Retrospective rule-making has few supporters and many opponents. Defenders of retrospective laws generally do so on the basis that they are a necessary evil in specific or limited circumstances, for example to close tax loopholes, to deal with terrorists or to prosecute fallen tyrants. Yet the reality of retrospective rule making is far more widespread than this, and ranges from ’corrective’ legislation to ’interpretive regulations’ to judicial decision making. The search for a rational justification for retrospective rule-making necessitates a reconsideration (...) of the very nature of the rule of law and the kind of law that can rule, and will provide new insights into the nature of law and the parameters of societal order. This book examines the various ways in which laws may be seen as retrospective and analyses the problems in defining retrospectivity. In his analysis Dr Charles Sampford asserts that the definitive argument against retrospective rule-making is the expectation of individuals that, if their actions today are considered by a future court, the applicable law was discoverable at the time the action was performed. The book goes on to suggest that although the strength of this ’rule of law’ argument should prevail in general, exceptions are sometimes necessary, and that there may even be occasions when analysis of the rule of law may provide the foundation for the application of retrospective laws. Dr Ian Ramsey has made considerable use of the word ‘disclosure’ in what he has to say about religion and in his attempts to give an account of the meaning of religious language. He sometimes speaks of ‘discernment’ or ‘insight’ but ‘disclosure’ is the word he normally favours. In what follows I shall ask: what a disclosure is, to what extent Dr Ramsey's use of the notion leads to confusions, and what questions have to be faced in order to resolve (...) these confusions. In an article in Philosophy R. G. Swinburne set out to argue that none of Hume's formal objections to the design argument ‘have any validity against a carefully articulated version of the argument’ . This, he maintained, is largely because Hume's criticisms ‘are bad criticisms of the argument in any form’ . The ensuing controversy between Swinburne and Olding 1 has focused upon the acceptable/unacceptable aspects of the dualism presupposed in Swinburne's defence of the design argument; upon whether any simplification (...) is achieved by reducing scientific explanation to agent explanation; and upon the problems which arise from taking a man's acting upon his body as the analogy for understanding a disembodied agent acting upon matter. In this article I shall refer to the Swinburne-Olding controversy when appropriate but my main concern is to return to Swinburne's original article and argue, seriatim , that Hume's individual criticisms of the design argument are for the most part a great deal more powerful than Swinburne allowed. I shall contend that cumulatively they destroy the design argument as any sort of rational foundation for theistic belief. But first I shall indicate briefly the character of the argument together with one or two of the distinctions and refinements in terms of which it has been found helpful to carry on the discussion in recent years. In 1896 William James published an essay entitled The Will to Believe, in which he defended the legitimacy of religious faith against the attacks of such champions of scientific method as W.K. Clifford and Thomas Huxley. James's work quickly became one of the most important writings in the philosophy of religious belief. James Wernham analyses James's arguments, discusses his relation to Pascal and Renouvier, and considers the interpretations, and misinterpretations, of James's major critics. Wernham shows convincingly that James (...) was unaware of many destructive ambiguitities in his own doctrines and arguments, although clear and consistent in his view that our obligation to believe in theism is not a moral but a prudential obligation -- a foolish-not-to-believe doctrine, rather than a not-immoral-to-believe one. Wernham also shows that the doctrine is best read as affirming the wisdom of gambling that God exists, a notion which James failed to distinguish from believing and which, among other things, he explicitly identified with faith. James's pragmatism, a theory concerning the meaning of truth, is shown to be quite distinct from the doctrine of The Will to Believe. In concentrating on a careful analysis of this doctrine of the will-to-believe, Wernham not only makes a major contribution to understanding James's philosophy, but also clarifies issues in the philosophy of religion and in the analysis of belief and faith. A great deal of modern Protestant theology looks very much like an attempt to conduct a salvage operation which is designed to make clear how it is possible to retain belief in Jesus Christ, and at the same time remain intellectually honest. For the same sceptical challenge which faces the secular historian also faces the theologian. If Christians are correct in arguing that the locus of God's revelation to man is in Jesus of Nazareth, then in order to know about (...) this supposed revelation, it is necessary to know about a period of time in the past; it is necessary to know the history of the man's life and actions. Theologians are therefore faced with the question: how, if at all, is it possible to bridge the logical gap between statements describing what Jesus of Nazareth said and did, and statements describing the evidence for what Jesus of Nazareth said and did. The solution found to this question by theologians tends to be determined by their conscious and unconscious philosophical presuppositions; just as it did in the examples discussed above of secular critical philosophies of history. Background:The severity of the Coronavirus pandemic has led to lockdowns in different countries to reduce the spread of the infection. These lockdown restrictions are likely to be detrimental to mental health and well-being in adolescents. Physical activity can be beneficial for mental health and well-being; however, research has yet to examine associations between adolescent physical activity and mental health and well-being during lockdown.Purpose:Examine the effects of adolescent perceived Coronavirus prevalence and fear on mental health and well-being and investigate the extent (...) to which physical activity can be a protective factor against these concerns.Methods:During United Kingdom lockdown restrictions, 165 participants (100 female, aged 13–19) completed an online questionnaire assessing perceived Coronavirus prevalence and fear, physical activity, and indicators of mental health and well-being (stress, anxiety, depression, fatigue, vitality, and perceived health). Separate hierarchical multiple linear regression analyses (with age, gender, perceived Coronavirus prevalence, and fear entered in step 1, and physical activity in step 2) were run to predict each well-being outcome.Results:Regression analyses indicated that in general, while Coronavirus fear was a negative predictor, physical activity was a positive and stronger predictor of enhanced mental health and well-being outcomes.Conclusion:Findings suggest that physical activity during the Coronavirus pandemic can counteract the negative effects of Coronavirus fear on adolescent mental health and well-being. Therefore, physical activity should be promoted during lockdown to support good mental health and well-being. (shrink)

it is easy to think that he did. Clifford certainly had one. In a celebrated essay he argued for the thesis that “it is wrong always, everywhere and for anyone to believe anything upon insufficient evidence“; and his title was “The Ethics of Belief.” Clifford was not alone, for Huxley, also, was of that same opinion. For him, such belief was not just wrong: it was “the lowest depth of immorality.” With that opinion, and with those advocates of it, James (...) was locked in a struggle throughout his life; and it is a reasonable suspicion that the opponent of one ethics of belief is himself an ethicist with a rival ethics of belief of his own. That suspicion, moreover, appears to be confirmed by James's best known essay. He himself came to the view that his The Will to Believe would have been better named The Right to Believe, and it is a commonplace that “right” is a word of the ethical vocabulary. In short, there are obvious signs pointing to a positive answer to our question. (shrink)

The Declaration of Helsinki and the Council of the International Organization of Medical Sciences provide guidance on standards of care and prevention in clinical trials. In the current and increasingly challenging research environment, the ethical status of a trial design depends not only on protection of participants, but also on social value, feasibility, and scientific validity. Using the example of a study assessing efficacy of a vaccine to prevent human papilloma virus in HIV-1 infected adolescent girls in low resource countries (...) without access to the vaccine, we compare several trial designs which rank lower on some criteria and higher on others, giving rise to difficult trade-offs. This case demonstrates the need for developing more nuanced guidance documents to help researchers balance these often conflicting criteria. (shrink)
