advocate for a fragmented, phenomenon-specific modeling approach. These are unconstructive to scientific progress. We outline how the Brain-Score community is moving forward to add new model-to-human comparisons to its community-transparent suite of benchmarks.

Pragmatism and the Political Economy of Cultural Evolution.

Fair allocation of scarce healthcare resources has been much studied within philosophy and bioethics, but analysis has focused on a narrow range of cases. The Covid-19 pandemic provided significant new challenges, making powerfully visible the extent to which health systems can be fragile, and how scarcities within crucial elements of interlinked care pathways can lead to cascading failures. Health system resilience, while previously a key topic in global health, can now be seen to be a vital concern in high-income countries (...) too. Unfortunately, mainstream philosophical approaches to the ethics of rationing and prioritisation provide little guidance for these new problems of scarcity. Indeed, the cascading failures were arguably exacerbated by earlier attempts to make health systems leaner and more efficient. This paper argues that health systems should move from simple and atomistic approaches to measuring effectiveness to approaches that are holistic both in focusing on performance at the level of the health system as a whole, and also in incorporating a wider range of ethical concerns in thinking about what makes a health system good. Examples of classic thought experiments are presented and some morals drawn. The views of my fellow symposiasts, Tamar Gendler, John Norton, and James McAllister, are evaluated. An account of thought experiments along a priori and Platonistic lines is given. I also cite the related example of proving theorems in mathematics with pictures and diagrams. To illustrate the power of these methods, a possible refutation of the continuum hypothesis using a thought experiment is sketched.

We call sublime those things and experiences supposed to be the very best. But what if the best actually leads to inequality and exploitation? Williams critiques the sublime over its long history and in recent returns to sublime nature and technologies. Deploying a new critical method that draws on process philosophy, he shows how the sublime has always led to inequality. This holds true even where it underpins ideas of cosmopolitan enlightenment, and even when refined by Burke, Kant, Nietzsche, Schopenhauer (...) and Zizek. Against the unjust legacies of the traditional sublime, James Williams defends a new, anarchist sublime: multiple, self-destructive and temporary; opposed to any idea of highest value to be shared by all but always imposed on the powerless. It is widely believed that the nature of love and friendship precludes them from being bought or sold. It will be argued in this paper that this view is false: There is no conceptual bar to the commodification of love and friendship. The arguments offered for this view will lead to another surprising conclusion: That these goods are asymmetrically alienable goods, goods whose nature is such that separate arguments must be provided for the views that they can be bought and (...) sold. The possibility of asymmetric alienability has not yet been recognized in the literature on commodification. (shrink)

A fresh explication of the Thomist justification of self-defense casts off the hobbles of the principle of double effects to find a more secure footing in the historicaldevelopment of subjective natural rights by medieval jurists, and a straight-forward application to the latent threat of death in childbirth posed by non-consensual pregnancy. By articulating the implicit Thomistic right to defensive abortion in terms of conditional rights bestowed in Creation as correlative to particular natural law duties, justly proportionate limits to defensive abortion (...) are identified, and balanced against the forfeited or reserved natural rights variously imputed to conceptus and embryo in non-consensual pregnancies. Subsequently, the varieties of involuntary consent are examined from a Thomist perspective with a view to their relevance in justifying recourse to a rehabilitated practice of defensive abortion when free and full consent to impregnation and childbirth is absent. Adolf Reinach was one of the leading figures of the Munich and Göttingen circles of phenomenology, and Husserl's first real co-worker. Although his writings are highly original and remarkably clear, Reinach's tragic death in the First World War prevented him from formulating a definitive statement of his phenomenology, leaving his name virtually unknown to all but a small circle. In his ground-breaking study, Judgment and Sachverhalt, DuBois shows how Reinach succeeds in developing a realist ontology and epistemology based on rigorous (...) argumentation and phenomenological elucidation. Drawing from numerous texts and the developments of Reinach's students and colleagues - Roman Ingarden, Alexander Pfänder and Dietrich von Hildebrand above all - DuBois presents, refines and defends Reinach's `phenomenological realism'. Confrontations of Reinach's theories of states of affairs, concepts and speech acts with the work of contemporary authors like Chisholm and Searle allow readers to evaluate Reinach's philosophy, not only in the light of the later developments of Husserl, but also in the light of certain Anglo-American developments. People around the world are agitating for democracy and individual rights, but there is no consensus on a theory of liberal democracy that might guide them. What are the first principles of a just society? What political theory should shape public policy in such a society? In this book, James S. Fishkin offers a new basis for answering these questions by proposing the ideal of a "self-reflective society"—a political culture in which citizens are able to decide their own fate (...) through unconstrained dialogue. Fishkin offers a comprehensive critique of liberal political theories that do not satisfy the requirements for a self-reflective society. He then explains his own theory of liberalism, showing that the freely self-examining society he advocates can provide the key to issues of political legitimacy and social justice. Fishkin proposes practical applications of his theory that would lead to more participatory democracy. Among these are deliberative opinion polls that would allow ordinary citizens to explore issues directly with candidates before elections, and vouchers that would allow them to organize representation for their interests. Fishkin examines a broad range of topics from the fresh perspective of a self-reflective society: utility and its limits, justice between generations, conflicting ideals of democracy, equal opportunity, the connections between theory and public policy, the notion of moral progress, and the bases for political obligation. It is intuitive to think that divine transcendence is incompatible with the sacredness of nature, especially when transcendence is combined with the idea that God alone is valuable. Divine transcendence seems to demote this-worldly values in favor of union with God in a disembodied afterlife. Divine transcendence also seems to legitimize hierarchies, including male–female and human-nature hierarchies. Divine immanence seems a better alternative. This set of intuitions about transcendence appears regularly in the field of Religion and Ecology, sometimes as an (...) implicit backdrop rather than an explicit position. This backdrop needs to be thematized and evaluated. For those with ecological concerns, divine transcendence and divine immanence need not be mutually exclusive. Rather, divine transcendence (understood non-contrastively) complements divine immanence and is compatible with both animist and polytheist cosmologies. The extent of this mutual compatibility and its importance for environmental concerns has yet to be fully articulated. (shrink)

What will it take for business to improve lives? Many think we need a theoretically sound meta-narrative to articulate the proper place for business in our lives. Important as that is, this meta-narrative will only come to life when everyone articulates his and her personal narrative, shares it with others, and ultimately fine-tunes it into a personal theory-in-use, one that guides everyday decision-making. Hoping that the Humanistic Management Association willsoon find room on its webpage for those of us in business (...) and business education to share our values and beliefs with each other, I thought I would start usoff by sharing mine here. James Ward was a renowned philosopher and psychologist who criticised the objective principles of scientific naturalism. Believing in the primacy of the subject–object relationship for human experience, he rejected the detached perspective of the sciences; coming to the final conclusion that matter is fundamentally derived from mind, and mind is given coherence by the existence of God. This metaphysical belief was derived from his observations as a psychologist during the earlier part of his career, and his understanding that the (...) subject cannot be reduced to a passive receiver of the objective world. This volume, which was originally published in 1911, was based upon the Gifford Lectures given during the years 1907–10. It constitutes a further development of Ward's beliefs into the form of a complete system, and it remains of value to anyone with an interest in philosophy, psychology or phenomenology. (shrink)

On his death in 1997 Isaiah Berlin was widely hailed as a leading philosopher of political liberalism. This article takes the position that Berlin’s philosophical views, particularly those on freedom and cultural pluralism, can also be construed as a valuable guide for historians working in the present, “postmodernist” climate of debate. It further argues that Berlin’s character and career, the subjects already of considerable critical inquiry, lend added authority to these views. The focus is on three lengthy essays on history (...) written by Berlin in the 1950s, one of which was first published in the first issue of this journal. The article concludes, following Berlin, that it is the responsibility of historians, as historians, to recognize the often incommensurate plurality of ultimate values to which their fellow human beings historically have subscribed and to judge, as judge they sometimes must, with that recognition fully in mind. If the result of these as well as the other choices that they make is a plurality of histories, of contending subjects, approaches, methods, and outcomes, that is only to be expected, indeed welcomed. It is freedom in practice, and infinitely preferable as such to any known alternative. (shrink)

This paper offers an interpretation of Locke's understanding of life, challenging a familiar reading which treats him as endorsing a mechanical reduction of the living body. Against the mechanists, Locke clearly states that the internal movement constitutive of life is excited from within the organism, and he also holds that the coordination of the bodily organs (their unity of function) cannot be understood mechanically. Rather, the different parts of the organism enjoy a ‘vital union', a concept that Locke borrows from (...) Henry More and the Cambridge Platonists. In the final part of the paper, it is shown how personhood, on Locke's understanding, partakes in this vital union and how the person is thus embodied in the human organism, or ‘Man’. (shrink)

This essay explores how vulnerability, understood not as precarity but as capacious responsiveness, much as the Philosopher Judith Butler identifies it, and recognition are key moral concepts that are prior conditions for the expression of conscience. Appreciating Thomas Aquinas' argument that conscience is neither a power or a habit, but rather an act, the essay argues that Aquinas' inclination synderesis, that prompts us to the good and away from evil, functions in a way similar to vulnerability. Fundamentally, vulnerability prompts us (...) to recognize the neighbor who needs our response. (shrink)
