The past decade has witnessed escalating legal and ethical challenges to the diagnosis of death by neurologic criteria. The legal tactic of demanding consent for the apnea test, if successful, can halt the DNC. However, US law is currently unsettled and inconsistent in this matter. Consent has been required in several trial cases in Montana and Kansas but not in Virginia and Nevada. In this paper, we analyze and evaluate the legal and ethical bases for requiring consent before apnea testing (...) and defend such a requirement by appealing to ethical and legal principles of informed consent and battery and the right to refuse medical treatment. We conclude by considering and rebutting two major objections to a consent requirement for apnea testing: a justice-based objection to allocate scarce resources fairly and a social utility objection that halting the diagnosis of brain death will reduce the number of organ donors. As philosophers of mind we seem to hold in common no very clear view about the relevance that work in psychology or the neurosciences may or may not have to our own favourite questions—even if we call the subject ‘philosophical psychology’. For example, in the literature we find articles on pain some of which do, some of which don't, rely more or less heavily on, for example, the work of Melzack and Wall; the puzzle cases used so extensively in discussions (...) of personal identity are drawn sometimes from the pleasant exercise of scientific fantasy, at times from surprising reports of scientific fact; and there are those who deny, as well as those who affirm, the importance of the discovery of rapid-eye-movement sleep to the philosophical treatment of dreaming. A general account of the relation between scientific, and philosophical, psychology is long overdue and of the first importance. Here I shall limit myself to just one area where the two seem to connect, discussing one type of neuropsychological research and its relevance to questions in the philosophy of mind and the philosophy of psychology. A general hypothesis of atom size effects for G.P. zone formation is discussed in this paper and results are presented of precipitation in the systems Fe-Au and Fe-Mo. Techniques used are resistivity measurements and electron microscopy. In the Fe-Mo system it is shown that after initial cluster formation during the early stages of ageing after the quench, further growth ceases and vacancies anneal out into dislocation loops. The activation energy for the initial clustering was 1·3 ev whilst the excess vacancy (...) concentration estimated from the loop area gave a vacancy formation energy of ∼1·5 ev. These results confirm recent quenching results on pure iron. The refusal of Mo zones to grow confirms the general hypothesis of size effects.In the Fe-Au system precipitation of gold platelets after quenching is shown to be associated with the high density of dislocations formed during quenching through the phase transformation of the iron matrix. The effect of the dislocations is shown by the low value of ∼0·5 for the Johnson—Mehl kinetic parameter and by the activation energy for growth which is ∼0·8 of the equilibrium diffusion energy for Au in Fe. As the size-effect hypothesis does not apply to precipitation on dislocations the growth of zones in Fe—Au does not affect its validity. (shrink)

Who is morally permitted to tell jokes about Jews? Poles? Women? Only those in the group? Only those who would be punching up? Anyone, since they are just jokes? All of the standard approaches are too broad or too narrow. In on the Joke provides a more sophisticated approach according to which each person possesses "joke capital" that can serve as "comic insurance" covering certain jokes in certain contexts. When Bob tells a joke about Jews, we can never know exactly (...) what Bob is intending since we cannot see inside Bob’s mind. But we could reasonably infer, if we knew Bob himself was Jewish, if he worked tirelessly for Jewish causes, or was a card-carrying Neo-Nazi. Each would affect his joke capital, and, in certain circumstances, we would have a moral standing to demand to see his ledger to see how much joke capital he had with respect to Jews. The permissibility of that joke depends upon four factors: the joke, the teller of the joke, the audience, and the setting. The view developed in In on the Joke is the only view that clearly explains how each of these components work together in an integrated, effective ethic of humor. (shrink)

AMBIS is a complete identification system which includes (1) a highly reproducible electrophoresis unit; (2) a beta‐scanner with the ability to rapidly locate and measure beta particle emission data from a variety of isotopes and surfaces; and (3) an IBM computer with a massive data storage capacity for the emission data plus subsequent manipulation of that data. Hence it provides a rapid facility for (1) classification of all types of micro‐organisms, (2) examination of cells of multicellular plants and animals, (3) (...) routine determination of molecular weights of one or more proteins in a complex mixture, (4) quantification of single or mixed compounds in a band, (5) scanning and quantification of dot and other blots, immunodiffusion precipitates and probes, (6) direct counting of radioactive solutions from RIA, column fractions, etc., without the need of expensive scintillation fluids with their consequent hazards, (7) circumventing the need of much time‐consuming auto‐radiography, and (8) setting up databases plus exchange and transference of data between AMBIS systems in different locations via floppy disk, modem or other forms of rapid transmission. This article describes a logic of distinction and succession within the late-twentieth-century Leningrad-St. Petersburg cultural field, whereby consecutive intelligentsia mainstreams were replaced by their avant-garde peripheries. In this dynamic picture of socio-cultural transformations, I propose a working hypothesis of a repeated stratification of the field into an ‘official’, an ‘unofficial’, and a third ‘non-aligned’ intelligentsia. This hypothesis is tested in reference to the ‘non-aligned’ groups founded by the avant-garde artist and ideologue Timur Novikov (1958–2002). Three major shifts are described: from (...) the politicized late-Brezhnevite early 1980s to the apolitical radicalism of Novikov’s New Artists; from this anarchistic underground, through the perestroika era, to the playful ‘classicism’ of the New Academy of Fine Arts in the 1990s; and from this postmodern international orientation to an arch-reactionary, neo-imperial posturing at the turn of the 2000s. Lastly, this ‘non-aligned’ intelligentsia is suggested as a possible precedent, or, indeed, a model for understanding other historically significant avant-garde peripheries, which commonly seek to distinguish themselves from (often mutually-exclusive) centres. During his lifetime, Sir Ivor Jennings was well known as the author of several standard books on constitutional law. He acted as constitutional adviser to the governments of Ceylon and Pakistan and was Vice-Chancellor of the University of Ceylon. This 1956 book followed in the tradition of his earlier The British Constitution and is a clear statement by an expert with a characteristically practical point of view. It is principally concerned with a practical problem: what constitution shall be given (...) to a new country about to govern itself for the first time? Published at a time when colonial empires were moving more or less peaceably towards self-government, it was based on a series of broadcast talks originally commissioned by the BBC in the belief that the experiences gained in Asia were in principle applicable to other countries approaching self-government. Through analysis of film sequences focusing on DNA in two British Broadcasting Corporation nonfiction science television programs, Wonders of Life and Bang! Goes the Theory, first broadcast in 2013, contrasting “religious” and “secular” representations of science are identified. In the “religious” portrayal, immutable scientific knowledge is revealed to humanity by nature with minimal human intervention. Science provides a creation story, “explanatory omnicompetence,” and makes life existentially meaningful. In the “secular” portrayal, scientific knowledge is changeable; is produced through technical skill in (...) expert communities; and is ambiguous, potentially positive and negative for society. Television representations of science affect audience understandings, and this is particularly the case for nonfiction representations of science, as they are likely to be “taken more seriously” than fictional representations. The consequences of the “religious” representation of science are discussed, and it is argued that a widespread understanding of science as presented in the religious portrayal would negatively impact democracy. This work tells the story of the rise of the modern German environmental imagination, with particular emphasis on its narrative and visual components.

Employee misconduct is prevalent in organizations and may be counterproductive in social and material terms. It is thus important to better understand how misconduct is construed by employees and the factors that determine its ethical acceptability in specific cases. This study explores attitudes towards unethical and minor deviant behaviours by examining the degree of acquiescence towards them in a sample of employees. Based on previous studies it was hypothesized that both organizational commitment and job satisfaction would be negatively related to (...) the acceptance of such behaviours in organizational settings. Results show that there is a relationship between the degree of acquiescence and organizational commitment and a more modest relationship with job satisfaction. They further indicate that organizational tenure impacts very significantly on the degree of acceptance. Although differences were found for age, neither gender nor organizational variables were found to be significant. (shrink)

This essay is a contribution to the field of institutional studies in that it treats the State as a substantial phenomenon, composed of institutions that require analysis in their own right. Here, the focus is on the political form of African states from the 1960s to the 1980s. On the one hand, I will follow Bourdieu here in insisting that the study of government demands that we know something of the history of political thought (la pensée politique). This simple observation (...) is seldomly applied when it comes to politics in postcolonial Africa. On the other, I use Peter Wagner´s concept of modernity to show that struggles against colonialism and Imperialism and the pursuit of self-determination for African and Asian peoples are unambiguously struggles against domination and for autonomy. The emergence of Third World nationalism (and the Non-Aligned Movement) is an event, therefore, firmly in modernity. So too is the phenomenon of the One-party state in Africa. (shrink)

The De Officiis of Ambrose, Bishop of Milan is a key text of early Christian literature. Based on a work by the Roman writer, Cicero, it presents the first systematic account of Christian ethics. It is the first full-length study of Ambrose's work written in English in modern times.

Stabler's novel approach allows results to be deduced with straightforward calculations and provides a systematic framework for tackling the problem of how speakers can infer the properties of an utterance from principles of the grammar. The special treatment of equality, induction principles, and inclusion of a general method for collecting structures from proofs means that sophisticated linguistic arguments can be carried out in detail, giving a rich perspective to issues in linguistic theory and parsing. The problem of ‘individuals’ is an age-old philosophical concern, but from time to time in the history of thought it is a problem which becomes acute. In our day the far-reaching advances in science—in physics and chemistry, in biology and bio-chemistry, in neurology and psychology—have made the philosophical attention to the problem of ‘individuals’ a matter of urgency. Yet, with some notableexceptions, philosophers have so far been displaying singularly little interest in the problem.

This is an earlier version of a chapter from my book "Plato's Republic as a Philosophical Drama on Doing Well" (2014). The book analyses Plato’s Politeia (= Republic) as a philosophical drama in which the participants turn out to be models of various types of psychic constitution, and nothing is said by them which may be considered to be an opinion of Plato himself (with all that that entails for Platonism). The debate in Book I between Socrates and Thrasymachus serves (...) as a test case for the assumptions that the Socratic method involves searching for truth or examining the opinions of interlocutors and that Socrates is the mouthpiece of Plato. Socrates and Thrasymachus are usually assumed to be arguing about justice. In fact, they are going through the motions of an eristic debate, where the aim is not to discover the truth about the matter under discussion but to defeat the opponent by fair means or foul, but especially foul. The outrageous wordplay used by both men is not so obvious in translation, and in any case tends to be ignored or explained away by scholars who assume that Plato the philosopher was writing a philosophical treatise (an exposition of philosophical ideas) and not a philosophical drama (a presentation of philosophically interesting models, to be compared and contrasted by the reader). The Republic is widely recognized to be Plato’s masterpiece, but for centuries it has been the subject of much debate. Is it about the ideal state, or the soul, or art, or education, or something else altogether? Interpretations have been many and various, for two main reasons: studies have tended to concentrate on parts of this very long dialogue to the exclusion of other parts; and some of the opinions expressed in the dialogue are routinely regarded as being those of (...) Plato himself. This analysis treats the dialogue as a dialogue, a conversation between the characters presented in it, and examines the dialogue in its entirety. The result is a holistic interpretation making sense not only of the dialogue as a whole, but also its parts. Each character is a paradigm representing an aspect of the central theme of the dialogue (apparent good), and it is because of what they represent that the conversation takes the course that it does. Many instances of "horismos" in Aristotle's Topics and Alexander's commentary have been altered to "horos" in the transmission of the texts. Philological and philosophical reasons are provided to substantiate this claim and to explain the phenomenon.

This strange dialogue becomes intelligible when Socrates is treated as a model of the good man who appears to the Many to be bad talking with a Hippias who is a model of the bad man who appears to the Many to be good. The good and apparently good are dramatized through these models. The good is revealed to be the fitting, while the fine/beautiful (kalon) is revealed to be the apparently fitting (hence the many confusions between the two concepts). (...) Fittingness may be perceived through the senses, but this immediate aesthetic fittingness is confused by the Many with pragmatic fittingness which can actually only be perceived over time and with rational thought. Many associated themes are condensed into this short but brilliant philosophical drama. (shrink)

The reasons for assuming an established orthodox Stoic school with scholarchs are considered and refuted. The traditional line of Stoics is a diadochic device to link Panaetius, and later, Posidonius, back to Zeno of Citium, using a chain of teachers and pupils. These Stoics were independent teachers sharing a general worldview but differing to a greater or lesser extent in the details.
