This article provides a survey of key topics on just inheritance taxation. It does so by first presenting the main arguments in the debate. Here, I distinguish between arguments in the academic literature and the various arguments which have proven important in the public debate. Secondly, I outline four influential proposals when it comes to how inheritance should be taxed. Finally, I examine a recent controversy and point towards a number of themes that have not been sufficiently discussed.
The most important analytical tool in non-cooperative game theory is the concept of a Nash equilibrium, which is a collection of possibly mixed strategies, one for each player, with the property that each player's strategy is a best reply to the strategies of the other players. If we do not go into normative game theory, which concerns itself with the recommendation of strategies, and focus instead entirely on the positive theory of prediction, two alternative interpretations of the Nash equilibrium concept (...) are predominantly available.In the more traditional one, a Nash equilibrium is a prediction of actual play. A game may not have a Nash equilibrium in pure strategies, and a mixed strategy equilibrium may be difficult to incorporate into this interpretation if it involves the idea of actual randomization over equally good pure strategies. In another interpretation originating from Harsanyi, see also Rubinstein, and Aumann and Brandenburger, a Nash equilibrium is a ‘consistent’ collection of probabilistic expectations, conjectures, on the players. It is consistent in the sense that for each player each pure strategy, which has positive probability according to the conjecture about that player, is indeed a best reply to the conjectures about others. In ausführlicher Auseinandersetzung mit Heidegger, in dessen Schriften eine sehr einflussreiche einseitige und entstellende Interpretation und Kritik der großen metaphysischen Tradition immer wieder präsentiert wird, zeigt Lorenz B. Puntel, dass die Gottesfrage klar, rational und argumentativ, kurz: mit theoretischer Rigorosität, behandelt werden kann. Dies aber setzt einen umfassenden philosophischen Theorierahmen voraus, der die Entfaltung einer systematischen Konzeption des Seins als solchen und im Ganzen ermöglicht und in nuce enthält. Anschließend (...) wird eine solche Konzeption im Grundriss zur Darstellung gebracht. In einem ausführlichen Kapitel werden die Positionen von É. Lévinas und J.-L. The aim of this paper is to elaborate on the phenomenological approach to expertise as proposed by Dreyfus and Dreyfus and to give an account of the extent to which their approach may contribute to a better understanding of how athletes may use their cognitive capacities during high-level skill execution. Dreyfus and Dreyfus's non-representational view of experience-based expertise implies that, given enough relevant experience, the skill learner, when expert, will respond intuitively to immediate situations with no recourse to deliberate actions (...) or mental representations. The paper will subsequently outline some implications and consequences of such an approach and will also examine to what extent Dreyfus and Dreyfus's skill model is capable to resist different attacks that have been made against their view, and in particular regarding the practical application of their approach to the skill domain of competitive sport. Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius . Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal und Van der Waal hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Der Kommentar des Codex diente dazu, einen grundsätzlichen lateinischen Text griechischen Studenten zu verdeutlichen, und zwar ausgehend von einer reinen Übersetzung bis zu einem juristischen Kommentar. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)
We have investigated the effects of organic content and maturation on the elastic properties of source rock shales, mainly through integration of a well-log database from the Central North Sea and associated geochemical data. Our aim is to improve the understanding of how seismic properties change in source rock shales due to geologic variations and how these might manifest on seismic data in deeper, undrilled parts of basins in the area. The Tau and Draupne Formations in immature to early mature (...) stages exhibit variation mainly related to compaction and total organic carbon content. We assess the link between depth, acoustic impedance, and TOC in this setting, and we express it as an empirical relation for TOC prediction. In addition, where S-wave information is available, we combine two seismic properties and infer rock-physics trends for semiquantitative prediction of TOC from [Formula: see text] and AI. Furthermore, data from one reference well penetrating mature source rock in the southern Viking Graben indicate that a notable hydrocarbon effect can be observed as an addition to the inherently low kerogen-related velocity and density. Published Kimmeridge shale ultrasonic measurements from 3.85 to 4.02 km depth closely coincide with well-log measurements in the mature shale, indicating that upscaled log data are reasonably capturing variations in the actual rock properties. Amplitude variation with offset inversion attributes should in theory be interpreted successively in terms of compaction, TOC, and maturation with associated generation of hydrocarbons. Our compaction-consistent decomposition of these effects can be of aid in such interpretations. (shrink)
Given the prominent position Habermas' philosophy has gained, it is surprising that his method, rational reconstruction, has not caused more debate. This article clarifies what this method consists of, and shows how it is used in two of Habermas' research programs. The method is an interesting, but problematic way of confronting some of the basic epistemological questions in the social sciences. It represents an alternative to both the empirical-analytical and the hermeneutic tradition. On the basis of this methodology, Habermas' work (...) is situated between the transcendental and the empirical approach. A fundamental problem is that it remains unclear how to test the hypothesis put forward through rational reconstruction. (shrink)
The traditional square of opposition is generalized and extended to a cube of opposition covering and conveniently visualizing inter-sentential oppositions in relational syllogistic logic with the usual syllogistic logic sentences obtained as special cases. The cube comes about by considering Frege–Russell’s quantifier predicate logic with one relation comprising categorical syllogistic sentence forms. The relationships to Buridan’s octagon, to Aristotelian modal logic, and to Klein’s 4-group are discussed.GraphicThe photo shows a prototype sculpture for the cube.
Jürgen Habermas’s theories have received enormous attention in the public sphere as well as in political science. It is therefore surprising that his method, rational reconstruction, is not more debated. In political science the method is of particular interest because of its ambition to bridge the gap between empirical and normative approaches. In this article the author traces Habermas’s interest in rational reconstruction by going back to his writings on theory and practice and subsequently shows what the method’s main principles (...) are. He then specifies how this methodological conception is used in Habermas’s political theory. Finally, the introduction of an empirical design allows the author to discuss one of the fundamental tensions in Habermas’s approach: the hypotheses arrived at through rational reconstruction are empirical hypotheses but cannot be tested by empirical means. Between the two World Wars, Jørgen Jørgensen was a central figure in Danish philosophy and internationally recognized, as his teacher Harald Høffding had been before World War 1. When in the late 1920s Jørgensen established contact with the movement that would later be called logical positivism, he found a group of philosophers of his own age who advocated empiricism, the tools of formal logic and the Unity of Science, and who shared his anti-metaphysical approach to philosophy. He became one of (...) the movement’s organizers and wrote its history, but he was only for a short period influenced by especially Rudolf Carnap’s philosophy of logic. Although Jørgensen was never an uncritical member of the movement, he is often considered as a central representative of logical positivism in Scandinavia. (shrink)
Immanuel Kant’s essay on Perpetual Peace contains a rejection of the idea of a world government. In connexion with a substantial argument for cosmopolitan rights based on the human body and its need for a space on the surface of the Earth, Kant presents the most rigorous philosophical formulation ever given of the limitations of the cosmopolitan law. Zugleich reflektiert er Probleme des neuen Denkens, das er insbesondere bei den französischen Aufklärungsphilosophen aufmerksam beobachtet und nicht selten vehement kritisiert.
In his explorations of the relations between the sacred and violence, René Girard has hit upon the origin of culture — the way culture began, the way it continues to organize itself. The way communities of human beings structure themselves in a manner that is different from that of other species on the planet. Like Albert Einstein, Sigmund Freud, Émile Durkheim, Martin Buber, or others who have changed the way we think in the humanities or in the human sciences, Girard (...) has put forth a set of ideas that have altered our perceptions of the world in which we function. We will never be able to think the same way again about mimetic desire, about the scapegoat mechanism, and about the role of Jewish and Christian scripture in explaining sacrifice, violence, and the crises from which our culture has been born. The contributions fall into roughly four areas of interpretive work: religion and religious study; literary study; the philosophy of social science; and psychological studies. The essays presented here are offered as "essays" in the older French sense of attempts or trials of ideas, as indeed Girard has tried out ideas with us. With a conscious echo of Montaigne, then, this hommage volume is titled _Essays in Friendship and in Truth_. (shrink)
Intuition has increasingly been considered as a legitimate foundation for decision-making, and the concept has started to find its way into military doctrines as a supplement to traditional decision-making procedures, primarily in time-constrained situations. Yet, absent inside the military realm is a critical and level-headed discussion of the ethical implications of intuitive behaviour, understood as an immediate and situational response with no recourse to thoughtful or deliberate activity. In this article the author turns to phenomenological philosophy, and in particular to (...) the works of Hubert and Stuart Dreyfus, to elaborate on the ethical implications and consequences of intuitive behaviour. Dreyfus and Dreyfus understand moral behaviour as a skill, and as such they claim that it is possible to develop this capability through practice. They even claim that intuitive behaviour is the hallmark of the way experts respond to situations. The article seeks to investigate if the prerequisites for development of experience-based intuition are fulfilled inside the frames of military operations. The possible implications and consequences of utilizing such a capability are also emphasized. The article's empirical materials are qualitative and build mainly upon extracted information from interviews and informal conversations with Norwegian soldiers and officers serving in Afghanistan under ISAF's Regional Command North in 2007 and 2008. Filosofi og pædagogik er gamle fæller, og der er et overlap mellem filosofiens historie og pædagogikkens historiske litteratur. Store tænkere som Platon, Aristoteles, Augustin, Descartes, Locke, Rousseau, Kant, Hegel, Schleiermacher, Herbart og Dewey hører hjemme begge steder. I den pædagogiske filosofi kan almene teoretiske og praktisk filosofiske spørgsmål udforskes systematisk og historisk. Gennem diskussioner af sådanne spørgsmål kan man forholde sig mere nysgerrigt, bevidst, begrundet og kritisk til pædagogisk praksis såvel som til pædagogisk teori, empiri og undervisningsteknologi. -/- Fællesskabet er (...) ikke uproblematisk. Pædagogik er ikke filosofi, og pædagogisk filosofi ikke kun pædagogik. Både didaktik og almen pædagogik kan komme i konflikt med pædagogisk filosofi. Hvordan kan almene pædagogiske spørgsmål overhovedet belyses filosofisk, og hvad betyder de for filosofien selv? En pædagogisk filosofisk tilgang forandrer kanon i både pædagogik og filosofi. Udvalget af nøgletekster ændres. Emner, der er værd at diskutere, forskydes. Nye forskningsspørgsmål og prioriteringer viser sig. Et pædagogisk perspektiv på filosofiens udvikling vil fremhæve dens bidrag til at forstå ’den pædagogiske problem- og fænomenverden’, ligesom et filosofisk perspektiv på pædagogikken vil flytte – eller rettere udvide – fokus med hensyn til dens idéhistorie såvel som dens aktuelle teoretiske praksis. Som i al anden filosofi kan man i den pædagogiske filosofi diskutere teoretiske og praktiske, såvel som poetiske og æstetiske spørgsmål; men det er typisk med en særlig vinkel, nemlig den pædagogiske. Man kan således diskutere erkendelse, viden og sandhed, ligeså vel som man kan undersøge ret, retfærdighed og skønhed. Ofte vil det være med en særlig tvist. Den pædagogiske filosofi kan vise sig som særegen både ved sin særlige position og ved at relatere sig til det pædagogiske som genstandsfelt. Hvad denne position og dette genstandsfelt egentlig er, er der dog ingen enighed om. Det kan ikke engang siges at være udelukkende pædagogisk defineret, og derfor må den pædagogiske filosofi forholde sig åbent til begge dele. Studier i pædagogisk filosofi indbyder til denne drøftelse. (shrink)
We define the paraconsistent supra-logic Pσ by a type-shift from the booleans o of propositional logic Po to the supra-booleans σ of the propositional type logic P obtained as the propositional fragment of the transfinite type theory Q defined by Peter Andrews as a classical foundation of mathematics. The supra-logic is in a sense a propositional logic only, but since there is an infinite number of supra-booleans and arithmetical operations are available for this and other types, virtually anything can be (...) specified. The supra-logic is a generalization of Lukasiewicz's three-valued logic, with the intermediate value duplicated many times and ordered such that none of the copies of this value imply other ones, but it differs from Lukasiewicz's many-valued logics as well as from logics based on bilattices. There are several automated theorem provers for classical higher order logic and it should be possible to modify these to our needs. (shrink)

Die Sukzession in der Zeit scheint für alles Bewußtsein konstitutiv zu sein. Die erfahrene Endlichkeit drückt sich in die phänomenale Wirklichkeit ein: - als ein Brandzeichen der Sterblichkeit und Vergänglichkeit. Es ist ihre Negativität, der scheinbar nichts zu entrinnen vermag. Sie ist die große Vernichterin allen Aufbauens und Gestaltens. Sie verbürgt schon vor allem Anfang das unausweichliche Ende: Die Niederlage vor ihrer (...) Gleichgültigkeit, in der jeder Moment von unterschiedsloser Bedeutung oder, was dasselbe ist, von keiner Bedeutung ist, geht jedem Sieg in der Zeit voran. (shrink)

The Danish critic Georg Brandes visited Warsaw in 1885 and 1886, with the pretext of lecturing—in French—on modern literature, making thereby the Polish cause for freedom his own. It was his endeavor not to take sides in the smoldering strife between radical and catholic circles, freedom from the brutal Russian regime being the chief common issue. During his second visit he lectured on Polish literature, though only knowing it through translations. This demonstration of solidarity was received with enthusiasm.In his book (...) Impressions from Poland—Danish 1888, in English, German and Polish 1898—he gives a vivid description of the Polish passion for freedom, not hiding more negative sides of the national character as he found them, such as improvidence and bohemianism. The book was understood as an act of solidarity, and during a visit to Krakow in 1898 he was hailed as the spokesman of freedom and one of the few West-European supporters of the Polish cause.When, by November 1914, Brandes learned about Polish religious pogroms he did not hesitate to condemn them in two articles born by indignation. The articles, immediately published in many languages, aroused much attention worldwide, at the same time costing him most of his Polish popularity. (shrink)
Zwischen 1987 und 1994 sandte ich 20 Briefe an Karl Popper. Die meisten betrafen Fragen bezüglich seiner Antiinduktionsbeweise und seiner Wahrscheinlichkeitstheorie, einige die organisatorische und inhaltliche Vorbereitung eines Fachgesprächs mit ihm in Kenly am 22. März 1989 (worauf hier nicht eingegangen werden soll), einige schließlich ganz oder in Teilen nicht-fachliche Angelegenheiten (die im vorliegenden Bericht ebenfalls unberücksichtigt bleiben). Von Karl Popper erhielt ich in diesem Zeitraum 10 Briefe. Der bedeutendste ist sein siebter, bestehend aus drei Teilen, geschrieben am 21., 22. (...) und 23. Oktober 1992, in dem er eine Vorform jener Definition der probabilistischen Unabhängigkeit entwickelte, die er 1994 im neuen Anhang *XX der 10. Auflage seiner Logik der Forschung (LdF) der wissenschaftstheoretischen Forschergemeinde vorstellte. Der berührendste ist sein letzter, geschrieben am 26. Juli 1994, in dem er trotz Erschöpfung mit Humor schildert, wie mühselig der Druck des Anhangs *XX verlaufen ist. Mein Bericht ist zugleich chronologisch und systematisch gegliedert: die ersten, vergleichsweise wenigen Briefe, großteils 1987 geschrieben, handeln von der Induktion; der große Rest, zeitlicher Schwerpunkt 1992, beschäftigt sich mit der Wahrscheinlichkeitstheorie. Berkeley’s criticism of Locke’s distinction between primary and secondary qualities is a challenge to epistemologists. Do we experience a mind-independent reality, even though we do it with the help of senses bound to give us subjective experiences? Berkeley – or a straw man by that name – played an important part as sparring partner for an influential development of Danish theoretical philosophy in the second half of the 20th century. The protagonists here are Peter Zinkernagel and David Favrholdt. Zinkernagel held (...) an extraordinary appointment as research fellow at the University of Copenhagen. Favrholdt was the founding father of the Philosophical Institute at Odense University. This essay focuses on the constructive moments in Zinkernagel’s alternative to immaterialism, being based on a distinction between perception and action, and on Favrholdt’s development of a reconstruction of the distinction between primary and secondary qualities.
